Causa Kajinek: mediální reflexe. Od reality k filmovému zpracování. / Causa Kajínek: the media reflection. From reality to the film processing.

This master thesis, entitled Causa Kajínek: media reflection. From reality to movie interpretation deals with the life story of murderer Jiří Kajínek, who was sentenced to life imprisonment. He served his punishment for the murder of an entrepreneur and his bodyguard from Plzeň, which took place in 1993. Kajínek was sentenced to life imprisonment in 1998. His case was then turned into the subject of a movie. The Czech movie called Kajínek, directed by Petr Jákl junior, premiered in cinemas in 2010. The master thesis focuses on this movie and examines published reviews from the Czech press and professional journals. The thesis also analyses the media presentation of the whole case, with special emphasis on the years 1993 (when the murders were committed), 1998 (the life imprisonment sentence for Kajínek) and 2000 (Kajínek's jailbreak from Mírov prison and subsequent capture). The aim of the thesis is to present conclusions about this case, which is still the subject of controversy and polemics about Kajínek's guilt or innocence.

Examining Rape Myths Through the Lens of Criminal Case Outcomes

Rape myths are pervasive and play a major role in the perpetuation and substantiation of sexual violence against women. This study sought to examine if rape myths could affect criminal case outcomes. An overview of rape myths and their foundations in feminist theories was presented. Four major rape myths (husbands cannot rape their wives, women enjoy rape, women ask to be raped, and women lie about rape) were operationalized into victim and case characteristics and subsequently assessed to determine if there is a relationship between the variables and criminal case outcomes (suspect arrest and suspect conviction). A sample (n = 463) of cases that were gathered from two jurisdictions in a north-eastern U.S. state were analysed. Results indicate that victim participation, consent defence, and other crimes being present in the initial police report were the strongest predictors of suspect arrest and suspect conviction. Weapon use was a strong predictor of suspect arrest and substance use was a strong predictor of suspect conviction.

Reopening a criminal case / Baudžiamosios bylos atnaujinimas

The dissertation analyses a new theme which has not yet been analysed in Lithuanian research and makes an attempt to reveal the theoretical foundations of the institute of reopening a criminal case. The object of the dissertation is the nature of the institute of the reopening of criminal proceedings, the historical development of this institute, the purposes, features, the existing grounds for the reopening of a case, types, specialness of the types, procedure for the reopening of a criminal case, and the place of the reopening of a criminal case among other forms of control over court judgments. The research has been carried out along two directions.. The first has analysed the theoretical grounds of the institute of reopening a criminal case. The second has evaluated both the norms of the Code of Criminal Procedure which regulate the reopening of a criminal case and the resultant court practice, the analysis of which has determined some of the theoretical conclusions. The research has conformed the hypothesis that the appropriate conception of the reopening of a criminal case as an extraordinary form of control over court judgment and the facultative stage of criminal process enables to safeguard both the lawful expectations of the parties to the process and a fair trial. Disertacinio tyrimo objektas – baudžiamosios bylos atnaujinimo instituto teisinė prigimtis, istorinė raida, tikslai, požymiai, pagrindai, dėl kurių atnaujinama byla, rūšys, rūšių ypatumai, atnaujinimo procedūra bei baudžiamosios bylos atnaujinimo vieta kitų teismų sprendimų kontrolės formų sistemoje. Mokslinis tyrimas atliktas dviem kryptimis. Pirma, analizuoti baudžiamosios bylos atnaujinimo instituto teoriniai pagrindai. Antra, vertintos baudžiamosios bylos atnaujinimą reguliuojančios Baudžiamojo proceso kodekso nuostatos ir jų pagrindu besiklostanti teismų praktika, kurios analizė vėlgi leido atskleisti ir suformuoti kai kurias teorines išvadas. Essa dissertação dá enfoque em especial para a prova em vídeo em razão de seu alto poder de persuasão, e discute se os operadores do Direito estariam capacitados para lidar com esse tipo de prova visual, quando tradicionalmente estão mais familiarizados com a prova escrita. A principal problemática, no entanto, diz respeito a aptidão da prova em vídeo para atingir o standard probatório utilizado nos casos criminais, qual seja, o standard da prova além da dúvida razoável. / The development of new technologies from the twentieth century led to profound changes in information processing in society. This technological progress reached Judiciary growing with the increased use of visual media as a form of evidence and persuasion. This dissertation specially focuses on video evidence due to its high power of persuasion, and discusses whether jurists would be qualified to handle this kind of visual evidence, when traditionally are more familiar with the written evidence. The main problem, however, concerns the ability of video evidence to meet the standard of proof used in criminal cases, that is, the standard of proof beyond all reasonable doubt.

The main topic of dissertation named "Case Radovan Krejčíř - from reality and newspaper/TV news to book and film cover and film critique" is person of Radovan Krejčíř, one of the biggest Czech criminals in the history of the country. A controversial billionaire was caught up in many criminal cases already in nineties, and not only in Czech Republic. He escaped the country in the spring of 2005 because of the danger of arrest and then he got on with pursuits against the law in the Seychelles (2005 - 2007) and later on also in South Africa (2007 - 2013). In South Africa in 2013, he was arrested and subsequently sentenced to 35 years in prison. However, the case is not yet completely closed, because there are some other Krejčíř's South African cases, that the judge's decisions are still pending. Life story of Radovan Krejčíř inspired investigative journalist and publicist Jaroslav Kmenta to write book trilogy Padrino Krejčíř (African - 2014, Gangster - 2015 and Shark - 2016) and director Jan Pachl to make a two movies (Gangster Ka and Gangster Ka: African - both 2015). Stížnost pro porušení zákona v trestních věcech / Complaint against a violation of law in criminal matters

The aim of the present dissertation is to provide the fullest possible legal analysis of the complaint against a violation of law, including its historical and international context, and to endeavour to reflect critically on its current application in practice. In the author's approach, the review of criminal cases on the basis of the files prior to a possible application of this legal remedy is an indispensable object of study. Among other things, the work thoroughly analyzes the applicable grounds for the complaint against a violation of law, its purpose and role in the whole system of extraordinary remedies, and it describes the course as well as the specifics of the Supreme Court proceedings. Standard and optional methods of interpretation are complemented by an empirical examination of the sample of 80 complaints submitted to the Supreme Court, which is aimed at identifying and classifying the alleged flaws and the extent to which there might be an overlap with extraordinary appeal (dovolání). The chosen topic appears to be very timely with regard to the ongoing preparatory legislative work on the new Criminal Procedure Code. We seek the best interpretation of the Supreme Court s exceptional original jurisdiction by prerogative function, making a parallel with the peculiar judgment of the Criminal Action Nº 470/MG. We demonstrate that ordinary citizens that do not hold function´s privileges should have preserved their right to natural justice, due process, and especially the double jurisdiction. At the end, we conclude that the double degree of jurisdiction is a fundamental right that can not be denied even to holders of prerogative function and we highlight the unconstitutionality regarding the latent negative of that right in the trial of Criminal Case Nº 470/MG. Wide literature was searched, manifestations of respected masters and doctors, reviews of various segments of society, slowly gathered the personal conviction of the author / Esta dissertação busca demonstrar a fragilidade a que se expõem os direitos fundamentais do homem, ao se permitir que pressões da opinião pública, movidas por interesses políticos e pessoais, levem nossa mais elevada Corte a olvidar os princípios vetores e as diretrizes hermenêuticas constitucionais na interpretação e aplicação da Constituição Federal ao caso concreto. Procuramos a melhor interpretação da excepcional competência originária por prerrogativa de função do Supremo Tribunal Federal para julgar infrações penais, fazendo um paralelo com a condução do tema no julgamento peculiar da Ação Penal n° 470/MG. Demonstramos que os cidadãos comuns não titulares de prerrogativas de função devem ter preservado seu direito ao juiz natural, ao devido processo legal, e principalmente ao duplo grau de jurisdição. The master thesis called "Czech films based on well-known criminal cases: from reality, newspaper/TV news to feature film and film reviews. Causa Velvet killers" deals with the notorious so-called Orlík Murders from the early 1990s. This case is considered as the biggest criminal case of the post-communist era in the Czech Republic. The group of five members killed five people, mainly for the money, between the years 1991 and 1993. Three of their victims were found in the Orlík Dam - two corpses were sealed in metal barrels and one was hidden in a mesh. The murderers were sentenced in 1997 after a four-year-long investigation. The movie called Velvet killers or The New Breed, which was directed by Jiří Svoboda, is based on these true events. This thesis focuses on the TV version of this motion picture and then also on the reviews published after the movie was released in 2005. This thesis mainly wants to reflect how the Czech media - specifically newspapers and television news - informed about this criminal case in analysed years from 1995 to 1997. The determining factor is the accuracy of the information. The aim of the work is to summarize the results of reporting on this case, which is still considered as one of the most brutal in the history of our country.

The thesis on The process of implementing modern information technologies in public administration with a focus on the Police of the Czech Republic deals with the progressive modernization of the administrative processes at Police of the Czech Republic. It describes and analyzes a particular example of the implementation of new electronic system called Evidence of Criminal Proceedings. Until now used method of evidence called the Diary of a criminal case files was mainly based on the principle of keeping paper documents in each part of organization. This thesis trying to compare the previously used system with newly introduced system and also makes reference to the various implementation models, which could be possible used during the introduction of an information system Evidence of Criminal Proceedings. Le 29 juillet 1881, la loi sur la liberté de la presse marque le point de départ d’un développement sans précédent de la presse écrite en France. Un développement qui amène cette presse à jouer un rôle désormais essentiel dans la vie politique, sociale et culturelle de tous les français. Très rapidement, la presse du Puy-de-Dôme profite de ce bouleversement institutionnel pour se développer à son tour. Parallèlement au succès des romans feuilletons, l’actualité criminelle devient alors un des atouts commerciaux majeurs de cette presse écrite devenue populaire, et ce depuis le début des années 1860 et la naissance du Petit Journal. Tous les moyens sont bons pour faire voir à son lectorat. Les dépêches ne suffisent plus, il faut désormais se déplacer, enquêter, s’interroger et révéler, avec ou sans la collaboration des autorités judiciaires. En effet, la criminalité a depuis toujours suscité au sein de la population un éventail d’émotions aussi diverses que la peur, le dégoût, la curiosité, la réprobation et la fascination. En réponse à ces émotions, les révélations et les jugements d’actes criminels sont l’occasion pour la presse de multiplier les éloges ou d’émettre des critiques vis-à-vis du système politique et judiciaire, de s’inquiéter de la déchéance des valeurs morales, de s’effrayer des menaces anarchistes et des monstres tapis dans les ruelles et les champs. Plus que de simples outils d’information et de politisation, les journaux deviennent alors par le biais de l’actualité criminelle le relais des interrogations et des convictions de toute une société. Le but de cette réflexion est de mettre en avant les spécificités de cette représentation médiatique de la criminalité en insistant sur sa dimension provinciale et sur son évolution, des premières années du Second Empire aux dernières heures de la Belle Époque. / On July 29th 1881, the law on the freedom of the press marked the starting point of an unprecedented development in the French written press which led to its playing what then became an essential role in the social, political and cultural life of all French people. Before long, the press in Puy-de-Dôme benefited from this development, to evolve in the same way. In parallel with the success crime reports brought to serialised fiction, these crime reports became one of the major commercial assets of this newly popular written press, and had done so in particular from the beginning of the 1860s and the founding of the Petit Journal. Newspapers would stop at nothing to show the readership what was involved; dispatches no longer sufficed. From then on it became necessary to go and see, investigate, reason things out and disclose information, with or without the collaboration of the judicial authorities. Indeed, crime has always aroused a wide range of emotions in people such as fear, disgust, curiosity, reprobation and fascination. In response to these emotions, the revelations of and verdicts given for criminal acts provided the press with an opportunity to endlessly praise or else to express criticism of the political and legal system, to show concern about the decline in moral values and to be scared of anarchistic threats and of monsters hiding in alleyways and fields. More than being simple informational or politicizing tools, newspapers, through crime reports, then became the indispensable relay of the questionings and convictions of society as a whole. The aim of this reflection is to highlight the specificities of this media representation of crime while insisting on the form it took in the provinces and on its evolution in the first few years of the Second Empire and the final hours of the Belle Époque.
