Manipulation of ethnic identity during the colonial reform of administration (1926-1931) and conflict in Rwanda.

This study aimed to highlight factors used by the Belgian authorities to divide Rwandans during the Colonial Reform Process between 1926 and 1931. More specially, it is aimed at identifying how they mobilised Hutu, Tutsi and Twa social classes and transformed the ethnic identities. To achieve this goal, unstructured interviews and a questionnaire were used. In addition, several data analyses were also used to measure and decipher the attitudes of both the interview and survey's respondents. The results indicated the conflict started when the Belgian colonisers implemented indirect rules that highlighted a selected elite from the Tutsi Tribe. This group benefited from social and economic advantages which totally excluded the Hutu and Twa tribes. With the reform, the previous traditional structure was destroyed, and with the new administration only Tutsi chiefs remained whereas Hutu and Twa chiefs were rendered obsolete. Tutsi were seen as born chiefs. On the contrary, they judged the Hutu good for manual work and exploited them as a labour force. For a deep acceptance of this new order, colonisers reinforced ethnic policies with ideological assumptions which defined Tutsi as the superior race. In this regard, several ethnologists and anthropologists attempted to prove the Hamitic origin of the Tutsi, allowing Belgians to use the "Hamitic Myth", which assumed that the Tutsi was the only group able to understand development and to command at the request of the colonial state. In addition, Belgians decided to issue identity cards which clearly stated the bearer's tribal origin. This undoubtedly influenced people to develop ethnic feelings and disposed the most fiercely rival groups (Hutu and Tutsi) to ethnic competition that led to outbreaks of violence in 1959 when Belgians shifted their allegiance from Tutsi to Hutu as the fomer was asking for independence. The scarcity of environmental resources increased the desire to monopolise control of the country as this was continually perceived as only means of access to resources. This led Rwandan politicians to use ethnicity as a way to secure power. Consequently, a culture of ethnic violence became entrenched. Coping with violence: institutional and student responses at the University of the Western Cape

This thesis is based on research conducted at the University of the Western Cape, a previously &lsquo / coloured&rsquo / university with its beginnings rooted in the political tensions in South Africa. The university is geographically disadvantaged since it is situated on the Cape Flats, which is viewed as a potentially violent area with high crime rates. The study focuses on students who stay in in- and off-campus residences since they are exposed to potential violence when they move inside as well as outside the campus and residence vicinity. In addition to semi-structured interviews conducted with students from the university, I draw on my own experiences as a student having lived in on- and off-campus residences at the university.<br /> <br /> In this thesis I investigate the tactics students use to stay safe in the face of potential violence in student residences and also in the vicinity of the university. I refer to violence in the same way as Scheper-Hughes and Bourgois (2004) do - as falling on a continuum along with other forms of violence which include structural violence, torture, genocide, political violence, state violence, symbolic violence, sexual violence and colonial violence. When students move outside of campus and residences they fear being robbed, murdered or sexually violated. Students also felt that if this should happen to them, others present will not step in to help them. The tactics students use to stay safe outside and on campus include moving in numbers, staying away from deserted or specific places at certain times, walking fast with a serious facial expression, and greeting oncomers. In residences women particularly feared going to ablution areas at certain times of the day because of stories they heard<br /> about sexual violence taking place in showers. The tactics they used to stay safe from that involved taking showers during &lsquo / peak&rsquo / hours. However, a lack of trust which students have in residential administrators impedes the safety students experience in residences. I questioned how students can feel safe outside residences when residential organisation leaves their safety precarious. Overall I found that awareness of potentially dangerous spaces, through stories, the news media or witness, informed students&rsquo / tactics of safety.<br /> <br /> Furthermore, this thesis explores the relevance of formal campus services in response to violence in the everyday lives of students who live in in- and off-campus residences. I discuss the changes that have taken place in terms of campus security, and how the meanings of safety, play an important role in the ways the university as an institution responds to violence. The meanings of safety and security also translate into specific safety interventions, which I found to focus more on perpetrators of violence from &lsquo / outside&rsquo / , that on perpetrators of violence on the &lsquo / inside&rsquo / . In the institution&rsquo / s dealings with sexual violence I also explore how perceptions of sexual violence and relationship dynamics influence the infection of HIV/AIDS, and the university&rsquo / s approach to dealing with this threat to students&rsquo / safety.

The South African Media’s coverage of the Abu Ghraib Prisoner abuses: an ethical case study of two selected newspapers

Thesis (MPhil (Journalism))--University of Stellenbosch, 2006. / Abstract: This study analyses the reporting of the Iraqi prisoner abuse issue at Abu Ghraib as reported upon by two South African newspapers from an ethical point of view. The focus falls on the issue of accuracy. Accuracy in war reporting of geographically distant conflicts as exemplified with this case study is a delicate and important matter, the media often being the only window for the public to learn of and about a conflict. In this case study, the two South African newspapers Cape Times and Mail&Guardian will be analysed to show the extent of their adherence to codes of conduct and exemplify the problematic practicalities in ethical reporting on international news. With the main focus of the study being on the ethical issues concerning accuracy, other relevant topics, such as ‘objectivity’, balance, fairness and truth telling, as well as more practical concerns will also be partially considered. The selected case studies are contextualized within the South African media environment so as to yield a better insight into the choices made on an editorial and/or newsroom level. As case studies, selected articles from the Cape Times and the Mail&Guardian during a three-month time-span are analysed using Day’s Situation/Analysis/Decision (SAD) model. Each article will further be analysed from the point of view of the newspaper’s own code of conduct and overarching ethical codes such as the South African Press Ombudsman’s Code of Conduct as well as in terms of the South African laws relevant to the media industry.

This sentence was given after 40 years of investigations into the crime against the parliamentarian. With different purposes and in different contexts, four state agencies performed investigations about the crime: the inquiry of the Army (1971), the investigation of the Federal Police (1986) then transformed into a Military Police Inquiry and conducted by the Army (1987), the survey made by the National Truth Commission and the Rio Truth Commission (2012-2014) and the investigation of the Federal Public Ministry (2012-2014). In addition, this research incorporated to analyze some specific periods of the Paiva family fight, as the request for investigation made by Eunice Paiva in the Council of the Human Rights (CDDPH) in 1971 and then in 1979. This reflection of the Rubens Paiva case procedures allowed to find representations of the paradoxes with which victims of human rights violations were addressed in different contexts since the military regime, exemplifying the cycles of this struggle. / O presente estudo analisou as investigações empreendidas sobre o desaparecimento do deputado federal Rubens Paiva entre 1971 e 2014 para tentar compreender a longa e tortuosa trajetória que levou a 2a Turma Especializada do Tribunal Regional Federal a reconhecer que o caso configurava um crime de lesa-humanidade – decisão até então inédita no Judiciário brasileiro. Essa sentença foi dada após 40 anos de investigações sobre o crime contra o parlamentar. Com diferentes objetivos e em distintos contextos, foram realizados quatro procedimentos de apuração de órgãos estatais sobre o desaparecimento de Rubens Paiva: (I) a Sindicância do Exército (1971), (II) o inquérito da Polícia Federal (1986), depois transformado em Inquérito Policial-Militar e conduzido pelo Exército (1987), (III) a pesquisa da Comissão Nacional da Verdade e da Comissão da Verdade do Rio (2012-2014) e (IV) a investigação do Ministério Público Federal (2012-2014). Além disso, a pesquisa incorporou para a análise alguns períodos específicos da luta da família Paiva, como o pedido de investigação feito por Eunice Paiva no Conselho dos Direitos da Pessoa Humana (CDDPH), em 1971, e depois em 1979. A análise sobre os procedimentos do caso Rubens Paiva permitiu encontrar representações dos paradoxos com as quais as vítimas de violações de direitos humanos foram tratadas em contextos distintos desde o regime militar, exemplificando os ciclos dessa luta.

Factors affecting vulnerability to depression among gay men and lesbian women

The present study explored factors affecting vulnerability to depression among gay men and lesbian women in metropolitan Gauteng, South Africa. Risk factors consistently cited in the literature on depression among gay men and lesbian women, namely self-esteem, social integration, hate speech, physical victimisation, fear of victimisation and alcohol and drug abuse, were examined to determine their ability to predict vulnerability to depression. Data was collected from 385 participants who self-identified as lesbian or gay, using a purposive quota sampling technique to ensure representation across age, gender, race and socio-economic status lines. Participants were selected through gay and lesbian organisations, support groups, counselling centres, the gay and lesbian Pride Parade, an online questionnaire, and via snowballing techniques. Multiple regression analysis indicated that self-esteem and hate speech were the only significant predictors of vulnerability to depression. The regression model accounted for 21.7% of the variance in vulnerability to depression scores. / Psychology / M. Sc. (Psychology)

Working women’s perceptions of power, gender-based violence and HIV-infection risks: an explorative study among female employees in an airline business

Power imbalances and gender-based violence (GBV) have increasingly been cited as important determinants putting women at risk of HIV infections. Studies have shown that globally one in every three women has been beaten, coerced into sex or otherwise abused in her lifetime. The study explored working women’s perceptions of power, gender-based violence and HIV-infection risks. A qualitative, explorative study was conducted among female employees in an airline business in Namibia. Five women participated in in-depth, face-to-face interviews. The findings show that all of the participants experienced power imbalances and GBV in their intimate relationships. All of the women reported emotional or psychological abuse, whilst the majority were subjected to economic abuse, followed by physical abuse, and two alleged having been sexually abused. Interviewing child victims : improve communication and understand child behaviour

This research investigates the communication abilities of children who are exposed to criminal investigations because a crime was committed against them or they have witnessed a crime happening to another person. The study also determines how crime detectives can maximise their efforts in obtaining evidence from such children with the help of an interview as a technique to elicit information. The aim of the research was to understand the behaviour of children, so that more effective investigative interviews can be undertaken with child victims. The researcher wanted to identify the communication challenges associated with obtaining information from child victims and possible ways to overcome such challenges. It was found that the developmental stages of children, the manner in which interviewers/investigators conduct themselves during child interviews and the amount of knowledge possessed by interviewers to elicit information in a legally defensible manner are central to child victim interviews. / Criminology and Security Science / M. Casa da mulher brasileira: uma política pública para mulheres em situação de violência

O estudo em discussão tem como objetivo conhecer o processo de implementação da Casa da Mulher Brasileira, na Cidade de Curitiba, enquanto nova política pública para acolhimento e atendimento mulheres vítimas de violência, com assistência integral e humanizada facilitando o acesso a serviços especializados e garantindo condições de enfrentamento da violência, de empoderamento e autonomia econômica. Para subsidiar a discussão da construção de políticas públicas para enfrentamento da violência contra as mulheres são discutidos os conceitos gênero, violência, violência contra as mulheres, direitos humanos, políticas públicas e políticas públicas para as mulheres e apresentados dados alarmantes sobre o fenômeno da violência contra as mulheres no Brasil, onde uma em cada três mulheres já sofreu violência física ou sexual. O país também aparece na 5ª posição em relação ao número de homicídio de mulheres, numa lista de 83 países, em relação ao número de homicídios de mulheres. Para este estudo realizou-se pesquisa qualitativa, por meio de entrevistas semi-estruturadas com cinco profissionais, mulheres, que atuaram na implementação da Casa da Mulher Brasileira em Curitiba, por meio de entrevistas com objetivo de apresentar como resultado uma contextualização deste processo. A Casa da Mulher Brasileira é uma ação definida no Artigo 3º do Programa Mulher: Viver Sem Violência. O Programa foi instituído pelo Decreto nº 8.086 em 30 de agosto de 2013 com o objetivo de integrar e ampliar os serviços públicos existentes voltados às mulheres em situação de violência, mediante a articulação dos atendimentos especializados no âmbito da saúde, da justiça, da rede socioassistencial e da promoção da autonomia financeira. Ao concretizar-se em realidade responde ao disposto na Lei Maria da Penha, que determina que a política pública para coibir a violência doméstica e familiar contra a mulher será realizada por um conjunto de ações articuladas entre União, dos Estados, do Distrito Federal e dos Municípios. / The study under discussion refers to the implementation process of the Casa da Mulher Brasileira, in the City of Curitiba, which is a new public policy for welcoming and assisting women victims of violence, with a humanized and integral assistance, helping the access to specialized services and ensuring conditions for standing up to violence, empowerment and economic autonomy. In order to subsidize the discussion of the construction of public policies to face violence against women, it discusses concepts of gender, violence, violence against women, human rights, public policies and public policies for women. It also shows alarming data on the phenomenon of violence against women in Brazil, where 1 in 3 women have already suffered physical or sexual violence. The country also ranks fifth in relation to the number of women homicides in a list of 83 countries in relation to the number of homicides of women. The field research executed with five professionals, women, who worked on the implementation of the Casa da Mulher Brasileira in Curitiba, through qualitative interviews, aiming to present as a result a contextualization of this process. The Casa da Mulher Brasileira is an action defined in Article 3 of the Women Program: Living without Violence. Decree 8.086 established the Program on August 30, 2013, with the goal of integrating and expanding existing public services aimed at women in situations of violence, through the articulation of specialized services in the health, justice, social assistance and the promotion of financial autonomy. When it comes to reality, it responds to the provisions of the Maria da Penha Law, which establishes that the public policy to curb domestic and family violence against women be carried out by a set of actions articulated between the Union, the States, the Federal District and the Counties.

Fontes do direito internacional: um estudo da jurisprudência sobre crimes contra a humanidade do Tribunal Penal Internacional para a ex-Iugoslávia / Sources of international law: a study of the jurisprudence of the International Criminal Tribunal for the former Yugoslav

Este trabalho tem por objetivo debater a contribuição e o papel que a jurisprudência do Tribunal Penal Internacional para a ex-Iugoslávia desempenhou no processo de produção e desenvolvimento do direito internacional penal costumeiro sobre crimes contra a humanidade e sua influência na formação do conteúdo normativo atual do art. 7o(1),(2)(a), do Estatuto de Roma, que trata do crime contra a humanidade. Para isso, analisa-se como a Corte determinou o costume válido sobre as elementares do crime contra a humanidade nos casos Duko Tadie Draen Erdemovi, julgados antes da conferência de Roma. Em seguida, examina-se a teoria das fontes, mais especificamente, o costume internacional, seu fundamento, seus dois elementos (combinação de prática e opinio iuris), bem como seus sujeitos criadores e veículos de exteriorização, em especial a jurisprudência internacional. Nesse percurso, apontam-se as práticas destoantes do costume e a dificuldade de sua determinação, para então indicar o binômio valor e poder como elementos que influenciam sua manifestação. Depois, procura-se verificar o contexto político e jurídico de criação do Tribunal Penal Internacional para a ex-Iugoslávia, associando-o à proteção do valor paz mundial e às alterações das estruturas de poder da ordem internacional. Então, faz-se uma avaliação da contribuição dos julgados analisados como veículos para exteriorização do costume ou de seus elementos. Por fim, com a análise da coincidência de resultados no que tange à estrutura de algumas das elementares decididas pelo Tribunal Penal Internacional para a ex-Iugoslávia e o conteúdo normativo atual do art. 7o(1),(2)(a) do Estatuto de Roma, pode-se concluir que a jurisprudência estudada veiculou parte da opinio iuris do direito costumeiro sobre crimes contra a humanidade, contribuindo, assim, com o desenvolvimento do direito internacional penal sobre o tema. / This work aims to discuss the contribution and the role that the jurisprudence of the International Criminal Tribunal for the former Yugoslavia played in the production and development of international criminal customary law on crimes against humanity and its influence in shaping the article 7o(1),(2)(a), of the Rome Statute, about crime against humanity. In order to accomplish this task, it analyses how the Court defined valid custom on the chapeau elements of crime against humanity in the Duko Tadi and Draen Erdemovi cases. Next, it considers the theory of sources, more specifically, international custom, its basis, its two elements (combination of state practice and opinion juris), as well as its subjects and forms of externalization, including international decisions. About this, it points out the dissonant ways custom emerges and the difficulty of its determination, then indicating values and power as elements that influence its manifestation. After, it analyses the political and juridical contexts in which the International Criminal Tribunal for the former Yugoslavia was established, relating it with the protection of world peace, as a value, and the changes in the power structures of international order. Then, it unpacks the contribution of the above decisions (Duko Tadi and Draen Erdemovi cases) as vehicles of externalization of custom or, at least, one of its elements. Finally, with the analyse of the coincidence between the chapeau elements of crimes against humanity as decided by the International Criminal Tribunal for the former Yugoslavia and the current normative content of article 7o(1),(2)(a),of the Rome Statute, it can be concluded that the jurisprudence studied ran part of the opinion jurisabout crimes against humanity as an element of custom, thus, contributing to the development of international criminal law on that issue.

A tutela penal dos direitos humanos e o expansionismo punitivo / The Protection of Human Rights and Expansion of Punitive Law

A expansão do direito penal pelos direitos humanos tem no direito penal internacional um privilegiado campo de estudo. Entre as tendências expansivas dos direitos humanos, motivadas pela luta contra a impunidade, e a necessária contenção mecanismo punitivo, princípios, estruturas de aplicação e fundamentação entram em choque, quando se pensava que os direitos humanos e o direito penal originaram-se da mesma matriz liberal de contenção do poder estatal. O tema ganha especial impulso diante da perspectiva expansionista por que passa o direito penal na modernidade, dos influxos da globalização. As decisões dos tribunais penais internacionais, de Nuremberg a Haia, dos tribunais de direitos humanos (europeu e interamericano), fornecem um panorama de como essa relação tem sido construída, favorecendo a aplicação da norma punitiva e flexibilizando garantias clássicas penais e processuais penais. A discussão empreendida busca matizar a luta contra a impunidade que seja tributária dos avanços jurídicos do sistema de garantias, também conquistas sociais e políticas para a efetiva proteção dos direitos humanos. Nesse contexto, alerta-se para o fato de que se estaria produzindo um direito especial motivado pela luta contra os mais graves crimes contra a paz e a segurança mundiais. Finalmente, expõe-se as dificuldades de validação do conteúdo preventivo das normas em direito penal internacional, do déficit democrático de sua produção desconectada da base social sobre a qual atua, e do efeito simbólico de seus enunciados à custa das máximas garantias. / The international criminal law features a special condition for the critical analysis of the expansion of criminal law through human rights. Between the expansive tendencies of human rights, motivated by the fight against impunity, and the necessary containment of punitive mechanism, stands the international criminal law, whose principles, implementation structures and grounds clash, despite the fact that human rights and criminal law originated from the same liberal matrix for the containment of state power. The debate gained particular momentum with the expansionist perspective experienced by the criminal law in modern times of globalization inflows. The decisions of international criminal courts, from Nuremberg to The Hague, human rights tribunals (European and Inter-American), provide an overview of how this relationship has been built, favoring the application of criminal provisions and easing criminal and criminal procedural classical guarantees. The discussion undertaken shades the fight against impunity, that shall be paved by the legal achievements for the effective protection of human rights, warning to the fact that it is producing a special law, away from the legal domestic law principles, motivated by the fight against the most serious crimes against peace and world security. Finally, sets up the difficulties in accepting the preventive content of international criminal provisions, the democratic deficit of its production disconnected of the social contexts in which operates, and the symbolic effect of its legal provisions at the expense of the maximum guarantees.
