Entre normes et pratiques.Les étrangers des trafics maritimes romains (1742-1797)

Si l'institution d'un Consulat de la mer à Civitavecchia en 1742 s'inscrivait avec retard dans un mouvement de réappropriation de l'exercice de la justice, l'événement symbolisait à la fois les prétentions romaines en matière de mercantilisme et les contradictions de son application pratique. Cette création institutionnelle devait en effet composer avec une ambigüité propre aux ports francs : être à la fois une porte d'entrée au commerce international et le filtre des échanges étrangers. Dans un contexte où le commerce ‘actif' devenait la ligne politique du pouvoir, le quotidien des acteurs économiques s'apparentait plutôt à une réinterprétation sociale des règles locales. Les agents institutionnels étaient en effet très souvent liés aux protagonistes du commerce. Acteurs économiques et institutions étaient alors à même d'incarner les normes avec un haut niveau de flexibilité. À ce titre, dans un contexte de création et d'affirmation d'une identité ‘étatique', l'insertion initiale des capitaines étrangers par l'intermédiaire de l'appareil normatif réglant les trafics maritimes romaines concrétisait la patiente accumulation de savoirs informels et la construction d'un réseau d'intermédiaires stratégiquement positionnés. Des savoirs qui furent un tremplin professionnel et économique mêlant pluriactivité et stratégies d'interprétation institutionnelle. Jouant en effet sur leur condition de stranieri ayant la capacité d'agir comme sudditi pontifici, ces capitaines et marins devinrent par la suite des opérateurs marchands économiquement profitables et incontournables. / If the creation of the Consolato del mare court of Civitavecchia in 1742 was the late expression of an ancient and global movement for the restoration of a State-controlled justice, it also epitomizes the pontifical contradiction in the application of mercantilism. This institution was however facing the free ports ambiguity: at the same time opened to international trade and supposed to screen foreign activity. Above all, the mercantilist political context pushed the economic actors to a daily reinterpretation of local rules. Indeed, institutional agents were usually connected with the protagonists of trade. Therefore, economic actors and institutions were able to enforce justice with a high degree of flexibility. As such, in a context of creation and assertion of a State identity, the initial insertion of foreign captains by the means of normative apparatus regulating papal maritime trade gave concrete expression to the slow accumulation of informal skills and the development of a network of strategically positioned go-betweens. Such skills revealed to be a professional and economic stepping stone, combining diversified activities and institutional interpretation strategies. Using their condition of stranieri, with the ability to act as sudditi pontifici, these captains and seamen became economically profitable and crucial merchant actors.

"All Necessary Force": The Coast Guard And The Sinking of the Rum Runner "I'm Alone"

Passage of the Volstead Act in 1920 expanded the mission of the U.S. Coast Guard. Law enforcement directives required officers to use "all necessary force" should a liquor smuggling vessel refuse the order to stop. On March 22, 1929, the Coast Guard Cutter Dexter sank the Canadian-flagged rum runner I'm Alone in the Gulf of Mexico, triggering an international incident that centered on "hot pursuit" and treaty jurisdiction. International encounters occurred frequently during Prohibition. The I'm Alone incident was the first sinking of a foreign flagged vessel that cost the life of a foreign national. The I'm Alone affair reflected the barriers any federal law enforcement agency faced in making Prohibition effective. The rum runner captain became a celebrity in Canada, while the Coast Guard was vilified. The Coast Guard amended boarding procedures after the incident cautioning officers about the possibility of accidental deaths.

C’est au navire que le droit maritime doit son particularisme, plus précisément au fait qu’il s’expose au risque de mer. On comprend dès lors que les évolutions des règles applicables au bien soient susceptibles d’avoir un impact sur la matière. Ainsi le particularisme du droit maritime ne manquera pas de s’étioler, à mesure que celui du navire se trouvera affecté. Or, le navire est susceptible de connaître plusieurs états qui vont de celui de navire à celui d’épave, en passant par les états de navire abandonné et de navire à démanteler, chacun de ces états du navire faisant intervenir un ensemble de règles juridiques qui lui est applicable. Ce sont les différents statuts du navire. Ils ont connu ces dernières années des évolutions notables de leurs régimes juridiques respectifs, dont le sens et l’influence sur le particularisme du droit maritime sont étudiés dans cette thèse.En effet si la volonté du législateur d’enfermer le navire dans une définition depuis l’entrée en vigueur du code des transports semble manifester une volonté de banaliser l’engin de transport et partant d’atténuer son particularisme, l’intégration des préoccupations et exigences environnementales aux règles gouvernant sa fin révèle, quant à elle, une nécessaire adaptation de la matière. Cette thèse se propose de montrer comment les évolutions du régime juridique des différents états du navire fragilisent davantage le particularisme du droit maritime, ou ce qu’il en reste. L’étude réalisée tend ainsi à démontrer comment le droit maritime qui s’est historiquement construit autour de la nécessité de protéger le navire contre le risque de mer par la mise en mouvement de règles originales se définit désormais de plus en plus comme un droit destiné à protéger la mer contre le navire. Ce mouvement se traduit par une certaine forme d’amarrage progressif du droit maritime au droit terrestre. / It is to the ship that the maritime law owes its particularism, more precisely to the fact that it exposes itself to the risk of sea. One understands then that the evolutions of the rules applicable to the good are likely to have an impact on the subject. Thus the peculiarity of the maritime law would fade if ship peculiarity is affected.However, the ship is likely to know several States that go from that of ship to that of wreck, through the States of abandoned ship and ship to dismantle, each of these States of the ship involving a set of legal rules that it is applicable. These are the different statutes of the ship. In recent years, they have undergone significant changes in their respective legal régimes, whose meaning and influence on the peculiarity of maritime law are studied in this thesis.Indeed, if the will of the legislator to enclose the ship in a definition since the entry into force of the transport code seems to manifest a desire to trivialize the transport vehicle and thereby mitigate its particularism, the integration of concerns and environmental requirements to the rules governing its end reveal, for its part, a necessary adaptation of the subject. This thesis proposes to show how the evolutions of the legal regime of the different statutes of the ship weaken further the particularism of maritime law, or what remains of it. The study carried out thus tends to demonstrate how maritime law, which has historically been built around the need to protect the ship against the risk of the sea by setting in motion original rules, is now more and more defined as a right destined to protect the sea against the ship. This movement is reflected in some form of progressive docking of maritime law to land law.

In Brazil, this modality corresponds to approximately 90% of cargo exports. The voyage charter party is one of the main contracts used for the export of large quantities of solid bulk, especially in regular shipping lines, known as liner, and it is the most common way of perceiving this contract in the maritime practice. The voyage charter party is not limited to transport goods in regular shipping lines, it can be used for non-regular line navigation, known as tramp, and for maritime support and heavylifts (ultra-heavy loaders ships). The Brazilian maritime doctrine always diverged on the legal nature of the voyage charter, classifying it in several ways, being usually equated as a contract of carriage of goods by sea and given the nature of carriage. The international doctrine also diverges on the subject, so the comparative analysis contributes to the solidity of the concept developed in this dissertation. The lack of consensus and incomplete analysis of this institute has legal-economic repercussions for the maritime sector, which represents a crucial point for the maintenance of the Brazilian economy. Thus, the research problem of this dissertation is: How is the legal nature of voyage charter party in Brazil juridical system classified and how does this classification legally and economically impact the Brazilian market? Thus, this dissertation aims to build a solid concept of the legal nature of voyage charter party in Brazil, demonstrating how the formation of this contract is made, with a focus on giving more legal certainty to the topic and reducing the right-cost as a significant factor of ¿custo Brasil¿, allowing greater investments in the domestic market. The applied methodology will be deductive and the sources of research will be bibliographical and documentary. / O modal marítimo é o mais utilizado no mundo para a operacionalização do comércio, sendo responsável pelo transporte de 85% de toda a carga comercializada. No Brasil, esse modal corresponde a aproximadamente 90% das exportações de cargas. O contrato de fretamento de navios mercantes por viagem é um dos principais contratos utilizados para na exportação de grandes quantidades de graneis sólidos, especialmente na navegação de linha regular, conhecida como liner, sendo a forma mais comum de se perceber este contrato na prática maritimista. O contrato de fretamento por viagem não é limitado a utilização em linha regular e ao transporte de cargas, podendo ser utilizado na navegação de linha não regular, tramp, e para apoio marítimo e heavylift (carregadores ultra pesados). A doutrina maritimista brasileira sempre divergiu sobre a natureza jurídica do contrato fretamento por viagem, classificando-o de diversas formas, sendo usualmente equiparado a contrato de transporte e sendolhe atribuída natureza de transporte. A doutrina internacional também diverge sobre o tema, portanto a análise comparada contribui para a solidez do conceito desenvolvido nesta dissertação. A falta de consenso e a análise incompleta deste instituto têm reflexos jurídico-econômicos para o setor marítimo, que representa ponto crucial para a manutenção da economia brasileira. Destarte, o problema de pesquisa desta dissertação é: Como é classificada a natureza jurídica do contrato de fretamento de navios por viagem no Brasil, e, como essa classificação impacta jurídico-economicamente o mercado brasileiro? Desta forma, esta dissertação objetiva a construção de um conceito sólido da natureza jurídica do contrato de fretamento por viagem no sistema jurídico Brasil, demonstrando inclusive como se dá a formação deste contrato, com fulcro de dar mais segurança jurídica para o tema e reduzir o direito-custo como fator significativo do custo Brasil, permitindo maiores investimentos no mercado nacional. A metodologia aplicada será dedutiva e as fontes de pesquisa serão a bibliográfica e a documental.

A tarefa exige análise direta (1) dos condicionantes geológicos e geomorfológicos sobre as quais estão definidos os critérios de delimitação da PCJ, e (2) do processo pelo qual um país legitima a incorporação da mesma ao respectivo território. Os documentos reunidos salientam resultados sociais, culturais, econômicos e estratégicos que podem ser obtidos pelo Brasil nesse processo, a depender do acolhimento do pleito por parte da Comissão de Limites da Organização das Nações Unidas (ONU). O texto da Convenção das Nações Unidas sobre Direito do Mar (CNUDM) garante aos Estados costeiros a expansão da Plataforma Continental, além do limite de 200 milhas marítimas - limite externo da Zona Econômica Exclusiva (ZEE). Para tanto, o Estado deve realizar levantamentos da margem continental (leito e subsolo marinhos) que comprovem a continuidade do bloco crustal para além dos limites da ZEE. Após o levantamento (LEPLAC, no Brasil), o país deve pleitear à Comissão de Limites da ONU a expansão de direitos sobre recursos minerais da área. A Dissertação contextualiza o tema, segundo ordenação temporal que vai da evolução geológica à da incorporação jurídica. O enfoque é essencialmente histórico: (1) Uma história de milhões de anos: sintetiza os processos geológicos formadores de nossa margem continental; (2) Uma história de milhares de anos: enfoca a relação da humanidade e do processo civilizatório com o mar; (3) Uma história de dezenas de anos: explica os trâmites legais para definição da Plataforma Continental Jurídica, com base em princípios geológicos, históricos e legais. O pleito brasileiro de 4.452.000 km2 amplia em 52 % a área de 8.514.876,6 km2 de terras emersas que compõem o território nacional. O material didático elaborado e testado propõe atividades capazes de desvendar, em sequência, cada aspecto citado. As metas principais são: (1) convidar o leitor a analisar uma situação-problema segundo ângulos diferentes de visão; (2) demonstrar que o processo civilizatório, decorrente de uma história das mentalidades, é parte fundamental para plena compreensão do interesse legal do Estado e (3) comprovar que esses conhecimentos são absolutamente imprescindíveis para plena formação de um cidadão brasileiro, em sintonia com os dias atuais. / Abstract: The objective of this research is to produce educational materials capable of explaining the idea of the Extended Continental Shelf (ECS) in textbooks and activities for basic education. It requires direct analysis of: (1) the geological and geomorphological requirements for such definition, and (2) the process by which a given country is capable to declare its ECS. The collected documents highlight social, cultural, economic and strategic results that Brazil may obtain from this process, depending on the acceptance of a case by the Commission on the Limits of the Continental Shelf (UN-CLCS). The text of the UN Convention on the Law of the Sea (UNCLOS) provides for coastal states to expand the Continental Shelf beyond the 200 nautical miles - the outer limit of the Exclusive Economic Zone (EEZ). To this end, the State should carry out surveys of the continental margin (soil, sediments and bedrock) to prove the continuity of the crustal block beyond the limits of the EEZ. After the survey (LEPLAC in Brazil), the country must plead to the UN-CLCS expansion of rights to mineral resources of the area. The dissertation contextualizes the issue, according to a temporal ordering from the geological evolution towards a legal definition. The approach is essentially historical: (1) A history of millions of years: summarizes the forming geological processes of the Brazilian continental margin, (2) A history of thousands of years: focuses on the relationship of humanity and the civilizatory process with the sea, (3) A history of decades: it explains the legal procedures for setting the Extended Continental Shelf, based on geological, historical and legal principles. The Brazilian application of 4,452,000 km2 expands 52% the area of 8,514,876.6 km2 of dry land that compose the country. The developed and tested teaching materials have proposed activities capable of revealing, in sequence, each one of these aspects. Aux Comores, le droit maritime est une discipline qui, depuis longtemps, est restée dans le flou. Les textes internes qui étaient censés régir le droit maritime aux Comores étaient presque inconnus et difficilement trouvables. Ces textes hérités de la France, mériteraient d'être amendés ou remplacés par de nouvelles dispositions tenant compte des réalités et de normes internationales. A ce jour, le pays n'a adhéré à aucune des conventions internationales en vigueur régissant le droit maritime international. Il est en manque cruel de spécialistes en droit maritime, alors que les différends dans ce domaine ne cessent d'augmenter. Plusieurs zones d'ombre et de non-droit planent sur les questions relatives au droit maritime. en nous référant au droit français avec lequel le droit comorien entretient toujours d'étroites relations, cette thèse a pour objectif principal de revisiter le droit maritime comorien afin d'en déceler les lacunes et les originalités, dans la perspective de pouvoir proposer une réforme d'ensemble du droit maritime comorien. / In the Comoros, the maritime law is a discipline which, for a long time, remained in the blur. The internal texts whiwh were supposed to govern the maritime law to the Comoros were almost inknown and not easily findable. These texts inherited France, would deserve to be amended or replaced by new provisions taking account of realities and the international standards. To date, the country adhered to none international conventions in force governing the international maritime law. It is in cruel lack specialists in maritime law, whereas the disagreements in this field do not cease increasing. Several not-right and remote regions plane on the relative questions with the maritime law. While referring to us with the French right with the Comotian Right maintains still and always close relations, this thesis aims main aim to revisit the Comorian maritime law in order to detect the gaps and the originalities of them, with a view to be able to propose an overallreform of the Comorian maritime law.
