In this topic there is analyzed the particularity of the creation of the Rule of law in Lithuania. The reality of the state life forced to choose this topic.
The implementation of the idea of the rule of law – the fundamental aim of every state, because only the rule of law firms the humanistic basis, makes sure the ways of life‘s wellbeing, freedom, fight with bureaucracy. The aim of the rule of law is firmed in the preamble of the Lithuanian Constitution. It means that the activity of the institutions conforms to law. Equity, the rule of law, the protection of the rights and freedoms of the people are the main fundamentals of such state. The social, political and public relations change every day, therefore law, which regulates these relations, can not be stable, it has to change continually, and they depend on the characteristic of the relations. Therefore in the topic there are analyzed the problems, which are typical to Lithuania reaching the rule of law. There are examined how the theoretical model of the rule of law conforms to legal, social and economical reality of the state and how there are firmed the rights and freedoms of the people. Advanced civil society is essential condition of the existence of the rule of law. Only the civil society can create the rule of law, and the state can not develop as the rule of law without the civil society. Juridiska – ett nytt språk? : En studie av juridikstudenters språkliga inskolning / Legalese - a new language? : A study of the language socialization of law studentsBlückert, Ann January 2010 (has links)
This dissertation considers the language socialization of law students. One message that the law students encounter is that legal Swedish is an entirely new language. The main aim is to investigate what linguistic norms are conveyed to the students through the teachers’ comments on the students’ texts and through various forms of writing instructions. The material consists of student texts with teacher comments and documentation on various phases of instruction with a focus on writing. Teacher comments on texts written during the first year of the law programme are analyzed and categorized. The analysis stems from two models. The first model is based on different text levels, like formal conventions of writing, sentence construction, text structure, word choice and style, and content. The second model distinguishes different linguistic norms based on three layers: The first layer consists of written language norms in general language practice, the second of academic language norms and the third of norms that are specific to the use of legal language. The results show that word choice and style is the most common category for the teachers’ comments in the first term of the law programme and content is the most common in the second term (with word choice and style the second most common). Formal conventions of writing, sentence structure and different types of grammatical constructions are some of the things the teachers criticize. Surprisingly few of the teachers’ comments concern more overarching aspects such as text structure or the aim and genre of the text. Comments are made on local features in the text, but rarely on more global features. The teaching practice that the writing of law students belongs to entails, among other things, that the students’ texts are assessed anonymously for the sake of fairness. This means that there is not much opportunity for a student to discuss the text with the teacher who commented on and assessed it. The construction of the teachers’ text comments is particularly important when dialogue between student and teacher on the text draft and final version is not an integral part of instruction. The teachers’ written comments are usually brief and do not allow much space for a consideration of linguistic norms and text patterns, which reduces the opportunities for the teachers and the law programme to contribute to a deeper linguistic awareness in the law students.

Italská a česká terminologie v oblasti soudnictví: kontrastivní analýza. / Italian and Czech Terminology of Justice System: a contrastive analysis.HOUDKOVÁ, Jana January 2014 (has links)
This diploma thesis deals with the Italian terminology of the Justice System. The work is divided into two parts. In the first part, the author focuses on the description of the special language, methods of his research, translational methods and problems of the translator. It describes also the Czech and Italian system of justice and defines the semantic field of the terminology of the Justice System that she will work with. In the second part she works with a selected sample of keywords compiled by the created corpora. The sample is divided into a several groups according to the semantic classification. The aim of the thesis is to review the existing Czech translations, if need be propose her own translations and recommend the translation that should be registered in a bilingual dictionary. The Czech-Italian and Italia-Czech vocabulary and the semantic dictionary is the supplement of this thesis.

Blir det mer begripligt? : En diakron studie av språkliga förändringar i domar från Göta hovrätt 2001–2021. / Is the comprehensibility increasing? : A diachronic study of linguistic changes in judgments from Göta Court of Appeal 2001–2021.Hansen, Lisa January 2022 (has links)
Syftet med denna studie är att undersöka hur begripligheten i Göta hovrätts domar förändrats mellan 2001 och 2021. Studien syftar till att undersöka dels hur syntax och lexikon förändrats i domarna, dels hur följsamheten till klarspråksråd har förändrats under perioden. Materialet består av totalt 18 domar från Göta hovrätt: tre brottmålsdomar och tre tvistemålsdomar vardera från 2001, 2011 och 2021. En kombination av kvantitativ och kvalitativ metod har använts i studien: I den kvantitativa analysen undersöktes syntax och lexikon i samtliga 18 domar och i den kvalitativa textanalysen användes klarspråkstestet för domar som verktyg för att analysera sex av domarna djupare. Resultatet visar att det skett förändringar i domspråket under den tid som undersökts, men att det inte är entydigt huruvida domarna har blivit mer begripliga eller ej. Den kvantitativa analysen visar att domarna i många avseenden ligger längre ifrån klarspråksidealet år 2021 än 2001 och 2011. Resultatet av den kvalitativa analysen visar dock att följsamheten till klarspråksråden förbättrats under den undersökta perioden. Facktermer rensas bort eller förklaras i större utsträckning, det juridiska språket närmar sig det vardagliga och tonen blir mer läsarvänlig. Den sammantagna slutsatsen blir därför att domarna i vissa avseenden blivit mer begripliga och närmat sig idealet, men att ytterligare förbättringar krävs för att de ska bli tillgängliga även för icke juridiskt kunniga läsare. / The purpose of this study is to examine how the comprehensibility of the judgments from Göta Court of Appeal has changed between 2001 and 2021. The study aims to examine how the syntax and terminology has changed within the judgments as well as how the compliance with Plain Language Guidelines has changed during this period. The material consists of 18 judgments from Göta Court of Appeal: three criminal convictions and three civil actions each from the years of 2001, 2011 and 2021.A combination of quantitative and qualitative methods has been used: In the quantitative analysis, syntax and terminology were examined in all eighteen judgments and for the qualitative analysis, Klarspråkstestet (“the plain language test”) was used as a mean to further analyze six of the judgments. The results show that the language has changed during the selected period, but it remains ambiguous whether the language has become more comprehensible or not. The quantitative analysis shows that the judgments lie further away from the Plain Language Ideal in 2021 than they did in 2001 and 2011. However, the results of the qualitative analysis show that the compliance with Plain Language Guidelines has improved during this period. Technical terms are removed or explained to a greater extent, the legalese is approaching the everyday language and the tone is becoming more reader friendly. The conclusion is therefore that in some respects, the judgments have become more comprehensible, but that further improvements are required to make them accessible for readers who do not have a clear understanding of judicial language.
