Prohibition & resistance: a socio-political exploration of the changing dynamics of the southern African cannabis trade, c. 1850 - the present

Looking primarily at the social and political trends in South Africa over the course of the last century and a half, this thesis explores how these trends have contributed to the establishment of the southern Africa cannabis complex. Through an examination of the influence which the colonial paradigm based on Social Darwinian thinking had on the understanding of the cannabis plant in southern Africa, it is argued that cannabis prohibition and apartheid laws rested on the same ideological foundation. This thesis goes on to argue that the dynamics of cannabis production and trade can be understood in terms of the interplay between the two themes of ‘prohibition’ and ‘resistance’. Prohibition is not only understood to refer to cannabis laws, but also to the proscription of inter-racial contact and segregation dictated by the apartheid regime. Resistance, then, refers to both resistance to apartheid and resistance to cannabis laws in this thesis. Including discussions on the hippie movement and development of the world trade, the anti-apartheid movement, the successful implementation of import substitution strategies in Europe and North America from the 1980’s, and South Africa’s incorporation into the global trade, this thesis illustrates how the apartheid system (and its collapse) influenced the region’s cannabis trade.

Drug trafficking : the use of South African drug mules in crossborder smuggling

This study was conducted in order to gain a better understanding of the phenomenon of drug trafficking with specific reference as to how South African drug mules are used in crossborder drug smuggling. Through media analysis, semi-structured interviews with drug trafficking experts and a literature study the researcher was able to make findings and recommendations as per the objectives of the study. The objectives of the study included examining how drug mules smuggle drugs across South African borders; what role drug mules play in drug trafficking syndicates and the motivations and reasons why South Africans are increasingly being recruited as drug mules. The researcher also attempted to determine the nature and extent of the drug demand supply in and to South Africa. By making the deduction that drug demand and drug supply are interrelated the researcher was ultimately able to conclude that drug mules will continue to engage in drug smuggling as long as there is a demand for drugs and readily available drug supply routes to and from a county. From the media reports analysed cocaine, methamphetamine and heroin were the drugs most smuggled by South African drug mules. It is also clear from the media reports that cocaine and methamphetamine are smuggled in the largest quantities by South African drug mules. The quantities of heroin found in the possession of South African drug mules were insignificantly small. This contradicts treatment centre data analysed that indicated heroin and methamphetamine users were almost double in numbers in comparison to cocaine users being treated at centres. Most South African drug mules are used to smuggle drugs to the cocaine markets in Europe and South Africa; the cannabis/marijuana (herb) market in Europe; the cannabis (resin) hashish market in Canada and the United States of America; the crystal methamphetamine market in the Far East (largely Japan and Korea) and the heroin market in South Africa. Using criminology theories as a basis, the researcher attempted to describe why people are vulnerable to being recruited as drug mules. Findings concluded that structural factors such as poverty and unemployment and substance abuse-related problems, particularly in marginalised and disadvantaged communities, all contribute to South Africans becoming drug mules. Recommendations by the researcher focused on identifying specific vulnerabilities associated with drug mule recruiting and its consideration in legislation relating to drug trafficking in South Africa. The recommendations focus on the specific prosecution of drug abusers, drug mules, drug distributors and drug mule recruiters. Lastly it is projected by the researcher that the drug demand in South Africa will continue to increase if the drug supply routes and drug smuggling operations by syndicates are not addressed more firmly / Criminology / M.A. (Criminology)

The state as a facilitator in the illicit global political economy : Guinea-Bissau and the global cocaine trade

Thesis (MA)--University of Stellenbosch, 2011. / ENGLISH ABSTRACT: This research study aims to approach illicit market activity, particularly transnational organ-ised crime, from a political-economy point of view. The study of illicit market activity is characterised by various and often ambiguous concepts and approaches. The benefits of a political-economy approach include the provision of an alternative view of the illicit, combin-ing aspects from these various approaches. The study of the Global Political Economy (GPE) examines the relationship between authority, mostly in the form of states, and markets. This thesis looks at the relationship between the state and illicit markets. It does so by using the concept Illicit Global Political Economy (IGPE), which is defined as concerning the social, political and economic arrangements affecting the global systems of illicit production, ex-change and distribution, and the mix of values reflected therein. States, illicit markets and criminal actors are considered here as interdependent and interrelated parts of the IGPE spe-cifically, and the overall GPE. Within this relationship several „roles‟ of the state are identi-fied: the state as a creator and regulator of the illicit, through its legislative and executive au-thorities; the state as a locale of the illicit, as home, host, transhipment or service state for transnational criminal activities; the state as a victim of the illicit, for example, through the inherent nature of crime denying the state´s jurisdiction over its territory and also through the use of violence or corruption by criminals; and the state as a facilitator for illicit activity, meaning that certain characteristics of states can enable illicit activity. This thesis is primarily concerned with the last role of the state. It is argued that certain characteristics of states, par-ticularly weak and transitional states, enable the state´s exploitation by criminal actors. In the framework provided by Phil Williams (2002) seven of these characteristics are referred to as capacity gaps, which can result in functional holes, possibly enabling illicit activity. The pri-mary research question of this thesis is, consequently: Is the role of the state as a facilitator in the IGPE enabled by the existence of capacity gaps and functional holes? The West African state of Guinea-Bissau has been chosen as a case study for its role as a transhipment state in the global cocaine trade. In the first part of the analytical process of this thesis, the global cocaine trade and its historical development are described and analysed for the social, political and economic arrangements affecting it. This highlights the im-portance of taking into account these arrangements for a full understanding of the illicit. Addi-tionally, an analysis of the political-economy of Guinea-Bissau provides the necessary back-ground for understanding the second part of this thesis´ approach. Here, the state of Guinea-Bissau is examined firstly for the existence of capacity gaps and functional holes. If they are found to exist, whether and how they are being used by cocaine traffickers is examined. It was found that six out of seven capacity gaps exist in Guinea-Bissau, most of which are being used by the cocaine traffickers. The involvement of the military in the drug trade in combina-tion with its apparent extra-judicial standing is found to be of particular importance for the cocaine traffickers. This analysis allows for the research question to be answered positively. Moreover, the thesis can be considered to generally affirm the usefulness of a political-economy approach to analysing the illicit and affirms specifically the usefulness of the con-cept of the IGPE. / AFRIKAANSE OPSOMMING: Hierdie navorsingstudie poog om onwettige markaktiwiteite, spesifiek transnasionale georganiseerde misdaad, uit 'n politiek-ekonomiese standpunt te benader. The recruitment and management of agents in undercover drug trafficking criminal investigations

Text in English / The organized and sophisticated way in which criminal targets conduct the crime of drug trafficking, necessitates the use of undercover agents in undercover drug trafficking criminal investigations. The goal of this research was to determine how agents should be recruited and managed for undercover drug trafficking criminal investigations. The correct recruitment and management processes when dealing with agents in undercover drug trafficking criminal investigations, which enable investigators to follow a logical sequence, was explored by the researcher. The entire recruitment process of agents in undercover drug trafficking criminal investigations was discussed, from studying the criminal target, identification of a suitable agent and then the recruitment process itself. Legal aspects and administrative processes to be utilized to manage agents were discussed. The researcher utilized national and international literature sources to gather new and current information on the recruitment of agents in undercover drug trafficking investigations. Interviews were conducted with retired and experienced former South African Police Service (SAPS) officials who managed and recruited agents during their employment in the SAPS. The general purpose of this research was to provide practical recommendations on the best practices for the recruitment and management of agents in undercover drug trafficking criminal investigations. / Police Practice / M.Tech. The motives of South African female perpetrators for becoming drug mules

Summary in English, Tswana and Zulu / The researcher aimed to examine female perpetrator motives for becoming drug mules. The aim was accomplished through the use of a qualitative study, case research. Collection of data occurred via semi-structured interviews with seven participants. Purposive sampling was employed to aid with the selection of participants, and thematic analysis used as a means to analyse the data collected. The study found that motivations differed amongst all participants; nonetheless, the primary findings indicate that participants chose to become drug mules mainly due to financial strain. The other themes identified included monetary rewards and the influence of social networking relationships. The most common finding was the involvement of Nigerians in all participants becoming drug mules. An analysis of the nature, extent and causes of smuggling at selected correctional centres in Gauteng

Text in English / This research is aimed at analysing the nature, extent and cause of smuggling at selected Correctional Centres in Gauteng with the aim to provide appropriate strategies to combat smuggling. Smuggling is seen as a chain of command that reflects predisposition of an organised crime. Smuggling in correctional centres is an ongoing concern. Unauthorised items that are smuggled into the correctional centres have an adverse effect into the lives of people and death is an ultimate price. The Department of Correctional Services is also experiencing a severe shortage of officials due to The Seven Days Establishment and the Occupation Specific Dispensation (OSD) policies of Centre- Based and Non-Centre- Based staff. The study shows an increase of smuggling of items such as dangerous weapons, dagga, cellular phones and sim card over a three-year period at the three Correctional Centres. Various recommendations are made to combat smuggling in correctional centres including going back to the basics of proper searching of visitors, offenders, cells and staff when entering the facilities. / Corrections Management / M.Tech. A criminological exploration of female drug mules incarcerated in Kgoši Mampuru II and Johannesburg female correctional centres

Abstract in English, Xhosa and Tswana / The recognition of the role of females in drug trafficking was established more than 30 years ago and there are notable cases of women undertaking leading roles in this crime for almost 100 years. This phenomenon has gained popularity in South Africa as is evidenced by the number of women who are found and incarcerated for smuggling drugs into or out of South Africa. The purpose of this study was to gain an in-depth understanding of the female drug mule phenomenon and explain the reasons why female drug mules are involved in drug smuggling. The objectives of the study were to develop a profile for female drug mules incarcerated in South African correctional centres, specifically Kgoši Mampuru II and Johannesburg Female Correctional Centre; to establish risk factors for being recruited and used as drug mules; to explain the mules’ motivations for being involved in drug smuggling; to determine the physical and emotional impact drug smuggling has on the drug mules; and to determine the methods used by drug mules to smuggle drugs. A qualitative research approach, with the use of one-on-one semi-structured interviews, was used to obtain information from participants. The sample comprised 20 diverse female offenders incarcerated at Kgoši Mampuru II and Johannesburg Correctional Centres. The data from the schedule of interview questions were analysed using thematic analysis, coding and categorising. It is envisaged that this research will be of significance to the criminal justice system, as recommendations on deterrence and preventative measures regarding the use of females as drug mules may be made from the findings. The general findings of this research demonstrate that a female drug mule, in the context of this study, is an African or Spanish woman that is open to methods that can produce various streams of income to support her children and family. Secondly, the findings in this dissertation revealed that women are recruited as drug mules because of their vulnerable economic state. Lastly, the most common method used to smuggle drugs revealed by participants in this research is through luggage concealment. Through this study, an in-depth insight into the history and life circumstances of female drug mules is provided. This will also help society to understand why some individuals are at risk of being recruited as mules or are motivated to engage in drug smuggling.
