Human rights monitoring in Africa : the African Peer Review Mechanism and the African Commission on Human and Peoples' Rights

"The New Partnership for Africa's Development (NEPAD) is an African Union (AU) mandated programme whose main focus is to address key social, economic, and political issues for the African continent. Within the NEPAD programme and vision is the African Peer Review Mechanism (APRM), which has been described as a system of self-assessment, constructive peer dialogue, persuasion, and sharing of experience among member states of the African Union. The APRM is the execution mechanism for NEPAD, whose mandate is to monitor the preformance of states in different programme areas including human rights. The mandate on human rights monitoring falls within the political governance component of the NEPAD Declaration on Democracy, Political, Economic and Corporate Governance (NEPAD Declaration). The APRM has been introduced with a human rights monitoring component in a context where there already exist a number of other human rights mechanisms and institutions such as the African Commission. The proposed processes of the APRM in monitoring human rights in some ways resemble those of the African Commission while at the same time there are major differences between these mechanisms. For example, while the Africa Commission is a quasi-judicial body, which engages in legal processes, the APRM is a political process where heads of state are among the main actors. Some analysts have expressed the view that the creation of the APRM as a political process adds a vital component to the human rights monitoring in Africa which, since the creation of the African Commission, has remained purely legal and thus had limited success in ensuring human rights protection in Africa. While some have shared their doubt over the added value and role of the APRM in human rights monitoring, others have hailed it for providing a forum where heads of state will make political commitments for the protection of human rights. In this regard, the aim of this study is to analyse the role that the APRM will play in human rights monitoring in Africa. This analysis is done in relation to the work that is being done by the African Commission and the challenges that it has confonted over the years. In analysing the role of the APRM in human rights monitoring, this study unpacks the concept of peer review and analyse its practical implementation in Africa, especially in the field of human rights. This study also explores the implications on human rights protection and promotion of the co-existence of the African Commission and the APRM. ... Chapter 1 states the research questions/hypothesis, objectives of the study, relevance of study and literature review. It also looks at the scope and limitations of the study. Chapter 2 gives background information to the concept of peer review, how it is used in ensuring compliance with set standards by states and organisation. An analysis of the use of peer review by other international organisations is done. Further it gives an analysis of the APRM with a specific focus on its human rights monitoring role. Chapter 3 provides a brief background of the African Commission, its mandate and the challenges confronting it in its work. Thereafter there is an analysis of the challenges of the APRM in human rights monitoring and protection. Furthermore, the chapter critically analyses and evaluates peer review and its application in human rights monitoring in Africa. This chapter also highlights the similarities, overlaps and differences in the work and mandate of the APRM and the African Commission. Exploring the potential of African higher education institutions in assisting the New Economic Partnership for Africa’s Development (NEPAD) to effectively achieve its goals

The thesis explores the potential of African higher education institutions in assisting the New Economic Partnership for Africa’s Development (NEPAD) in its quest to affectively achieve its goals. My contention is that higher education institutions need to be favourably positioned in terms of institutional autonomy and academic freedom to assist the achievement of the NEPAD goals. Moreover, there is a need for deliberative democracy, if the NEPAD goals are to be achieved affectively, especially from the perspective of higher education institutions.

Pourquoi, comment et quand y a-t-il changement institutionnel et politique en Afrique ? En examinant les stratégies de développement économique de l’Afrique postcoloniale et en s’intéressant à l’évolution du rôle de l’État – État comme acteur central du développement, tentative du retrait de l’État, interventionnisme limité au social, retour de l’État dans la sphère économique –, la présente thèse se propose d’expliquer le changement sous l’angle original des innovations politiques et institutionnelles. En effet, derrière l’apparente continuité que la plupart des auteurs tant analytiques que normatifs fustigent, il se produit des innovations dont nous proposons de rendre compte par le biais des variables idéationnelles, stratégiques, temporelles et institutionnelles. Cette thèse propose ainsi une analyse comparative inédite du rôle des acteurs nationaux (élites, États, administrations publiques du Bénin, Burkina Faso, Cameroun, Côte d’Ivoire, Congo, Sénégal, Mali, Niger, Togo), des institutions internationales (FMI, Banque mondiale, ONU) et des organisations d’intégration régionale (Union africaine, NEPAD) dans l’émergence et les trajectoires des stratégies de développement en Afrique. Les contextes temporels favorables, les crises des modèles précédents, les configurations et héritages institutionnels structurants, les stratégies instrumentales des acteurs intéressés, l’apprentissage politique, les dimensions cognitives et normatives des idées permettent d’expliquer la diffusion, la sédimentation et la conversion institutionnelles comme processus privilégiés d’innovation en Afrique. La critique de ces concepts permet de développer des outils mieux adaptés pour expliquer certaines innovations, soit l’inclusion et l’intrusion institutionnelles. L’inclusion institutionnelle est un processus mi-stratégique et mi-idéationnel à travers lequel les acteurs nationaux ou régionaux incluent intentionnellement des stratégies (ou solutions) internationales déjà existantes dans une nouvelle institution ou politique dans le but d’accroître la probabilité d’acceptation (reconnaissance, convenance sociale, partage réel ou supposé des mêmes valeurs) ou de succès (pour faire valoir les intérêts) de cette dernière dans un environnement politique structuré. Les idées sont constitutives des intérêts dans ce processus. L’intrusion institutionnelle renvoie à un processus mi-stratégique et mi-structurel par lequel les acteurs nationaux se font relativement imposer de nouvelles institutions ou politiques qu’ils n’acceptent qu’en raison de l’asymétrie de pouvoir, de la contrainte structurelle (structure), ou des gains escomptés (stratégies) des acteurs internationaux, alors que des solutions de rechange pertinentes et non contraignantes sont quasi inexistantes. By examining the postcolonial African strategies for economic development, and focusing on the evolution of the role of the State—the State as the central actor for development, the attempt to retrench the State, limited interventionism, the return of the State to the economic arena—the present thesis proposes an explanation of institutional change with a special focus on political and institutional innovations. In fact, behind the apparent continuity that most analytical and normative authors critique, there are innovations that the ideational, strategic, temporal and institutional variables allow us to demonstrate in a heuristic manner. This thesis thus proposes a new comparative analysis of the role of African public institutions (elites, States, public administration: Cameroon, Ivory Coast, Benin, Congo, Burkina Faso, Mali, Niger, Togo, Senegal), international institutions (the IMF, the World Bank, the UNO) and regional organizations (the African Union, the NEPAD) in the emergence and the trajectories of development strategies in Africa. The favorable temporal contexts, the crises of the preceding models, the structuring configurations and institutional heritage, the instrumental strategies of the interested actors, the political learning, the cognitive and normative dimensions of the ideas contribute to explaining the diffusion and institutional sedimentation and conversion as privileged processes of innovation in Africa. The critique of these concepts makes it possible to develop tools better adapted to explain institutional inclusion and intrusion. Institutional inclusion is a semi-strategic and semi-ideational process through which national or regional actors intentionally include (international) strategies (or solutions) that already exist in a new institution or policy with the aim of increasing the probability of acceptance (recognition, social suitability, real or perceived common values) or success (to ensure their interests) of their strategy within a structured political environment. The ideas are constitutive of the interests in this process. The institutional intrusion is a semi-strategic and semi-structural process by which national actors are partly forced to adopt new institutions or policies, and agree to do so only because of the asymmetry in power, the structural constraints (structure), or the potential benefits (strategies) of the international actors. In this context, relevant and non-constraining alternatives are quasi inexistent, but national actors still have (limited) room for negotiations. Inspired by specialist like Nicolas van de Walle, Kathleen Thelen, Robert Bates, Barry Weingast, Alexander Wendt, Peter Hall, Theda Skocpol, and Paul Pierson, the concepts of institutional intrusion and inclusion that we propose reconcile many approaches that many scholars considered contradictory. They successfully integrate strategic, structural, temporal and ideational variables to analyze the same scientific object. Empirically speaking, the present thesis explains the emergence of development strategies in Africa, as well as provides a better knowledge of the relationship between the international, regional and national actors in the process of emergence and development of institutions and public policies. From war economies to peace economies : the challenge of post-conflict reconstruction in Sierra Leone

The difficulty of transforming war economies into peace economies has become increasingly problematic in the search for long-term peace and stability in Africa. In many African countries such as Sierra Leone, Angola and the Democratic Republic of Congo, conflict actors have created distinct war economies in order to maintain the conflict in these countries. The enduring nature of the war economies presents a unique challenge to actors involved in ensuring that peace returns to a country by applying a peacebuilding strategy. The economic environment during a conflict has a vast influence on a post-conflict economy and a post-conflict reconstruction strategy. Although post-war rebuilding occurred during the reconstruction of Europe and Japan after the Second World War, the terms "post-conflict peacebuilding" and "post-conflict reconstruction" have only came to prominence during the mid-1990s. Using the case study of Sierra Leone, this study explores the challenge of war economies and its impact on post-conflict reconstruction. Sierra Leone presents an appealing case study as the country experienced a very profitable war economy during the armed conflict in the country between 1991 and 2002, and continues to struggle to transform this war economy into a peace economy. The case study of Sierra Leone is well researched, however, most studies focus on the conflict period, and only briefly look at the post-conflict period. In addition, discussions of post-conflict reconstruction in Sierra Leone have failed to adequately address the challenges presented by the war economy. This study uses existing analyses about the war economy in Sierra Leone, and links these to the current post-conflict reconstruction strategy, focusing specifically on the economic dimension. Good governance in the New Partnership for Africa’s Development (NEPAD): a public administration perspective

The object of this study is good governance, the context for its consideration is the New Partnership for Africa’s Development (NEPAD), and the disciplinary perspective from which it is considered is Public Administration. Good governance is a conceptual problematique. It is multi-dimensional, value-laden, trans-contextual and nebulous. The question of what good governance means is a subject of contestation. Good governance is used in NEPAD as a principle without the attempt to clarify its meaning at the conceptual level. Much of the existing body of scholarship on NEPAD also considers good governance largely as a principle rather than a concept. This erroneously presupposes unanimity on its meaning. The African leadership is divided on what good governance means in the context of NEPAD. In this regard scholarship largely fails to provide an intellectual solution. The extent of complexity of the concept in the study lies in the fact that the context of its consideration [NEPAD] is itself a subject of contestation whereas the disciplinary perspective [Public Administration] from which it is considered has not yet reached a consensus with itself about its theoretical base. Against this background the question that the study asks is, what does the concept good governance in the context of NEPAD mean for Public Administration? The study examines this question to make a contribution towards a better insight into, and broadening of, the body of scientific knowledge by engaging in conceptual, theoretical and philosophical studies to understand good governance in the context of NEPAD and determine its meaning for Public Administration. The study finds that the paradigm of engagement in the existing body of literature is framed in the binary logic, which is rooted in realist epistemology or positivism. This approach to scientific discourse is limited in dealing with complex conceptual, theoretical and philosophical questions. The study develops, as a contribution to science, an alternative epistemological framework from which good governance in the context of NEPAD could be understood. Such epistemological framework is, for the purpose of this study, termed the contingent co-existence of opposites.
