O Poder legislativo e as políticas públicas educacionais no período 1995-2010 / The congress and the educational public policies in the period 1995-2010

Este trabalho versa sobre o papel do Poder Legislativo brasileiro na definição das políticas públicas educacionais. Foi feito o exame de conteúdo de cerca de mil e quinhentos projetos de lei e propostas de emenda à Constituição, apresentados pelos deputados nas legislaturas compreendidas entre os anos de 1995 e 2007. Foram também realizados três estudos de caso sobre duas questões estruturantes das políticas educacionais: o financiamento da educação e a avaliação da educação superior. Nesses casos, analisaram-se as propostas de emendas constitucionais e projetos de lei ou medidas provisórias regulamentadoras, as emendas oferecidas pelos parlamentares, os pareceres e substitutivos apresentados e os textos afinal convertidos em lei. Os resultados encontrados confirmam os estudos que apontam que a iniciativa legislativa dos parlamentares, em algumas áreas de políticas públicas, como a da educação, não está predominantemente vinculada a interesses particularistas ou voltada para a distribuição de benefícios concentrados. Evidenciou-se a predominância de iniciativas legislativas voltadas para benefícios difusos, independentemente da vinculação partidária. O estudo demonstra que, nas questões mais estruturantes de políticas públicas educacionais, normalmente submetidas ao Congresso Nacional pelo Presidente da República, é expressiva a intervenção do Poder Legislativo, por meio da apresentação e à aprovação de emendas, alterando significativamente os textos originais das proposições e freqüentemente levando à aprovação de textos com orientação diversa daquela originalmente pretendida pelo Poder Executivo. Os textos resultantes não são um amontoado de emendas particularistas, mas contribuições para o aperfeiçoamento da legislação, que refletem uma ampla negociação em torno de linhas consensuais de política. Revelam também que a alternância de partidos políticos no Poder Executivo não tem determinado ruptura nessas políticas, mas continuidade com aperfeiçoamento ou ampliação de abrangência. Governos diferentes, com suporte parlamentar diverso, promoveram, com decisiva participação do Poder Legislativo, radical mudança nos mecanismos de financiamento da educação pública, implantando procedimentos redistributivos de recursos e envolvendo o conjunto das três esferas da federação brasileira. Estas iniciativas configuram inovação nas políticas públicas educacionais, estabelecendo novo padrão de financiamento. No campo da avaliação da educação superior, também foram introduzidas normas e procedimentos inovadores, com significativa atuação do Congresso Nacional. / This work discusses the role of the Brazilian Congress, in defining public policies in education. We examine the contents of about fifteen hundred bills and proposed constitutional amendments submitted by deputies in legislatures between the years 1995 and 2007. We also conducted three case studies on two structural issues of educational policy: education funding and evaluation of higher education. In such cases, we analyzed the proposals for constitutional amendments and their respective regulatory bills, the amendments made by parliamentarians, and the texts that finally became law. The results confirm other studies showing that the initiative of parliamentarians in some policy areas such as education, is not predominantly linked to particularistic interests or facing the distribution of concentrated benefits. It is revealed the predominance of legislative initiatives that aimed at diffuse benefits, regardless of party ties. The study shows that in the more structural issues of public educational policies, normally submitted to Congress by the President, there is a significant intervention by the Legislature, through the submission and approval of amendments, which significantly change the original texts of the propositions, often leading to the adoption of texts with different orientation than that originally intended by the Executive Branch. The texts are not a bunch of particularistic amendments, but contributions to the improvement of legislation, which reflect a broad trading around consensual lines of politics. They also show that the alternation of political parties in the Executive Branch has not determined break of those policies, but continued improvement or extension of coverage. Different governments, with diverse parliamentary support and decisive participation of the Legislature, promoted a radical change in the funding of public education, implementing procedures of redistribution of resources involving the three spheres of the Brazilian federation. These initiatives shape innovation in public policy education, establishing a new pattern of funding. In the field of higher education assessment, innovative policies and procedures were also introduced, with significant action of Congress.

Esta pesquisa analisa interlocuções ocorridas na formulação da proposta de criação do FUNDEB, no período compreendido entre o processo de criação do FUNDEF e o protocolo da Proposta de Emenda Constitucional 415/05 no Congresso Nacional pelo Executivo Federal. Mapeia posicionamentos dos atores que participaram da elaboração da proposta no âmbito do Executivo Federal, identificando idéias, interesses e aprendizagens ocorridas no processo. A pesquisa envolveu análise documental, entrevistas e observação dos posicionamentos de atores institucionais, do Executivo Federal, da representação dos estados, da representação dos municípios e da sociedade civil. O procedimento teórico metodológico envolveu a análise de conteúdo como técnica para análise dos resultados finais e a abordagem teórica de dimensão cognitiva, Advocacy Coalition Framework, para análise da mudança da política, buscando valorizar o papel das idéias, de crenças e do conhecimento. A utilização da abordagem visou compreender o processo da mudança e o papel da aprendizagem política através da interação de atores das diferentes instituições e a influência de coalizões no processo decisório. Foram definidos como categorias de análise: os paradigmas, as estratégias, a abrangência da política, os fatores estáveis e os fatores dinâmicos que influenciaram os posicionamentos. Um ponto comum no posicionamento das instituições pesquisadas foi a aprovação na mudança da política de (re) distribuição de recursos intergovernamentais para financiamento da Educação Básica. As divergências relacionavam-se com as etapas a serem incluídas e os recursos para composição do Fundo, bem como a fórmula do cálculo do valor mínimo por aluno. Sob o ponto de vista de ter havido aprendizagem nesse processo de discussão, pode-se dizer que a experiência do FUNDEF foi sendo avaliada como uma política que estrutura melhor os recursos e a aplicação dos mesmos, melhorando, inclusive, o controle sobre eles, mesmo que os fatores econômicos limitem a ampliação do financiamento da educação. Neste caso a política anterior contribuiu para que fosse projetada uma política mais abrangente. As limitações, bem como, as características do FUNDEF, foram os parâmetros para a construção de uma nova proposta. / This research analyzes interlocutions in the formulation of the proposal for creation of FUNDEB, from the process of creation of FUNDEF to the protocol of Proposal of Constitutional Amendment 415/05 in the National Congress by the Federal Executive Power. It traces the positioning of actors that participated in the elaboration of the proposal in the Federal Executive Power, identifying ideas, interests, and learning that took place along the process. The research has involved documental analysis, interviews and observation of positions of institutional actors, Federal Executive Power, State representation, municipal representation and civil society. The theoretical-methodological procedure involved the content analysis as a technique to analyze the results and the theoretical approach of cognitive dimension, Advocacy Coalition Framework, to analyze the policy change, in an attempt to value the role of ideas, beliefs and knowledge. The use of this approach aimed at understanding the change process and the role of political learning through the interaction of actors from different institutions and the influence of coalitions in the decision process. The following categories of analysis have been defined: paradigms, strategies, political comprehensiveness, stable factors, and dynamic factors that have influenced the positions. A point in common in the positions of the institutions researched was the approval of the change of policy of (re)distribution of intergovernmental resources for funding Basic Education. The divergences were related to the phases to be included and the resources for composing the Fund, as well as the formula to estimate the minimum value per student. From the perspective of the existence of learning in this discussion process, one can say that the experience of FUNDEF has been evaluated as a policy that better structures the resources and their application, thus improving the control over them, even if the economical factors limit a broader education funding. In this case, the previous policy contributed to the design of a more comprehensive policy. The limitations as well as the characteristics of FUNDEF have been the parameters for the construction of a new proposal.

Tem como objeto de estudo a relação entre qualidade do ensino, financiamento e gestão de duas escolas públicas. Dialogando com autores que problematizam as questões atinentes à qualidade da educação básica nas últimas décadas, em especial Dourado, Oliveira e Santos (2007), Azevedo (1997, 2007), Pinto (2008), Aguiar (2010), buscou identificar os fatores atinentes ao financiamento e à gestão da educação que influenciam a dinâmica administrativo-pedagógica das unidades escolares com possíveis repercussões nos resultados concernentes ao Índice de Desenvolvimento da Educação Básica - IDEB. Tem como hipótese que a eficiência da gestão constitui destacado fator para influenciar a dinâmica escolar, refletindo positivamente no IDEB. Para comprovar ou não tal hipótese, considerando-se as categorias analíticas – financiamento e gestão da educação, e qualidade da educação –, efetivou-se uma pesquisa bibliográfica e documental, bem como entrevistas semiestruturadas e aplicação de questionários com dirigentes de duas escolas, da rede municipal de ensino do Recife, campo empírico da pesquisa. Para as análises foram utilizadas técnicas de triangulação nas perspectivas de Bauer e Gaskell (2007), Yin (2005), e Gil (2009). As evidências empíricas obtidas com os sujeitos da pesquisa, confrontadas com os estudos da área, permitem indicar que a gestão constitui, na realidade das escolas focalizadas, pertencentes a uma mesma região político-administrativa do município do Recife, e que recebem aportes de recursos financeiros similares, um fator relevante para explicar a diferença de resultados concernentes às suas respectivas posições no que tange ao IDEB. Conclui-se que o volume de recursos financeiros aportados individualmente a cada uma das unidades escolares mostrou-se um fator menos relevante do que a prática da gestão para influenciar a qualidade do ensino aferida pelo IDEB. / The present case study focuses on funding, school management and the quality of basic education, particularly in elementary school, in the municipal public education system of Recife, Pernambuco. It has as object of study the relation between the teaching quality, financing, and management of two public schools. In dialogue with the authors that discuss the quality of basic education issues in the late decades, specially Dourado, Oliveira and Santos (2007); Azevedo (1997, 2007); Pinto (2008); and Aguiar (2010); it aims to identify the financing and education administration factors that influence the administrative and pedagogical dynamics of the school units, with possible repercussions on the concerning results to the Basic Education Development index - IDEB. It has as hypothesis that the management efficiency consists an outstanding factor to influence the school dynamics, positively reflecting on IDEB. To prove or not this hypothesis, considering the analytical-financing and management of education, and quality of education, a bibliographical and documentary research was realized, as well as semi-structured interviews and questionnaires with leaders of two schools from the municipal school system of Recife, empirical field of research. For the analyzes, triangulation techniques were used from the perspectives of Bauer and Gaskell (2007), Yin (2005) and Gil (2009). The empirical evidence obtained from the research subjects, faced with the area studies, allows us to indicate that the management is, in fact – from the targeted schools perspective, which belong to the same political-administrative region of the city of Recife, and receive similar funds contributions – a relevant factor to explain the different results, concerning to their respective positions, regarding the IDEB. It is concluded that the volume of financial resources, contributed individually to each of the school units, proved to be a less important factor than the management practice to influence the quality of education measured by IDEB.

In this way, we begin from the problem that is the access democratization and stay through the years of 2007 to 2013. Therefore, we infer that we have to verify the FUNDEB distribution at a government level; both state and counties in Goiás. Following this path, the discussion proposed presents itself divided into two parts: a) at a first moment, the goal is to know the historical funding process of Basic and Special education, which pervades by the right principle present in the Federal Constitution. That is a reason why, it is indispensable to characterize the formulation process of FUNDEB, trying to understand the debate about the Basic Education funding policies reformulation that occurred because of that fund; b) Secondly, we will analyze educational and financial data to evaluate the impacts on enrollment in the fund’s special education in the state of Goiás and its counties. Methodologically, this research is based on the quantitative/qualitative analysis, including documental and bibliographic research. Altogether, it is indicated that the funding policies enabled the access to special education , intensifying the municipalization of enrollments in the state of Goiás, mainly in the cities with bigger population, an effect of the resources received by the counties from FUNDEB. On the other hand, there were resource losses in in the smaller cities, due to the small number of enrollments. Therefore, it is ought a review in the financial distribution of FUNDEB and national education policies, and adopt a quality standard and collaboration regime between the states. / Esta pesquisa tem como objetivo compreender o deslocamento de recursos via Fundo de Desenvolvimento do Ensino Básico e Valorização do Magistério (Fundeb) para a garantia do acesso e permanência do público alvo da Educação Especial do/no estado de Goiás entre os anos de 2010-2013. Este recorte temporal se justifica pelo fato de que foi este período que efetiva a totalização de impostos vinculados ao Fundeb, outrossim, à implantação da matrícula dupla-vis (homologada pelo Parecer nº 13 do Conselho Nacional da Educação (CNE) e Câmara da Educação Básica(CEB)/2009, que regulamentou o Decreto nº 6.571/2008 e a Resolução CNE/CEB nº 4/2009), que definiu o Atendimento Educacional Especializado (AEE) em turno contrário ao da escolarização, como forma de garantir não apenas o acesso, mas a permanência do aluno na escola. Para alcançar o objetivo central desta pesquisa, torna-se necessário: analisar o processo de deslocamento de recursos via Fundeb e sua contribuição para o aumento do número de matrículas na Educação Especial em Goiás; observar se houve um processo de municipalização da Educação Especial no Estado; verificar se ocorreu um aumento do número de matrículas nas salas de Atendimento Educacional Especializado (AEE) e se, nesse processo, aconteceu também o aumento da privatização da Educação Especial em Goiás. Metodologicamente, esta pesquisa se pauta na análise qualitativa/quantitativa, englobando revisão bibliográfica e pesquisa documental. De modo geral, indica-se que a política de fundos possibilitou o acesso à Educação Especial, intensificando o processo de municipalização das matrículas no estado de Goiás, efeito dos recursos recebidos pelos municípios na cesta do Fundeb. Verificou-se, ainda o aumento de matriculas no ensino fundamental (anos finais) e ensino médio, evidenciando a permanecia do público alvo da educação especial no ensino básico. Assim, entende-se que se faz necessária a revisão/transparência em ralação as etapas e modalidades da distribuição financeira do Fundeb e da política educacional do país para a adoção de padrão de equidade na colaboração entre os entes federados.

Teoria do capital humano e financiamento educacional no Estado de São Paulo, 1986-2003 / Human Capital Theory and Educational Funding at the state of São Paulo

A pesquisa a seguir teve como objetivo principal mensurar o investimento em educação, Ensino Fundamental e Médio, no Estado de São Paulo no período de 1986-2003. Ao investigar o Balanço Geral do Estado de São Paulo, criou-se uma série histórica que permitiu analisar o comportamento dos dados e o perfil gráfico da despesa dos governos destinada à Secretaria da Educação. Essa verba foi redistribuída Às unidades orçamentárias, que são as subsecretarias submetidas à Secretaria da Educação, responsáveis pela ação direta no sistema educacional do Estado de São Paulo. Para ambos os casos, utilizou-se os métodos de análise quantitativa. Os aspectos econômicos foram observados pela ótica da teoria do capital humano. Para tanto, buscou-se descrever a trajetória da teoria, seus conceitos e sua importância na história recente da educação paulista. A disposição dos dados e o levantamento do número de matrícula permitiram ainda aferir o valor custo-aluno ano e mês, e a participação de cada unidade orçamentária na composição deste custo. Assim, foi possível comparar o valor do investimento, custo-aluno , em capital humano público e capital humano privado. A pesquisa também analisou aspectos históricos, as mudanças, as continuidades da educação paulista e as características da política educacional de cada governo no período / The following research aimed to measure the investment in education, elementary and secondary degree education at the state of São Paulo in the period 1986-2003 . When investigating an Overall Picture (Budget) of the state of São Paulo it was engendered a historical series that allowed us to analyze the behavior of the data and the chart listing the expenditure of governments intended for local Secretary of Education . That resorce was redistributed to budgetary units , which was submitted to the secretariats Secretary of Education responsible for direct action in the educational system of the state of São Paulo . For both cases we used the methods of quantitative analysis . The economic aspects from the perspective of human capital theory were observed . To this purpose, we sought to describe the trajectory of the theory , its concepts and its importance in the recent history of São Paulo education. The provision of data and raising the number of registrations allowed further assess to the cost per student year and month , and the participation of each budgetary unit in the composition of such cost value. Thus, it was possible to compare the value of the investment cost per student both in public and private human capital . This diploma thesis compares organizational structures of selected universities in the Czech Republic, in the Slovak Republic and in France. The aim of this analysis is to determine whether the organizational structures of sampled universities are comparable or not, and whether there are inefficiencies in the management of these universities. The first part describes systems and funding of higher education in the selected countries. The second part is focused on comparison of the organizational structures using annual reports of the universities. The second part of this thesis also concludes and summarizes the outcomes of the analysis and determines the management effectiveness of selected universities.

United we stand? Investigating the impact of unified dues agreements between state and national Career & Technical Education (CTE) professional organizations on CTE funding in the southern states

Career and Technical Education (CTE) teachers have long been active in lobbying the federal and state governments in support of CTE through their professional organizations, but these are not traditionally considered interest groups. This study sought to determine if the formal relationships—dues agreements—between the two largest national professional organizations, and their state affiliates had an impact on state funding for CTE. The impacts of professional organization unity, membership rates, and lobbying expenses on state-level CTE funding were analyzed through the lens of interest group theory, a subfield of political science. Within this population (N = 13), 1) a link was found between dues agreement type and funding; 2) Agricultural educators joined their professional organization(s) at higher rates than other CTE teachers; 3) a low relationship was discovered between professional organization membership percentages and funding; and 4) a high degree of relationship was found between lobbying expenses and funding.

Perceptions of Decision-Makers of the Future Role of the Texas Higher Education Coordinating Board in the Funding Process for Public Senior Colleges and Universities

This study compares the perceptions of presidents and academic and fiscal vice presidents of Texas public senior colleges and universities and with those of (appointed) members of the Texas Coordinating Board. A survey instrument was developed, based upon appropriate coordinating board functions discussed in the literature review, A five-point scale was used to measure intensity or agreement or disagreement. Responses were subjected to one way analysis of variance to determine differences between administrators and board members. Differences significant at the .05 level are reported. Administrators and board members differed significantly on all statements related to centralized control versus internal autonomy. Board members endorsed a greater variety of roles and a higher level of activity for the board than did administrators, although members were not expansionistic. Administrators indicated diverse opinions regarding the board's role. Responses related to formula funding were similar. Board members believed that requests to the legislature for higher education funding needs should be presented in terms of a statewide system; administrators indicated uncertainty. Both agreed on the increasing importance of long-range planning in formula development, but administrators were unsure whether such planning would help provide stability and realistic expectations in funding. Both groups endorsed a greater role for the board in collecting, interpreting, and disseminating information regarding higher education institutions. Neither subgroup offered an opinion regarding subjection of higher education budget requests to the criteria used for other state agencies. Board members and administrators disagreed as to whether private business standards were appropriate for higher education institutions. The relationship between funding recommended by the board and appropriations passed by the legislature was not considered appropriate for evaluating board success. State appropriations for higher education were seen as an investment in the state's economic future. Administrators did not believe college and university faculties understood the board s role in funding; board members were undecided.
