The purpose of this research was to describe and explain crimes against women in the Gauteng Province of South Africa. It was conducted by means of a literature review, followed by empirical research, based on police dockets, against the background of Seligman's theory on learned helplessness. The literature review was used to design a research schedule. The schedule was used for data capturing from police dockets from the Crime Information Analysis Centre (QAQ at their Gauteng Regional office in Johannesburg. From this data, a convenience sample, consisting of 303 cases, was compiled. These cases were reported at the charge offices of Pretoria-Moot Villieria, Pretoria-North, Pretoria-West Eersterust and Hillbrow, for the period between 1 January 1997 and 1 March 1998. Finally, recommendations are made for the design of preventative strategies, and suggestions are made for possible future research. / Die doel van hierdie navorsing was om misdade teen vroue in die Gauteng Provinsie van Suid-Afrika te beskryf en te verklaar. Dit is gedoen aan die hand van literatuurstudie, en is uitgebrei met 'n empiriese ondersoek wat op polisiedossiere ebaseer is, teen die agtergrond van Seligman se teorie van aangeleerde hulpeloosheid. Die literatuurstudie is gebruik om 'n skedule te ontwerp. Die navorsingskedule is gebruik vir datavangs uit polisiedossiere. Die polisiedossiere van die Misdaadinligting-Analisesentrum (MIAS) van Gauteng se streekkantoor in Johannesburg is gebruik vir die samestelling van 'n gerieflikheidsteekproef bestaande uit 303 gevalle. The International Criminal Tribunal for Rwanda's approach to serious violations of humanitarian law

On October 1, 1990 the Rwandan Patriotic Front launched a war from and with the support of the Republic of Uganda against Rwanda. This war was accompanied by unspeakable violations of International Humanitarian Law. Both conflicting parties violated the basic rules protecting the civilian population in situations of armed conflicts. The United Nations Security Council, acting under Chapter VII of its Charter, passed resolution 955 of November 8, 1994 establishing the International Criminal Tribunal for Rwanda to prosecute alleged responsible of such violations. This study investigates the background of the ICTR and questions the nature of the conflict that prompted the Security Council to establish another ad hoc international criminal tribunal after the one established for the former Yugoslavia. It further inquires into its jurisprudence and reflects critically on the ICTR's approach to serious violations of IHL under Article 3 Common to the Geneva Conventions and Additional Protocol II. / Jurisprudence / LL. A family systems analysis of child murderers

For decades there has been growing interest into the crime of child murders. Emphasis was placed on victims and those at risk. Not much focus was placed on perpetrators and their families. Evidence suggests that the family and social systems play a vital role in determining adult violent behaviour. This qualitative study aims to explore the experiences of convicted child murderers in their family and social system. Data was collected and analysed, using genogram interviews and analysis. Themes were highlighted using hermeneutic thematic analysis, within a post-modern paradigm. Results were presented in the form of genogram analysis and thematic content analysis. Prominent themes that arose were separation, rejection, abuse, neglect and substance abuse. These life experiences together with poor education are some of the characteristics that may have contributed to the child murderers actions towards children. / Psychology / M. A. A survey on the extent and nature of poly-victimization of adolescents in Heideveld

The goal of the study was to conduct a survey on the extent and nature of poly-victimization of adolescents in Heideveld. This researcher used a quantitative approach, administering an altered form of the Juvenile Victimization Questionnaire to achieve the goal. This questionnaire had 34 screener items exploring victimization events across a broad range of possible victimization types. Convenience sampling of grade 8-10 learners was used from a school in Heideveld. Ninety-one respondents completed the questionnaire, the age range spread from 13 – 18 years of age. Descriptive statistics were used to analyse the results. Responses of respondents to victimization (directed either at themselves or a peer) were explored through open-ended questions. Content analysis was performed to describe the data collected. The results showed that the extent of poly-victimization of adolescents in Heideveld is high. Understanding the experiences of adolescents trafficked for sexual exploitation : informing social work services

The impact of adolescent human trafficking for sexual exploitation is of such a nature that it interferes with the attainment of adolescent developmental tasks that would lead to the ability to become independent adults. This interference offers specific challenges to service providers. The goal of this study was therefore to develop an in-depth understanding of service providers’ perceptions of the experiences of adolescents trafficked for sexual exploitation with a view to inform social work services. The research methodology entailed the use of the contextual, explorative and descriptive research designs within a qualitative approach. Semi-structured interviews were used to collect data. Data analysis led to the identification of themes, sub-themes and categories that addressed the goal of the study. The crimes committed by UN peacekeepers in Africa: a reflection on jurisdictional and accountability issues

This thesis investigates both substantive and procedural issues pertaining to allegations of crimes committed by UN peacekeepers in three African countries, Somalia, Burundi, and the Democratic Republic of Congo. Under the current UN Model Status-of-Forces Agreements, criminal jurisdiction over peacekeepers rests with their sending States. However, although the UN has no criminal jurisdiction, it has been the Office of Internal Oversight Services that has conducted investigations. It is argued that every Status of Force Agreement and every Memorandum of Understanding should contain specific clauses obligating Troop-Contributing Countries to prosecute and the UN to follow-up. If rape, murder, assault, and any other crimes by UN peacekeepers go unpunished, the message sent to the victims is that peacekeepers are above the law. Rape is the most commonly committed crime by peacekeepers, but is usually considered as an isolated act. The procedural issue of prosecuting peacekeepers is investigated in order to establish whether troops can be caught under the ambits of the criminal law of the Host State to hold UN troops criminally accountable for their acts. The laws relative to the elements of each crime and the possible available defences under the three Host States, and the criminal law of South Africa as a Troop-Contributing Country, are discussed. The apparent lack of prosecution is investigated and existing cases of prosecution discussed. Alternatives to the unwillingness by States with criminal jurisdiction under the Status of Forces Agreement or under the Memorandum of Understanding are considered. Considering the current rules related to crimes committed by peacekeepers, the argument put forward is that crimes by peacekeepers must be dealt with completely and transparently though a Convention aiming at barring Troop-Contributing Countries who do not meet their obligations under international law from participating in future operations of peace. This thesis, furthermore, suggests a tripartite court mechanism to fill the lacunae in the law relating to the prosecution of peacekeepers. It considers the issues of reserving jurisdiction over peacekeepers to the Troop-Contributing Countries which are reluctant to prosecute repatriated alleged perpetrators. The International Criminal Court and the end of impunity in Kenya

This thesis considers the extent to which the International Criminal Court's Office of the Prosecutor ('OTP') has been successful in realising its self-defined mandate of ending impunity in Kenya. In particular, it focuses on the OTP's attempts to encourage domestic investigations and prosecutions as part of its strategy of positive complementarity. This strategy has been hailed as being the best and perhaps the only way that the OTP may use its finite resources to make a significant contribution to ending impunity. Despite this, no empirical study has been published that evaluates the effectiveness of this strategy and the impact that it has on ending impunity in the targeted situation country. This thesis seeks to address this gap in the literature by conducting a case study on the OTP's implementation of its strategy of positive complementarity in Kenya following that country's post-election violence in 2007/08. In doing so, I also hope to make a modest contribution to existing debates over the effectiveness of the ICC as an institution as well as international criminal justice and transitional justice more generally.

Perceptions of sexual harassment amongst university students : a case study of the South African Military Academy

Thesis (MPhil)--Stellenbosch University, 2002. / ENGLISH ABSTRACT: Tertiary institutions worldwide as well as locally have investigated sexual harassment on their campuses. This was done partly because of the negative consequences of sexual harassment on students and staff, particularly their work performance. Incidents of sexual harassment reported at universities range from rape and sexual assault to threats and sexist remarks by lecturers. When researching this phenomenon, difficulty is normally encountered partly due to the uncertainty that surrounds this activity. This is because perceptions differ as to what kind of conduct constitutes sexual harassment. Research further indicates that there are gender and racial differences in the assessment of sexual harassment. The current study investigates the uncertainty, gender and racial differences that exist regarding sexual harassment at a specific university campus. By means of a survey the perceptions of students regarding these three issues were determined at the Faculty of Military Science, a satellite campus of the University of Stellenbosch. With the utilisation of statistlcal packages, frequencies and statistical differences amongst the various sub-groups at the campus were determined. This was done in order to compare these findings with those of other universities who conducted similar sexual harassment surveys on their campuses in South Africa. It was found that no clear idea of what constitutes sexual harassment exist amongst these students. In particular women in the survey consistently viewed more incidents as contributing to sexual harassment than men. As oppose to other findings, Blacks registered a more conservative attitude when assessing whether certain incidents can be viewed as sexual harassment. The above was found notwithstanding the differing social context, especially the socialisation process and the fairly rigid codes of conduct, that students at the Military Academy are exposed to. / AFRIKAANSE OPSOMMING: Verskeie tersiêre instellings, wêreldwyd sowel as plaaslik, het seksuele teistering op hul kampusse ondersoek. Dit was deels gedoen as gevolg van die negatiewe gevolge wat hierdie aktiwiteit op studente en personeellede het, veralop hul werksprestasie. Gerapporteerde insidente by universiteite wissel vanaf verkragting en seksuele aanvalle tot dreigemente en seksistiese opmerkings deur dosente. Probleme is ondervind tydens navorsing oor die verskynsel wat deels toegeskryf kan word aan die onsekerheid wat hierdie aktiwiteit omhul. Dit hou verband met persepsies wat verskil ten opsigte van die soort gedrag wat seksuele teistering teenwoordig. Navorsing wys verder daarop dat geslags- en rasverskille bestaan by die assesering van seksuele teistering. Die huidige studie ondersoek die onsekerheid, geslags- en rasverskille ten opsigte van seksuele teistering by 'n spesifieke universiteitskampus. Exploring aftercare support for child trafficking victims

Child trafficking is a crime committed against humanity; it is punishable by the law and can be prevented by the law. According to the International Labour Organization (ILO), the United Nations International Emergency Fund (UNIICEF) and the United Nations Global Initiative to Fight Human Trafficking (UN.GIFT) (2009:01), 1,2 million children are trafficked, domestically and across borders worldwide, for labour and sexual exploitation, drug trade, organ removal and illegal child adoption. The trauma of this can be so inordinate, leaving victims broken and hopeless (Frederick 2005:8-12). Although numerous studies have been conducted on the subject of human/child trafficking, it was found that little research has been conducted on the aftercare of victims. As a result, this research focused mainly on exploring and assessing aftercare support provided to victims of human trafficking, specifically children. This qualitative research found that child trafficking has serious negative effects on the victims who suffer, among others, violation of children’s rights, physical pain and psychological and emotional trauma. A society cannot function optimally when such atrocities are committed against its most innocent members who are supposed to be its future. Accordingly, adequate aftercare support, which aims at enabling and empowering victims of child trafficking to regain control over every aspect of their lives, is crucial. The 30 participants who were interviewed for this study revealed that victim identification is the initial and the most vital step towards offering victims aftercare. The next step in the offering of aftercare of victims is the rescuing of victims followed by the immediate placing of victims in transitory places of safety where their basic needs are taken care of and they are provided with instant physical and specialised psychological support. Even though participants provided details of the type of programmes currently offered in South Africa, it was found that aftercare centres, in their current state, are not sufficiently resourced to offer the appropriate support to victims of child trafficking. It is for this reason that transitional housing with long term housing assistance and programmes tailor-made for victims of child trafficking be considered. It is evident from the literature and theory that the triple challenge of poverty, inequality and unemployment perpetuates the crime of child trafficking. Therefore, as a form of long-term preventative measure, it is suggested that stakeholders, such as the Department of Basic Education (DoE), Department of Social Development (DSD) and Department of Health (DoH), focus attention on ensuring that victims of child trafficking are not denied the right to go to school and that societal norms, which propagate inequality, are discouraged. The latter can be done by teaching boy children from a young age positive masculinity, such as respecting girl children and their bodies, helping with house chores or crying when in pain. Moreover, the DoE should consider revising its curriculum and focus on teaching learners to strive to become employers and not job seekers as they are currently taught.
