Crimes Passionais e Honra no Tribunal do JÃri Brasileiro / Crime of Passion and Honor

CoordenaÃÃo de AperfeiÃoamento de Pessoal de NÃvel Superior / Esta tese apresenta um estudo de dez crimes passionais julgados pelo Tribunal do JÃri brasileiro, sendo quatro os conceitos-chave que orientam a discussÃo: crimes passional, jÃri, honra, veredicto e sentenÃa. Um dos principais objetivos do trabalho foi caracterizar o discurso da honra nas prÃticas escritas e orais da elaboraÃÃo do crime passional, entendendo a honra como o valor do rÃu aos olhos dele mesmo e, mais ainda, à Ãptica da sociedade a que pertence. Na anÃlise que se segue, sÃo discutidos os conceitos de honra ligados ao pensamento sociolÃgico, antropolÃgico e jurÃdico, mais especificamente na figura do homicida passional, mediante atravÃs da apresentaÃÃo dos casos de crimes passionais e na anÃlise do argumento da âlegÃtima defesa da honraâ, discurso constituÃdo durante a narraÃÃo dessas mortes, desde a denÃncia do ato atà o julgamento pelo Tribunal do JÃri. A elaboraÃÃo deste texto à fundamentada na tipologia de estudo de casos, com abordagem qualitativa e mÃtodo descritivo. Na montagem da problemÃtica que orienta a discussÃo desta tese, tem-se a seqÃÃncia: caracterizaÃÃo da honra, apresentaÃÃo do Tribunal do JÃri, relato de uma sessÃo do jÃri, descriÃÃo dos casos de crimes passionais e anÃlise dos ilÃcitos. Nas conclusÃes da anÃlise, pode-se perceber que o crime passional, o discurso, o julgamento e a sentenÃa tÃm significados sociolÃgicos relevantes na caracterizaÃÃo desse condensado de idÃias, interpretadas como expressÃo das tradiÃÃes sociais, dever moral exposto na sentenÃa, e fortalecimento dos discursos da honra nas narrativas, aspectos formuladores do mundo social. / This thesis presents a study of ten cases of crimes of passion tried before the Jury Court (Tribunal do JÃri), a Brazilian court with specialized jurisdiction over each of certain grave offenses in which a life is taken. A main objective of the study was to characterize the discourse concerning honor in the written and oral practices in the construction of the crime of passion, understanding honor as a value of the accused, both through their own eyes and through the eyes of the society to which they belong. Concepts of honor are discussed in connection with sociological, anthropological and juridical thought, more specifically in the figure of the passionate murderer within the presentation of cases of crimes of passion and in the analysis of the juridical "legitimate defense of honor", a discourse constructed in the narrative of these deaths throughout the process from the charge of the crime to the verdict of the Jury Court. The development of the text is based upon a typology of the cases using a qualitative approach and descriptive method. The construction of questions guiding the discussion in this thesis takes the following sequence: characterization of the concept of honor, overview of the Jury Court, account of a jury session, description of the cases of crimes of passion and analysis thereof. It can be seen in the conclusions of the analysis that crime of passion, discourse, verdict and sentence all have sociological meaning as expression of social traditions and moral duty, strengthening the discourse concerning honor in the narrative and reinforcing aspects of the construction of the social world.

Notre pratique d’expert psychologue au pénal nous a amenée à entreprendre cette recherche, sur les crimes passionnels. Cette catégorie, non reconnue par le droit met l’accent sur ce qui se joue parfois de façon dramatique entre un homme et une femme. Amour, crime et folie fondent l’humanité.La criminologie, au XIXe siècle, à partir des aliénistes et de la médecine légale, s’inscrivant dans un mouvement de défense sociale, a posé la question de la folie et de la dangerosité de ces criminels. Au XXIe siècle, le signifiant majeur est violence faite aux femmes, la femme devient victime ayant des droits à défendre. La psychanalyse, avec Freud et Lacan mettent la dimension de l’acte et du désir au cœur de la psyché. Lacan a montré, avec Aimée la dimension imaginaire du crime, puis sa dimension symbolique dans les années 50. Avec son dernier enseignement, et l’invention de l’objet a, la causalité du passage à l’acte est psychique et s’inscrit dans le réel.Reconnaître le hors sens du crime permet de ne pas disjoindre passage à l’acte et personnalité, et peut amener le sujet à accéder à sa responsabilité et à être jugé en conséquence.Les neurosciences ne peuvent dire ce qu’est l’amour ou le crime, les techniques actuarielles ne permettent pas de le prédire.L’amour est un semblant qui voile l’impossible du rapport sexuel. Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / A presente tese tem o objetivo de promover uma análise sobre a norma penal brasileira que versa sobre a violenta emoção, com base no estudo teórico da ação criminal passional. Tem por objeto de estudos a discussão sobre a temporalidade psíquica da ação que sustenta as distinções no instituto jurídico da violenta emoção apresentada nos artigos 28; 65, III, c; 121 1 e 129 4 do Código Penal Brasileiro. A partir de uma construção genealógica, buscou-se os antecedentes históricos dessas leis, posteriormente, interpretadas à luz de conceitos psicanalíticos e de contribuições da antropologia social acerca do imaginário cultural que sustenta a eclosão e o julgamento de crimes na esfera amorosa. O método de trabalho consistiu em um estudo teórico de caráter dedutivo-construtivo baseado em fontes oriundas de diferentes campos teórico-práticos e também de consultas abertas feitas a juristas e estudiosos da criminologia. As transformações históricas nos julgamentos indicam uma transposição da antiga indulgência em relação aos criminosos ao atual apelo por recrudescimento das penas, demonstrando que justificar ou punir crimes sob a rubrica da violenta emoção ligados à esfera amorosa representa um sintoma atrelado ao contexto social. O conceito de "violenta emoção" está sujeito a reducionismos teóricos, devido à ênfase dada à dimensão da "culpabilidade consciente" no sistema jurídico, ao predomínio de interpretações ligadas aos aspectos psicofisiológicos do ímpeto, bem como à incipiente atenção dada às condições inconscientes culturalmente determinantes do ato criminal violento em casais. Desse modo, o texto dos referidos artigos pode servir indevidamente à diminuição da pena em crimes envolvendo casais, assim como a devida atenuação pode ser desconsiderada quando a/o ré/u sofre de privações sociais e psíquicas prolongadas constitutivas de um mal-estar passional por vezes dissociado do tempo da ação. Com as limitações apontadas, reconhece-se a importância da existência da referência à violenta emoção enquanto uma atenuante criminal genérica e critica-se a sua aplicação como "privilégio" de diminuição de pena em crimes de ímpeto em casais. Its basis for study is a discussion concerning the psychic temporality of the act that sustains the distinctions within the juridical institution of violent emotion presented in articles 28; 65, III, c; 121 1 et 129 4 of the Brazilian Penal Code. From a genealogical construct, the historical antecedents of such laws were targeted and then interpreted in light of psychoanalytic concepts and contributions from social anthropology regarding the imaginary customs that nourish the profusion and judgment of crimes within the sphere of love. The work method hinged on a theoretical study in the deductive-constructive manner based on sources ranging from different theoretical/practical fields and on open interviews with jurists and specialists on criminology. The historical transformations of the trials indicate a transposition from the old indulgence towards criminals to todays appeals for the harshening of sentences, showing that justifying or punishing crimes of violent emotion in the sphere of love represents a symptom directly linked to a social context. The concept of violent emotion is not immune to theoretical simplifications, given the emphasis placed on the dimensions of conscious culpability within the penal law system, the predominance of interpretations linked to the psychic-physiological aspects of the drive, as well as the incipient weight placed on the unconscious, culturally determinant conditions of the criminal act among couples. In this manner, the text in the referred Articles may unduly serve for the lessening of sentences for crimes involving couples, just as the due attenuation of sentences may be overlooked when the defendant suffers from prolonged social and psychic privations comprised of a discontent often times dissociated from the time of the criminal act. Pointing out such limitations, one must recognize the importance of the existing reference to violent emotion as a generic means for criminal attenuation and criticize its use as a privilege for the lessening of sentences in crimes of impetus among couples. A psychoanalytic, historical study of the theme stresses the need to enhance the subjective responsibility tied to the realization of a psychopathological tendency, yet furthermore enhances the social responsibility in relation to crimes of passion, thus underscoring the importance of providing alternatives to the penal court answer in order to promote a careful interpretation of articles on violent emotion for the better understanding of the unconscious temporality inherent to these crimes in the penal context.

An exploration of significant themes in the diary of a person who committed murder

The objective of this study was to explore the authentic knowledge that evolved from a spontaneously written personal diary and other texts of a person who committed a crime of passion. I attempted to demonstrate how spontaneous linguistic forms could be used to gain a better understanding of the dynamics underlying and precipitating a crime of passion. A crime of passion represents a part of reality where both the suffering individual and the therapeutic or researching community seem to be either out of control or very vague understanding and explaining this seemingly paradoxical phenomenon. The main question is: why is the knowing (loving a person) in such cases not revealed in their way of being (killing that person)? An existential-phenomenological approach was adopted to explicate the apparently paradoxical phenomenon of a crime of passion. I explored the complicated hidden meanings (knowledge) in the diary of a person who murdered his fiancée, to unravel these assumed paradoxes, and found that the knowledge (epistemology) in the subject spontaneous self-expression provided a key for a better understanding of his way of existence or being (ontology) within a specific context, time and part of his life. Exploratory, descriptive, conceptual and semantic questions were explored by adopting an existential-hermeneutical orientation that allowed me to explicate the paradoxes both at primary and secondary levels. Working from a qualitative research perspective and phenomenological methodology, an in-depth analysis of meaning units and conceptual categories clarified underlying and hidden meanings in the texts. Theoretical linkages between different conceptual categories were explicated, highlighting the gaps in our previous understanding and theorising about crimes of passion. In this I could reveal how the person s existence gradually changed from inauthentic (insincere) and pretending to a more authentic (sincere) life of caring and responsibility after the crime. It is the act of extreme violence between couples, which occurs when the individual is taken by a sense of passion and intense emotion, going berserk in a situation of threat or loss of the object of love. The field of interest of this research is understanding the motivations for carrying out the crime of passion, the perceptions upon the act on individuals deprived of liberty, the insight into the emotional aspects linked to the crime committed, and the comprehension of offenders perception about the prison experience. Survey participants were offenders who committed the crime of passion against intimate partners, and were imprisoned in a detention facility in Viana, Angola. This study has a qualitative nature, utilizing a semi-structured interview as a research tool. The sample selected for the survey included 17 male participants, among which four were awaiting trial and thirteen had already been convicted. The age of respondents ranged between 26 and 54 years old. Categories were defined after the analysis of the contents of interviews. The theoretical approach was the psychodynamic psychology, which helped us understand the behavior of the subjects. The results revealed that the main reasons pushing the individuals to the crime of passion were jealousy and betrayal arisen by the presence of a rival, real or imaginary, stimulating the subject to evoke a mixture of thoughts, feelings, emotions and behaviors that aroused in him lack of control, intolerance and frustration, mobilizing him to the act of extreme violence / O crime passional é um fenômeno sociocultural que afeta a saúde pública. É o ato de violência extrema entre casais, que ocorre quando o sujeito é tomado por um sentimento de paixão e emoção intensa, descontrolando-se diante de uma situação de ameaça ou perda do objeto de amor. A presente pesquisa tem como campo de interesse a compreensão das motivações para a realização do crime passional, as percepções sobre o ato em sujeitos privados de liberdade, a apreensão dos aspectos emocionais ligados ao crime cometido e a percepção dos infratores a respeito da vivência carcerária. Os participantes da pesquisa eram infratores que cometeram crime passional contra as parceiras íntimas, e se encontravam encarcerados no estabelecimento prisional de Viana, em Angola. O método de estudo utilizado é de caráter qualitativo, e o instrumento de investigação foi a entrevista semiestruturada. A amostra selecionada para a pesquisa reuniu 17 participantes do sexo masculino, dos quais quatro se encontravam à espera de julgamento e treze já tinham sido condenados. A faixa etária dos entrevistados situava-se entre 26 e 54 anos de idade. As categorias foram definidas após a realização da análise do conteúdo das entrevistas. A abordagem teórica foi a psicologia psicodinâmica, que nos ajudou a compreender o comportamento dos sujeitos. Os resultados apontaram que os principais motivos que impulsionaram os sujeitos ao crime passional foram o ciúme e a traição, que surgiram com a presença de um rival, real ou imaginário, suscitando no indivíduo a evocação de uma mistura de pensamentos, sentimentos, emoções e comportamentos que nele despertaram descontrole, intolerância e frustração, mobilizando-o para o ato de violência extrema

Dans les rapports familiaux, les mécanismes de la responsabilité paraîssent s’appliquer plus difficilement qu’ailleurs. Qu’il s’agisse d’engager la responsabilité des époux, ou bien celle d’un parent envers son enfant, ou même encore de juger un délinquant passionnel, il peut être malaisé de déterminer les parts de responsabilité et de culpabilité qui reviennent à chacun. L’élément affectif, qui n’est pas regardé en principe comme un objet possible du droit, est susceptible d’expliquer cette difficulté. L’objet de cette thèse est donc de découvrir ce que peut être cet affect, et s’il intervient effectivement de façon significative dans les responsabilités familiales. Dans la pensée classique, l’affect n’a pas d’autonomie, en ce sens qu’il est toujours assimilé et réduit à d’autres notions, telles que l’émotion ou la volonté. En le dégageant de ces réductions, pourtant, l’affect peut être un élément isolable, qui est clairement identifiable dans le lien conjugal ou dans la filiation. L’affect est ainsi un élément concret, mais aussi dynamique, en ce sens qu’il est doté d’une valeur normative. Il est donc capable, non seulement d’éclairer des situations familiales pour lesquelles la responsabilité, civile ou pénale, doit être mise en oeuvre, mais encore de porter une valeur, que le droit peut découvrir et protéger. / In family relations, responsibility mechanism seems to apply themselves with much more difficulty then elsewhere. Whether it engages the responsibility of the married couple, or the one of a parent towards his child, or even to judge a crime of passion, it can be difficult to determine the responsibility or guilt of each party. The affectif element, that is usually not considered like a text of law, is likely to explain this difficulty. Therefore, the purpose of this thesis is to discover what can be this affect, and if it indeed intervenes in a significant way in family responsibilities. In the classical thought, the affect has no autonomy, in a way that it is always assimilated and reduced to other notions such as emotion or free will. Removing these simplifications, the affect can be an element which can be isolated and clearly identified in the conjugal link or in filiation. Consequently, the affect is a concret element, but also dynamic, in the way it is doted by a normative value. It is therefore able, not only to enlighten family situations for which, civil or penal responsibility must be applied, but must also carry a value, that law may discover and protect.

A main objective of the study was to characterize the discourse concerning honor in the written and oral practices in the construction of the crime of passion, understanding honor as a value of the accused, both through their own eyes and through the eyes of the society to which they belong. Concepts of honor are discussed in connection with sociological, anthropological and juridical thought, more specifically in the figure of the passionate murderer within the presentation of cases of crimes of passion and in the analysis of the juridical "legitimate defense of honor", a discourse constructed in the narrative of these deaths throughout the process from the charge of the crime to the verdict of the Jury Court. The development of the text is based upon a typology of the cases using a qualitative approach and descriptive method. The construction of questions guiding the discussion in this thesis takes the following sequence: characterization of the concept of honor, overview of the Jury Court, account of a jury session, description of the cases of crimes of passion and analysis thereof. It can be seen in the conclusions of the analysis that crime of passion, discourse, verdict and sentence all have sociological meaning as expression of social traditions and moral duty, strengthening the discourse concerning honor in the narrative and reinforcing aspects of the construction of the social world. / Esta tese apresenta um estudo de dez crimes passionais julgados pelo Tribunal do Júri brasileiro, sendo quatro os conceitos-chave que orientam a discussão: crimes passional, júri, honra, veredicto e sentença. Um dos principais objetivos do trabalho foi caracterizar o discurso da honra nas práticas escritas e orais da elaboração do crime passional, entendendo a honra como o valor do réu aos olhos dele mesmo e, mais ainda, à óptica da sociedade a que pertence. Na análise que se segue, são discutidos os conceitos de honra ligados ao pensamento sociológico, antropológico e jurídico, mais especificamente na figura do homicida passional, mediante através da apresentação dos casos de crimes passionais e na análise do argumento da “legítima defesa da honra”, discurso constituído durante a narração dessas mortes, desde a denúncia do ato até o julgamento pelo Tribunal do Júri. A elaboração deste texto é fundamentada na tipologia de estudo de casos, com abordagem qualitativa e método descritivo. Na montagem da problemática que orienta a discussão desta tese, tem-se a seqüência: caracterização da honra, apresentação do Tribunal do Júri, relato de uma sessão do júri, descrição dos casos de crimes passionais e análise dos ilícitos. Nas conclusões da análise, pode-se perceber que o crime passional, o discurso, o julgamento e a sentença têm significados sociológicos relevantes na caracterização desse condensado de idéias, interpretadas como expressão das tradições sociais, dever moral exposto na sentença, e fortalecimento dos discursos da honra nas narrativas, aspectos formuladores do mundo social.
