Accountability of child soldiers in conflict situations in Sub Saharan Africa

Throughout the world, but especially in the African continent, international, cross-border and national conflicts are ongoing. In the majority of these conflicts child soldiers are involved in various ways. Judicial problems concerning the prosecution of commanders and leaders of armed groups, irrespective of governmental or not are being solved. Thus, underlying concern is left to the issue of accountability of child soldiers. International, Regional and National protection measures provide for certain judicial standards dealing with children under the age of eighteen. In order to fully understand the difficulties arising from the existence of universal binding measurement dealing with the accountability of child soldiers, one has to be aware of the international, regional and national legislative frameworks. In Sub Saharan Africa, especially in Rwanda, Uganda and the Democratic Republic of Congo, governments face various difficulties, such as the implantation process of international protection measures and ongoing conflicts, making it very difficult to examine the status of accountability measures for child soldiers. States have different minimum ages for accountability for child soldiers. Only a process of international co-operation between governments and non state actors can attempt to deal with the accountability of child soldiers. Not only deterrent, but rather restitution approaches and reintegration programmes should be followed in order to bring justice and achieve results in peace processes.

Assessing linkages between local ecological knowledge, HIV/AIDS and the commercialisation of natural resources across Southern Africa

That natural resources (NRs) are important to those experiencing adversity, and, especially, vulnerability associated with HIV/AIDS, is well documented, particularly with respect to food and energy security. What is unclear is where HIV/AIDS ranks in terms of its significance in comparison to other household shocks, the role local ecological knowledge may (LEK) play in households' response to shock, a propos the types of coping strategies that are employed. Consequently, this research aims to bridge the knowledge gap between HIV/AIDS and the degree to which it is contributing to the expansion of NR commercialisation and to explore the unknowns surrounding the influence of LEK on people's choice of coping strategy. A two phase study was designed to provide quantitative rigour with qualitative depth. Phase one was an extensive, rapid survey of NR traders within urban and rural settings in five southern Africa countries. The principle objective was to profile the trade, the livelihoods of those involved and their reasons for entering the trade, to ultimately establish to what degree HIV/AIDS may have been a catalyst for this. Almost one third of the sample entered the trade in response to illness and/or death in their households, with 80% of deaths being of breadwinners. The findings illustrated considerable dependence on the sale of NRs; for almost 60% of the sample it was their household's only source of income. There was evidently increased blurring of the lines between rural and urban NR use with a greater diversity of products being traded in urban areas. Phase two involved in-depth interviews and work with a smaller sample at two sites selected based on the findings from the first phase. It incorporated three groups of households; non-trading, inexperienced trading and experienced trading households. Key areas of focus were household shocks, coping strategies employed in response to these and the role LEK may be playing in the choice of coping strategies. Within a two year period, 95% of households registered at least one shock, of which 80% recorded AIDS-related proxy shocks. Non-trading households were significantly worse-off in this regard, while in the case of non-AIDS proxy shocks, there was no such difference between groups. The most frequently employed coping strategy was the consumption and sale of NRs and was of particular importance when households were faced with AIDS proxy shocks. Trading households emerged as having superior levels of LEK in comparison to non-trading households, even for non-traded NRs, suggesting that prior LEK of NRs opened up opportunities to trade in NR as a coping strategy. Further inspection of the latter group however revealed that the portion of non-trading households who traded on a very ad hoc basis actually had comparable levels of LEK to the trading households. Despite the ad hoc trading households' vulnerable state and their disproportionately high level of AIDS proxy measures, they had at their disposal, sufficient LEK to unlock certain key coping strategies, namely the NR trade. In this sense there are apparent linkages between LEK, HIV/AIDS and the expansion of the commercialisation of NRs.

The management of knowledge : a model for the African Renaissance

The study goes beyond knowledge existing in the literature study of the philosophy and theory of knowledge, knowledge management, African knowledge and the management of knowledge by African institutions, including the peace and security architecture of Africa, to reveal a coherent conceptual framework and themes to guide the field research. During the field studies of specific cases in the Great Lakes region of Africa, principles and practices emerged that formed a framework for a constructed Trans-dimensional Knowledge Management Model (TDKM-M) to develop a theoretical model for the management of knowledge for conflict resolution as the first step towards the revival of Africa. The study proposes practical solutions for the management of knowledge that would empower decisionmakers to intervene successfully in conflict situations. Furthermore, the study serves to expand the knowledge base in the field of trans-disciplinary African studies, transcending the boundary between political science and epistemology to navigate the middle ground between disciplines and the space that lies beyond all disciplines and dichotomised thinking towards a new holistic understanding. A systems approach using MIT (multi-disciplinarity, interdisciplinarity and trans-disciplinarity) and qualitative research methodology on a transnational level was followed. The study consists of a literature study and a field study consisting of a pilot study, semi-structured interviews and participation in communities of practice to access the worldviews of diverse cultures. An observable knowledge dimension, consisting of a normative foundation, empirical knowledge domain and analytical knowledge domain, is identified. Furthermore, a tacit metaphysical knowledge dimension is identified that is informed by the observable dimension. The two dimensions transacts with each other to attain a higher level of trans-dimensional knowledge. The TDKM-M proposes principles and practices of how trans-dimensional knowledge, including indigenous African knowledge and external knowledge, can be managed in a collective middle ground to produce holistic understanding. This higher level of understanding can activate intervention into the causes and consequences of conflict. Innovation of African society could follow, achieving desired outcomes such as peace, justice, human rights, self-empowerment and innovation towards transformative growth, competitiveness and negotiate equilibrium with the global community, and ultimately the revival of Africa. / Political Sciences / D. The Kunene River mouth : managing a unique environment.

The Kunene River Mouth (KRM) is one of only two river mouths in Namibia. The Kunene river and river mouth is bisected by the international border between Namibia and Angola, and lies between two protected areas, Iona National Park in Angola and Skeleton Coast Park in Namibia. The governments of Namibia and Angola have signed a Memorandum of Understanding (MoU) to link these two parks as a transfrontier park. This study further proposes a transfrontier Marine Protected Area to protect the marine environment surrounding the KRM and the Angola Benguela Front. The KRM is a fluvially dominated freshwater river mouth. The area is a biogeographically important biodiversity hotspot. The remoteness and pristine character contribute to the aesthetic appeal of the area. This study provides a profile of the KRM addressing its conservation value in terms of both biodiversity and aesthetic value, making use of the concept of “sense of place”. An analysis of all current and potential stakeholders is presented and their interests, activities and potential threats are evaluated. The main stakeholders are Government: the Ministry of Environment and Tourism, the Angolan Government, Ministry of Fisheries and Marine Resources, Namwater, Ministry of Mines and Energy, and the Kunene Regional Council. The private sector presently has a small stake in the area, with the exception of the Northern Namibia Development Corporation who is prospecting for diamonds at the KRM. Although the area has great tourism potential there is no tourism development currently underway or planned. The threat analysis suggests that the KRM is under severe threat from inappropriate development, both locally as well as within the catchment. Mining and prospecting were identified as the greatest threat, whereas tourism poses the least threat to the area. It is suggested that appropriate tourism is the most suitable development for this sensitive area. There is currently no coherent management strategy in place for the KRM. The current environmental legislation is ineffective. The need for a stringent adaptive management regime is identified and management goals for the area are suggested. It is further suggested that the concepts of “Thresholds of Potential Concern” and “Limits of Acceptable Change” are useful to monitor indicators for biophysical components and development activities respectively and to maintain a “Desired State” for the area. This “Desired State” must be the result of a participatory process. To be effective stakeholders must reach consensus on the “Desired State”. The management of international watercourse systems as reflected by international law and in view of the Southern African Development Community

International water law has been unable to translate its principles into effective institutions for the management of shared water resources. National interest has often override any real commitment to the principles of international water law as reflected by the draft Articles of the ILC. Based on the theory of sovereignty, it emphasises a discretionary power to co-operate. However, the community of interest's theory is rather recommended as basis for co-operation. The draft Articles does not take sufficient account of the role domestic water policies, international relations and economics play in the co-operation of states. An integrated approach that considers social and economic effects within an environmental context is proposetL The political economy of water includes the potential of 'virtual water' through the importation of staple grains. A holistic approach, taking global trade in agriculture into account, is recommended. The SADC countries should also consider the potential of regional trade in 'virtual water'. / Law / LL. M. (Law)

A strategy for managing teacher migration in Southern Africa

International teacher migration has emerged as one of the key policy challenges confronting many countries, particularly in Southern Africa, with Botswana, South Africa and Zambia experiencing variable degrees of the cross-border movement of teachers. The aim of this research was to develop a strategy for managing teacher migration in Southern Africa, and balancing the right of individual teachers to migrate internationally, while protecting the integrity of vulnerable education systems and their human resources. The research comprised a literature review and an empirical study based on a mixed-methods research design combining the quantitative and qualitative research approaches. The literature study examined international teacher migration, including its main concepts, theories, causes and effects, while the empirical study assessed the statistical scope of teacher migration in Southern Africa (Botswana, South Africa and Zambia), its causes, effects, and management. A self-administered questionnaire was used to gather quantitative data from education officials, school principals and migrant teachers, while personal in-depth interviews were used to elicit complementary qualitative data from some experts on migration, education officials, teacher union leaders, school principals and migrant teachers. The results of the study revealed that teacher migration statistics and data were generally patchy and incomplete in Southern Africa; that international teacher migration in the region was driven by three main causes related to economic, political and salary conditions; and that teacher migration had both positive and negative effects on the education systems of Southern African countries, migrant teachers and their families. The findings further revealed that improving the management of teacher migration in Southern Africa required a systematic and coordinated approach involving sending and receiving countries, with reference to a common policy and legal framework supported by comprehensive teacher migration data. In this regard, and based on the identification of key principles and guidelines for teacher migration management, a model is proposed for the viable management of teacher migration in the Southern African region. / Educational Leadership and Management / D. Strategic interests in transboundary river cooperation in Southern Africa – the case of the Okavango

Its availability and quality directly relates to what is possible in agriculture as well as human health. In Southern Africa, water issues have become an important political agenda as a result of the droughts that the region has been experiencing. The Southern Africa Development Community (SADC), in its water protocol advises its member states to set up river basin organisations to manage transboundary rivers in Southern Africa. The aim is to encourage the sustainable use of international rivers. Sharing international rivers has proven to be a very difficult issue as shown by the voting patterns on the UN Convention on the Law of Non Navigational Uses of Transboundary Rivers and the subsequent failure of entry into force of this convention. While strategic interests on the global levels manifest themselves in voting patterns in forums like the UN Assembly, the situation is trickier at the regional level. These strategic interests are ever present as a result of states’ need for recognition of their sovereignty and the inability of states to accept any hierarchical enforcement. This study investigates the impact of these interests at the basin level on the structure of cooperation. With the use of a case study, namely the Okavango River Basin Commission, and guided by regime theory, the study looks at the process of regime formation and maintenance in the basin. It concludes that states use cooperative arrangements (international water cooperation regimes) as tools for the strategic protection of their sovereignty. / AFRIKAANSE OPSOMMING: Water is lewe. Die doel is om lidstate aan te moedig om die volhoubare gebruik van internasionale riviere te bevorder . Die vedeling van internasionale riviere is ‘n komplekse kwessie soos wat VN stempatrone aandui ten opsigte van die Wet op die Verbod teen Navigasie op Oorgrensende Riviere en die daaropvolgende versuim van die inwerkingtreding van die Konvensie aandui. As gevolg van state se behoefte vir erkenning van hul soewereiniteit en hul strategiese belange bly die deel van rivierkomme ‘n moeilike internasionale probleem. Hierdie studie ondersoek die impak van die bogenoemde belange op die kom vlak op die struktuur van samewerking. Met die gebruik van ʼn gevallestudie, naamlik die Okovango Rivier Kom Kommissie, en aan die hand van regime teorie, ondersoek die studie die proses van regime formasie asook die problematiek rondom die instandhouding van die Komissie. Die gevolgtrekking is dat state koöperatiewe reëlings (internasionale water samewerking regimes) as instrumente vir die beskerming van hul strategiese soewereiniteit en eie belange gebruik.
