The following study focuses on compulsory care and its legislation. The Swedish legislation on compulsory care is divided into three laws - LVU, LVM and LPT. LVU is the Care of Young Persons Act, LVM is the Care of Abusers Act, and LPT is the Compulsory Psychiatric Care Act (Domstolsverket 2019). Previous research in the field shows that it is not only the legal norms that influence judgements regarding compulsory care (Friis 2005) and that several other influencing factors (Wallander & Blomqvist 2005) may have an impact on investigations and decisions regarding compulsory care. This has lead the aim of the study to investigate how foundations for compulsory care are constructed and what legal security issues may arise. The focus of what legal security issues that may arise is centralized around what consequences this may have on the person being subjected to forced care. The study was conducted with a qualitative discourse analysis where the focus was on identifying aspects of power and how grounds for coercive remedies are constructed in judgments. The empirical material has been collected by requesting judgements regarding compulsory care according to LVU, LVM and LPT from the administrative court in Växjö. The main results show that the construction of grounds for coercive care can be influenced by several different factors and it can be related to aspects of power, discretionary decision-making and norms.

La conciliation entre la protection de la nature et les intérêts de nature économique s'opère en recourant à la notion de développement durable. D'un point de vue juridique, les acteurs clés pour opérer une telle conciliation sont l'administration et le juge, qui appliquent et interprètent les normes applicables. Ils concilient l'intérêt général tenant à la protection de l'environnement avec les intérêts et les droits des acteurs du tourisme en utilisant leur pouvoir discrétionnaire, selon des modalités qui diffèrent en France et en Allemagne. Les parcs naturels nationaux et régionaux ont été retenus pour limiter le champ de recherche et constituent des exemples permettant d'illustrer les modalités de la conciliation entre exploitation économique et protection environnementale. Tandis que l'objectif assigné au parc national par la loi vise en premier lieu la protection de la nature, les parcs régionaux sont consacrés au développement durable, outil de conciliation entre les intérêts économiques et environnementaux. Le tourisme joue ainsi un rôle central dans l'organisation et le fonctionnement des parcs régionaux et présente la particularité d'être une activité économique qui suppose l'existence d'un environnement au moins en partie vierge et une nature préservée. / An optimal balance between economic and environmental issues is guided by the concept of sustainable development. From a legal perspective, the main parties making arbitrary decisions in this matter are the administrations and the administrative courts. They apply and interpret the respective rules by using their specific national power of discretion, arbitrary arbitrating between the public interest to protect the environment and the issues of the key players of the "green" tourism industry. The National parks and the Regional parks have been chosen to refine the study because these two constitute an example painting out the methods of arbitrary decision making between economic exploitation and the protection of the environment. With regard to the National park, the law assigns priority to the protection of the environment whereas the Regional park is dedicated to sustainable development as the method to accomplish the arbitration between economic and environmental issues. The tourism industry is playing a central role in the functional organisation of the Regional parks and is characterized by being an economic activity dependent on an environment at least in part untouched and still pristine.

La globalidad de la problemática a través de diferentes niveles jerárquicos, funciones y roles del conjunto de empleados lleva al análisis de un conjunto limitado de factores relacionados con la retribución enmarcado en el ámbito de empresas españolas cotizadas y directamente en el papel de la retribución y de las diferencias retributivas a nivel del equipo de alta dirección. Este trabajo estudia factores contextuales que mayor influencia tienen sobre la fijación del nivel retribución del equipo de alta dirección, considerando las características del trabajo de esos mismos –posición jerárquica, discrecionalidad, interdependencia de tareas, e incertidumbre– y cómo dichas características pueden influir en las diferencias salariales entre los propios miembros del equipo de alta dirección. Completado por la verificación del efecto del gobierno corporativo y el papel de los mecanismos de supervisión para controlar a los directivos (el marco de la teoría de
la agencia) se enriquece este trabajo sobre el contexto de dispersión retributiva y resultados de la empresa. / The globality of the problem through different hierarchical levels, functions and roles of all employees takes to the analysis of a limited set of factors related to compensation in the context of listed Spanish companies and directly on the role of pay and the pay differences at the top management team. This paper examines the contextual factors of main influence on establishing remuneration levels of top management team, considering the nature of their working activities- hierarchical position, discretion, task interdependence, and uncertainty-and how these characteristics may influence pay differences between the members of the top management team. Completed by the exploration of effects of corporate governance and the role of supervision mechanisms to control managers in the agency theory context this paper is enriched in the topic concerning pay differences and operating results.
