The Impacts of Mass Surveillance on Fundamental Human Rights Abstract In this thesis I mainly deal with instruments of mass surveillance, which were recently revealed to the public by American IT specialist Edward Snowden. A considerable part is also devoted to Directive 2006/24 / EC of the European Parliament and of the Council, which at the time obliged Member States to adopt legislation providing for the retention of data generated or processed in connection with the provision of publicly available electronic communications services or of public communications networks. I also deal with the current form of its transposition into the Czech legal order. The purpose of this thesis is to assess if these instruments of mass surveillance meet the conditions of admissibility of measures limiting fundamental human rights, especially the right to privacy. I have understood the content of these conditions on the basis of the interpretation of relevant laws and international treaties on human rights, or their commentaries and relevant case law. This has led to the assessment of the accordance of these instruments with the principle of proportionality or the application of the proportionality test in its various forms. AJ Over the past decade, digital technology has undergone unprecedented development. The Internet, which originally served as a mean of communication among academics, has become the main communication mechanism used throughout the world. The way people can communicate with each other is much easier now. As a result, the attention of governments and secret agencies has also been focused on cyberspace, with the aim of controlling it as much as possible. Following the Snowden revelations in 2013, the debate on the international scene regarding the feasibility of mass surveillance as a tool in the fight against terrorism began. Since the events of September 11, the powers of the secret services in the field of communication of persons have been extended. This practice has brought up some interesting and unresolved issues. Are such activities permissible at all? If so, under what conditions? This diploma thesis analyzes the legitimacy of massive electronic surveillance and data collection in international law in the context of the protection of human rights, especially the right to privacy. This thesis examined how aware upper secondary school students are of how the informationthey share on social media platforms is handled, what concerns are raisedregarding the personal data collected and used by corporations and authorities andhow upper secondary school students view the future education of digital privacy.Questions in the thesis are answered by performing a study using questionnaires asa data collection method. The conclusion is that upper secondary school students inSweden are fairly unaware of how their information is handled in the digital worldand what regulations are in place to protect their data. Some concerns are raisedaround the participants’ lack of knowledge and how their trust in authorities haslowered due to digital surveillance, the lack of mitigating actions against abuse ofsurveillance, and the debate regarding mass surveillance. In the future, the participantswant more education about digital privacy, and they believe it should be partof the curriculum in upper secondary school.

The digital age has reconfigured the security services, especially the forms of mass surveillance aimed at preventing various threats to society. However, this scenario may become problematic from the perspective of protecting the freedom of the media and journalistic privilege. The author of this article offers an overview of the scope of the protection of the journalistic privilege pursuant to the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as its management in Poland from the developments prepared by its Constitutional Court. / La era digital ha reconfigurado los servicios de seguridad, sobre todo las formas de vigilancia masiva que buscan prevenir distintas amenazas para la sociedad. No obstante, este escenario puede convertirse en problemático desde la perspectiva de la protección de la libertad de los medios de comunicación y del privilegio periodístico. El autor del presente artículo nos ofrece un panorama sobre los alcances de la tutela del privilegio periodístico en el Convenio Europeo para la Protección de los Derechos Humanos y de las Libertades Fundamentales, así como sobre su tratamiento en Polonia a partir de los desarrollos realizados por su Tribunal Constitucional.
