Os sistemas eleitorais : limites e possibilidades de efetiva??o da soberania popular

No. of bitstreams: 1 474354 - Texto Parcial.pdf: 238914 bytes, checksum: edf3e6bfd95aff4882ce4536c317308c (MD5) Previous issue date: 2015-07-15 / The research henceforth presented was aimed to establish a scientific study on the Brazilian proportional electoral system, taking the principle of the popular sovereignty as its nuclear variable, supported over two premises, the limit and the possibility. The discussion itself is now new, but the approach is unpublished. Two bases have been thought to reach the conclusion, the first, the historical search of the meaning of Democracy, since the ancient times up until the implanted model in Brazil during its empire as well as republic regimes. The second basis was developed from a conception of political representation built in accordance with the principle of popular sovereignty as it is expressed in the Federal Constitution. A parallel was made with the German electoral system, mainly due to the perception of a kind of preference by the national researchers in relation to such system. Finally, we get to the core point the work, which is the critical study of the Brazilian proportional electoral system, on which a variety of aspects were found to stop it from carrying out the principle of popular sovereignty, making it dependent on a practical and theoretical rationalization so that it may reach the desired proportionality and, thus, giving effectiveness to its main goal, which is the political legitimacy in the present constitutional law ground. / O trabalho que se apresenta teve o objetivo de estabelecer um estudo cient?fico do sistema eleitoral proporcional brasileiro, tomando-se como vari?vel a realiza??o do princ?pio da soberania popular, a partir dos dois extremos, o limite e a possibilidade. A discuss?o em si n?o ? nova, mas a abordagem ? evidentemente in?dita. Dois alicerces foram forjados para a constru??o da conclus?o, o primeiro, a busca hist?rica do sentido de Democracia, desde a antiguidade at? o regime adotado pelo Brasil imperial e republicano. O segundo alicerce foi o desenvolvimento de uma concep??o de representatividade pol?tica que fosse consent?nea com o princ?pio da soberania popular tal como se encontra exposto na Constitui??o Federal. Um contraponto foi feito com o sistema eleitoral alem?o, principalmente pela constata??o de uma predile??o dos te?ricos nacionais em rela??o a esse sistema. Enfim, se chega ao ponto nuclear do trabalho, que ? o estudo cr?tico do sistema eleitoral proporcional brasileiro, sobre o qual se constatou um conjunto de aspectos que o impedem de realizar o princ?pio da soberania popular, tornando-o carente de uma racionaliza??o te?rica e pr?tica para que alcance a proporcionalidade e, assim, realize este objetivo primordial, que ? o de legitimar a representa??o pol?tica no arcabou?o constitucional vigente.

A literatura demonstra que essas institui??es est?o consolidadas para esse processo, contudo, ? necess?rio compreender a din?mica de funcionamento dos conselhos e sua rela??o com os ?rg?os gestores para analisar a qualidade da participa??o social e a sua influ?ncia no ?mbito do processo decis?rio e do exerc?cio do controle social. Assim, o objetivo deste trabalho, ? analisar a din?mica de funcionamento dos conselhos municipais de Natal e Parnamirim (RN), com base nos pressupostos das teorias da democracia participativa e deliberativa, apreendendo as categorias anal?ticas da participa??o, da representa??o pol?tica, da efetividade deliberativa e da accountability. A partir da pesquisa documental (leis de cria??o dos conselhos, regimentos internos, atas, resolu??es e relat?rios de gest?o), bem como da participa??o em reuni?es dos colegiados e das entrevistas com conselheiros e gestores, buscou-se empreender uma an?lise sobre como o compartilhamento do poder acontece nessas institui??es e como elas influenciam as respectivas gest?es municipais. Os resultados demonstram que a din?mica de funcionamento dos conselhos relaciona-se tanto ? abertura da gest?o ? participa??o social quanto ao protagonismo dos conselheiros em promover debates, apresentar demandas e exercer o controle social sobre as a??es e presta??es de contas dos gestores. Nesse sentido, ? poss?vel afirmar que as institui??es participativas atuam qualitativamente para a democratiza??o das pol?ticas p?blicas, mesmo que a correla??o de for?as desigual entre Estado e sociedade civil ainda esteja presente no processo decis?rio de alguma maneira nos casos analisados. / The Public Policy of Social Assistance established by the Federal Constitution of 1988 is a duty of the State and the right of the citizen and is carried out through a decentralized and participatory system, articulating the State and civil society in the decision-making process of management and in the inspection of actions and public resources. The managing councils institutionally assume the prerogative to materialize social participation for the democratization of public policies, and its existence is a legal condition for the transfer of federal resources in the scope of Social Assistance. The literature shows that these institutions are consolidated for this process, however, it is necessary to understand the dynamics of the functioning of the councils and their relationship with the management bodies to analyze the quality of social participation and its influence in the decision-making process and the exercise of Social control. The objective of this work is to analyze the dynamics of the municipal councils of Natal and Parnamirim (RN), based on the assumptions of theories of participatory and deliberative democracy, apprehending the analytical categories of participation, political representation, deliberative effectiveness and Accountability. Based on documentary research (council creation laws, internal regulations, minutes, resolutions and management reports), as well as participation in meetings of the collegiate and interviews with directors and managers, an attempt was made to analyze how sharing of power takes place in these institutions and how they influence the respective municipal administrations. The results demonstrate that the dynamics of functioning of the councils is related to the opening of management to social participation and to the role of directors in promoting debates, presenting demands and exercising social control over the actions and rendering of accounts of managers. In this sense, it is possible to affirm that participatory institutions act qualitatively for the democratization of public policies, even though the unequal correlation of forces between State and civil society is still present in the decision-making process in some way in the analyzed cases.

Situated in the field of study of the agrarian question, focuses on the role of agrarian elites in the drafting and revision of legal texts on environmental preservation and ownership of natural resources, pointing to the processes and relationships that permeates and dialectically structured the State . It assumes that private property is one of the structural elements of inequality between classes and, consequently, is instituted and instituting policies representations that make up the state in general, and especially Brazil. Addressing the process of formation of laws, while playing field, aims to understand the power relations between classes as has been legitimized in the Brazilian agrarian reality. For such analyzes the action of Agriculture of the Parliamentary Front (APF), also known as caucus, in the face of environmental and land legislation. More specifically rescues the Brazilian Forest Code (Decree n. 23,793 / 34 /, Law no. 4,771 / 65 and Law no. 12,651 / 12), with an emphasis on recent process 1965 Code reform, to identify as political representation ruralistas of interests is organized, clear and positions in political institutional process. This study identifies that, despite the economic dominance and privileged status in the social hierarchy represented by the power of large farmers in our society, rural employers classes and agroindustrial not give up take and act on institutional policy, be present in the democratic and interfere with its rules. Acting in state spheres and with civil society producing consensus and weaving alliances are complementary actions and integrate the building strategies of its hegemony. Thus the research has focused on the narratives and discourses of legislative documents relating to the Forest Code, the parliamentary speeches in the course of the Brazilian Forest Code reform bill of 1965 in the House of Representatives, as well as in street mobilizations - hearts and minds - promoted by the caucus in partnership with trade unions and non-unions of rural employer representation. It was possible that, through legal reform, the ruling classes in the field is expanding and diversifying its spaces, forms and political action strategies to legitimize their structural interests as the owner class that is the absolute right of private property and the monopoly on their instruments of economic, environmental and social regulation. / Esta tese de doutorado versa sobre as classes dominantes, a propriedade privada sobre a terra e a natureza e a representa??o pol?tica no Brasil republicano. Situada no campo de estudos da quest?o agr?ria, foca a atua??o das elites agr?rias no processo de elabora??o e revis?o dos textos legais sobre a preserva??o ambiental e a apropria??o dos recursos naturais, apontando para os processos e rela??es que permeia e, dialeticamente, estruturam o Estado. Parte do pressuposto que a propriedade privada ? um dos elementos estruturantes da desigualdade entre as classes e que, consequentemente, ? institu?da e instituinte das representa??es pol?ticas que comp?em o Estado em geral, e o brasileiro especialmente. Ao abordar o processo de forma??o das leis, enquanto campo de disputa, visa compreender as rela??es de poder entre as classes tal como vem sendo legitimadas na realidade agr?ria brasileira. Buscamos tamb?m compreender a partir das trajet?rias desses representantes, mobilizando o conceito de campos (Bourdieu, 1989,2002) como dinamizam, influenciam a organiza??o interna, de pautas e tomada de decis?es nos espa?os para representa??o (Colegiado e N?cleo Diretivo). A partir de observa??es participantes, como tamb?m de entrevistas semi-estruturadas com os agentes considerados centrais, podemos vislumbrar elementos que aproximam essas trajet?rias. Oriundos da Agricultura Familiar, os representantes centrais conseguem exercer o poder simb?lico (Bourdieu, 1989) nesse campo de debates e interesses, compartilham em suas trajet?rias pontos comuns como o tr?nsito entre movimentos sociais e organiza??es de assist?ncia t?cnica, processos que se reproduzem em um contexto de neglig?ncia das gest?es municipais e Estadual com esse debate, fator que condicionaria a reprodu??o de um ambiente de baixa participa??o social em torno da promo??o do desenvolvimento rural, logo das perspectivas trazidas pela abordagem territorial. / The rural development policy in Brazil has the territorial approach as a strategy and established a few years ago the creation of spaces for diverse social participation, called Council or territorial forums. These spaces should be attended by representatives of various segments of society that make up the political dynamics of the territories: civil society organizations (NGOs, trade unions, associations, unions, social movements, etc.) and public managers (municipal and state secretaries, local authorities and agencies federal as MDA). This work aims to analyze the relations between political representatives considered central in the debate and enforcement actions with territorial focus in Mato Grande / RN. Focus on the influence of their actions in the field conformed discussions from the institutionalized space of participation, the Territorial Council, established under the guidance of this strategy in 2005 as the body of management and social control of state actions. We also seek to understand from the trajectories of these representatives and mobilizing the concept of fields (Bourdieu, 1989.2002) as streamline, influence the internal organization, agendas and decision making in representation spaces (Council and Director Center). Building on participants made observations, as well as in semi-structured interviews with agents considered central, can be glimpsed elements that bring these trajectories. Originating Family Agriculture, the central representatives can exercise the symbolic power (Bourdieu, 1989) in the field of debates and interests and have common points in their trajectories as transit through social and service organizations movements. Processes that reproduce in a context of neglect of municipal administrations and state with this debate, a factor that would condition the reproduction of a low social participation environment surrounding the promotion of rural development, then the perspectives brought by the territorial approach.
