The convergence of U.S. military and commercial space activities : self-defense and cyber-attack, "peaceful use" and the space station, and the need for legal reform

The ever-increasing convergence of U.S. military and commercial space activities poses new challenges to the viability of the legal concepts that have traditionally governed the use of outer space, and particularly the military use of space, from the beginning of the space age. This paper will look at two examples of where the melding of U.S. military and commercial space activities necessitates a reexamination of the applicable legal theories. Part I will examine the concept of self-defense in outer space, by considering the legality of the use of conventional military force to defend against "cyber-attack" on its commercial space assets. Part II will examine the concept of the use of outer space for "peaceful purposes" under international law, by focusing on the permissibility of military use of the International Space Station. As private commercial entities increasingly take their place aside State actors in outer space, understanding the impact of space commercialization on the law governing military-related activities in outer space becomes more-and-more important to policymakers, military planners, legal scholars and space law practitioners alike.

This thesis examines the way legal space risks are managed in commercial space transportation provided by major carriers, such as, NASA, the US private launch sector, and Arianespace, as well as in the system envisaged for Australia. Its purpose is to show that even if all systems tend to provide a favorable risk allocation scheme to the space launch industry, there are several alternatives for the telecommunications satellite operators. It also attempts to show that, even if all these risk sharing regimes have been modeled after NASA's, there are certain important differences, which stem from the different political objectives of each of the countries where these carriers are inserted.

Im letzten Drittel des 19. Jahrhunderts konnte Chemnitz seine Stellung als führende Industriestadt in Sachsen festigen und weiter ausbauen. Zu den bisher bestehenden Zweigen - Maschinenbau und Textilindustrie -, die ständig ihr Profil erweiterten (Maschinen für Nahrungs- und Genussmittel, Trikotagen) kamen weitere hinzu, die bald überregionale Bedeutung erlangten: u.a. Chemische Industrie, Fahrzeugbau und Büromaschinenbau. In Chemnitz wurde zwischen 1871 und 1914, außer Schiffen und Waffen, nahezu alles produziert, wozu damals die Industrie in der Lage war.

No theory, experience! : Talent Management in the Chinese Educational Sector

Talent management (TM) has been researched and practiced by many researchers and practitioners for years. The theory itself is based on empirical findings. However, there is no clear and solid definition for it despite thousands of articles and books were published in the past century. Among them, there are not many related to TM in Chinese context, not to mention TM in the Chinese educational sector which we are quite interested in. The lack of literature and research in this specific field evoked curiosity from us. Therefore, a case study was conducted in Chinese middle schools with a focus on talented teacher management where those teachers are considered the talent which need to be managed. This study is based on qualitative approach with empirical data collected from four in-depth interviews. After analyzing the data, we got unexpected results. As a matter of fact, the schools have no knowledge about TM even though what they did to the teachers reflect some aspects of TM, or in other words, they are not aware of what they did is in fact part of TM. This empirical finding reflects how TM is found, developed and labeled. In the end, we concluded that TM is an area of fascination and inspiration. It comes from the practice without which it will not exist and develop, which is embodied in our case study. In this study, school leaders are not aware that they were in fact using some methods of TM. They just do not know how to label those methods.
