This study s choice by jurisprudential analysis is justified by the observation that the sustainable environment is a very large and vague concept, which gives it a huge room for judicial intervention in the case. In view of this situation, it highlights the importance of studying judicial decisions on this matter, in order to verify whether there is any trend and uniform standard behavior by the magistrates. This study wants also to verify if the Courts ends adopted in its decisions not only legal criteria for defining sustainable development. This jurisprudential research expects to contribute with the identification of criteria used by the Brazilian Courts to settle disputes like those above mentioned, having a clearer view of how the concept of sustainable development has been implemented by this institution / O presente trabalho tem por objetivo analisar a orientação adotada pela jurisprudência no que toca aos limites e extensão do conceito de desenvolvimento sustentável, quando decide conflitos entre o regular exercício da atividade econômica e a proteção do meio ambiente. A opção do estudo pela análise da jurisprudência decorre da constatação de que o conceito de desenvolvimento sustentável é bastante amplo e vago, permitindo grande intervenção judicial no caso concreto, das formas mais variadas possíveis. Em vista dessa situação, evidencia-se a importância do estudo de decisões jurisprudenciais sobre o assunto, objetivando verificar se existe tendência e padrão de atuação uniforme de magistrados. Pretende-se verificar, ainda, se o Poder Judiciário adota, em suas decisões, critérios não somente jurídicos para definição de desenvolvimento sustentável. Espera-se, com a presente pesquisa jurisprudencial, contribuir para a identificação de critérios utilizados pelo Poder Judiciário para decidir conflitos como aqueles narrados acima, tendo uma visão mais clara da forma como o conceito de desenvolvimento sustentável acaba sendo concretizado por tal instituição

Les conclusion des commissaires du gouvernement près le Conseil d’État sont un discours d'un type particulier. Appelés à proposer, en toute indépendance et impartialité, une solution à chaque litige, les commissaires du gouvernement contribuent, sans y participer, à l’exercice par le juge administratif de la fonction de dire le droit. L’étude de la construction de la théorie jurisprudentielle du service public durant la période 1873-1956, sous l’angle du discours des commissaires du gouvernement, permet de comprendre à la fois la catégorie juridique de service public et l’institution du commissaire du gouvernement. Spécifique par son statut, ses fonctions et sa méthode, le discours des commissaires du gouvernement éclaire sous un jour nouveau l’histoire de l’élaboration de la catégorie de service public qui, par sa densité conceptuelle et sa fonction fédératrice dans le droit administratif, accède au rang de théorie jurisprudentielle. La richesse de cette histoire fournit d’innombrables matériaux afin de comprendre la particularité du discours des commissaires du gouvernement, lesquels proposent des adaptations constantes de l’état du droit, tout en cherchant à préserver l’œuvre prétorienne du Conseil d’État. Leur attachement profond à la théorie jurisprudentielle du service public montre que celle-ci devient, au fil du temps, un élément inséparable de l’histoire de l’institution. / The conclusions of the Government Commissioners at the Conseil d’État are a particular type of speech. Appointend to propose, with complete independence and impartiality, a solution to each case, the Government commissioners contribute to the exercise by the formation of judgement of the judcial function, without participating. The study of the development of the jurisprudential theory of public service during the period 1873-1956 from the point of view of the speeche of the Government commissioners makes it possible to understand both the category of public service and the institution of the Government commissioner. Specific by its status, its functions and its method, the speech of the Government Commissioners sheds new light on the story analyzed of the elaboration of the category of public service which, by its conceptual density and unifying function in the Administrative law, attains the rank of jurisprudentialtheory. The richness of this story provides countless materials to understand the particularity of the speech of government commissioners, who propose constant adaptations of the positive law, while seeking to preserve the jurisprudential work of the Conseil d’État. Their deep attachment to the jurisprudential theory of public service shows that it becomes, over time, an inseparable element of the history of the institution.

La diffusion des données publiques en support numérique suscite un changement d'échelle dans le temps et dans l'espace et elle modifie le concept classique de publicité qui existait dans l'univers papier. Nous étudierons les moyens de respecter le droit à la vie privée et les conditions d'accès et d'utilisation des données personnelles, parfois à caractère sensible, contenues dans les documents publics diffusés sur Internet. Le cas particulier des données accessibles dans les banques de données judiciaires exige des solutions particulières : il s'agit de trouver l'équilibre nécessaire entre le principe de transparence judiciaire et le droit à la vie privée. / The upheavals generated by the new means of disseminating public data, together with the multiple possibilities offered by the Internet, such as information storage, comprehensive memory tools and the use of search engines, give rise to major issues related to privacy protection. The dissemination of public data in digital format causes a shift in our scales of time and space, and changes the traditional concept ofpublic nature previously associated with the "paper" universe. We will study the means of protecting privacy, and the conditions for accessing and using the personal information, sometimes of a "sensitive" nature, which is contained in the public documents posted on the Internet. The characteristics of the information available through judicial data banks require special protection solutions, so that the necessary balance can be found between the principle of judicial transparency and the right to privacy.

A insatisfação com o sistema latifundiário predominante na América Latina tem levado à implementação de reformas, ainda que com diferentes intensidades. O direito constitui um fator essencial nesses processos, através dos textos constitucionais e das leis que dispõem que a propriedade da terra deve cumprir uma função social. Tal concepção significou uma transformação do clássico direito de propriedade, aquele que assegura o uso pleno e ilimitado do bem pelo proprietário. Sua incorporação nas constituições ocorreu num processo amplo de reconhecimento dos direitos econômicos, sociais e culturais, denominado constitucionalismo social, verdadeira mudança de paradigma em meio a uma grande concorrência de interesses e pressões. Junto à função social, posteriormente foi considerada a função ambiental da propriedade fundiária, entendida como um requisito essencial nos tempos atuais. Este trabalho consiste num estudo comparativo acerca do surgimento, evolução e incorporação do princípio da função socioambiental da propriedade pelos ordenamentos jurídicos da Argentina, do Brasil e do Paraguai, assim como sobre o entendimento dos Tribunais de última instância a respeito da sua aplicação em casos concretos. Graças à revisão e análise do material bibliográfico, pôde-se interpretar que a pressão exercida pelos movimentos sociais constitui um dos principais fatores que determinaram a incorporação deste princípio nos sistemas jurídicos, embora com diferentes níveis de profundidade, vista a disparidade de força com a qual estes grupos atuam nos três países. Por outro lado, através da análise de conteúdo dos principais julgamentos dos Tribunais Superiores tratando sobre a função socioambiental da propriedade, foi possível advertir que tal princípio é aceito e levado em conta nos três casos. Porém, principalmente no caso brasileiro, seu cumprimento é em última análise colocado num segundo plano para a resolução das controvérsias, o que demonstra que sua aplicação concreta como princípio de justiça social é ainda tímida no âmbito judiciário. / The discontent with the landowner system in Latin America has led to the implementation of reforms, although with different intensities. The law has been a key factor in these processes through constitutions and laws which state that land ownership should fulfill a social function. This has meant to a transformation of the classic ownership law, one that ensures the full and unlimited use of the good by the owner. Its incorporation in constitutions takes place within a broad recognition process of economic, social and cultural rights, called social constitutionalism, a genuine paradigm shift that entailed huge fight of interests and pressures. Besides the social function, later was considered the environmental function, understood as a key requirement nowadays. This work is a comparative study about the emergence, evolution and incorporation of the social and environmental function principle of property by the legal systems of Argentina, Brazil and Paraguay, as well as on the understanding of the courts of last resorts regarding of their application in specific cases. By means of the review and analysis of bibliographic material, we could interpret that the pressure exerted by social movements has been one of the main factors in determining the incorporation of this principle in the legal systems, although with different strength, given the relevance of these groups operation in the three countries. Moreover, by analyzing the content of the Superior Courts main judgments dealing with the social and environmental function of property, it was possible to observe that such a principle is accepted and taken into account in all three cases. However, especially in the Brazilian case, its lack of compliance is placed in the background for disputes resolution, which shows that its practical application as a principle of social justice claims is still timid in courts.

It is intended to establish a compliance of the concept of positive law and legal rules, with legal security as one of the basic pillars of the legal system, and its cargo of legal value as a principle in the preservation of the normative expectations consistent and widespread transmitted to society, and its protective expression of legal situations in progress (past legal situations) in the category of vested right. From the analysis of definitions assigned by the Brazilian doctrine on legal security and vested right, a distinct idea of the traditional doctrinal repertoire is set to apply to the purpose that it aims to achieve, in the reference system of the functional concept of the system of law. A specific case on Brazilian jurisprudence is analyzed to establish the theoretical content of vested right, as a corollary of legal security, to the pragmatic view of the jurisprudential changes in Tax Law. Finally, all the concepts and legal institutions in the process of normative production in Constitutional Court STF are analyzed, as well as the (in)compliance of vested law in respect of amendment of the rule of law result of positioning consolidated by jurisprudence, (normative judicial precedent), given the normative expectations formed in this process mutation / Discute-se a segurança jurídica especificamente sob o prisma das mutações jurisprudenciais no âmbito do Direito Tributário, com foco em uma proposta da sua manifestação como direito adquirido , como forma de assegurar as expectativas normativas da sociedade diante de um contexto de direito intertemporal no seio da mutação jurisprudencial tributária. Pretende-se estabelecer uma compatibilização do conceito de direito positivo e de normas jurídicas, com a segurança jurídica como um dos pilares fundantes do sistema do direito, e sua carga de valor jurídico como sobreprincípio a projetar-se na preservação das expectativas normativas congruentes e generalizadas transmitidas à sociedade, e sua expressão protetiva nas situações jurídicas em curso (situações jurídicas transactas) na categoria de direito adquirido . A partir da análise das definições conferidas pela doutrina brasileira sobre a segurança jurídica e do próprio direito adquirido, coloca-se uma ideia distinta do tradicional repertório doutrinário a fim de aplicar à finalidade que se almeja alcançar, dentro do sistema de referência do conceito funcional do sistema do direito. In this sense, health goes through condition of universal right and duty of the State, which should be guaranteed by social and economic policies aimed at reducing the risk of disease and other hazards, in addition to ensuring universal and equal access to actions and services for its promotion, protection and recovery (Article 196 by CF/88). Achieving the purposes aimed by the constituent to the area of health is the great challenge that requires the Health System and its managers. To this end, several policies have been structured in an attempt to establish actions and services for the promotion, protection and rehabilitation of diseases and disorders to health. In the mid-90s, in order to meet the guidelines and principles established by the SUS, it was established the Pol?tica Nacional de Aten??o Oncol?gica PNAO, in an attempt to sketch out a public policy that sought to achieve maximum efficiency and to be able to give answers integral to effective care for patients with cancer, with emphasis on prevention, early detection, diagnosis, treatment, rehabilitation and palliative care. However, many lawsuits have been proposed with applications for anticancer drugs. These actions have become very complex, both in the procedural aspects and in all material ones, especially due to the highcost drugs more requested these demands, as well as need to be buoyed by the scientific evidence of these drugs in relation to proposed treatments. The jurisprudence in this area, although the orientations as outlined by the Parliament of Supreme Court is still in the process of construction, this study is thus placed in the perspective of contributing to the effective and efficient adjudication in these actions, with focus on achieving the fundamental social rights. Given this scenario and using research explanatory literature and documents were examined 108 lawsuits pending in the Federal Court in Rio Grande do Norte, trying to identify the organs of the Judiciary behave in the face of lawsuits that seeking oncology drugs (or antineoplastic), seeking to reconcile the principles and constitutional laws and infra constitutional involving the theme in an attempt to contribute to a rationalization of this judicial practice. Finally, considering the Rational Use of health demands and the idea of belonging to the Brazilian people SUS, it is concluded that the judicial power requires ballast parameters of their decisions on evidence-based medicine, aligning these decisions housing constitutional principles that the right to health and the scientific conclusions of efficacy, effectiveness and efficiency in oncology drugs, when compared to the treatments offered by SUS / A Constitui??o Federal brasileira de 1988 ao apresentar o cat?logo dos direitos e garantias fundamentais (T?tulo II), traz, expressamente, que tais direitos alcan?am os direitos sociais, econ?micos e culturais (art. 6? da CF/88), como forma n?o s? de ratificar os direitos civis e pol?ticos, mas, tamb?m, de faz?-los efetivos e concretos na vida do povo brasileiro, especialmente diante da previs?o de aplica??o imediata dos referidos direitos e garantias. Nesse sentir, a sa?de passa ? condi??o de direito de todos e dever do Estado, o qual dever? ser garantido mediante pol?ticas sociais e econ?micas que visem ? redu??o do risco de doen?a e de outros agravos, al?m de garantir acesso universal e igualit?rio ?s a??es e servi?os para sua promo??o, prote??o e recupera??o (art. 196 da CF/88). Alcan?ar os fins almejados pelo constituinte para a ?rea da sa?de ? o grande desafio que se imp?e ao Sistema ?nico de Sa?de e aos seus gestores. Para tanto, diversas pol?ticas p?blicas t?m sido estruturadas na tentativa de estabelecer a??es e servi?os para a promo??o, prote??o e recupera??o de doen?as e agravos de sa?de. Em meados da d?cada de 90, e procurando atender as diretrizes e princ?pios estabelecidos pelo SUS, foi institu?da a Pol?tica Nacional de Aten??o Oncol?gica PNAO, na tentativa de esbo?ar uma pol?tica p?blica que buscasse atingir o m?ximo de efici?ncia e que fosse capaz de dar respostas efetivas ao integral atendimento aos pacientes com c?ncer, com ?nfase na preven??o, detec??o precoce, diagn?stico, tratamento, reabilita??o e cuidados paliativos. No entanto, muitas a??es judiciais t?m sido propostas com pedidos de medicamentos antineopl?sicos. Essas a??es v?m cercadas de muita complexidade, tanto nos aspectos processuais quanto nos aspectos materiais, especialmente em raz?o dos altos custos dos f?rmacos mais solicitados nessas demandas, bem como pela necessidade de serem balizadas as evid?ncias cient?ficas desses medicamentos em rela??o aos tratamentos propostos. A jurisprud?ncia nessa ?rea, apesar dos contornos j? delineados pelo Plen?rio do Supremo Tribunal Federal, ainda est? em pleno processo de constru??o, raz?o pela qual o presente estudo se coloca na perspectiva de contribuir para a efetiva, eficaz e eficiente presta??o jurisdicional nessas a??es, com foco na concretiza??o dos direitos fundamentais sociais. Diante desse cen?rio e utilizando-se da pesquisa explicativa, bibliogr?fica e documental, foram analisadas 108 a??es judiciais em tr?mite perante a Justi?a Federal, Se??o Judici?ria do Estado do Rio Grande do Norte, buscando identificar como os ?rg?os do Poder Judici?rio se portam diante das a??es judiciais que pleiteiam medicamentos oncol?gicos (ou antineopl?sicos), procurando compatibilizar os princ?pios e normas constitucionais e infraconstitucionais que envolvem a tem?tica, na tentativa de contribuir para uma racionaliza??o dessa pr?tica judici?ria. The debate on how to understand the legal figureof “jurisprudence” is still relevant in Constitutional Law and, in general, in the Theory of Law, in countries where the legal system follows Civil Lawand also in those that are under Common Lawsystems.The Peruvian Constitutional Procedure Code has introduced in its Preliminary Title two figures that are related to constitutional jurisprudence: the jurisprudential doctrine and the constitutional binding precedent.In the present article, the author makes an approach to both figures from the theory of the sources of Law. She presents an overview on how the “production of Law” is understood in doctrine, and on how the constitutional jurisprudence could take a place in this order, taking into account the form in which the role of the Judge is considered. / En el Derecho Constitucional y, en general, en laTeoría del Derecho, el debate sobre cómo entender la figura jurídica “jurisprudencia” sigue vigente, tanto en los países cuyo sistema jurídico se afilia al Civil Law como en aquellos que pertenecen alCommon Law.En el Perú, el Código Procesal Constitucional ha in- troducido dos figuras relacionadas con la jurispru- dencia constitucional: la doctrina jurisprudencial y el precedente constitucional vinculante.En el presente artículo, la autora realiza una aproximación a ambas figuras desde la teoría de las fuentes del Derecho. Así, presenta un panorama sobre cómo se entiende la “producción del Derecho” en doctrina, y luego cómo podría encajar la jurisprudencia constitucional en este esquema, teniendo en cuenta cuál es el papel que se considera cumple el Juez.

Este trabalho consiste num estudo comparativo acerca do surgimento, evolução e incorporação do princípio da função socioambiental da propriedade pelos ordenamentos jurídicos da Argentina, do Brasil e do Paraguai, assim como sobre o entendimento dos Tribunais de última instância a respeito da sua aplicação em casos concretos. Graças à revisão e análise do material bibliográfico, pôde-se interpretar que a pressão exercida pelos movimentos sociais constitui um dos principais fatores que determinaram a incorporação deste princípio nos sistemas jurídicos, embora com diferentes níveis de profundidade, vista a disparidade de força com a qual estes grupos atuam nos três países. Por outro lado, através da análise de conteúdo dos principais julgamentos dos Tribunais Superiores tratando sobre a função socioambiental da propriedade, foi possível advertir que tal princípio é aceito e levado em conta nos três casos. Porém, principalmente no caso brasileiro, seu cumprimento é em última análise colocado num segundo plano para a resolução das controvérsias, o que demonstra que sua aplicação concreta como princípio de justiça social é ainda tímida no âmbito judiciário. / The discontent with the landowner system in Latin America has led to the implementation of reforms, although with different intensities. The law has been a key factor in these processes through constitutions and laws which state that land ownership should fulfill a social function. This has meant to a transformation of the classic ownership law, one that ensures the full and unlimited use of the good by the owner. Its incorporation in constitutions takes place within a broad recognition process of economic, social and cultural rights, called social constitutionalism, a genuine paradigm shift that entailed huge fight of interests and pressures. Besides the social function, later was considered the environmental function, understood as a key requirement nowadays. This work is a comparative study about the emergence, evolution and incorporation of the social and environmental function principle of property by the legal systems of Argentina, Brazil and Paraguay, as well as on the understanding of the courts of last resorts regarding of their application in specific cases. By means of the review and analysis of bibliographic material, we could interpret that the pressure exerted by social movements has been one of the main factors in determining the incorporation of this principle in the legal systems, although with different strength, given the relevance of these groups operation in the three countries. Moreover, by analyzing the content of the Superior Courts main judgments dealing with the social and environmental function of property, it was possible to observe that such a principle is accepted and taken into account in all three cases. However, especially in the Brazilian case, its lack of compliance is placed in the background for disputes resolution, which shows that its practical application as a principle of social justice claims is still timid in courts.
