Sobre a metodologia, a pesquisa teve uma abordagem qualitativa que permitiu pensar na natureza socialmente construída da realidade e na relação estabelecida entre o pesquisador e o que foi “estudado”. Considerando todas as limitações situacionais que influenciaram essa investigação, recorremos a uma documentação diversificada, incluindo jornais, periódicos ─ especificamente a revista Veja, processos crime de homicídio e produção jurídica (Códigos Penais e literatura de comentadores dos Códigos). Analisou-se ainda, obras voltada para a discussão do crime passional, bem como os posicionamentos dos doutrinadores penais a respeito do tema. Neste sentido, o estudo em questão teve a preocupação de avaliar e discutir as aproximações e rupturas entre os projetos e as vivências, bem como a multiplicidade de significados que perpassam as dimensões dos saberes e das práticas relativas à passionalidade, buscando-se compreender o universo das diversidades a partir das diferenças de gênero e, portanto, das inter-relações com o contexto social mais amplo, marcado por profundas transformações. Discutiu-se que no campo jurídico, diversas representações da sociedade são construídas e outras reforçadas. Representações essas reproduzidas em sociedade, na escola, na família, na comunidade, nas relações de gênero. Não à toa, analisar processos-crime permitiu também uma percepção das sensibilidades, dos sentimentos vividos por esses indivíduos em seus dramas passionais. Além disso percebeu-se que ainda existe um longo caminho de luta para ser percorrido para que essa representação, que mantém e reitera as mulheres através de processos discursivos em uma relação de submissão perante os homens, possa ser enfim desconstruída. Luta essa, que vem sendo travada pelas militantes do movimento feminista brasileiro desde a década de 70, que trouxe para a esfera do público, logo da política, assuntos que antes eram relegados para o âmbito do privado. / This research aimed to investigate how cultural changes reflected in criminal law and in the representations and practices relating to crimes of passion attributed to individuals of both sexes, occurred in Brazil, especially in the city of Salvador between 1940-1980, from a perspective gender. On the methodology, the research was a qualitative approach that allowed thinking about the socially constructed nature of reality and the relationship established between the researcher and what was "studied”. Considering all the situational constraints that influenced this research, we turn to a diverse documentation, including newspapers, periodicals ─ specifically Veja magazine, homicide production processes and legal (criminal codes and codes commentators literature). Analyzed also works focused on the discussion of the crime of passion, as well as the positions of criminal scholars on the subject. In this sense, the study in question took care to assess and discuss the approaches and breaks between projects and experiences, as well as the multiplicity of meanings that underlie the dimensions of knowledge and practices related to passionateness, seeking to understand the universe of differences from gender differences and therefore the interrelations with the broader social context, marked by profound changes. It has been argued that in the legal field, various representations of society are built and others reinforced. These representations are reproduced in society, at school, in the family, in the community, in gender relations. No wonder; analyze criminal proceedings also allowed a perception of sensitivities, feelings experienced by these individuals in their passionate dramas. In addition it was noted that there is still a long way to fight to be covered so that this representation, which maintains and reiterates women through discursive processes in a relation of submission before men, to be finally deconstructed. Fight this, being waged by militants of the Brazilian feminist movement since the 70s, which brought into the sphere of the public, then the policy issues that were relegated to the realm of the private.

A main objective of the study was to characterize the discourse concerning honor in the written and oral practices in the construction of the crime of passion, understanding honor as a value of the accused, both through their own eyes and through the eyes of the society to which they belong. Concepts of honor are discussed in connection with sociological, anthropological and juridical thought, more specifically in the figure of the passionate murderer within the presentation of cases of crimes of passion and in the analysis of the juridical "legitimate defense of honor", a discourse constructed in the narrative of these deaths throughout the process from the charge of the crime to the verdict of the Jury Court. The development of the text is based upon a typology of the cases using a qualitative approach and descriptive method. The construction of questions guiding the discussion in this thesis takes the following sequence: characterization of the concept of honor, overview of the Jury Court, account of a jury session, description of the cases of crimes of passion and analysis thereof. It can be seen in the conclusions of the analysis that crime of passion, discourse, verdict and sentence all have sociological meaning as expression of social traditions and moral duty, strengthening the discourse concerning honor in the narrative and reinforcing aspects of the construction of the social world. / Esta tese apresenta um estudo de dez crimes passionais julgados pelo Tribunal do Júri brasileiro, sendo quatro os conceitos-chave que orientam a discussão: crimes passional, júri, honra, veredicto e sentença. Um dos principais objetivos do trabalho foi caracterizar o discurso da honra nas práticas escritas e orais da elaboração do crime passional, entendendo a honra como o valor do réu aos olhos dele mesmo e, mais ainda, à óptica da sociedade a que pertence. Na análise que se segue, são discutidos os conceitos de honra ligados ao pensamento sociológico, antropológico e jurídico, mais especificamente na figura do homicida passional, mediante através da apresentação dos casos de crimes passionais e na análise do argumento da “legítima defesa da honra”, discurso constituído durante a narração dessas mortes, desde a denúncia do ato até o julgamento pelo Tribunal do Júri. A elaboração deste texto é fundamentada na tipologia de estudo de casos, com abordagem qualitativa e método descritivo. Na montagem da problemática que orienta a discussão desta tese, tem-se a seqüência: caracterização da honra, apresentação do Tribunal do Júri, relato de uma sessão do júri, descrição dos casos de crimes passionais e análise dos ilícitos. Nas conclusões da análise, pode-se perceber que o crime passional, o discurso, o julgamento e a sentença têm significados sociológicos relevantes na caracterização desse condensado de idéias, interpretadas como expressão das tradições sociais, dever moral exposto na sentença, e fortalecimento dos discursos da honra nas narrativas, aspectos formuladores do mundo social.
