Could you imagine that face on that body? : A study of deepfakes and performers’ rights in EU law

The natural desire to express the human experience through song, dance, speech and movement have characterised culture and society throughout history. From frantic dances around fires, to comedies and dramas at the ancient theatres, to sold out arena concerts, all driven by the same fundamental spirit of creation and expression. The unification of intellectual creation and physical action that constitutes a performance were for a long time only a transient activity, but that all changed with the introduction of recording technology. To protect the economic and moral interests of performers, a new form of intellectual property right, known as performers right, was introduced. This new form of IP-right was based on a similar rationale as the one for copyright protection of artistic and literary works, and it allowed performing artists to exercise a certain degree of control over fixations of their work. The modern development of image manipulation has come to challenge the integrity of performers rights however. Deepfakes is a form of AI-assisted technology that has made the synthetic manipulation of images, sound and video possible in ways previously unseen, in terms of quality, quantity and accessibility. The manipulation of videos by changing faces or voices of individuals raises a number of questions in a variety of legal areas. In order to bring clarity to the relation between deepfakes and performers rights, the condition under which a deepfake can constitute an infringement, and a granter, of performers rights under EU law, was investigated in this thesis. By primarily relying on a legal dogmatic method to interpret and systematise the existing EU legislation, case law and international treaties in the field of intellectual property, the synthetic manipulations of recorded performances were studied in relation to the applicable law. It was concluded that deepfakes may infringe on the rights of performers if the manipulated content constituted a reproduction of a fixation of a performance. Furthermore, it was also established that a deepfake in itself can not constitute a source of performers rights, due to its synthetic nature

Canutt perfected methods and designed mechanisms that made dangerous stunts safer and visually exciting. Many of Canutt's techniques are still used today by modern stuntmen like Hal Needham, Ronnie Rondell, and Paul Baxley. Directed by stuntman Hal Needham and starring "box office draw" Burt Reynolds, Hooper presented the stuntman as a rugged, fun-loving, almost suicidal superman. For the first time in film's short history, the stuntman and his craft became a topic of wide public interest. The stuntman had become "glamorous" almost rivaling his actor counterpart.

My paper aims to value their talent management processes, and if there are gaps that could be filled and methods that could be developed.</p><p><strong>Metod: </strong>Qualitative method through six interviews and by doing a comparison between empirical findings and theory</p><p><strong>Resultat/slutsatser:</strong> talent management processes are very well developed in this business line in Company X, and in some areas they are even better than what literature suggests. They need to keep encouraging their personnel to take challenges and rotate. They also need to have a clear understanding of the roles in the organization, the responsibility of top recruitment and development. The areas that are in need of further development are leadership development, learning and training. Even if they have grasped the importance of these factors, they have some difficulties implementing right methods for reaching their targets. The Gladiators of the OMXSPI : What are the key drivers trailing the durable performance?

Background and problem: The impact on the stock market of macroeconomic factors have been analyzed in several earlier studies. These are forces constantly changing and thereby they contribute to changing the supply and demand of stocks. The fact that macroeconomic variables have affected the top performing stocks of the OMXSPI during 2004 – 2018, in terms of performance, plays an important part of the study. Different authors have recognized different factors to affect the stock price development and there has not yet been established an explanation of the determinants of stock prices. Purpose: The purpose of the study was to identify the stocks that continuously have had a development superior to the OMXSPI, and therefore have contributed the most to the development of the OMXSPI during 2004 – 2018. Moreover, the study analyzes the drivers that have contributed to the performance of these stocks. Furthermore, the study clarifies which factors that have contributed to the development of the P/E and the EV/EBITDA of the top performers. Methodology: The study followed a quantitative and deductive approach. The Swedish stock market was analyzed with a focus on the OMXSPI were the top performing stocks of this index were identified through a screening process. Moreover, the top performers were put against the OMXSPI in different time periods to compare the performance. Furthermore, multiples of these top performers and the sectors which they trade in were calculated in order to compare the multiples to each other, with the purpose of analyzing them relative to each other in different time periods. Conclusion: From the findings it could be established very similar patterns between the top performers and the OMXSPI. The difference mainly being that the top performers in every sequence experienced a superior development than the OMXSPI, but also greater declines during short sequences. Moreover, the tables displayed remarkable returns of the top performers and the aggregated top performers traded at premium levels in all analyzed time periods.

Long-term multiple stressors, coping and academic performance

This research comprised of three studies designed to investigate the coping strategies utilised by high and low performing university students with non-academic stressors. Coping research has frequently focused on single stressors providing a distorted picture of coping. Utilising a combination of quantitative and qualitative methodologies, this research provides new insights into the dynamic and multi-dimensional nature of coping with long-term, multiple stressors. It extends our understanding of coping beyond traditionally individualistic conceptualisations where active coping is valued over prosocial relationship-focused coping. Conceptualisations of social support is broadened to view it in more complex interactional terms. In Study 1, 521 university students were surveyed using a standardised coping inventory, the Ways of Coping Checklist revised. Several demographic groups were identified as at academic risk. Having good health, along with the high use Social Support and Problem Solving and the low use of Self Blame strategies all predicted high GPA. Study 2 involved a content analysis of 179 Exclusion Appeal letters submitted by excluded students. When confronted with multiple stressors, poor performing students compartmentalised or amplified multiple stressors which resulted in patterns of reactive problem-focused or emotion-focused coping. Passive and uni-directional approaches to social support resulted in the depletion of such resources. Study 3 investigated adaptive coping patterns using an open-ended questionnaire and a semi-structured interview with twenty high performing students. High performers viewed multiple stressors as inter-related, which is termed cross situational appraisal and displayed a versatile coping pattern across stressors termed cross situational versatility. Proactive and prosocial coping are critical for the acquisition and maintenance of social support over a long-term period. All forms of cultural interaction are expressive and creative. In particular, what the performing arts express is not always the conscious, the ideal and the rational, but more often the preconscious, pre-verbal, asocial and irrational, touching on darker undercurrents of human and extra-human interrelations, experiences, beliefs, fears, desires and values. So what is performance and how does it differ in cultures? A performance is a translation of an idea into a synaesthetic experience. In the context of this thesis, however, translation does not imply reductive literal translation as can be attempted by analogy in spoken or written descriptions and notation systems. The translation is one through which participating groups and individuals seek to understand the being in the world of the Other by means of mutual, embodied negotiation of meaning - sensually, experientially, perceptually, cognitively and emotionally - that is, by means of performance. Transnational migration of labor and skills: A case study of Mongolian circus performers

This study is about the Mongolian circus performers who work in Taiwan. Do their skills influence the outcome of their work conditions in Taiwan? This qualitative research carries out with interviews and participation observations. It explores Mongolian circus performers¡¦ working conditions, and the problems they face in different environments. The author has made several fieldwork trips to three places, and interviewed 17 performers. It contends that Mongolian circus performers are not in a disadvantaged industrial relations position due to, first, they are skilled labor; second, there is no clear rule regarding circus performers by Taiwan government; and third, the contract is clearly written about working contents, which makes the conflict less likely between migrant workers and employer.
