The changing nature of Israeli-Indian relations, 1948-2005

The focus of this research is on the analysis of relations between Israel and India from 1948 to 2005. The State of Israel was established in 1948 but only on 18 September 1950 did India recognise Israel. Eventually, the two countries finally established full diplomatic relations on 29 January 1992. The research covers three specific timeframes and aims to clarify the factors that have affected and effected the relations between the two countries in terms of levels of analysis. The first timeframe (from 1948 to 1991) pertains to bilateral relations between the two countries before the establishment of diplomatic relations, including preindependence relations. India's foreign policy towards Israel reflected its selfinterest in the Middle East as well as its traditional sympathy with the Arabs and had been influenced by India's commitment to the Non-aligned Movement and the sentiments of the Indian Muslims. Eventually it was transformed into an anti- Israeli foreign policy. In the second timeframe, the change in bilateral relations between Israel and India in 1992 and the establishment of diplomatic relations between the two countries are analysed by the Aggregative Model of Bilateral Foreign Relations Strategic Change. This analysis deals with the operational environment within which the Indian systemic foreign policy changed towards Israel. In the third timeframe, the evolving bilateral relations between India and Israel from 1992 to 2005 are analysed in terms of the Oscillated Diplomacy Model. Consecutive Indian governments in power had an influence on the volume of Indian diplomacy towards Israel as well as the direction of the relations between the two countries. Furthermore, three types of mutual national strategic interests, namely, joint strategic interests, common strategic interests and discrepant strategic interests, influenced the operational diplomacy of both countries. In essence, Israeli-Indian relations from 1948 to 1991 were characterised by partial and consistent pro-Arab and anti-Israeli foreign policy. In 1992, a significant diplomatic change occurred when India and Israel established full diplomatic relations. Since then bilateral relations have evolved continually in a positive manner concentrating on the convergence of strategic interests of the two countries. / International Politics / D.Litt. et Phil. 區域差異性對失業率影響之研究 / The effect of regional differences on unemployment rate

區域發展差異現象一直以來為國家政策所關注,而近年來台灣地區失業率有逐漸上升的趨勢,各縣市之表現亦大相逕庭,顯示各地區存在失業差異現象。過去研究較少以空間觀點觀察失業相關議題,此外,關於區域差異因素對失業率之影響鮮少納入政府規劃因素。因此,本研究以空間自相關分析方法檢測失業是否具有空間相關性及聚集性,並應用長期追蹤資料(panel data)迴歸模型,以人口、產業、所得、都市化程度及政府規劃因素,分析台灣22縣市1988至2008近二十年來各區域差異因素對失業率之影響,藉由實證結果提出相關都市及產業政策之建議。實證結果發現,台灣失業分佈具有一定程度的空間相關性,且高低失業率在各縣市間亦有聚集現象。再者,依固定效果模型實證結果發現人口數、工業及服務業就業者百分比、都市化程度、工業區面積百分比與失業率間呈現顯著正向關係;經濟發展支出百分比與失業率呈現顯著負向關係;區域固定效果,即排除自變數影響下,各縣市本身區域特質對失業率之影響,結果顯示台北縣及桃園縣之係數為負向,南投縣、嘉義縣、台東縣與花蓮縣之係數為正向;時間固定效果方面,大部分年度皆具顯著性,且係數有由負轉正之趨勢,代表特定時間衝擊會對失業率造成影響。 / Differences in regional development have been a focus on national policies. Recently, there is a increasing trend in the unemployment rate in Taiwan, and it also differs from cities and counties, indicating there exists differences in regional unemployment. Previous research rarely combined unemployment issues with spatial perspective. In addition, the effect of regional discrepant factors on the unemployment rate rarely take government planning factors into account. Therefore, this study uses spatial autocorrelation analysis to detect whether unemployment has spatial correlation and aggregation, and applies panel data regression model with population, industry, income, the degree of urbanization, and government planning factors to analyze the effect of regional discrepant factors on the unemployment rate in Taiwan's 22 cities and counties from 1988 to 2008. According to the empirical results, we come up with some urban and industrial policy proposals. Empirical results indicate that the distribution of unemployment in Taiwan has a certain degree of spatial correlation, and high or low unemployment rate also has aggregation among cities and counties. Furthermore, according to the results of the fixed effects model, population, the percentage of industrial and service sector employment, the degree of urbanization, and the percentage of industrial area show a significant positive relationship with unemployment rate. The percentage of expenditures for economic development shows a significant negative relationship with unemployment rate. Region-specific fixed effect, which exclude the influence of independent variables, is the effect of regional characteristics of counties and cities on the unemployment rate. This result shows the coefficient of Taipei County and Taoyuan County is negative, and the coefficient of Nantou County, Chiayi County, Taitung County and Hualien County is positive. As for time-specific fixed effect, almost all years are significant, and the coefficient has the trend from negative to positive, indicating that a particular time impact will affect the unemployment rate.

Frater, soror, contubernalis : greedy institutions and identity relationships in the auxiliary military communities of the northern frontier of Roman Britain in the first and second centuries A.D

This thesis is a reassessment of the concept of the ‘fort community’ and analysis of the people who dwelled within it, utilising archaeological evidence from the northern frontier of Roman Britain. Traditional approaches which have focused on military functions or on military-civilian dichotomies cannot provide a full account of discrepant identities (Mattingly 2011). A holistic approach which acknowledges and incorporates non-military activities can provide an important alternative perspective into how the inhabitants of Roman fort communities related to one another. The thesis utilises Lewis Coser’s concept of the ‘greedy institution’ (1974) to resituate the imbalance of power affecting identity within the Roman military. The discussion is framed within nested layers of identity and community. In the first chapter, a historical overview of Roman military scholarship is presented that contextualises the current archaeological climate and illustrates key issues of bias. Three core forms of identity are analysed in the second chapter in the context of the Roman auxilia; socio-cultural, gender, and ethnicity. This discussion positions the auxiliaries as a group both empowered and subjugated, consisting of ‘martial races’ exploited within a military role. In the third chapter, the textual evidence for identity on the northern frontier is analysed, using epigraphy and the Vindolanda tablets. Within these the discrepant identities of members of the fort communities are identified. In the fourth chapter, I analyse the architectural underpinnings of military identity through an examination of the development and ideology of the ‘standard plan’ fort. In the fifth chapter, I analyse the material evidence for the habitus of fort community life, focusing on three activity contexts; military display, craft and industry, and bodily consumption. The thesis concludes by assessing the strengths of the ‘greedy institution’ approach and outlining its significance with regards to future research.

自由心證之運作 —以間接證明模組建立作為自由心證運用合理化之基礎為核心 / Operations of Free Evaluation of Evidence Principle —On Building Models of Indirect Proof as Legitimized Ground

職司審判之法院,其職權係為「認定事實」與「適用法律」。就事實之認定,我國採取「自由心證原則」,亦即事實應如何透過證據證明、推論而得,授權由法官於個案中認定,然該原則中「自由」之意義,係具有其具體之內在內涵與外在限制,並非由法官恣意判斷。過去之實務與學說並未就此為深入之闡釋,迭生審級平行與垂直判決之歧異,及人民對法院判決之非議。從而根本之道,應係完整建構自由心證原則之實質意義,由運用之主體、客體、內在內涵、外在限制及其作用等面向,並提出其運用之模組,具體化此立法者規範之不確定法律概念,使運用該原則之法官,得以有依循及參考之路徑。 而自由心證原則內涵中,最常於訴訟中運用者,即為「間接證明」,因主要事實由直接證據直接證明乃少見之情狀,而由間接證據證明間接事實,進而依間接事實之推理作用,推論主要事實存否之情形,乃訴訟中之常態。然間接證明之內涵中,「間接事實之內容與數量」、「推理作用之內涵」、「間接事實間推理作用所得證明主要事實之射程」,皆係高度個案裁量運用之認定,然現今實務之運作,卻出現審級間運用內容及結果極為歧異之現象,從而應探究其內涵,並嘗試提出運用之模組,供運用之法官思考。 自由心證與間接證明作為具有高度實務操作性格之訴訟法原則,其運用之 良窳,已實際影響具體個案事實認定之問題。為改善及斧正目前實務運作上出現之認定歧異、迭經發回之問題,亟須透過以上之研究,提出訴訟中運用之方式,以及其於事實審間、事實審與法律審間運用之審查、互動關係,使該二抽象原則具有一定法安定性,而有一定運用之軌跡可循。 / The court, to act as trial institute, has its major authority to “determine the fact” as well as “apply the law”. As for the fact-finding, our country adopts “Free Evaluation of Evidence Principle”, which authorizes the judge to determine case by case how the fact is proved and inferred through the evidences. However, the meaning of “Free” in that principle is constructed with concrete inner connotation and outer restriction, and not decided by the willfulness of the judge. In the past, courts and scholars didn’t elaborate that principle in depth, which has given a rise to the discrepant verdicts between different courts and criticisms from the people. Consequently, the fundamental solution is to build the substantial connotation of free evaluation of evidence principle, by means of the observations of its operating subject, object, inner connotation, outer restriction and function as well as its operating model, and to reify this uncertain concept of law regulated by legislator, so as to find a way to follow and refer to by the judge. The most commonly-adopted content of free evaluation of evidence principle is “Indirect Proof ”. Owing to proving the direct fact through direct evidence is rarely seen in lawsuit, the application of proving indirect fact by indirect evidence, and then inferring the existence of direct fact through the inferring function of indirect fact, is much common in each case. Nevertheless, in the meaning of Indirect Proof, the “content and amount of indirect fact”, “content of inferring function” and “scope which the direct fact could be inferred from the direct fact” are determined by large-scale discretion of the judge case by case. As a result of the discretion, the circumstances of divergent operating contents and consequences are emerged. Therefore, the connotation of that principle should be analyzed and the operating models are tried to addressed, hoping to provide for the judge to take into account. “Free Evaluation of Evidence Principle” and “Indirect Proof”, which are conducted as civil procedural principle in a highly individually case-operating nature, substantially influence the fact-finding in specific lawsuit with its odds and ends of operation. In order to improve and correct the discrepant fact-finding and constantly-verdict-reversing problems appearing in the courts at present, it is necessary to bring up the ways to operate the two principles as well as the reviewing and interacting relationships between trial courts and trial court and trial of law, and to establish specific legal certainty, legal steability and operation standards.
