Les données personnelles sensibles : contribution à l'évolution du droit fondamental à la protection des données personnelles : étude comparée : Union Européenne, Allemagne, France, Grèce, Royaume-Uni / No English title availableKoumpli, Christina 18 January 2019 (has links)
La protection des données personnelles sensibles consistait, jusqu'au RGPD, en un contrôle préalable réalisé par une autorité indépendante, malgré l’obstacle posé à la libre circulation. Cette protection renforcée est aujourd'hui remplacée par l’obligation du responsable de traitement d’élaborer une étude d’impact. Une telle mutation implique un risque de pré-légitimation des traitements et peut être favorable au responsable de traitement. Or, est-elle conforme au droit fondamental à la protection des données personnelles ? La thèse interroge le contenu de ce droit et la validité du RGPD. À partir d'une étude comparative allant des années 1970 à nos jours, entre quatre pays et l’Union européenne, les données personnelles sensibles sont choisies comme moyen d'analyse en raison de la protection particulière dont elles font l’objet. Il est démontré qu’en termes juridiques, la conception préventive fait partie de l’histoire de la protection européenne des données et peut donner un sens à la protection et à son seul bénéficiaire, l’individu.Un tel sens serait d’ailleurs conforme aux Constitutions nationales qui garantissent aussi l’individu malgré leurs variations. Cependant, cette conception n’est pas forcement compatible avec l’art. 8 de la Charte des droits fondamentaux de l’UE. La thèse explique que cette disposition contient la garantie d’une conciliation (entre les libertés de l’UE et celles des individus) qui peut impliquer une réduction de la protection de ces dernières. Or, il revient à la CJUE, désormais seule compétente pour son interprétation, de dégager le contenu essentiel de ce droit ; objectif auquel la thèse pourrait contribuer. / Before the GDPR, protection of sensitive personal data consisted of a prior check by an independent authority despite limiting their free movement. This has been replaced by the obligation of the controller to prepare a privacy impact assessment. With this modification, one can assume a risk of pre-legitimization of data processing, putting the controller at an advantage. Is that compatible with the fundamental right to the protectionof personal data ? This thesis questions the content of this right and the validity of the GDPR. It is based on a comparative study from 1970s until present day between four European countries and the European Union, in which sensitive data are chosen as a meanto the analysis due to their particular protection. Research shows that in legal termsthe preventive conception is a part of the history of protection in the European Union. By limiting freedom of processing it gives meaning to protection and its only subject,the individual. Such an interpretation is compatible with National Constitutions despite their variations. However, the preventive conception of data protection is not so easily compatible with article 8 of the European Charter of Fundamental Rights. The thesis puts forward that this article contains the safeguard of a balancing, between EU liberties and individuals’ freedoms, which implicates reduced protection. It is up to the European Court of Justice to identify the essence of this right, an aim to which this thesis could contribute.

Dealing with cross-cultural conflict in a multicultural organisation: an education management perspectiveDoerr, Joan C. 30 November 2004 (has links)
This study investigated the effect of cross-cultural differences on conflict episodes in a multicultural organisation in South Africa. The sample consisted of seven people, who represented six cultures. The phenomenological method of inquiry was used.
Following the data collection process, the researcher identified the sources of conflict, then determined the qualities of leadership which aid in minimizing conflict. The five conflict management strategies were discussed, with further exploration into the use of confrontation and mediation. The researcher believes that the framework for describing conflict management strategies may need to be expanded as cross-cultural interaction is better understood. Finally, the study explored the positive and negative outcomes of conflict. Although many conflicts are costly to an organisation, some conflicts may assist people in cross-cultural understanding.
Because diversity is becoming a more pressing issue in the 21st century, most people and organisations are facing the need to effectively communicate cross-culturally. The researcher recommends a three stage diversity training programme, which begins with new employees, then includes all employees and, finally, becomes an ongoing learning process in the organisation. / Education management / M.Ed.(Management)

La ricerca approfondisce il ruolo svolto da Adriano Bernareggi, sacerdote milanese, poi dal 1932 vescovo di Bergamo, nel movimento di rinnovamento degli studi ecclesiastici che ha attraversato il primo trentennio del Novecento. Formatosi presso le Università Gregoriana e Lateranense, nel clima segnato dal modernismo e dalla reazione pontificia, Bernareggi insegnò presso il Seminario di Milano, dal 1909 al 1932, e presso l’Università Cattolica, dal 1922 al 1926. In queste sedi, si sforzò di dare una risposta moderna – non modernista – all’ansia spirituale dell’uomo contemporaneo, attraverso un nuovo linguaggio religioso, capace di valorizzare la storia della Chiesa e, soprattutto, la sua liturgia. Trained at the Gregorian and Lateran Universities, in a climate marked by modernism and vatican reaction, Bernareggi taught at the seminary of Milan, from 1909 to 1932, and at the Catholic University, from 1922 to 1926. In these sites, he strove to give a modern response - not modernist – to the spiritual anxiety of modern man, through a new religious language, able to enhance Church history and, especially, its liturgy. Particular attention has been paid to: the teaching, including the attempt to promote an update of the Ratio Studiorum of the Theological Faculty, following lines that anticipated Deus Scientiarum Dominus; the direction of the magazine “La Scuola Cattolica”, that he attempted to transform in a national periodic of sacred sciences, to regenerate religious studies through the application of an historical perspective and critical-philological research method; the participation in the liturgical and artistic movement in Milan, looking to french teachings and Maria Laach, especially to rediscovery the initiation value of rites; the prevostship at St. Vittore al Corpo, a laboratory of a new “liturgical practice”; the role in the debate on the Roman Question and Conciliation.

Previous issue date: 2012 / Por mais que a informatização esteja avançada (interligação por meio da rede internet de computadores entre os órgãos e entidades públicas pelo Estado), máquina alguma substituirá os dramas do homem contemporâneo, principalmente aqueles que sempre estiveram alijados da cidadania. O presente estudo traz à baila as reflexões e discussões acadêmicas desenvolvidas ao longo das mais de 700 horas/aulas do curso de mestrado em Poder Judiciário, turma 2010. Longe de ser uma unanimidade o Poder Judiciário é um poder do Estado que representa antes de tudo a capacidade e a prerrogativa de julgar, de acordo com as regras constitucionais e das leis criadas pelo Poder Legislativo em determinado país. É um dos mais sólidos pilares nas democracias e um perigoso algoz nos regimes absolutos. Apesar desta importância e de no Brasil ser um poder sólido que já demonstrou sua importância para a garantia da solidificação da democracia, são poucos os estudos sobre o Judiciário, poucos e iniciais são as pesquisas sérias sobre este poder de suma importância para a sociedade, para economia e para as instituições. Como, também, não é espanto quando vemos que fato repetitivo que a maior insatisfação ou reclamação da sociedade reside na morosidade das soluções judiciais traduzida pela alta taxa de litigiosidade da justiça brasileira. O Poder Judiciário é objeto de estudos sistemáticos, contínuos e avançados em diversos países que já demonstraram a importância de se conhecer bem as suas propostas, os resultados das suas atividades, funções e os seus gastos, pois, o seu 'negócio'é a resolução dos conflitos da sociedade de forma a contribuir com a pacificação da mesma através de uma ordem jurídica justa. Os estudos realizados nos Estados Unidos, Alemanha e Espanha, como exemplo, demonstram que conhecer bem o judiciário é o primeiro passo para melhor gerenciá-lo. Assim, deve-se menção e reconhecimento no investimento realizado pela Fundação Getúlio Vargas em promover com destaque o presente Mestrado em Poder Judiciário. A FGV é uma das poucas instituições privadas que tem como um dos seus objetivos o preparo pessoal, extrapolando as fronteiras do ensino com avanços significativos nas áreas da pesquisa e da informação. No mesmo caminho da qualificação profissional de seus magistrados e servidores e na vanguarda da gestão judiciária, o Tribunal de Justiça do Distrito Federal e dos Territórios, investiu e acreditou na proposta de estudos e pesquisas do presente mestrado, merecendo, significativamente, os elogios e agradecimentos pela visão de futuro e investimento realizado no conhecimento que é sempre importante e necessário. A dissertação em comento representa primeiramente uma visão contraposta ao modelo de política pública encampada pelo Conselho Nacional de Justiça, através da Resolução 125 de 29 de novembro de 2010, cujo objeto é o tratamento adequado dos conflitos de interesse no âmbito do Poder Judiciário, representando, assim, interesse especial de pesquisa científica por se tratar de uma política nacional judiciária a ser adotada, obrigatoriamente, por todos os Tribunais de Justiça do país. Além deste aspecto supra referido, reside, também, o fato do ineditismo deste estudo e pesquisa, especificamente, porque essa política pública judiciária aborda aspectos e variáveis novas no tratamento das atividades e das funções próprias do Poder Judiciário quando propõem, como exemplo, o tratamento dos conflitos considerados pré processuais. Outro aspecto importante merecedor de atenção no estudo reflete-se na discussão do modelo de política pública que, em premissa vênia, deveria ser tratado em caráter geral republicando do Estado e não particularizado em um dos seus entes, mesmo que pareça ser, constitucionalmente, pressuposto da alçada do Poder Judiciário tratar exclusivamente do problema da altíssima litigiosidade e do baixo resultado de resposta à demanda posta para seu controle. Este estudo, tem como objetivo demonstrar que a resolução 125/2010 do CNJ é insuficiente para resolver os problemas de congestionamento e morosidade da Justiça brasileira, como preconizada, isso porque, o modelo que se propõe para combater o problema da morosidade é restrito e está 'contaminado' pela idéia do monopólio da jurisdição ou por uma espécie similar que traz para o âmbito do judiciário uma nova atividade de trabalho, a qual é relacionada com a solução do conflito pré-processual a qual deveria fazer parte de uma política pública geral não restrita a um poder republicano. A correspondência dos argumentos com a materialização utilizada para o problema será comprovada nas linhas que se seguem, pois, assuntos com grande abrangência como as soluções judiciais devem, preferencialmente, adotar mecanismos públicos de caráter geral para uma boa solução. Nesse sentido, o trabalho demonstrará que as tentativas recorrentes em superar o problema da alta demanda judicial está restrita a modelos insuficientes abrangidos por um monopólio que não deveria ser aplicado para solucionar problemas pré processuais no âmbito do Poder Judiciário. Constitui, pois, um contraponto à idéia de efetividade na redução da demanda judicial tradicional 1 como prevista pela política pública judiciária frente ao monopólio da jurisdição, ou seja, frente à reserva que detém o Judiciário na promoção e gestão de uma nova atividade – o tratamento dos conflitos de interesse pré-processual por meio dos instrumentos de autocomposição, notadamente as conciliações e mediações. Apresentam-se, igualmente, neste trabalho proposições legislativas que dão o suporte material às idéias apresentadas, caracterizando a comprovação de viabilidade entre a apresentação do problema científico, as justificativas para o enfrentamento do problema e uma solução para o mesmo, como vista a modernizar uma política pública. Importante reafirmar que o escopo do presente trabalho não reside na observação própria dos modelos e técnicas de resolução de conflitos, notadamente as conciliações e mediações, incentivadas pelo CNJ, ou nos modelos arbitragem. Ao contrário, espera-se que todas as tentativas que possam melhorar e modernizar os atuais serviços judiciais no Brasil sejam válidas, eficazes e são muito bem vindas, pois, é uma tentativa positiva para melhorar o atual cenário em que se encontra o Poder Judiciário quando é confrontado em seu acesso à justiça, rapidez, confiabilidade e segurança nos seus julgamentos. / As much as technology is growing (connecting computers through the internet among agencies and public entities by the state), any machine will replace the drama of contemporary man, especially those who've been priced out of citizenship. Man's problems can not be solved by machines in distant locations without allowing direct access to the human who controls the machine. This study brings up the reflections and academic discussions developed over the more than 700 hours / lessons of the masters course in the Judiciary, class 2010. Far from being a unanimous decision, the Judiciary is a state power that represents above all the ability and prerogative to judge, according to the rules and the constitutional laws created by the Legislature in a determinate country. It is one of the strongest pillars in democracies and dangerous regimes in the absolute nemesis. Despite this importance and the fact that in Brazil is a solid that has demonstrated its importance in ensuring the solidification of democracy, there are few studies on the Judiciary, and initials are few serious researches on this power of paramount importance to society, to economy and institutions. When we see that the most repetitive dissatisfaction or complaint society lives in the slowness of judicial solutions translated by the high rate of litigation in Brazilian courts. The Judiciary is the object of systematic studies, continuous and advanced in several countries have already demonstrated the importance of knowing well its proposals, the results of its activities, functions, and their costs, because their 'business' is the resolution the conflicts of society to contribute to the pacification of the same through a fair legal system. Studies in the United States, Germany and Spain, for example, show that the Judiciary is familiar with the first step to better manage it. Thus, we have to mention the investment made by the Fundação Getúlio Vargas to promote especially the present Master of the Judiciary. FGV is one of the few private institutions that have as one of its goals the personal preparation, beyond the boundaries of teaching with significant advances in the areas of research and information. In the same way of the professional qualification of judges and their servers and at the forefront of judicial management, the Court of Federal District and Territories, invested and believed in the proposed study and research of this master, deserving significantly, the praise and thanks for vision and investment in the knowledge that it is always important and necessary. The dissertation represents at first a vision against the model of public policy championed by the National Judicial Council, through Resolution 125 of November 29, 2010, whose object is the appropriate treatment of conflicts of interest within the Judiciary, representing this way a special scientific interest because it is a national judicial policy to be adopted, must, by all the courts of justice in the country. Apart from that mentioned above, lives also the fact that the novelty of this study and research, specifically because this public policy deals aspects and new variables in the treatment of the activities and functions of the Judiciary when they propose, as an example, the treatment of the conflicts. Another important aspect that worth the attention in the study is reflected in the discussion of public policy model, that should be treated in general republishing from the state and not particularized, even if it seems constitutionally of the Judiciary to treat exclusively with the problem of high litigation and low answer to the demand in its control. This study has a goal to demonstrate that the resolution 125/2010 CNJ is insufficient to solve the problems of congestion and delay in the Brazilian courts, as recommended, because, the model proposed to combat the problem of delays is restricted and is 'contaminated' by the idea of the monopoly of jurisdiction or a similar kind that brings justice to the scope of a new work activity, which is related to the solution of the conflict pre-trial which should be part of a general public policy does not restricted to a Republican power. Correspondence with the materialization of the arguments used for the problem will be proven in the lines that follow, therefore, with great coverage issues such as judicial remedies should preferably adopt mechanisms for general public a good solution. In this sense, the work will demonstrate that the recurrent attempts to overcome the problem of high lawsuit is restricted to insufficient models covered by a monopoly that should not be applied to solve procedural problems in the pre Judiciary. It is therefore a counterpoint to the idea of effectiveness in reducing the traditional lawsuit as provided for by the judicial against the monopoly of jurisdiction, ie, the reserve forward who holds the judiciary in promoting and managing of a new activity - the treatment of conflicts of interest pre-trial through instruments, notably the conciliation and mediation. We present also, in this study, legislative proposals that give material support to the presented ideas, characterizing the evidence of the viability between the presentation of scientific problem, the reasons for the confronting of the problem and a solution for it, how to modernize a public policy. Important to reaffirm that the scope of this present work is not based on the observation of the models and techniques of conflict resolution, notably the conciliation and mediation, encouraged by the CNJ, models or arbitration. Rather, it is expected that all attempts to improve and modernize the current legal services in Brazil are valid, effective and very welcome, because it is a positive attempt to improve the current scenario is the Judiciary when is confronted in their access to justice, speed, reliability and security of your judgments.

The general focus of this thesis is on how the family, work and the welfare system are intertwined. A major determinant is the way responsibilities are shared by the state, the market and civil society in different welfare state regimes. An introductory chapter will therefore be dedicated to the development of the social dimension in the process of European integration. A first chapter will then go deeper into the comparative analysis of welfare state regimes, to comment on the provision of welfare in societies with a different mix of state, market and societal welfare roles and to assess the adequacy of existing typologies as reflections of today’s changed socio-economic, political and gender reality. Although they stand strong on their own, these first two chapters also contribute to contextualising the research subject of the remainder of the thesis: the study and comparison of the differential situation of women and men and of mothers and non-mothers on the labour markets of the EU-15 countries as well as of the role of public policies with respect to the employment penalties faced by women, particularly in the presence of young children. In our analysis, employment penalties are understood in three ways: (i) the difference in full-time equivalent employment rates between mothers and non-mothers, (ii) the wage penalty associated with motherhood, and (iii) the wage gap between part-time and full-time workers, considering men and women separately. Besides from a gender point of view, employment outcomes and public policies are thus assessed comparatively for mothers and non-mothers. Because women choose to take part in paid employment, fertility rates will depend on their possibilities to combine employment and motherhood. This Master of Laws dissertation is a treatise of “The efficacy of Alternative Dispute Resolution (ADR) in labour disputes: a critical comparative analysis of Botswana, South Africa (RSA) and Zimbabwe.” Alternative Dispute Resolution hereinafter referred to as (“ADR”) has attracted so much research ado worldwide with policy makers alive to its possibilities in so far as it ought to shed off the burden of the courts in handling disputes. Courts are considered inundated with unresolved cases taking many years to finalise. ADR is therefore touted, not only the panacea, but the cheaper, efficient and effective alternative to normal court process. This study was saddled with the common challenges of definition, scope and methodology as does most scientific studies, especially to locate the concept ADR in the plethora of views from prominent exponent-s of the discipline. This study labored on the considered view that ADR is essentially an ‘out of court settlement approach to dispensing with disputes involving an attempt by disputants to rope in an impartial third party to aid finality to the respective wrangle. The lack of a methodological approach to treat this subject matter, made this study more challenging. The study had to therefore rely on a hypothetical model developed after gleaning through various scholarly views 1 that sought to treat the subject of ADR efficacy in labour dispute resolution. The study contented with the strongly held view 2 that ADR is an efficacious approach in resolving disputes outside the court system. As to whether this was the case in Botswana, RSA and Zimbabwe in so far as labour dispute resolution is concerned was the major challenge this study was seized with? A model was formulated which envisaged that efficaciousness of ADR may be achieved if three conditions or criteria are present within a jurisdiction, namely (1) ADR Background Conditions that comprise (a) adequate legislative and political support; (b) Supportive institutional and cultural norms, (c) adequate and competent manpower, (d) sufficient funding support, and (e) power-parity of disputants; (2) ADR Program Design comprising of (a) Planning and preparation and (b) Operations and implementation and finally (3) ADR Measures (a) Client satisfaction; (b) Time efficient; (c) Cost saving and (d) Settlement & enforcement. This study measured the situations obtaining in the three countries using these three-pronged criteria. In all three measures3 this study found that although all the three countries still have a long way before their ADR became as efficacious as would be reasonably possible, RSA has made many strides such as legislative enactments immediately upon attaining independence that sought to address the injustices of the past and thereby installing structures for enforcing industrial democracy 4, while Botswana and Zimbabwe took 5 years 5 and over 10 years 6 respectively after attaining independence. RSA established an independent body for dispensing with labour dispute settlement7 while Botswana8 and Zimbabwe 9 are still reluctant to do so, relying rather on their labour ministries often marinated in bureaucratic bottlenecks hence stalling efficacy of ADR. While RSA makes effort to provide adequate and competent manpower because of sufficient funding, Botswana and Zimbabwe still struggle to dispense with disputes under their labour departments who are either inadequately skilled or also accused of favouritism in the case of Zimbabwe.10 All the three countries are regarded as unequal societies which tends to sway the power-parity of disputants with capitalists still wielding unbridled powers in dispute outcomes. South Africa enacted section 143 to the Labour Relations Act 11 which empowers the Director of CCMA to certify an arbitral award, giving it the same force as an order of the Magistrate Court. This has cut off the time and administrative burden of having to register an arbitral award with the court so as to obtain writs of executions and enforce it, a practice which is still prevalent in Zimbabwe. The Department of Labour in South Africa has made funding available to the CCMA to assist employees who are not in a financial position to enforce awards in their favour.12 The funding is aimed at employees who are too indigent to afford the costs of enforcement.13 These employees are deemed to be: (a) Employees who earn below the earnings threshold (currently at R205 433.30 per annum) – proof of income will be required by the CCMA. There is no record regarding enforcement or ease of enforcement of ADR outcomes in Botswana and Zimbabwe or at least this study is aware of. The governments of Botswana and Zimbabwe have been accused of using a heavy hand in determining wages, the right to strike and often curtailing union power through declaring certain sectors essential services. RSA’s Commission for Conciliation, Mediation and Arbitration hereinafter after referred to as (the “CCMA”)14 runs an electronic system of case management by which cases are screened and assigned commissioners whereas Zimbabwe and Botswana still rely on manual systems often inefficiently managed especially when it comes to allocating matters to ADR interventionists.15 In Zimbabwe the challenge of resources is acute often the Labour Officers lacking a simple photocopier and postage stamps to dispense with administration of disputes. This dissertation found that Botswana and Zimbabwe lack publicly available information from which to infer the efficaciousness of ADR practices therein. Measuring client satisfaction, efficiency and cost effectiveness, enforcement and settlement has not been tackled with ease, which was different when it came to RSA. This study argues that RSA’s ADR is efficacious rated at 75% attainment of settlement of disputes, despite accusations of failing to offer disputants options and job retention at the end of ADR intervention. Botswana and Zimbabwe on the measures raised above are not yet close to achieving efficaciousness based on the above criteria. The challenges need to be addressed to ensure that in all three measures ADR affords Botswana, RSA and Zimbabwe disputants a cheaper, efficient and effective alternative to dispensing with labour disputes. This study concluded with recommendations arising from the three measures ADR Background Conditions; ADR Program Design and (3) ADR Measures could be implemented towards achieving an efficacious ADR regime for the three countries and beyond. / Mercantile Law / LL.M.
