Membre articulé : modèle anatomique de l'automotricité dans le De motu animalium d'Aristote : un opérateur de la pensée de l'immanence / Articulated member : anatomical model of animated automotricity in Aristotle's De motu animalium : an operator of thought of immannence

La présente thèse se propose de réfléchir sur le caractère cinétique de la méthode analogique adopté dans le De motu animalium d’Aristote. En considèrant que l'objet du traité est la cause commune du mouvement et qu'Aristote en adopte une solution du type paradigmatique, d'une manière générale l'automotricité est le thème pendant que le membre articulé est le phore dans le raisonnement analogique du DMA. Nous considérons hypothétiquement que les stratégies plastiques sont le fil conducteur du raisonnement suivi par la recherche de la cause commune de la motricité pour tout mouvement. Notre double objectif général est, d’une part de tirer les acquis philosophiques sur le caractère immanent du principe du mouvement de la recherche menée dans le DMA et, d’autre part de percevoir le caractère cinétique et plastique de sa démarche, qui comporte des procédés méthodologiques dynamiques dans le but de s’adapter à l’objet. Ce que nous faisons en deux pas : premièrement par l’analyse des étapes de l’établissement du paradigme du membre articulé ; et en suite par l’analyse de l’analogie entre le membre articulé et l’automotricité animée. Les deux analyses visent saisir des éléments pour confronter les deux termes de l'analogie et vérifier la validité de toute la thèse et de la considération selon laquelle, la méthode analogique est un l'instrument plastique de la pensée de l'immanence. / This thesis proposes to reflect on the kinetic character of the analogical method adopted in De Motu Animalium of Aristotle. Considering that the object of the treatise is the common cause of the movement of animais, in general, automotricity is the "thème" while the articulated member is the ''phore" in De Motu's analogical reasoning. Hypothetically we consider that the plastic strategies of the analogical method of De motu are the guiding thread of the reasoning undertaken in the research on the common cause of the motility of ail animal movements. Our general double aim is: on the one hand, to take philosophical acquisitions on the immanent character of the principle of movement, and on the other hand, to grasp the kinetic and plastic character of this philosophical enterprise, which involves dynamic methodological procedures in view of the adaptation of the method to the object. We seek to achieve these objectives through two analyses: first, the analysis of the stages of the establishment of the articulated member paradigm (AMP), and then the analysis of the main analogy of the treatise, between the articulated limb and the animated automotricity. Through the two analyses we must gather the necessary elements to confront the two tenns of the main analogy, as well as to verify the general validity of the thesis and also the consideration according to which the analogical method of De Motu Animalium is a plastic instrument of the thought of immanence.

A scala naturae de Aristóteles na obra De generatione animalium

It will discuss particularly, in which way such idea was present in Aristotle s work De generatione animalium. It will describe Aristotle s methodology, as well as, trying to elucidate if Aristotle had intended to present a classification of animals. If so, which criteria he had used to draw it. Besides that, it will try to find which view he held about the origin of animals. This dissertation contains an introduction and four chapters. Chapter 1 discusses the idea of scala naturae from Antiquity to 19th century. Chapter 2 deals with some respects of Aristotle s life and writings, emphasizing the ones in which he studied the living beings. It also discusses some concepts adopted by him. Chapter 3 analyses the idea of scala naturae in De generatione animalium, as well as, the criteria he had used to draw his scale. Chapter 4 provides some final remarks on the subject. This study led to the conclusion that Aristotle invested lots of energy in classifying the great groups of animals which were arranged in his scale of perfection, contrary to the view held by some authors. The main criterion adopted by him was the vital heat of animals. Moreover, he did not present a sketch of his scale, although it was implicit in his writings. Besides that, there is no idea of organic evolution in Aristotle s scale of perfection. It represents just an arrangement of the great groups of animals. In this way, it is in harmony with his cosmological view / Os objetivos desta dissertação são discutir de um modo geral, a concepção de scala naturae, uma visão que esteve presente no pensamento ocidental durante muitos séculos. Discutirá particularmente, de que modo ela se apresenta na obra De generatione animalium de Aristóteles. Descreverá a metodologia de Aristóteles, procurando elucidar se ele pretendia apresentar uma classificação dos animais. Em caso positivo, procurará identificar os critérios que ele utilizou para isso. Além disso, procurará detectar qual era a opinião de Aristóteles sobre a origem dos animais. Esta dissertação está dividida em uma introdução e quatro capítulos. O Capítulo 1 discute a idéia de scala naturae, que se iniciou na Antiguidade e perdurou até o século XIX. O Capítulo 2 discorre sobre alguns aspectos da vida e obra de Aristóteles, enfatizando aquelas onde ele estudou os seres vivos. Discute também alguns conceitos adotados por ele. O Capítulo 3 analisa a idéia de scala naturae na obra De generatione animalium bem como os critérios adotados por Aristóteles na elaboração da mesma. O Capítulo 4 apresenta algumas considerações finais sobre o assunto. Este estudo levou à conclusão, de modo oposto à interpretação dada por alguns autores, de que Aristóteles investiu bastante energia na elaboração de uma classificação dos animais que ele distribuiu em grandes grupos na sua escala de perfeição. O principal critério que ele adotou foi o grau de calor vital dos animais. Além disso, ele não apresentou um esquema de sua escala, embora ela esteja implícita em seu trabalho. Não há nenhuma idéia de evolução orgânica na escala de perfeição de Aristóteles. Ela representa apenas um arranjo dos grandes grupos de animais. Nesse sentido, pode-se dizer que a visão de Aristóteles em relação a este assunto está em harmonia com sua visão cosmológica

L'animal en droit public / Animals in public law

Les animaux, longtemps considérés comme des êtres appartenant au régime juridique des biens, tendent aujourd’hui à s’éloigner de cette catégorie. Si en France le droit leur refuse le statut de personne non-humaine, la qualification d’être sensible leur est toutefois attribuée et reconnue. Cette singularité juridique – où l’animal est à la fois un être vivant et appartient à la catégorie juridique des biens – a fait l’objet de nombreux travaux, et certains chercheurs sont parvenus à résoudre ces paradoxes. Toutefois, si l’animal a été abondamment abordé sous le prisme du droit privé, peu de travaux spécialisés ou d’ensemble ont été menés en droit public. Pourtant, il semble que l’étude de l’animal en droit public apporte des questionnements et des réponses tout aussi intéressantes. C’est ainsi que la présente thèse, « L’animal en droit public », a suivi deux choix principaux et complémentaires : celui de l’inventaire, puis celui de la théorisation. Enfin, le droit public offre de nouvelles perspectives dans la réalisation d’un véritable droit de l’animal. Cette construction, qui a pour principal résultat d’apporter de nouveaux éléments de déréification, et d’éviter certaines incohérences, permettrait une mise en avant des intérêts animaliers, notamment en les assimilant à un nouvel ordre sociétal à protéger ou en apportant une nouvelle approche dans la personnification des animaux. En outre, l’étude du droit public comparé nous offre des perspectives différentes dans la défense de la cause animale, notamment par le biais de la constitution / Animals, which for a long time were legally classified as property, are nowadays beginning to be recategorised. Even if French law denies them the status of non-human persons, they are nonetheless recognized as being sentient. This legal oddity, in which animals are at one and the same time both living beings and property, has been the subject of numerous studies, and certain researchers have succeeded in resolving these paradoxes. However, if the status of animals has been frequently examined from a legal angle, little specific or overall research has been undertaken in the domain of public law. And yet, it appears that the study of animals in public law raises questions and answers that are equally interesting. That is why the present thesis, « Animals in public law », follows two main, complementary choices: that of being an inventory, and that of theorizing. Charting, first of all, the reality of the situation seems essential in order to facilitate doctrinal or jurisprudential interpretation. Secondly, this study has made possible the theorizing of certain judicial questions. Finally, public law offers new perspectives for the creating of a true system of laws concerning animals. This work, whose main outcome is to contribute new elements to dereification and to avoid certain inconsistences, would foreground animal interests – notably by placing animals in a new societal order to be protected, or by setting forth a new approach to the personification of animals.
