Is Iran an Islamic State : A Comparison between Shia Islamic Theory of State and Ayatollah Khomeini's Islamic Republic of Iran

Andersson, Jonas January 2009 (has links)

The Islamic Republic of Iran‟s alleged pursuit of nuclear missile capabilities is proving in-creasingly problematic for the international community, which places the country in a sig-nificant position in world politics. In turn, the world‟s attention towards the thirty-year-old Republic established by the late Ayatollah Khomeini has resurged. The Republic of Iran based on Ayatollah Khomeini‟s interpretation of Islam has long stood in the spotlight of both public and scholastic scrutiny, particularly due to its perceivably radical manoeuvres on the international stage. However, as the focus of these scrutinizing views has been the Iranian unwillingness to subdue and conform to western norms, the issue of the „Islamicness‟ of the Republic has been overlooked.

Hence, this thesis seeks to draw further attention to this question - whether Iran can truly be regarded as an Islamic State - in order to ensure a deeper and more accurate under-standing of the Republic of Iran. The purpose of this paper is thus to investigate and re-flect on the theory of Islamic governance promoted by Ayatollah Khomeini and the politi-cal system of the Islamic Republic through the prism of Islamic history. The theory of the Islamic State and the Shia Islamic leadership has been and continues to be central in Aya-tollah Khomeini‟s and the Islamic Republic‟s official rhetoric, being claimed as the sole foundation of the „new‟ Iranian system. In consequence, this paper delves into the Islamic theory of State and the concept of the Imamate in order to critically analyze Ayatollah Khomeini‟s theory and the Islamic Republic. This is aimed at yielding a conclusion whether Iran is justly labeled an Islamic State.

By performing this norm-fulfilling analysis of the subject in question reliant on a qualitative data collection, the thesis has found that the correlation between the two theories of Islam-ic governance is one of considerable disputability. The paper has, based on the investigated material, been able to conclude that the Islamic Republic of Iran holds a political structure lent from non-Islamic sources, but that its personnel and political field of contest can still be considered Islamic. What the paper has thus revealed is that Khomeini‟s reasoning con-stitutes a novel and unique form of Islamic fundamentalism formed in conjuncture with political ideas of modern and non-Islamic nature. Hence, the results of the study suggests that the Islamic Republic of Iran is in need of serious reconsideration as the Iranian model of Islamic governance remains a source of contention because of the significant deviations from what it claims as its sole basis.
/

Postavení správce daně při zabezpečení státních příjmů / The position of tax administrator in providing the national income

Lodek, Jan January 2012 (has links)
The focus of this dissertation is in the area of theoretical knowledge in customs law and tax law connected with practical knowledge implemented throughout legal relations, its subjects and objects, the rights and obligations of parties in the Act on Taxes and Charges Administration and the new Tax Code as a complex concept of legal proceeding within individual branch of financial law while fulfilling the determining criterion in the system of law. I understand the term "system of law" has more meanings. The system of law is a variously formatted summary of relations between the branches of objective law and legal rules. I also take the term as a set of basic legal systems. Usually it can also be described as a system based on a set of elements connected to each other by a certain structure of relations. On the other hand the system of law symbolizes the indication of the structure of law as a normative legal framework. It then represents a greater unity but also the inner differential in law. The differential sign of dividing law into branches or sub-branches is the nature of the group of social relations which are subject to legislation. The legal system (objective law) is in every country (national law) always somehow structured. The way of matching and organizing the legal institutes into branches is...

An annotated translation of the manuscript Irshad Al-MuqallidinʾInda Ikhtilaf Al-Mujtahidin (Advice to the laity when the juristconsults differ) by Abu Muhammad Al-Shaykh Sidiya Baba Ibn Al-Shaykh Al-Shinqiti Al-Itisha- I (D. 1921/1342) and a synopsis and commentary of its dominant themes

Gamieldien, Mogamad Faaik 06 1900 (has links)
Text in English and Arabic / In pre-colonial Africa, the Southwestern Sahara which includes Mauritania, Mali and Senegal belonged to what was then referred to as the Sudan and extended from the Atlantic seaboard to the Red Sea. The advent of Islam and the Arabic language to West Africa in the 11th century heralded an intellectual marathon whose literary output still fascinates us today. At a time when Europe was emerging from the dark ages and Africa was for most Europeans a terra incognita, indigenous African scholars were composing treatises as diverse as mathematics, agriculture and the Islamic sciences. A twentieth century Mauritanian, Arabic monograph, Irshād al- Muqallidīn ʿinda ikhtilāf al-Mujtahidīn1, written circa 1910/1332, by a yet unknown Mauritanian jurist of the Mālikī School, Bāba bin al-Shaykh Sīdī al- Shinqīṭī al-Ntishā-ī (d.1920/1342), a member of the muchacclaimed Shinqīṭī fraternity of scholars, is a fine example of African literary accomplishment. This manuscript hereinafter referred to as the Irshād, is written within the legal framework of Islamic jurisprudence (usūl al-fiqh). A science that relies for the most part on the intellectual and interpretive competence of the independent jurist, or mujtahid, in the application of the methodologies employed in the extraction of legal norms from the primary sources of the sharīʿah. The subject matter of the Irshād deals with the question of juristic differences. Juristic differences invariably arise when a mujtahid exercises his academic freedom to clarify or resolve conundrums in the law and to postulate legal norms. Other independent jurists (mujtahidūn) may posit different legal norms because of the exercise of their individual interpretive skills. These differences, when they are deemed juristically irreconcilable, are called ikhtilāfāt (pl. of ikhtilāf). The author of the Irshād explores a corollary of the ikhtilāf narrative and posits the hypothesis that there ought not to be ikhtilāf in the sharīʿah. The proposed research will comprise an annotated translation of the monograph followed by a synopsis and commentary on its dominant themes. / Religious Studies and Arabic / D. Litt. et Phil.
