A Study of Contracting-out for the Open University of Kaohsiung

Abstract It carries an important educational mission to set up the Open University of Kaohsiung. Such an epochal establishment also marks the advent of adult education in Taiwan. There have been many kinds of universities developed in the recent 10 years. Higher education in Taiwan, thus, becomes much more generalized and marketable. More and more public or private institutions have implemented programs for adult education. However, the development and the market of institutionalized adult education, such as National Open University and the extension education of accredited colleges and universities, plus non-accredited community universities are becoming more and more competitive. Besides, the Kaohsiung City Government has encountered financial problems and subsidiaries from the Central Government are less and less as well. All of these changes have caused that the rate of student recruitment of the Open University of Kaohsiung doesn¡¦t grow up as expected. Therefore, the development and management of the Open University of Kaohsiung needs to reasonably consider an alternative method to work with ¡§authorized management.¡¨ The purpose of the present study is to make up a practical pattern on authorized managements of the Open University of Kaohsiung. The financial support from the government is less and less, and it is becoming much difficult for many universities to develop and manage. In addition to strategic alliances and university merges, there are other practical ways for local governments and related institutions to develop and manage adult education program. This research finds that certain improvements must be done to develop and manage well for the Open University of Kaohsiung. Authorized management is feasible. First, the Open University of Kaohsiung itself should make sure that adult education and extension education are its management focuses. Secondly, at the same time, it should locate its target market and create its core competition capability. Specifically, there are some students who need academic credits and degrees to get professional licenses for their jobs. Other students expect to gain more professional knowledge on marketing, management, and Internet commerce. Furthermore, more and more students are eager to acquire more practical training on foreign languages. Currently, the original regulations of authorized management have been based on the Fundamental Education Law, and Law for Promotion of Civil Participation in Infrastructure Projects. However, there have been no exact and clear regulations or models for public universities¡¦ authorized managements, at present. Thus, this study refers to the existing law and related regulations of authorized management above mentioned. Then, the researcher proposes a draft covenant of authorized management, tender instructions, and other related regulations for the Open University of Kaohsiung and expects to make them as references for other public universities.

A partir dessas manifestações aparentes, mas não se limitando a elas, buscar-se-á a explicação do processo de cooptação da cultura pelo mercado, elucidando a particularidade brasileira e vinculando-a ao movimento de mundialização do capital. A presente tese tem como objetivo, portanto, explicitar e apreender como e por que, entre os anos de 2003 a 2013, houve um movimento de intensificação da mercantilização da cultura. Para tal apreensão, partindo da imediaticidade do real, realiza-se a análise das empresas fomentadoras de cultura que se beneficiam da Lei nº 8.313/91 que trata do incentivo à cultura, popularmente conhecida como Lei Rouanet. A hipótese apresentada é a de que a cultura se insere de diferentes formas no movimento de reprodução do capital: como um serviço, agregando valor à marca e à cidade e, assim, contribuindo para processos especulativos e criadores de renda; e como uma mercadoria que permite a realização de outras mercadorias que contêm um alto grau de tecnologia, como os aparelhos eletroeletrônicos e informacionais. Cabe ao Estado brasileiro, por meio da ampliação da lei de incentivo, realizar o papel de mediador entre as produções culturais e o mercado, contribuindo, assim, de forma institucionalizada para os processos de produção e reprodução do capital tanto de setores nacionais como internacionais e especulativos. Observa-se, ao final da pesquisa, que o movimento de expansão do capital sobre a cultura desenvolve-se no momento em que há a preponderância financeira na economia e que os setores com tendências à concentração de capital são os diretamente beneficiados com a intensificação da mercantilização da cultura. / In the last few decades there has been a unique approach between cultural productions and the market. In the immediacy of daily life, there can be noticed the use of culture as a means of enhancing the image of the city, as a method of marketing for large corporations, as well as a form of speculative investment. From these apparent manifestations, yet not limited to them, this research will seek to explain the process of co-optation of culture by the market, elucidating Brazilian’s peculiarity and linking it to the movement of capital globalization. Therefore, this thesis aims to clarify and understand how and why, between the years of 2003 and 2013, there has been a movement of intensification of cultural commodification. For such understanding, starting from the immediacy of the real, there will be carried out an analysis of the companies that promote culture and are benefited by Law 8,313/91 – popularly known as Lei Rouanet –, a Federal Law for cultural incentive. The hypothesis presented here is that culture is inserted in different ways in the movement of capital reproduction: as a service, adding value to the brand and to the city, thus contributing to processes of speculation and income creation; and as a commodity that enables the achievement of other goods with high technology, such as electronic and informational appliances. It is up to Brazilian State, through the expansion of the incentive law, to play the role of mediator between cultural productions and the market, contributing institutionally to the process of production and reproduction of capital both in national, international, and speculative sectors. One can notice at the end of the research that the movement of capital expansion over culture takes place at a time when there is a financial preponderance in the economy and that the sectors with tendencies towards capital concentration are those directly benefited by the intensification of cultural commodification.

The Southern African Development Community (SADC) is a regional economic community established by Treaty in 1992 and comprising fifteen southern African countries. The Tribunal, SADC’s judicial organ, is situated in Windhoek, Namibia and became operational in 2005. The Tribunal enjoys a wide mandate to hear and determine disputes between states, states and SADC, and between natural and legal persons and states or SADC. It is mandated to develop its own jurisprudence having regard to applicable treaties, general rules and principles of public international law, and principles and rules of law of member states. Being new in the field, the Tribunal has not as yet developed a significant jurisprudence although it has delivered a number of judgments some of which are referred to in the study. The Tribunal is expected to develop its own jurisprudence having regard to the jurisprudence developed by other international courts involved in the judicial settlement of disputes. The study offers a comparative review and analysis of the jurisprudence of two selected courts: the International Court of Justice (ICJ) and the Court of Justice of the European Union (ECJ). The focus is on four selected areas considered crucial to the functioning of the Tribunal and the selected courts. The study discusses the parties with access to the Tribunal and compares this with access to the ICJ and ECJ. The jurisdiction of the Tribunal is contrasted with that of the two selected courts. The sources of law available to the Tribunal are discussed and contrasted to those of the two courts. Lastly, the enforcement of law in SADC is contrasted to what applies in relation to the selected courts. In each selected area, similarities and differences between the Tribunal and the two courts are noted and critically evaluated. Further, rules and principles developed by the two selected courts are explored in depth with a view to identifying those which could be of use to the Tribunal. The discuss all stages of manufacturing, morphological, structural and magnetic characterization of a multifunctional composite containing zinc oxide and cobalt ferrite. Thus, studies of ZnO, and the CoFe2O4 composite (0,80ZnO+0,20 CoFe2O4) initiated by the synthesis of nanosized powders by combustion reaction phases were performed. The compounds studied were sintered at different temperatures (1100 to 1250°C) to obtain relative density near to 90% of the theoretical density. Analysis by scanning electron microscopy, spectroscopy energy dispersive, vibrating sample magnometry and diffraction ray-X were made. Measurements of magnetic properties were conducted at room temperature (22°C) and high temperature (22°C to 700°C). In the samples, formation of ceramic structures was verified, the stoichiometry of the proposed chemical compounds was maintained and possibly the formation of a mixed zinc and cobalt ferrite to composite samples. In the sample of the composite sintered at 1250°C there was the formation of cubic zinc oxide. The magnetic behavior and magnetic anisotropy of the samples were similar, however, significant differences were observed in the values of the Curie temperature, coercive field, can assume different origins for the magnetic CoFe2O4 and the composite (0,80ZnO+0,20CoFe2O4) due, perhaps to the formation of a mixed ferrite. / Materiais multiferróicos que exibem simultaneamente duas ou mais propriedades físicas têm cada vez mais suscitado o interesse da comunidade científica e tecnológica para o desenvolvimento de novos materiais multifuncionais. Objetivou-se discutir todas as etapas de fabricação e caracterização morfológica, estrutural e magnética de um compósito multifuncional contendo óxido de zinco e ferrita de cobalto. Assim, foram realizados estudos sobre as fases das amostras de ZnO, CoFe2O4 e o compósito (0,80ZnO+0,20CoFe2O4) iniciados pela síntese de pós nanométricos por via de reação de combustão. Os compostos estudados foram sinterizados em diferentes temperaturas (1100 e 1250°C) obtendo densidades relativas próximas a 90% das densidades teóricas. Foram efetuadas análises por microscopia eletrônica de varredura, espectroscopia de energia dispersiva, difratometria de raio-X e magnometria de amostra vibrante. As medidas de propriedades magnéticas foram realizadas à temperatura ambiente (22°C) e em função da temperaturas (22°C à 700°C) (altas temperaturas). Em todas as amostras estudadas foi verificada a formação de estruturas cerâmicas, mantendo a estequiometria dos compostos químicos propostos e possivelmente a formação de uma ferrita mista de zinco e cobalto para as amostras do compósito. Para a amostra do compósito sinterizada a 1250°C verificou-se também a formação de óxido de zinco cúbico. O comportamento magnético e a anisotropia magnética das amostras foram similares, entretanto diferenças significativas foram observadas nos valores obtidos da temperatura de Curie, do campo coercitivo e do momento magnético total, podendo supor origens magnéticas diferentes para o CoFe2O4 e o compósito de 0,80ZnO+0,20CoFe2O4 devido a formação de uma ferrita mista.

La consécration sur la scène juridique, en 1999, des modes de conjugalité alternatifs au mariage - le concubinage et le PACS-, a contribué à renouveler l'appréhension de la notion de couple, placée au coeur des préoccupations législatives. De plus en plus envisagé comme une notion unitaire, le couple est désormais compris dans une acception qui transcende les modes de conjugalité, au point que la réalité d'un droit commun du couple encouragé par le législateur est aujourd'hui tangible. Dans cette logique, on observe un rapprochement des processus de rupture résultant de l'extension de certaines règles protectrices du divorce aux ruptures du PACS et du concubinage. Dès lors, le développement d'un droit commun de la rupture du couple au détriment de la spécificité du divorce est-il inéluctable ? ou à l'inverse, la rupture est-elle encore le symbole des différences fondamentales entre les modes de conjugalité, en révélant ce qui est l'essence irréductible de chacun d'eux -et ceci, dans un contexte du droit de la conjugalité profondément renouvelé par l'appréhension nouvelle du mariage en tant qu'union ouverte aux personnes de même sexe ?Telle est l'alternative pour le législateur à qui il incombe de donner une nouvelle cohérence au droit de la conjugalité. / The arising on the legal scene in 1999 of various types of union as alternatives to marriage (cohabitation and french civil partnership -PACS-) contributed to reconsider the very notion of couple as the core of legislative priorities. More and more understood as a unitarian concept, the couple is now included in an understanding that goes beyond the type of union, to the point where a common law of couples becomes a reality, promoted by the legislator. Doing so, the legal ways of ending a cohabition or a PACS are now obviously converging with the way of ending a marriage, thanks to the extension of protective laws that initially concerned only married couples.From here, must we consider inevitable the development of a common law of ending a couple, at the expense of the specificity of divorce ? Or, at the opposite, is the ending of a couple still the best representation of the fundamental differences between unions, revealing their very nature - moreover now that the laws of conjugality have been deeply reconsidered through the legalization of same sex marriage ?Such is the alternative for the legislator, who has now to give a brand new coherence to the laws of conjugality.

Title: Reflections of the New Civil Code in the life of sports clubs at the local level. Objectives: The goal of this diploma thesis is to specify the changes in the life of sports clubs at the local level after the New Civil Code, which came into effect on 1. 1. 2014. The main object is to discover the changes in the structure of the non-profit sport organizations, tax management of the sports clubs and also to offer concrete advices, which would help to cope with the transformation to the New Civil Code. Methods: In this thesis the qualitative method is used. Semi-structured interviews are helping to get the complex overview of the problems and concrete issues. In case of availability, the legislative documents of interviewed non-profit sport organizations are analyzed to specify and verify their answers. Research is supplemented by basic analyzes of public register, which will help to describe current situation of reactions on the New Civil Code. Results: Thanks to the research it was discovered that non-profit sport organizations, which have the help of private sector, support of umbrella organization or advantage of having professional member with experiences in accounting, taxes or law, will more likely manage with all the changes caused by the new legislative. As referidas legislações são de cunho racista e segregaram, a partir da sua vigência, todos os judeus que estivessem em território alemão, incluindo o ocupado após o início da Segunda Guerra Mundial. Verifica-se que vários métodos discursivos na Alemanha nazista, tiveram sua gênese na modernidade, com a adoção dos termos sangue impuro e racialmente inferior, referindo-se a judeus e outros considerados racialmente inferiores. O nacional-socialismo também se espelhou no laboratório experimental realizado no Sudoeste Africano (atual Namíbia), que foi colônia alemã do final do século XIX até o ano de 1915. Os primeiros campos de concentração, a modernização de tecnologia de estudos sobre hierarquia racial e as legislações restritivas de casamento entre nativos e germânicos foram exemplos de práticas que foram aperfeiçoadas anos depois, com a ascensão de Hitler. Tal e qual como no continente africano, o leste europeu foi o palco dos campos de extermínio nazistas e utilizado para estudos (pseudo)científicos com cobaias humanas. Para atingir este desiderato, a metodologia que sustenta o desenvolvimento dessa dissertação foi o de análise de conteúdo, com a finalidade de captar os discursos ocultos no conteúdo do texto das leis discriminatórias, com o apoio do método histórico para contextualizar o surgimento dos referidos diplomas legais. Ao final do trabalho, observa-se que existem indicadores de discurso colonial nas legislações analisadas, demonstrando que as relações de poder modernas podem ser manipuladas através do domínio do Direito. / The imposed regime by National Socialism from 1933 to 1945 has some similarities to the colonial dominations deployed during modernity due to the individuals infeiorization discourse and techniques similar to the colonizing methods employed by Western Europe. Therefore the purpose of this dissertation is to verify whether there are indicators of colonial discourse in the Law for the Protection of German Blood and the German Honor and in the First Supplementary Decree of November 14th 1935, by the content analysis tool, with the support of the Historical and bibliographical survey methods. These laws are racist and have segregated all Jews on German territory, including the region occupied after the start of World War II. Thus various discursive methods in Nazi Germany, had their genesis in the modernity, by adopting terms like “impure blood” and “racially inferior”, referring to Jews and others considered racially inferior. The nazism was also based on the experimental laboratory conducted in South-West Africa (present-day Namibia), which was a German colony from the late nineteenth century until the year 1915. The first concentration camps, the modernization of technology of studies on racial hierarchy and the law about marriage prohibition between natives and Germans, were examples of practices that were enhanced years later with the rise of Hitler. Just asin the African continent, Eastern Europe was witness of Nazi death camps and used for (pseudo) scientific studies with human guinea pigs. In order to achieve this goal, the methodology that supports the development of this dissertation was the content analysis, with the purpose of capturing the hidden discourses in the text of the discriminatory laws, with the support of the historical method to contextualize the rise ofmentioned legal diplomas. At the end of the paper, it is observed that there are indicators of colonial discourse in the analyzed legislations, demonstrating that modern power relations can be manipulated through the rule of law.

根據近幾年來瑞士洛桑國際管理發展學院發表之「全球競爭力」調查報告與國際透明組織公佈之「全球貪腐印象指數」的排名結果,發現國家競爭力越高者,清廉度亦相對較高,二者間存有強烈的正相關。而歷次調查結果,均顯示臺灣僅為中度廉潔的國家,因此在推動防貪的過程裡,仍存有許多改善的空間。 晚近公部門貪瀆案件、政商掛勾的弊端層出不窮;為遏止公職人員貪污腐化,政府提擬出一系列陽光法案,而公職人員財產申報法就在民國82年匆匆立法通過,成為第一道陽光法案。該法開宗明義即揭示,「爲端正政風、確立公職人員清廉作為,建立公職人員利害關係之規範,特訂定本法」,足徵防制貪瀆係該法所積極追求的目標。但迄今為止,申報不實之公職人員仍然眾多,亦未見任何觸法者因此去職或終結政治生命,可見財產申報法尚無法完全發揮遏制貪瀆弊端的力量,故有修法之迫切需要。 本研究係從文獻資料探析財產申報法的立法歷程與規範重點,並針對法務部95年版修正草案加以檢討,同時擷取美國、新加坡的財產申報制度的優點以供我國修法參考。另外,則藉由深度訪談的過程,了解我國財產申報制度在法規面與執行面的優缺點,進而提出改善建言,以期達成建構廉能政府的施政目標。 經綜合文獻分析與深度訪談的研究結果,發現整體申報制度之缺失有申報對象界定失衡、防堵脫產未克其功、公開透明猶有不足、裁處罰則難以懾人、執行審核確有困境等。依據前述研究發現,本文提出下列建議包括:建置整體陽光法案、法令體系的結合運作、其他配套措施、追查資金流向、建立弊端揭發人保護制度、鼓勵民眾監督公部門、強化公務人員倫理教育、簡化行政作業流程、研議高薪養廉政策等,以期完善整體申報法制。
