Cette thèse porte sur la relation qu'un président, bénévole et un directeur, salarié, d'une MJC, mais aussi d'autres associations d'éducation populaire, peuvent entretenir dans le cadre de la gouvernance qu'ils exercent ensemble. Des entretiens avec 62 présidents et directeurs mais aussi d'autres salariés de fédérations de MJC ainsi que trois historiens ou sociologues ont permis de confirmer certains postulats théoriques quant à la complexité de la relation entre un président et un directeur d'association, parfois conflictuelle, mais aussi de révéler la diversité de formes que cette relation peut revêtir, tout comme la diversité des acteurs, quant à leur rapport au pouvoir mais aussi à leur militantisme. Cette thèse a en outre mis en avant un point commun à l'ensemble de ces acteurs associatifs : un sentiment d'appartenance à un réseau et plus largement à un courant de pensée, l'éducation populaire. / This thesis deals with the relationship that a volunteer president and a managing director, employee, of a MJC, but also other popular education non-profit organizations, can maintain within the governance they exercice together. Interviews with 62 presidents and managing directors, but also other employees of MJC and three historians or sociologists confirmed some of the basic premises about the complexity of the relationship between a president and a managing director of non-profit organization, sometimes conflicting, but showed also the variety of forms this relationship can take on, as the diversity of the actors, about their relation to authority but also to their militancy. Moreover, this thesis has highlighted a common point to the totality of these associative actors : a sense of belonging to a network and more widely to a line of thought, the popular education.

This thesis investigates the problem of commencement of insolvency proceedings, content of an insolvency petition, the effects of insolvency proceedings and the decission about insolvency petition. In connection with the filing of insolvency petition focuses on issues of international jurisdiction. The paper also analyzed the empirical data relating to insolvency proposals. The aim is examining whether the current legal system of commencement insolvency proceedings can be misuse and whether the legal framework of international jurisdiction can be misuse. There are also examine various possibilities of misuse legislation. Also, the thesis focuses on the possible regulatory considerations.

This thesis analyzes use of extraordinary legislative instruments with a special focus on executive decrees. Executive decrees are analyzed in terms of their theoretical definition and their practical use in connection with other executive and legislative powers. The main part of the study is dedicated to the case study which analyzes the frequent use of executive decrees in Italy. The aim of the thesis is to determine causes of this phenomenon, examine how the use of executive decrees affects the democratic functioning of parliamentary democracy, and to find general tendencies of use of executive decree power across different political systems. The study therefore contains also a comparative analysis of the Italian case with other chosen countries - Argentina, Brazil and Spain, whose constitutions also allow executive power to promulgate decrees.

In the theoretical part, I processed information about the authority, teacher s personality, and other factors which affect the work of teachers and the building up of their authority. In the practical part, I summarized the results of my research, the research I carried out at business academies and elementary schools. I asked the teachers for their opinion on the authority. The result of this research, I have generalized and processed the results of this research in the summary.

Kdo je tady šéf? Analýza genderových rozdílů v manažerských pozicích / Who's the boss? Analysis of gender inequality in managerial positions

Using cross-sectional data from EU-SILC for the Czech Republic this thesis shows existence of gender gap in workplace authority at the Czech labor market. Controlling for human capital, job attributes and household characteristics reduced the gender gap in workplace authority but not at full range. It implies the existence of discrimination at the Czech labor market. This thesis also shows that gender differences in earnings returns to authority also exist, and men have these returns significantly higher compared to women.

The identification is carried out via the analysis of primary and secondary data. Primary data are surveyed by means of consumer research and interviews with experts. At the end of the Master's Thesis the results are summarized and the improving arrangements are put forward.

Management kvality jako nástroj zvyšování efektivity municipalit / Quality management as a tool for improving the efficiency of municipalities

The aim of this thesis is to define methods and techniques of quality management as a tool for improving the efficiency of municipalities. The theoretical part deals with the concept of quality and its management, the European Union's attitude and the basic methods of quality management in municipalities. Especially, the method of the Common Assessment Framework (CAF) is discussed. Finally, the theoretical background characterizes the town of Sušice, its activity and the functional composition of the municipal authority in Sušice. In the practical part, the CAF model is implemented into the municipal authority in Sušice. It provides a report describing the results of self-assessment, information about the evaluation team, procedures and forms of assessment, and responses to the questions of the CAF model. The outcome includes the evaluation of individual criteria, the summary of results using the SWOT analysis and a draft of the improvement plan.

Faktory měnícího se tržního podílu přístavů EU využívaných zákazníky z České a Slovenské republiky / Factors of market share changes of ports in EU used by clients from Czech and Slovak Republic

The thesis is focused on factors influencing port customers in their choice of the most convenient port. Port customer is primarily freight forwarder but ship operators and multimodal transport operators are also involved in decision making process. Principles of port functioning system reflected in port ownership and port governance with connection to individual subject in port organizational structure are introduced in the theoretical part of the thesis. The following part describes volumes of transported TEU in relation between specific port and Czech and Slovak Republic. The main goal of this thesis is to identify and analyze the key endogenous and exogenous factors which were affecting performance of selected ports. Factors with highest influence on freight forwarder choice are described in detail. Emphasis is placed on the Port of Hamburg because of its ongoing highest performance on the market with highest TEU volumes and also on the Port of Koper because of its growing performance profile.

Formas híbridas e food service: uma análise da alocação de autoridade em franquias de alimentação no Brasil / Hybrid forms and food servisse: an analyses of authority allocation on food franchise chains in Brazil

Este trabalho tem como objetivo propor um modelo econômico para os determinantes da alocação de autoridade em cadeias franqueadas no Brasil no setor de alimentação fora do lar - food service. Baseando-se no aporte teórico da economia neoinstitucionalista, especialmente na linha teórica desenvolvida por Claude Ménard (2004; 2010) para o estudo das formas híbridas, foi aplicado um estudo de múltiplos casos com foco em uma hamburgeria, uma pizza delivery e uma cafeteria, em que se procurou discutir a hipótese de que um aumento na complexidade no ponto de venda (lojas que demandam grande esforço operacional) levaria à descentralização do arranjo franqueado. Observou-se que a complexidade no ponto de venda realmente influencia a alocação de direitos de propriedade dos arranjos, mas no sentido contrário ao esperado, ou seja, no sentido da centralização. Tal centralização foi caracterizada por uma integração de determinadas tarefas básicas e pelo aumento do controle efetivo exercido pelas franqueadoras sobre as tarefas que continuaram sendo compartilhadas com as lojas franqueadas. / This work intends to propose an economic model reflecting the determinants of authority allocation on food service franchise chains in Brazil. Drawing on the New Institutional Economics framework and, in particular, on the hybrid forms approach by Claude Ménard (2004; 2010), a multiple case study has been conducted on a hamburger fast food restaurant chain, a pizza delivery chain and a special coffee shop chain, discussing the hypothesis that: the more outlet complexity increases (stores that demand high operational effort), the more decentralized the chain should be. Results show that outlet complexity is indeed a determinant of the allocation of property rights, although in the opposite direction, i.e. towards centralization. Such centralization was characterized as a mix of: vertical integration over key tasks and of an increase in the effective control over the remaining tasks that kept being shared with franchisees.
