Prison overcrowding in the South African correctional services: a penological perspective

Incarceration of offenders has been relied upon as the dominant sentence option through the years to address the objectives of punishment. Research has shown that the above-mentioned approach does not match the current lifestyle anymore. Correctional centres (prisons) not only in South Africa, but across the board are faced with the same challenge. This is of course not a problem of the Department of Correctional Services alone, but that of the entire justice system. It is therefore obligatory for Justice to join hands with society in accordance with the White Paper on Corrections in South Africa (2005:63-68). Playing a major role in all above-mentioned bodies is Parliament, without which the whole justice system would not exist, let alone functioning. The victims of crime would most probably not condone any soft approach towards treating offenders, worse with alleviating overpopulation by releasing inmates from correctional centres. It is the researcher's submission that the effects of overpopulation coupled with inmate's human rights, as entrenched in the Constitution becomes the major driving force to address overcrowding in our correctional centres. / Penelogy / (M.A. (Penelogy))

An evaluation of health care of prisoners at selected institutions : a nursing perspective

Thesis (MCur) -- University of Stellenbosch, 2005. / ENGLISH ABSTRACT: A non-experimental descriptive study was conducted in four prisons in the Western Cape. The research focussed on the standard of care within primary health care settings in the purposively selected prisons. No official written standards existed to measure the quality of care. After an in-depth literature study, structure, process and outcome standards were formulated and validated. The main findings of the study indicated that: • Standards in these three dimensions of care did not meet the pre-set level of performance as determined by the researcher; • The clients were generally satisfied with the hygiene in the clinics; • Aspects of concern were the lack of explanation offered to the clients before and after consultations and nursing care interventions. The researcher recommends the implementation of a comprehensive quality care model for the health care of the prisoners with adequate human and nonhuman resources Core words: Qualtiy care, Correctional services health care, Nursing care in prisons. / AFRIKAANSE OPSOMMING: "n Nie-eksperimentele beskrywende studie is in vier gevangenisse in die Wes- Kaap uitgevoer. Die navorsing het gefokus op die gehalte van sorg binne primere gesondheidsorgomgewings in die doelbewuste geselekteerde omgewings. Geen amptelike geskrewe standaarde om die gehalte van sorg te meet, het bestaan nie. Na 'n in-diepte literatuurstudie is struktuur-, proses- en uitkomsstandaarde geformuleer en gevalideer. Die belangrikste bevindings van die studie het aangedui dat: • Standaarde in hierdie drie dimensies van sorg het nie aan die voorafbepaalde vlak van sorg voldoen het nie soos deur die navorser bepaal is; • Die kliente was oor die algemeen tevrede met die higiene in die klinieke; • Kommerwekkende aspekte het ingesluit die gebrek aan voldoende verduidelikings aan kliente voor en na konsultasies en verpleegintervensies. Die navorser bevel aan dat In omvattende gehalteversekeringsmodel vir die gesondheidsorg van gevangenes ingestel word met voldoende beskikbare mensen ander hulpbronne. Prison overcrowding : a penological perspective

The World Prison Brief Walmsley (2001:2) reveals that there are 8,7 million people held in penal institutions throughout the world, either as pre-trial detainees or having been convicted and sentenced. Although the rising prison population in South Africa is of great concern, it is certainly not just a South African problem, but an international phenomenon. Prison overcrowding and the resultant financial and human rights problems related to this phenomenon, remain one of the paramount concerns of both developed and developing countries. Overcrowding of prisons negates the rehabilitation of offenders, undermines human dignity in correctional facilities and renders the safety and security of offenders and the community vulnerable. Another problem facing the Department of Correctional Services is the control of communicable diseases and viruses, particularly HIV/AIDS and Tuberculosis. The problem of overcrowding facilitates the easy spread of communicable diseases among inmates. Imprisonment as a sanction remains a reality. Providing alternatives to imprisonment, for example, community based-sanctions, does however ensure that a significant number of offenders can be dealt with in a more balanced manner. Alternative sanctions to incarceration can be more successful, less costly to the state, have fewer negative implications and will lighten the load for the criminal justice system, hence reducing overcrowding. In order to reduce the overcrowding in prisons there has to be a reduction in the number of both awaiting-trial and sentenced prisoners. Reducing the inflow of offenders from the courts to the prisons and trying to get minor offenders in prison to be released should accomplish this. Courts and magistrates must break away from centuries of reliance on imprisonment as punishment. If more people show interest in the human rights of incarcerated prisoners, then further effort will be placed on resolving the overpopulation problem facing the Department of Correctional Services. / Criminology and Security Science / (D. A presente dissertação teve como objetivo geral analisar a Rede de Atendimento que se constitui a partir do adolescente privado de liberdade no Centro de Socioeducação de Pato Branco – PR (Cense), o lócus da pesquisa. O Cense é uma instituição estadual que atende aos adolescentes em cumprimento de medidas socioeducativas de internação em virtude do cometimento de ato infracional. Para atender o que preconiza a legislação específica para adolescentes privados da liberdade o Cense necessita integrar a Rede de Atendimento do município e utilizar-se dos recursos disponíveis na comunidade. Para analisar a Rede buscou-se suporte teórico e metodológico na Teoria Ator- Rede a qual tem como principal autor Bruno Latour. Apresenta também, uma discussão sobre a modernidade e a separação que esta provocou criando polos: entre sociedade e natureza, humanos e não-humanos, especialistas e leigos. Esta divisão é questionada pela Teoria Ator-Rede, a qual aponta caminhos para analisar a constituição dos coletivos (associações). O Estudo apresenta de forma breve, a trajetória da constituição das instituições de atendimento aos adolescentes privados de liberdade no Brasil e no Paraná. Na qual, se apontam as condições materiais destes sujeitos que estão distantes dos benefícios das promessas da modernidade. A pesquisa utilizou-se de alguns instrumentos: observação participante, diário de campo, entrevistas e formulários com questões abertas. Para representação da Rede formada a partir das indicações dos entrevistados utilizou-se da ferramenta Ucinet 6 ®. Em síntese, as análises sinalizaram que a Rede formal criada pelas normativas e legislações não se apresenta como um recurso que poderia ser acessada plenamente pelos adolescentes privados da liberdade. Que a Rede acessada pelos adolescentes integram mais elementos não formais do que as instituições legalmente constituídas. E, que a articulação entre as diferentes instituições governamentais e não-governamentais ainda se constituiu um ideal a ser alcançado. / The present dissertation had as general objective to analyze the Network of Attendance that is constituted from the adolescent deprived of freedom in the Center of Socioeducation of Pato Branco - PR (Cense), the locus of the research. Cense is a state institution that serves adolescents in compliance with socio-educational measures of deprivation due to the commission of an infraction. In order to meet the requirements of the specific legislation for adolescents deprived of liberty, Cense needs to integrate the Municipal Service Network and use the resources available in the community. In order to analyze the Network, theoretical and methodological support was sought in the Theory-Actor Network whose main author is Bruno Latour. It also presents a discussion about the modernity and the separation it has created by creating poles: between society and nature, human and non-human, specialists and lay people. This division is questioned by the Actor-Network Theory, which points out ways to analyze the constitution of the collectives (associations). The study briefly presents the trajectory of the constitution of institutions for the care of adolescents deprived of their liberty in Brasil and Paraná. In which, it is pointed out the material conditions of these subjects that are far from the benefits of the promises of modernity. The research used some instruments: participant observation, field diary, interviews and forms with open questions. For the representation of the Network formed from the interviewees indications, the Ucinet 6 ® tool was used. In summary, the analyzes indicated that the formal network created by norms and laws is not a resource that could be fully accessed by adolescents deprived of their liberty. That the Network accessed by adolescents integrate more non-formal elements than legally constituted institutions. And, that the articulation and between the different governmental and non-governmental institutions still constituted an ideal to be reached.

The effect of the experience of incarceration on prison inmates

This research was undertaken to establish the effect incarceration of individuals in the total institution called prison has on the incarcerated individuals. A literature study along with an empirical study, with 17 ex-inmates, was completed to explore the environment and circumstances of the institution called prison and the effect it has on the prisoners it incarcerates. Issues discussed include the prison environment, the prisonisation process, the inmate code and the process of incarceration. Also discussed are the presence, activities and influence of the gangs within the prison environment. It would appear that prison has a lasting effect on most prisoners and limited rehabilitative value, although there does appear to be some deterrence value. The subject begs further investigation, especially among a wider mix of inmate type, in order to deliver further recommendations to the South African Department of Correctional Services. / Social work / M.A.(Social Science)

The impact of prison reform on the inmate population of Swaziland

The purpose of this study was to contextualise the Swaziland correctional services environment and inmate population, analysing how best to respond to the needs of the organisation and providing strategies that can have an impact on crime and recidivism. Offenders in Swaziland are incarcerated because alternatives to imprisonment or the resources necessary to make a visible impact on the inmate population are not provided. There is also very little scientific information available on the profiles of inmates to determine who really needs to be incarcerated, who could be incarcerated for a shorter time and who could be taken care of in the community. In addition to the above, Swaziland correctional services finds itself in a predicament where it has to provide concrete evidence that it is effective and adding value to the social and economic reconstruction of the country. This implies the frequent assessment of the organisation's performance to ensure the continuous delivery of cost-effective, innovative and high quality correctional services. In an attempt to understand the breadth of the problems faced by Swaziland correctional services, this thesis sets out to assess the environment in which Swaziland correctional services operates and to suggest mechanisms which can be used to rehabilitate and reduce the inmate population in order to add value and sustain the delivery of an effective correctional service. This study would seem to be of value not only to correctional practitioners, but also to the police and judiciary in that they will have a better understanding of dilemmas faced by Swaziland correctional services. This will assist the police and judiciary to take more informed decisions with regard to effective law enforcement, detention of awaiting-trials and sentencing practices. A model of performance management for the parole boards in South Africa : a penological perspective

One of the fundamental objectives of the criminal justice system in any country is to punish, rehabilitate, deter, incapacitate and reintegrate offenders into communities. The main motive of punishment therefore is to transform criminals into responsible and law-abiding citizens. Parole is acknowledged as an internationally accepted mechanism that allows for the conditional release of offenders from correctional centres into the community and forms one of the most important components of the criminal justice system value chain. The release of the offenders on parole therefore, does not negate the objectives of punishment but entrenches them through setting conditions by which all parolees must abide by. In other words, all offenders released on parole are supervised at all times by parole officials within their communities to ensure that they comply with their conditions. It is for this function- to grant parole to offenders, that the parole boards have been established in different countries. The Department of Correctional Services in South Africa has adopted the independent model of parole which provides for the parole boards that are headed by independent members from the public appointed by the Minister of Correctional Services. Parole is administered by the parole boards and has, as one of its main functions the release of offenders based on their eligibility. The absence of the performance management system for the parole board makes parole board decision making less transparent and government accountability difficult to establish. Performance management systems have been used to strengthen good governance. The purpose of this study is to contribute to the design of a model of performance management of the parole boards in the Department of Correctional Services in South Africa. / Penology / D.Litt. et Phil.
