The scope of the Administrative Procedure Code Abstrakt The Administrative Procedure Code as a code of activity of public administration is not a novelty in our legal system, but perhaps that is exactly why it is appropriate to consider how far its scope of application extends. Although the definition of the scope of the Administrative Procedure Code is regulated in the first section of the Act, a closer examination will probably reveal many ambiguities or doubts as to how far its limits extend. And it is precisely the detailed breakdown of the circumstances to which the Administrative Procedure Code is applicable and under what conditions it will apply, which I have set as my goal of this rigorosum thesis. The scope of the Administrative Procedure Code can be examined from two points of view. The first of them is the material definition of the scope of the Administrative Procedure Code, that is, the definition of public administration as such, the evaluation of individual forms of its activities, the subsequent evaluation, in which cases the Administrative Procedure Code is applicable. The second point of view is the institutional definition of the scope of the Administrative Procedure Code, which goes hand in hand with the formal concept of public administration. The Mexican energy reform in December 2013 has represented a radical change in the structure of the sector, which has grown from a public monopoly to a competitive market. This article aims to analyze the attributions and the legal and administrative nature which has be granted to the Energy Regulatory Commission (CRE) after the normative change that will play a key role in the correct implementation thereof. The nodal problem is to confirm if the CRE has being given the correct legal instruments to develop its function autonomously and transparently. / La reforma energética mexicana de diciembre de 2013 ha representado un cambio radical en la estructuración del sector, el cual ha pasado de ser un monopolio público a un mercado de libre competencia. El presente artículo tiene como objetivo analizar las atribuciones y la naturaleza jurídico administrativa que se ha concedido a la Comisión Reguladora de Energía (CRE) tras el cambio normativo, dado que este, en calidad de organismo regulador del sector, tendrá un rol fundamental en la correcta implementación de la misma. El problema nodal de la cuestión reside en corroborar si se ha dotado a la CRE de los correctos instrumentos jurídicospara desenvolver su función de forma autónoma y transparente.

Previous issue date: 2013-06-05 / Nenhuma / Como a atual sociedade, também o Direito Penal está passando por um processo de intensas mudanças. A sociedade pós-industrial, com a crescente complexidade inerente a ela, assim como as demandas objetivas e subjetivas por mais segurança vem exigindo do Direito Penal um papel cada vez maior nos processos de regulação social. Constata-se a existência de uma tendência nas legislações no sentido da introdução de novos tipos penais, assim como um agravamento dos já existentes, que se pode considerar uma “reinterpretação” das garantias clássicas do Direito Penal substantivo e do Direito Processual Penal. Essa tendência, denominada “expansão”, tem levado a criação de novos “bens jurídicos penais”, ampliação dos espaços de riscos jurídicos-penalmente relevantes, flexibilização das regras de imputação e relativização dos princípios político-criminais de garantia. O presente estudo é a análise deste fenômeno de expansão, bem como o designado de administrativização do Direito Penal em sua inter-relação com os crimes tributários tal como foram positivados no ordenamento jurídico-penal brasileiro e em face de sua recepção jurisprudencial nos Tribunais Superiores. Antes que uma discussão dogmática tópica sobre os tipos penais tributários vigentes nas leis penais brasileiras, o objetivo do estudo é co-relacionar o fenômeno da administrativização com a modulação legislativa e jurisprudencial a eles conferida, para inferir sobre a legitimidade de sua própria criminalização. Vale observar que o tema está intimamente relacionado à independência e autonomia das instâncias administrativa e criminal, motivo pelo qual sem tal premissa o assunto não pode ser analisado. / As wellas current society, criminal law is also undergoing a process of intense transformation.The post-industrial society, with itsincreasingly inherent complexity, in additionto the objective and subjective demands for more security, required from criminal law an accumulative role in the processes of social regulation.There appears to be a trend in the legislation for the introduction of new criminal types, as well as the worsening of the existing ones, indicating a “reinterpretation” of the classic guarantees of the substantive criminal law as well asthe criminal procedure law.This trend, called “expansion”, has led to the creation of new “criminal legal interests", increased opportunities for legally relevant legal risks, and relaxedthe rules of attribution and relativity of political and criminal principles of guarantee.The present study was to analyze this phenomenon of expansion in addition to the fact that criminal law is becoming administrative in its relationship with tax crimes asin the Brazilian legal and criminal law and in the face of its jurisprudential reception in the Superior Courts.Rather than a topical dogmatic discussion of the tax criminal types existing in the Brazilian penal laws, the purpose of the study is co-relate the administrative phenomenon with the legislative and judicial modulation conferred upon them, to infer about the legitimacy of their own criminality.It is worth pointing the close relationbetween the theme and the independence and autonomy of administrative and criminal authorities, which iswhy suchpremise absence prevents the analysis of this matter.

Paradigme de la pensée juridique française, la distinction entre les domaines administratif et politique est devenue confuse en raison du renforcement de l’Etat de droit et des approfondissements de la décentralisation. Alors que l’Etat apparaît comme une entité politique avec une dimension administrative, les collectivités territoriales constituent des entités administratives dont la dimension politique n’est pas reconnue par la conception traditionnelle de la décentralisation. Pourtant, en distinguant de façon théorique les organes administratifs des organes politiques, les organes locaux tant exécutifs que délibérants présentent des caractères politiques, sans toutefois pouvoir être assimilées aux institutions politiques étatiques qui elles seules exercent la souveraineté. Succédant à cette délimitation organique, la délimitation matérielle des deux domaines, qui se concentre sur les fonctions juridiques de ces organes, leurs actes et leurs responsabilités, confirme le placement des entités étatique et locales à la frontière entre ces deux domaines. Croissante, la dimension administrative de l’Etat s’oppose à l’irréductibilité du politique. La dimension politique des entités décentralisées, qui s’exprime par un pouvoir décisionnel, ne peut s’affirmer que dans le cadre de l’Etat unitaire. Fondée sur une analyse de la doctrine et de la jurisprudence, la délimitation des frontières juridiques entre les deux domaines permet finalement de cerner les notions d’administration et de politique en droit public. / The distinction between administrative and political domains was always a paradigm of French legal thought, yet it became complicated by the strengthening of both the Rule of Law and local autonomy. While the State appears as a political entity with an administrative dimension, local authorities are administrative entities whose political dimension is not recognized by the traditional conception of local autonomy. Nevertheless, by trying to separate administrative bodies from political bodies, local authorities entail political characteristics without being equated with state political authorities (which are the only authorities that can exercise sovereignty). Subsequent to this organic demarcation, the material delimitation of both domains, which focuses on the legal functions of these bodies, their actions and responsibilities, confirms that the State and local authorities are at the boundary between these two domains. Increasingly, the administrative dimension of the State can be contrasted directly with the irreducibility of policy. The political dimension of local entities, which is expressed through decision-making power, cannot question the unitary State. Based on an analysis of the doctrine and jurisprudence, the delimitation of boundaries between the two domains allows us to define ultimately the concepts of administration and policy.

The thesis is focused on theoretical principles of demarcation of products with health effects in the EU law and on the reflection of these issues in the application and administrative practice in commercial law. The thesis developed yet been brought judicial interpretation with the scientific interpretation of certain key and decisive problems that separate from each other law-regimes of regulation: medicinal product for human use, foods, cosmetics products, medical devices and biocides. Correct law-regime for a particular product is determinating of the general legal basis in the EU internal market. It is therefore a important problem not only in EU law, but also in EU economic. Thesis results are highly critical of current practice in the local markets of EU member states, especially Czech Republic, and in many instances documented sub-optimal application of this law in general practice.
