A Study on Dangerous Driving Prevention Legal System of Police OfficerChen, Yu-Ching 31 January 2008 (has links)
Due to the great change of Taiwan social environment, values are seriously distorted. Many adolescents would gather together at holiday nights for dangerous driving on road (racing) which not only causes gridlock on road and interferes traffic seriously, what¡¦s worse is these youths even attack the public, police officers on duty and related competed agency with force. This behavior not only violates legal regulations but damages social security severely, threatens citizens¡¦ life, body and property safety. Since the role of police officer serves as the function of social security maintenance, to clamp down and hold back dangerous driving is one important segment for the exercise of police powers.
The exercise method of police powers in Taiwan has been reformed greatly due to the change of political and economical situation. During Martial Law Period, to meet the demand, this nation conferred authority on police officers to great extension. The nature of duty enforcement also belonged to regulation, clampdown, and penalty with compulsive implementation upon enforcement. However, the delegation scope pursuant to law is unspecific and the requirement of enforcement is general, human right violation controversy is often occurred. Till Interpretation of Shih-Zih No. 535 made by Grand Justice of Judicial Yuan, police authority then faces the importance of administrative procedure and is able to step forward to a country of nomocracy. With the promotion from all circles, ¡§Act of Exercise of the Police Powers¡¨ of Taiwan was effected on Dec. 1, 2003, herein not only regulates specifically the definition, function of power limits and implementation method of police officer, it also stipulates the practical measures of civil rights adopted for police powers exercise in proclamation to demand police officers to be in compliance with principle of proportionality while exercising authority. It also bestows the legal basis on police powers exercising that can look after both the insurance of human right and the maintenance of police safety which really possesses groundbreaking meaning of a time. Only that whether the formulation of the said act in practical really indicates the dangerous driving prevention legal system of police officers has already achieved its perfection worth the further research and exploration by this study.
Administrative law is deep and profound as well as extensive and infinite and hasn¡¦t formed a complete administration law till now. Only that with observation from the method and principle of administrative act, it can be divided into five main structures of Basic Principle, Organization Framework, Limit of Administrative Rights, Administrative Relief, and Administrative Surveillance. Any administrative legal system pursuits to achieve its perfection, it then shall be analyzed by the five main structures of administrative act. Therefore, the five main structures of administrative act serve as the center in this study to examine the dangerous driving prevention legal system of police officer and review the practice method of police authority and compare to current relative decrees and regulations, expecting police officers can work out the problems concerning to the requirements of power exercise and procedure and to be advantageous to the reinforcement of dangerous driving prevention.
Under this pattern of thought, this study tries to examine all systems upon dangerous driving prevention and clampdown of Taiwan police officers from the angle of administrative act with the said five main structures of administrative act basic principles as the research method in this study. The main frameworks of this study are divided into seven chapters respectively:
Chapter 1 Introduction
To bring forth the dubious interpretation of current dangerous driving prevention reinforcement by police authority firstly to explain the research motive, purpose, research scope, limits, research method, framework, the determination of related terms, and so on.
Chapter 2 The Basic Principle of Dangerous Driving Prevention Legal System of Police Officer.
To interpret the concept and definition of dangerous driving firstly and then bring forth the cruxes in reality and data analysis against the four aspects of society with actual phenomena, economy with most appropriate adjustment, politics of interrogation and legal system of decrees and regulations to make us understand the establishment background of dangerous driving prevention legal system of police officers. And further to compliment with Japan dangerous driving prevention system, the analysis of international aspect to adopt the successful experiences of dangerous driving prevention in foreign countries; and then explore the nomocracy of dangerous driving legal system of police officers from the angle of three principles of administrative act and seven principles of procedure justices to discuss the related legal basis and regulations concerning police power exercise; and finally explore the participation of relative parties of dangerous driving prevention legal system of police officers, expecting to assist police officers in the reinforcement of dangerous driving prevention with the participation of the public to make the dangerous driving prevention legal system more complete.
Chapter 3 The Organization Framework of Dangerous Driving Prevention Legal System of Police Officer
To explore current central and local police administrative organization to deep understand the problems of organization framework, personnel system and fund budget of police authority, expecting to establish complete organization framework for the advantages of practical operation of dangerous driving prevention of police authority.
Chapter 4 The Limit of Administrative Rights and Implementation of Dangerous Driving Prevention Legal System of Police Officer
Traditional clampdown with penalty and other administrative actions exempted from high power type are included. The types and meaning is to be explored against the regulation items of seven ¡§Administrative Procedure Law,¡¨ including Administrative Investigation, Administrative Plan, Administrative Legislation, Administrative Penalty, Administrative Contract, Administrative Instruction, and the insurance of Administrative Duty Reinforcement that is helpful for the clear-up of the requirements and procedures of police power exercise.
Chapter 5 The Relief and Solutions to Problems Arising from Dangerous Driving Prevention Legal System of Police Officer
According to the different categories of agency receiving relief procedures, they can be divided into the administrative relief within and outside administrative system. Start from the relief system of compliant, declaration against different opinions and petition; and then discuss the administrative suit system outside administrative system; and then continue to compliment other relief ways of petition and pleading; and finally to explore national compensation, constitute interpretation and public vote one by one to cover all surveillance rights of people in details.
Chapter 6 The Administrative Surveillance of Dangerous Driving Prevention Legal System of Police Officer
Due to quality and quantity changes of modern country administration, the necessity of administrative control increases day by day. Complete administrative surveillance legal system consists in exploring the supervising system of inspect, supervise, political affairs and sales within police authority and outer supervising system of power, the public, opinion and social groups. With the supervising function of administrative surveillance to expect the work of dangerous driving prevention of police officer would meet the demand of nation, society and people in the respects of legal system and effects.
Chapter 7 Conclusion and Suggestion
To bring forth problems discovered after research and propose suggestions for improvements against dangerous driving prevention for the reference of police officers upon the reinforcement.

Förstudie av blyfria lod till mjuklödning : Utfasning av bly hos ABB i LudvikaSkörvald Li, Elin January 2014 (has links)
This study was done for ABB’s work for the phasing out of lead in their soft soldering processes and aims to identify possible lead-free substitutes, due to the RoHs directive and the Reach regulation and the fact that lead is a particularly dangerous chemical. The company’s current solder was defined as SnPb. A literature study has been made where information has been reported regarding lead-free alternatives; SnZn, SnAgCu, SnAg, SnCu, SnBi, SnSb and SnIn. Based on the literature review five lead-free solder were ordered and examined to see if these are possible substitutes for the specific soldering processes. The lead free alternative melting points were measured and the solder technicians ranked the lead-free alternatives in comparison with the reference SnPb to decide which alternative was the most fitting. The literature study and the practical tests show which solder are the best for the company from an economic, social and environmental perspective. The conclusion was that the solder SnCu was the option that fitted the company's soldering processes. To clarify that the solder was a better option than SnPb, the substitution had to be seen from an overall perspective, this could for example, be done by a life cycle analysis.

Redo att ingripa : En kvalitativ studie om varför människor ingriper i farliga situationer / Ready to intervene : A qualitative study examining why people intervene in dangerous situationsWassberg, John, Höglund, Niklas January 2014 (has links)
The purpose of this study was to investigate why people intervene in dangeroussituations. To answer this purpose, 11 respondents with intervening experiences fromdangerous situations were interviewed. The respondents’ thoughts about why theyintervened are presented. The recorded interviews were transcribed and analysedthrough an inductive thematic approach. From the analysis, the following six mainthemes appeared: Instinct, Experience, Moral, Empathy, Consciousness andDisinhibition. The main themes are explanations to why the respondents intervened. These main themes where then summarized into a core theme: Readiness to act. ThisReadiness to act can be considered as the single nearest explanation to why therespondents intervened. In sum, the result shows that, even though the respondentsintervened out of different main themes, they have all possessed the Readiness to act.It seems that Readiness to act is a prerequisite for intervention.

Black Hole Search in the Network and Subway ModelsKellett, Matthew 06 February 2012 (has links)
In this thesis we look at mobile agent solutions to black hole search and related problems. Mobile agents are computational entities that are autonomous, mobile, and can interact with their environment and each other. The black hole search problem is for a team of these agents to work together to map or explore a graph-like network environment where some elements of the network are dangerous to the agents. Most research into black hole search has focussed on finding a single dangerous node: a black hole. We look at the problem of finding multiple black holes and, in the case of dangerous graph exploration, multiple black links as well.
We look at the dangerous graph exploration problem in the network model. The network model is based on a normal static computer network modelled as a simple graph. We give an optimal solution to the dangerous graph exploration problem using agents that start scattered on nodes throughout the network. We then make the problem more difficult by allowing an adversary to delete links during the execution of the algorithm and provide a solution using scattered agents.
In the last decade or two, types of networks have emerged, such as ad hoc wireless networks, that are by their nature dynamic. These networks change quickly over time and can make distributed computations difficult. We look at black hole search in one type of dynamic network described by the subway model, which we base on urban subway systems. The model allows us to look at the cost of opportunistic movement by requiring the agents to move using carriers that follow routes among the network's sites, some of which are black holes. We show that there are basic limitations on any solution to black hole search in the subway model and prove lower bounds on any solution's complexity. We then provide two optimal solutions that differ in the agents' starting locations and how they communicate with one another.
Our results provide a small window into the cost of deterministic distributed computing in networks that have dynamic elements, but which are not fully random.

Zhodnocení bezpečnosti přepravy nebezpečných věcí po silnici / Evaluation of the safety of the transport of dangerous goods by roadNĚMEC, Tomáš January 2016 (has links)
The theoretical part approaches the topics connected with the transport of dangerous goods and associated topics, for example, from the development of legislation relating to the transport of dangerous goods from the time of the Austrian empire and the First Czechoslovak Republic through the current legislation, e. g. domestic and international validity, and also an important document - the agreement of the ADR, on which the legal rules are based. The next part of the thesis is concerns hazardous substances, including the description of their classification and identification. The following section, which deals with the characteristics of the transport of dangerous goods, including training of persons carrying dangerous goods, the obligations of the participants with transportation from the point of view of safety. An important part of the transport of dangerous goods is also documentation. The three basic documents are: transport document, safety data sheet and the written instructions for the driver. The theoretical part of the thesis deals with the following: the requirements regarding the properties on gear road vehicles that transport dangerous goods; the activities of the occupants of the vehicle, if an accident occurs or the emergency situation and the related release of hazardous substances; traffic restrictions, such as restrictions on the transit of vehicles carrying dangerous goods in road tunnels. Conclusion of the theoretical part deals with the principles of the behavior of the population in case of accidents with leakage of hazardous substances and related improvised protection of individuals. These principles build on the models of situations with leaks of hazardous substances that are listed as part of the results. The aim of this thesis is to determine compliance with the legislation on the transport of dangerous goods by road. For setting the goals there are two research questions, namely: How much are traffic regulations being broken? Which regulation of the transport of dangerous goods by road is being broken most often? To determine the answers to the research questions we chose a survey using the questionnaire survey focused predominantly on the driver transporting dangerous goods by road. In the thesis, respectively, the research included a total of 100 valid questionnaires. In the questionnaire survey all of the respondents were randomly chosen, however, some of them refused to answer some questions. The survey revealed that infringement in the field of transport occurs in a fairly small range. The selected eighteen provisions in the legislation, which were violated in varying degrees, were most often replied by the drivers that they never met with the violation of the regulation (together marked 825 times, expressed in % 45,83 % of the total), exceptionally (together marked 782 times, expressed in % 43,44 % of the total), regularly (together indicated by 181 times, expressed in % 10,06 % of the total) or always (together identified 12 times, expressed in percent of the 0.67% of the total). The questionnaire survey also revealed that violations of regulation of the smoking ban is most often. Out of 100 respondents, 30 answered that they met with a violation of this regulation regularly (26) or always (4). Among the other most frequently infringed legal regulations in the field of transport include the rules in securing the cargo to the loading area, where 19 respondents out of 100 answered that they met with a violation of this regulation regularly or always. The rules concerning the manipulation with dangerous goods during the course of loading and unloading, it was noted that 19 of the respondents met with a violation of this regulation regularly (17) or always (2). There are also the results of modeling accidents in the program of the Terrorist Expert TerEx.

Traffic accidents are everyday events of the main highways, streets and avenues of Brazil, motivated hair increasing vehicle fleet, the poor state of conservation of paving, negligence of drivers and pedestrians in traffic between other cases.
This thesis analyses the implementation of compulsory hospitalisation in Contemporary Brazil in order to understand the impact of the Psychiatric Reform and the National Law 10.216/01 on the considered insane offender field. Therefore, it presents the dangerous logic focusing on this group of vulnerable subjects, observing how it constitutes and maintains. Through the guidance of Foucault and Agamben’s works, it maps the mechanisms operating in the considered insane offender field, which authorize and legitimize the most diverse violence against inmates in Brazilian legal mental institutions. The central question of this thesis is, therefore, what are the existing mechanisms in the punitive practices field that nullify the achievements made in the mental health field (psychiatric reform)? How have the significant changes introduced by the Law 10.216/01 been reflecting in dealing with insane offenders? From Foucault’s Os Anormais book, I discuss how the merger between legal and psychiatric sciences occurs, focusing on this subject that is neither properly considered mentally ill nor strictly criminal, but an abnormal. To accomplish this objective, many resources were analysed, such as an interview with Ernesto Venturini; notes made after visits to IPFMC in Porto Alegre; the 2011 census on legal mental institutions in the country; data from the Departamento Penitenciário Nacional (DEPEN); researches on compulsory hospitalisation and Custody Hospitals and Psychiatric Treatment under the Law 10.216/01, carried out by the Federal Attorney for Citizens' Rights (PFDC) of the Federal Public Ministry (MPF), the Brazilian Psychiatric Law Reform (Law 10.216/01) and the Italian Psychiatric Law Reform (Act 180). Part of this research took place at the University of Bologna, Italy, under the co-direction of the criminologist Massimo Pavarini, in order to understand how the country has been dealing with the compliance of the compulsory hospitalisation and how the Psychiatric Reform has advocated changes in the considered insane offender treatment. As a result, this thesis states that the union between the two fields of knowledge generates a third stream/speech, something different from what the jus sciences and the psi sciences produce alone. Since there is not a specific epistemology, practices aimed at these individuals do not have a limitation; there are no brakes, because there is not a well-defined science, but a merge between those two. And, as consequence, what eventually occurs is the legitimation of conducts that violate rights, acting against the considered insane offender, often in lethal ways. People crowded in legal mental institutions, differed by the other so-called "crazy people" just by the fact of having committed a crime. The law is applied to them not by imposition of medical science or legal science, but because the union of these two fields creates its own discourse, which is addressed to a person considered abnormal.

Neodkladná a následná opatření v případě úniku chlóru - Simulovaná havárie vozidla přepravujícího chlór / The urgent and follow-up precautions in case of leakage of chlorine - Simulated accident of vehicle carrying chlorineKADIČ, Milan January 2013 (has links)
The goal of this diploma thesis is to introduce urgent and follow-up precautions in case of leakage of chlorine - simulated accident of vehicle transporting chlorine. The major objective of this study is to analyse the risk of chlorine-transport for people with the aid of available simulation programme and to specify urgent and follow-up precautions. The next part of this study is to investigate the knowledgeability of people. The theoretical part of this study is systematical structured into a number of chapters and worked out on the basis of available legislative regulations, literature and internet sources. At first basic legislation of transport of dangerous substances is described, from the european, as well as national perspective. The next chapter deals with transport of dangerous substances, danger classes of these substances, their labeling in transport, as well as labeling of transport units. The following chapter is devoted to aspects of an accident in case of transporting of dangerous substances. This chapter demonstrates an accident with leakage of dangerous substance, its impact, escape of this substance and its spread. Further the sources and risks of transportation of dangerous substances and accident rate in this transport are described. The next chapter deals with the specific dangerous substance - chlorine. It is aimed at physico-chemical characters of chlorine, its history and its current utilisation, its effect on human health, on environment and first aid in case of contact. At the end urgent and follow-up precautions in case of an accident inkl. leakage of chlorine. The empirical part of this study is devoted to two basic research questions. Qualitative, as well as quantitative methods of research were used to answers these questions. The empirical part is devided into two major chapters. The primary purpose of this study is to simulate an accident of vehicle transporting chlorine with the aid of the programme TerEx and to determine its impact on people and surrounding. The first question was to analyse the potential dangerous for people and surroundings in case of an accident with chlorine. For this purpose the town České Budějovice was used. First the transport of liquid chlorine in small containers in the Czech Republic was analysed focusing on the southbohemian region and especially the regional city. Thereafter input data were entered. On the basis of obtained outputs were determined threats, that arise from the transport of dangerous chlorine and on the basis of simulation were characterized activities carried out by Integrated Rescue System using appropriate urgent and follow-up precautions. Part of this work was also the second research question - the level of knowledge of people located close to the simulated accident about this problem. This survey was aimed at the risk of chlorine, its transport and characteristics and impact on human health as well as protection against its adverse effects. For this purpose a group of second-year students of the local gymnasium located close to the place of simulated accident was chosen. The data were collected through a questionnaire, which contained a group of questions relating to this problem. The obtained data were evaluated using basic methods of elemental statistical analysis and graphic processing. Findings resulting from the analysis of transporting of chlorine and from the simulation using the programme TerEx show, that the danger to the population of České Budějovice in case of an accident with chlorine is significant. The issue of chlorine-transport and its risks is additionally complicated by insufficient regulation. Another negative factor of transporting of these substances is the complicated traffic situation in the country town. Based on the results of the questionary can be stated, that these students have average knowledge in this issue.
