The thesis called "Expert proofs" deals with one of the types of proper evidence which is applied in cases when an expert report is necessary to clarify facts important for criminal trial proceedings. Thesis is divided into 5 basic chapters. The first chapter is introductory and talks about some of the general problems of expert laws - evaluation of the current legal regulations of expert's function - expert law and expert ordinance, especially from the point of view of the changes that these legal regulations have undergone as well as the forthcoming changes in the form of updating of the current law and preparation of a brand new law. It also talks about definition of an expert, especially the difference between a witness and a consultant, then briefly about their rights and duties in the criminal trial proceedings in general. The second chapter deals with the presence of an expert explicitly in criminal trial proceedings and is divided into three parts. The first one provides basic information about admitting an expert and its form. The second one concerns the definition of an expert's assignment and the third one concerns preparation of an expert report, in which the expert familiarizes themselves with the criminal case. The Crime of Perjury and False Expert Report according to Section No. 346 of the Criminal Code Abstract A great deal of media attention has been dedicated recently to cases of experts facing the charge of perjury and false expert report pursuant to Section No. 346 of Act No. 40/2009 Coll. of the Criminal Code (hereinafter referred to as the Criminal Code). These cases reduce the experts' credibility in the eyes of the public, cast doubts on their practice as a whole and are therefore commonly used as an argument for adopting a new Law on the experts' conduit. In accordance with the aforementioned facts, the goal of this thesis is to provide a further insight into the crime of perjury and false expert report under Section No. 346 of the Criminal Code. The thesis consists of an introduction, five chapters and a conclusion. The first chapter gives a historical overview concerning perjury and false expert report followed by the definition of Section No. 346 of the Criminal Code, including its specific elements, and finally an analysis of several disputed cases that call into question the conclusion of criminal liability under Section No. 346 of the Criminal Code, such as the expert's consultant, the processor of the expertise or the formal and the material witnesses. This thesis addresses the use of expert evidence in criminal trial proceedings. The author's primary aim is to present a thorough analysis of this highly specific form of evidence as contained in the Criminal Procedure Code, Act No. 141/1961 Coll., to identify its insufficiencies, and to suggest some potential legislative modifications. The author is aware that the role of an expert in criminal proceedings is also determined in part by the Act on Experts and Interpreters, Act No. 36/1967 Coll., but he deals with this organizational norm only marginally, as his main goal is to analyze the possibilities of using expert evaluations within the framework of criminal procedure. In this thesis, the author describes the historical development of this type of evidence, discusses the concept of the role of the expert in legal theory, and above all, presents his views regarding the law currently in effect, describing the use of expert evidence from its initial stages of appointment of an expert to the preparation and presentation of the expert opinion and the evaluation thereof. The author also takes account of some currently topical issues such as the confrontation of experts and the use of computer software in the expert's work. Os laudos periciais nas ações judiciais por erro médico: uma análise crítica / Expert reports in medical malpratice lawsuits: a critical analysis

A proposta deste trabalho é fazer uma apreciação crítica dos laudos periciais realizados em ações judiciais de responsabilidade civil por alegado erro médico. A prova pericial deve orientar o julgador para que este possa fixar os limites da responsabilidade do médico ou profissional de saúde. O perito deve responder adequadamente as questões discutidas no processo, bem como trazer ao juiz os elementos que considerar úteis ou necessários para auxiliar a decisão judicial. Na parte teórica são estudados os campos de apuração da responsabilidade por erro médico, os pressupostos da responsabilidade civil, os tipos de prova que podem ser produzidos no processo, quais são os elementos essenciais do laudo pericial e os critérios que devem ser usados pelo perito para determinar se estão presentes os requisitos do dever de indenizar. Em seguida, utilizando-se dados obtidos em processos judiciais, são abordados os aspectos mais relevantes nas ações desta espécie, como a incidência dos tipos de dano alegados pelos autores, as especialidades médicas mais acionadas judicialmente, o tempo médio entre o ajuizamento da ação e a sentença judicial e a relevância dos laudos nas decisões judiciais observadas. Ao final, é realizada uma análise crítica dos conteúdos dos laudos, verificando se eles contêm todos os elementos recomendados e descritos na parte teórica, fazendo-se críticas sobre se eles cumpriram sua função de forma adequada e propondo instrumentos para seu aperfeiçoamento. / The aim of this work is to do a critical appreciation of the expert reports in judicial proceedings for alleged medical malpractice. The expert report should guide the judge and help to determine the limits of the physician\'s or health professional\'s responsibility. The expert must answer appropriately the questions discussed in the lawsuit, as well as bringing the elements that he or she might consider useful or necessary to aid the judicial decision. The theoretical section concerns the medical malpractice responsibility verification, the presupposed civil responsibility, the kinds of proof that can be produced in the process, what are the essential elements of the expert report, and which criteria that should be used by the expert to determine if the requirements of the duty of compensating are present. Then, using data obtained from judicial proceedings, the most important aspects in this kind of lawsuit are exposed, such as the incidence of types of damage alleged by the authors, the most prosecuted medical specialties, the average time between the beginning of the action and the judicial sentence, and the relevance of the expert reports in the observed judicial decisions. At the end, a critical analysis of the reports is accomplished, verifying if they contain all the recommended elements described in the theoretical part, criticizing the accomplishment of their function, and proposing instruments for their improvement.

Forensic accountants are occasionally called upon to assist in criminal law proceedings. The role of the forensic accountant in such proceedings is usually determined during the engagement of the forensic investigation to assist in the matter under investigation. During such investigations, various investigation techniques may be utilised by the forensic accountant in order to convey the facts and findings of the forensic investigation in a written report, drafted by the forensic accountant. When criminal prosecutions are instituted and the forensic accountant is called upon to act as an expert witness, such evidence is mostly based on the findings of the written report. Thus, in giving evidence, the forensic accountant must ensure that the testimony and evidence will be admissible in court and that the forensic accountant is found to be a credible witness. Although there are various legal standards that the forensic accountant must adhere to, the ICFP, which is the South African regulatory body for commercial forensic practitioners, is still in its infancy and has as yet not set any standards with which forensic accountants must comply with when assisting in criminal investigations or drafting written reports. The objective of this study is to highlight the role of the forensic accountant in criminal law proceedings. This objective is reached by clarification of the following: • the difference between a forensic accountant and an auditor; • the techniques available to the forensic accountant when conducting a forensic investigation; • the standards with which a forensic accountant‘s report should comply; and • the forensic accountant‘s role in testimony. The study illustrates the difference between a forensic accountant and an auditor and suggests a definition for a forensic accountant. The study furthermore explores various techniques that the forensic accountant may utilise during the investigation. The study also analyses the legal standards with which a forensic accountant must comply in order to ensure the admissibility of the written report and its findings. In order to achieve this, international regulatory standards applicable to forensic accountants are analysed and discussed. Finally, the role of the forensic accountant in court proceedings is examined.
