CoordenaÃÃo de AperfeÃoamento de Pessoal de NÃvel Superior / As lagostas espinhosas apresentam grande importÃncia nos desembarques nacionais de pescado e, sobretudo, no estado do CearÃ. Representadas pelas espÃcies Panulirus argus e Panulirus laevicauda, apresentam-se em estado de sobrepesca, o que torna necessÃria a reformulaÃÃo do sistema de gestÃo atual a fim de assegurar a sustentabilidade da pescaria. Foi feita uma anÃlise da gestÃo atual do recurso, bem como das consequÃncias da variaÃÃo da composiÃÃo das capturas por tamanho nas profundidades de 0-10 m (setor raso) e 30-50 m (setor intermediÃrio), a partir de amostragens a bordo e da anÃlise de coorte de Jones baseada em comprimentos. Verificou-se que nÃo hà divisÃo territorial para evitar aglomeraÃÃes do esforÃo de pesca em uma mesma regiÃo. As capturas sÃo realizadas com o uso de artes de
pesca (legais e ilegais) nÃo seletivas e embarcaÃÃes de diferentes portes, ocorrendo o constante descumprimento das medidas regulatÃrias de uso e acesso existentes. O sistema de
comercializaÃÃo nÃo beneficia o pescador, sendo parte do lucro destinada a um intermediÃrio. Na prÃtica, o acesso ao recurso à livre, originando um regime de acesso irrestrito, em que hà geraÃÃo de externalidades negativas e levando à sobre-explotaÃÃo do recurso. Constatou-se diferenÃa entre as distribuiÃÃes de comprimento nos setores amostrados, havendo maior ocorrÃncia de indivÃduos juvenis e prÃ-recrutas no setor raso (SR) e de indivÃduos maiores no setor intermediÃrio (SI). As curvas de seletividade revelam que no SR o valor do L50 à 12% menor que o tamanho mÃnimo legal, enquanto no SI, à maior. Verificou-se tambÃm que no SR
86% das capturas correspondem a indivÃduos jovens e prÃ-recrutas, enquanto no SI, essa porcentagem cai para 26%. As biomassas mÃdias (Bm) calculadas para o SR e o SI sÃo constituÃdas, respectivamente, em 98% e 55% por indivÃduos menores que o permitido. No SR, um aumento de 13% no valor do L50 faz com que atinja o tamanho mÃnimo legal, incrementando a biomassa em 79%. TambÃm um aumento de 21% no L50 o eleva ao tamanho mÃnimo Ãtimo (80 mm), havendo um incremento de 84% na biomassa. Como as populaÃÃes brasileiras de lagosta sÃo metapopulaÃÃes fechadas, um plano de gestÃo abrangente que inclua medidas para mitigar as externalidades negativas como a criaÃÃo de uma TAC (Captura Total PermissÃvel), tambÃm o aumento no tamanho mÃnimo de captura, aliado à eliminaÃÃo da sobrepesca de crescimento deve ser benÃfico para aumentar os estoques de lagosta, assim como para elevar as capturas em peso. / The spiny lobsters present a great importance in national fish landings, especially in Cearà state. Represented by the species Panulirus argus and Panulirus laevicauda, both pecies in a overfishing situation, it is necessary a recast of the current management system to ensure the sustainability of their fishery. An analysis of current resource management was taken and the consequences of the variation in composition of catches by length at depths of 0-10 m (shallow region) and 30-50 m (intermediary region), from on board sampling and Jonesâlength-based cohort analysis. It was found that there is no territorial division to avoid agglomeration of fishing effort in the same region. The catch has been taken using fishing gears (legal and illegal) non selective and vessels with different sizes, occurring constant noncompliance of use and access to regulatory measures. The marketing system does not benefit the fisherman, being part of the profit destined to a middleman. In practice, the access to the resource is open, originating a system of unrestricted access, in which there is negative externality generation and leading to over-exploitation of the resource. It was found a difference between the length distributions in the sampled regions, with higher occurrence of juveniles and pre-recruits in the shallow region (SR) and larger individuals in the intermediary region (IR). The selection curves reveal that in the SR the value of L50 is 12% smaller than the minimum legal size, while the IR is greater. It was also found that in the SR 86% of catches correspond to juveniles and pre-recruits, while in IR, this percentage decreases to 26%. The
mean biomasses (Bm) estimated to SR and IR are constituted in 98% and 55% by smaller individuals than permitted, respectively. In SR, an increase of 13% in the value of L50 makes it achieve the minimum legal size, increasing biomass by 79%. Also an increase of 21% in the L50 elevates the optimal minimum size (80 mm), with an increase of 84% in biomass. As Brazilian lobsterâs populations are closed metapopulations, a comprehensive management plan that includes measures to mitigate negative externalities such as the creation of a TAC (Total Allowable Catch), also the increase of the minimum catch size combined with the
elimination of growth overfishing should be beneficial to increase the stocks of lobster, as well as to increase the catch by weight.

The conservation of biodiversity inside and outside protected areasOldekop, Johan January 2011 (has links)
In recent decades there has been a push to try and include communities in natural resource conservation initiatives. This thesis uses a multidisciplinary approach and a series of case studies in the Ecuadorian Amazon to look at the role that common property regimes can have in conservation initiatives. Results show that community managed forests can have positive conservation outcomes. Local communities, however, will often integrate into local market economies creating significant tradeoffs between livelihoods, local management decisions and natural resource conservation. Nonetheless, resource scarcity can drive the evolution of local resource management institutions and communities have the potential to accurately monitor changes in natural resources. These results suggest that local communities have the potential to play an important role in conservation practices but that local economic incentives can affect the way in which communities manage their resources.

Matrimonial property regimes in Italian and Czech law Resumé This master thesis deals with matrimonial property regimes under the Italian Civil Code and the Czech Civil Code. This issue is significant not only from the perspective of spouses and their families, but also important for everybody who makes contract with a spouse. The purpose of this thesis is to analyse and compare Italian and Czech provisions related to marital property regimes and to point out similarities and differences between them. This thesis consists of an introduction, three parts that are further divided into chapters and a conclusion. The first part is an analysis of Italian provisions. It deals with the fundamental principles of the Italian legal system and matrimonial property regimes as codified in the Codice civile. First of all, it examines statutory community of property, marital assets (marital property, deferred community of property and liabilities), personal property and also deals with mandatory rules of the management of marital assets. Then it deals with contractual regimes, namely the separation of property, the property fund and other marital and prenuptial agreements. East African Hydropatriarchies : An analysis of changing waterscapes in smallholder irrigation farmingCaretta, Martina Angela January 2015 (has links)
This thesis examines the local waterscapes of two smallholder irrigation farming systems in the dry lands of East African in a context of socio-ecological changes. It focuses on three aspects: institutional arrangements, gender relations and landscape investments. This thesis is based on a reflexive analysis of cross-cultural, cross-language research, particularly focusing on the role of field assistants and interpreters, and on member checking as a method to ensure validity. Flexible irrigation infrastructure in Sibou, Kenya, and Engaruka, Tanzania, allow farmers to shift the course of water and to extend or reduce the area cultivated depending on seasonal rainfall patterns. Water conflicts are avoided through a decentralized common property management system. Water rights are continuously renegotiated depending on water supply. Water is seen as a common good the management of which is guided by mutual understanding to prevent conflicts through participation and shared information about water rights. However, participation in water management is a privilege that is endowed mostly to men. Strict patriarchal norms regulate control over water and practically exclude women from irrigation management. The control over water usage for productive means is a manifestation of masculinity. The same gender bias has emerged in recent decades as men have increased their engagement in agriculture by cultivating crops for sale. Women, because of their subordinated position, cannot take advantage of the recent livelihood diversification. Rather, the cultivation of horticultural products for sale has increased the workload for women who already farm most food crops for family consumption. In addition, they now have to weed and harvest the commercial crops that their husbands sell for profit. This agricultural gender divide is mirrored in men´s and women´s response to increased climate variability. Women intercrop as a risk adverting strategy, while men sow more rounds of crops for sale when the rain allows for it. Additionally, while discursively underestimated by men, women´s assistance is materially fundamental to maintaining of the irrigation infrastructure and to ensuring the soil fertility that makes the cultivation of crops for sale possible. In sum, this thesis highlights the adaptation potentials of contemporary smallholder irrigation systems through local common property regimes that, while not inclusive towards women, avoid conflicts generated by shifting water supply and increased climate variability. To be able to assess the success and viability of irrigation systems, research must be carried out at a local level. By studying how local water management works, how conflicts are adverted through common property regimes and how these systems adapt to socio-ecological changes, this thesis provides insights that are important both for the planning of current irrigation schemes and the rehabilitation or the extension of older systems. Although evidence continues to indicate an urgent need to transition food systems away
from industrialized monocultures and toward agroecological production, there is little
sign of significant policy commitment toward food system transformation in global North
geographies. The authors, a consortium of researchers studying the land-food nexus in
global North geographies, argue that a key lock-in explaining the lack of reform arises
from how most food system interventions work through dominant logics of property
to achieve their goals of agroecological production. Doing so fails to recognize how
land tenure systems, codified by law and performed by society, construct agricultural
land use outcomes. In this perspective, the authors argue that achieving food system
“resilience” requires urgent attention to the underlying property norms that drive land
access regimes, especially where norms of property appear hegemonic. This paper first
reviews research from political ecology, critical property law, and human geography to
show how entrenched property relations in the global North frustrate the advancement
of alternative models like food sovereignty and agroecology, and work to mediate
acceptable forms of “sustainable agriculture.” Drawing on emerging cases of land tenure
reform from the authors’ collective experience working in Scotland, France, Australia,
Canada, and Japan, we next observe how contesting dominant logics of property
creates space to forge deep and equitable food system transformation. Equally, these
cases demonstrate how powerful actors in the food system attempt to leverage legal
and cultural norms of property to legitimize their control over the resources that drive
agricultural production. Our formulation suggests that visions for food system “resilience”
must embrace the reform of property relations as much as it does diversified farming
practices. This work calls for a joint cultural and legal reimagination of our relation to land
in places where property functions as an epistemic and apex entitlement.

Previous issue date: 2012-05-22 / The property regime chosen to apply between spouses implies
several consequences in the administration of property and family
relations ships. This study is primarily designed to evaluate the elements
and conjecture economic, legal and social legislation that led to the
country to choose the regime of partial community property as statutory
or supplementary, applied to situations where the spouses do not realize
deed of prenuptial agreement with arrangements other than marriage set
to take effect.
The agreament of comparative law, in this narrow way, appears as
a necessary tool for understanding the legislative option. Reflections on
the historical evolution of the institute and the intense debates taking
place in the doctrine and case law after the enactment of Law 6515 of
December 26, 1977, also assist in the task of making more effective the
analysis desired.
The study of property regime is a tool to solve increasingly
intricate issues, raised by the continuous evolution of the world and

os elementos e conjecturas econômicas, jurídicas e sociais que levaram a

regime legal ou supletivo, aplicado às situações em que os nubentes não
realizam escritura de pacto antenupcial com regime diverso do
estabelecido para vigorar no casamento.
A abordagem de direito comparado, nesse caminho estreito,
aparece como ferramenta necessária para a compreensão da opção
legislativa. Reflexões acerca da evolução histórica do instituto e dos
intensos debates promovidos na doutrina e na jurisprudência após a
edição da Lei 6515, de 26 de dezembro de 1977, também auxiliam na
tarefa de tornar mais efetiva a análise pretendida.

A partir da observação da precariedade presente em atendimentos habitacionais com diferentes modalidades executadas pelo Poder Público, cuja população que recebeu os determinados programas habitacionais ainda está distante de alcançar melhorias significativas nas suas condições de vida, buscou-se a compreensão dos motivos pelos quais, mesmo após ter o problema habitacional resolvido ou melhorado, sua condição de vida, de modo geral, não apresenta salto de qualidade significativo ou não consegue se integrar à cidade formal. Ao longo do trabalho, discorre-se sobre a origem do problema habitacional no país, apresenta-se breve resumo de como o Poder Público atuou historicamente e se lança a discussão sobre as ações que podem se somar às atuais Políticas Públicas de Habitação, para que a precariedade possa ser minimizada no cotidiano das comunidades. Constatou-se que a precariedade está relacionada a diversos fatores como a descontinuidade da presença do Estado na área e também pela relação deficitária entre a população atendida e o Estado. Ademais, verificou-se que a dificuldade do acesso à terra e o alto valor da habitação formal sempre foi um fator de exclusão para a grande maioria da população. Porém, no sistema jurídico brasileiro atual já existem instrumentos legais suficientes para amenizar a exclusão, basta que seja efetivado seu uso e sejam propostas novas alternativas de propriedade. Para o alcance de melhorias na continuidade do atendimento habitacional de interesse social, uma série de diálogos entre todos os envolvidos precisa ser estimulada e desenvolvida, de forma que resulte em ações planejadas no intuito de diminuir as insuficiências identificadas na pesquisa. / From the observation of the precariousness presents in residential care, with different modalities implemented by the State, whose population that was supported by the housing programs is still far from achieving significant improvements in its living conditions, it was sought to understand the reasons why people, even after getting the housing problem solved or improved, their living conditions, in general, do not present significant breakthrough or are unable to be integrated into the formal city. Throughout the essay, the origin of the housing problem in the country is discussed, a brief abstract about how the State historically proceeded in this issue is presented and also the discussion about the actions that can support the current Public Housing Programs, so that the precariousness can be reduced in the daily life of the communities. It was verified that the precariousness is related by several factors: the absence of State\'s support in the area and also by the lack of a suitable relationship between the population and the State. In addition, it was verified that the difficulty of land access and the high cost of a usual housing have always been a factor of exclusion for the population\'s majority. However, in the Current Brazilian Legal System, there are sufficient legal instruments in order to settle the exclusion, it only needs to get its procedure effective and suggest new properties alternatives. To achieve improvements in the prosecution of social interest housing, a series of dialogues between all those involved participants have to be encouraged and developed, so that it results in planned actions to reduce the identified shortcomings in the research.

法定財產制,向來為夫妻財產制之重點制度,我國婚姻當事人多適用之。觀其內涵,可分作「非常法定財產制」和「通常法定財產制」,前者規定於民法第1010條,後者規定於民法親屬編第二章第四節第二款。然而,法定財產制的相關討論,多集中於特定條文,而不利制度全貌之還原,本論文遂揀選民法第1010條、第1018條之1、第1022條等非熱門規定,以期達到拋磚引玉之效果。惟須注意的是,儘管第1010條、第1018條之1、第1022條同為廣義法定財產制之規定,考量到我國民法親屬編將第1010條置於通則之結構,本論文仍以「夫妻財產制」為題,以免造成誤會。
本論文共分作六章,第一章將說明研究動機與目的、範圍與限制、方法與架構等基本設定。
第二章的部分,基於後續第1010條、第1018條之1、第1022條「條文解析」和「實務運作」之研究需要,此處將先介紹我國夫妻財產制和法定財產制,以建構基本背景。
第三章至第五章,分別為第1010條、第1018條之1、第1022條之專章。有鑑於1010條、第1018條之1、第1022條基礎討論甚少,本論文雖以實務狀況為主要觀察目標,在架構上,仍從根本的「條文解析」出發,復延伸至「實務運作」,從大量裁判中,探究人民與法院之狀況為何。
第六章結論,本論文將綜合研究結果,作一反思,期許能為法條未來發展,貢獻棉薄之力。
