The concept and application of ḍamān in Islamic commercial lawJaffar, Zainudin January 1994 (has links)
This study deals with an important concept in fiqh known as ḍamān. Despite its universal usage in various areas of law, including that of criminal law and law of torts especially in facilitating award of compensation, this study will confine its survey within the bounds of commercial transactions. Ḍamān forms one of the most complicated subject-matters in the Islamic Law of Obligation. In this context, ḍamān is generally perceived as civil liability in the widest meaning, arising from the non-performance of contractual obligation, violation of trust, misrepresentation and unlawful enrichment. Firstly, this study will discuss suretyship, as ḍamān is, to some extent, treated as synonymous with kafālah by the jurists. Secondly, ḍamān will be surveyed as a method of redress of any contractual irregularities under the notion of gharāmah. Such practices are motivated by the Sharī'ah doctrines of maqāṣid shar'iyyah (objectives of the law), upholding the concept of lā ḍarara wa lā ḍirār (no harm shall be inflicted or reciprocated) and respecting the notion of sanctity of legitimate ownership (ḥurmat al-milkiyyah) and freedom of contract (ḥurriyat al-ta'āqud). Methods of establishing liability (ṭuruq ithbāt al-ḍamān) and its waivers (al-i'fā') min al-ḍamān), provision of redress (mabda' al-ta'wīḍ) and the institutional framework which are involved in it are then discussed. The study will be concerned with the prescriptions of the Qur'ān and Sunnah on ḍamān and their explanations in the classical manuals of Islamic Law. In addition, certain post-classical texts offering specific treatment of ḍamān, particularly al-Baghdādī's Majma' al-Ḍamānāt and al-Ma'danī's Taḍmln al-Ṣunnā' will be studied. Also, decisions by juristconsults of various localities, recorded in various collections of fatāwā and court decisions in the literature of adab al-qaḍā, will be examined to enhance our knowledge of the way ḍamān has been treated. For the purpose of systemization, texts of Uṣūl al-Fiqh and Qawā'id Fiqhiyyah are essential. Similarly, evidence on the economic history of Muslim civilization in the form of actual contracts, letters, business records and institutional operations, are examined. The research also relies heavily on the codifications of Islamic law like the Ottoman Majallat al-Aḥkām al-'Adliyyah, Qadrī Bāshā's Murshid al-Ḥayrān and the Ḥanbalīs Majallat al-Aḥkām al-Shar'iyyah. Finally, an analysis of the contemporary legislations in Egypt, the United Arab Emirates and Malaysia will prove that a classical concept like ḍamān is still vital for modem commerce. This also lays stress on the importance of neo-ijtihād to ensure ability and competence to apply ḍamān to fresh problems in commercial life.

The influence of HIV status on woman of advanced maternal age presenting for generic counsellingBee, Justine 25 October 2006 (has links)

MSc (Med) Genetic Counselling - School of Pathology / Increasing numbers of pregnant women of advanced maternal age (AMA) counselled in
the prenatal genetic counselling clinics in Johannesburg are human immunodeficiency
virus (HIV) positive. This has altered the information these women must consider when
deciding about amniocentesis for prenatal diagnosis of chromosomal abnormalities.
Antiretroviral treatment (ART) is advised for HIV positive women prior to the procedure,
to minimise vertical transmission from mother to child. The risk of mother to child
transmission (MTCT) of HIV also necessitates counselling regarding termination of
pregnancy (TOP).
A study over two 6-month periods in 2003 and 2004 documented the HIV status of the
advanced maternal age women attending genetic counselling clinics at three academic
hospitals in Johannesburg, and the choices these women made regarding testing for
possible chromosome abnormalities. An interview schedule, conducted over 6 months in
2004, investigated the HIV positive women’s perceptions of HIV in pregnancy, and their
thoughts on termination of pregnancy based on HIV transmission risk.
Of 169 women seen over six months, February to July 2003, 83 (49%) were HIV negative,
15 (9%) were HIV positive and 71 (42%) were of unknown status. Forty (48%) HIV
negative patients had amniocenteses compared to 2 (13%) HIV positive women. In 2004,
181 patients were seen; 100 (55%) were HIV negative, 29 (16%) were HIV positive and 52
(29%) were of unknown status. Thirty-nine (39%) HIV negative patients had
amniocenteses compared to 4 (14%) HIV positive women. Data from fifteen completed
questionnaires indicated that most women understood the severity of HIV infection, 12/15 (80%), five (33%) considered termination of pregnancy based on the HIV transmission
risk, and four (27%) would have had amniocentesis if they had been HIV negative.
A significant percentage of AMA women attending the genetic counselling clinics are HIV
positive, and they are faced with difficult issues, including the risk of chromosome
abnormalities in the fetus, the risk of transmission of HIV during pregnancy and
amniocentesis, and the option of TOP up to 20 weeks gestation based on the risk of vertical
HIV transmission. It is vital that cogent policies are developed to provide optimum care for
these women. Ideally, the access to highly active antiretroviral therapy (HAART)
throughout pregnancy, to reduce the risk of MTCT of HIV to about 1%, would make the
option of prenatal diagnosis a safer one for AMA women to consider.

O Antígeno 1 de Membrana Apical (AMA-1) tem sido sugerido como candidato a compor uma vacina contra estágios assexuados sanguíneos de Plasmodium. Recentemente nosso grupo identificou o domínio II (DII) de AMA-1 de Plasmodium vivax (PvAMA-1) como uma região altamente reconhecida por anticorpos IgG de indivíduos brasileiros infectados por P. vivax. No presente estudo avaliamos as propriedades imunogênicas da proteína recombinante DII, produzida a partir de Escherichia coli. Grupos de 6 camundongos fêmeas BALB/c foram imunizados quatro vezes com 10 µg dessa proteína na presença de diferentes formulações de adjuvantes [Adjuvante Completo/Incompleto de Freund (ACF/AIF), MPL-TDM, TiterMax, Hidróxido de Alumínio (Alum), Quil A, QS-21 e CpG-ODN 1826], individualmente, ou em combinação (Alum + QS-21 ou Alum + CpG-ODN 1826)). Nosso objetivo foi avaliar comparativamente a resposta de anticorpos (IgM, IgG e isotipos de IgG), induzida pelos diferentes esquemas de imunizações, visando futuros estudos pré-clínicos em primatas não humanos. Os títulos de anticorpos IgG contra (o ectodomínio) PvAMA-1 foram determinados por ELISA, duas semanas após cada imunização. A presença de IgM e dos isotipos de IgG também foi avaliada após o final do esquema de imunizações. Nossos resultados demonstraram que a proteína recombinante DII foi altamente imunogênica em camundongos BALB/c quando administrada na presença dos adjuvantes testados. Altos títulos de IgG1, IgG2a e IgG2b foram observados na maioria dos grupos (com exceção do adjuvante Alum), sugerindo uma resposta mista Th1/Th2. In the present study, we evaluated the immunogenic properties of a bacterial recombinant PvAMA-1 DII. La investigación realizada presenta un estudio que evaluó el nivel percibido por los clientes de la calidad de servicio en el hotel San Antonio en la ciudad de Bagua. El tipo de investigación tuvo un enfoque cuantitativo nivel descriptivo, asimismo, se aplicó un cuestionario a 200 clientes. Se analizó el constructo con sus tres dimensiones (tangibles, personal y organización). Se evidencia que el hotel no es percibido como una infraestructura de alta calidad, respecto a la dimensión personal, al parecer la calidad vista desde la individualidad es mejor apreciada y la dimensión organización, sigue siendo un punto a mejorar la iniciativa y capacidad de resolución de problemas. Se sugiere invertir en la ampliación de las instalaciones, reforzar la capacitación del personal para una mejor atención y optimizar la organización del hotel a través de estrategias. / Tesis

La empresa objeto de estudio no tiene una estructura de costos que le permita conocer y analizar el costo real de brindar el servicio. Por tal motivo se planteó como objetivo, diseñar una estructura de costos para determinar la rentabilidad de la empresa Multiservicios Jhonatá EIRL, Bagua Grande, periodo 2017. La investigación presenta una metodología cuantitativa, de tipo aplicada, ya que se va a utilizar una estructura de costos para dar solución a las deficiencias de la empresa, bajo un nivel descriptivo y un diseño no experimental/transaccional; se ha considerado tomar como población datos históricos del año 2017 a los estados financieros, balance de comprobación, registro de costos y gastos, reportes de mantenimiento , al gerente general , contador e ing. Mecánico, utilizando como técnicas de investigación las entrevistas y el análisis documentario. Como resultado final se elaboró una estructura de costos, la cual permitió conocer las actividades que intervienen en la prestación del servicio, e identificar los elementos del costo y gasto; así mismo al elaborar el estado de resultados consolidado por línea de negocio, se obtuvo una variación de S/1,850,729.90 en la utilidad bruta, dicha variación está dada, debido a que la empresa no ha considerado un costo de venta. Los costos directos ascienden a S/ 1.781,558.65 representando un 96% del costo de venta, los costos indirectos a S/83,291.10, representando el 4% y los gastos administrativos son de S/167,403.03, también se determinó un margen de utilidad de 13.48% para maquinaria y un 14.32% para vehículo. / Tesis

La correcta gestión, parte de bases sólidas con respecto a la información contable que la empresa reúne. Entonces, se pueden identificar las falencias y aciertos encontrados en el proceso que permitan la correcta toma de decisiones que consecuentemente señalaran el camino hacia la consecución de los objetivos planteados. El recreo turístico Los Delfines es una empresa familiar que trabaja basada en las costumbres, sin la aplicación de conocimientos empresariales técnicos de vanguardia competitiva. Presenta problemas en la gestión operacional y el ciclo operativo. Esto, se podría traducir en un riesgo de pérdida del valor y calidad de servicio prestado. Este proyecto evidencio los retos que el contador del siglo XXI enfrenta y para los cuales es capaz de dar solución afianzando su formación profesional. Por lo que se buscó determinar la eficacia de los procesos operativos y su efecto en la rentabilidad del recreo turístico Los Delfines – Bagua 2016 2017. Esta investigación es de tipo aplicada - no experimental y diseño descriptivo. Las técnicas empleadas fueron observación directa, rastreo, indagación, encuestas y cuestionarios. Se identificaron problemas inmersos en las empresas familiares permitiendo brindar las sugerencias necesarias para superar la extinción provocada por un deficiente control; en la medida que se indago y proceso la información oportuna y necesaria. Obesity as a Disease: Effects on Weight-Biased Attitudes and BeliefsAta, Rheanna Nichole 01 January 2015 (has links)
In June 2013, the American Medical Association (AMA) made the highly controversial decision to designate obesity a disease. Proponents predicted the decision would lead to reduced weight-related stigma, whereas opponents predicted designating a third of the population as “diseased” would exacerbate stigma. To determine the effects of defining obesity as a disease on explicit and implicit weight-biased attitudes and explicit weight-biased beliefs, female undergraduate students (N = 146) were randomly assigned to one of two groups: disease or lifestyle. Participants in the disease group (n = 71) were asked to read an article describing obesity as a disease caused by biology and genes; participants in the lifestyle group (n = 75) read an article describing obesity as the result of personal choices, including over-consumption of food and inactivity. Explicit weight-biased attitudes and beliefs were measured pre- and post-exposure to the article. Change in beliefs about the controllability of weight was examined as a potential meditator of the relationship between group and explicit weight-biased attitudes; and body mass index (BMI), health orientation, and fitness orientation were examined as potential moderators. Results revealed a significant interaction between group and time on weight-biased beliefs. Participants in the disease group exhibited stronger beliefs that obesity is outside a person’s control from pre- to post-exposure, whereas participants in the lifestyle group exhibited a weakening in these beliefs over the same time period. Contrary to hypotheses, this change in beliefs about the controllability of weight did not extend to weight-biased attitudes.

Recycling of concrete for sustainable road construction : Why are proven methods not currently used?Tolsma, Shaun, Torfgård, Ingrid January 2018 (has links)
This report aims to investigate why proven methods for recycling concrete waste as road construction material are not practiced in Sweden. An additional objective is to investigate how concrete is handled as a waste product and whether it would be environmentally friendly and financially beneficial to clients and contractors. Information has been extracted via interviews conducted with experts from various positions within the civil engineering industry. Additional information was obtained through literature studies and questionnaires sent and received via email. Results which were frequently mentioned by engineering professionals included the extra expense of transporting and processing crushed concrete, parties involved in the design and construction processtend to follow traditional methods of using tried and tested virgin materials, the assumption of responsibility for structural failure due to alternative materials and general lack of knowledge surrounding crushed concrete as a construction material. Conclusions are that crushed concrete is suitable for construction of subbases in roads and base courses of cycle/pedestrian paths. Traditionally used virgin materials are generally less expensive than crushed concrete. Existing legislation makes the use of recycled construction material difficult. Awareness and education regarding recycled concrete, as a construction material, should be increased.

La presente tesis se ha realizado en Meflo Hotel categoría 3 estrellas en la ciudad de Chachapoyas 2016, dirigido a turistas nacionales e internacionales. Con el propósito de aumentar las ventas en el servicio de alojamiento y establecer una aceptación a través de un Plan de Marketing. Para obtener este trabajo de investigación, se realizó entrevistas a la administradora y la supervisora del Meflo Hotel; asimismo, una entrevista a Carlo Inga Galoc, gerente de la agencia de viajes Amazon Expedition, cuya información ayudó a conocer las necesidades, preferencias, gustos y atributos más valorados de los turistas. Además, se realizó un Focus Group conformado por turistas nacionales y extranjeros, donde expresaron sobre las preferencias y atributos que desean obtener por un servicio de hospedaje. Y, asimismo, una encuesta aplicada a 251 turistas, siendo 207 encuestados nacionales y 44 encuestados extranjeros. A través de la evaluación financiera del Plan de Marketing se obtuvo resultados positivos que demostraron que el plan es factible, y dan solución a los problemas de ocupabilidad que atraviesa Meflo Hotel y a provechar las múltiples oportunidades que brinda el mercado. / Tesis
