AposiÃÃes nÃo restritivas nominais em artigos de opiniÃo / Non-restrictive appositions in opinion articles

CoordenaÃÃo de AperfeÃoamento de Pessoal de NÃvel Superior / A presente dissertaÃÃo propÃe uma anÃlise das aposiÃÃes nÃo restritivas nominais em artigos de opiniÃo, utilizando o suporte teÃrico da GramÃtica Discursivo-Funcional, de Hengeveld e Mackenzie (2008). Rediscutimos a tipologia adotada por Nogueira (1999), mais especificamente em relaÃÃo à correspondÃncia entre funÃÃes textual-discursivas e relaÃÃes textual-semÃnticas no fenÃmeno da aposiÃÃo, visto que a unidade apositiva pode ter sua funcionalidade voltada para todo o discurso que a circunda. As construÃÃes apositivas nÃo restritivas nominais foram extraÃdas de artigos de opiniÃo disponÃveis no site das OlimpÃadas de LÃngua Portuguesa. Por conta da predominÃncia da sequÃncia argumentativa em tal gÃnero, lanÃamos como hipÃtese geral neste trabalho que a relaÃÃo textual-semÃntica mais frequente seria a de atribuiÃÃo, motivada por sua funÃÃo textual-discursiva de avaliaÃÃo. A anÃlise dos dados comprova parcialmente nossa hipÃtese: de fato, a avaliaÃÃo constitui a funÃÃo discursiva mais frequente nos textos, ao passo que a relaÃÃo semÃntica de equivalÃncia referencial foi predominante. ConcluÃmos que a avaliaÃÃo, nesse contexto, alÃm de estar a serviÃo da indicaÃÃo da atitude do falante em relaÃÃo ao que ele diz na primeira unidade apositiva, tambÃm està relacionada diretamente à tese que ele procura defender em todo seu texto, lanÃando mÃo de estratÃgias de referenciaÃÃo textual.

Facteurs de résolution des enquêtes de meurtres sexuels

Le but de notre étude était de déterminer des variables du modus operandi de meurtres sexuels prédisant la résolution de l’enquête policière. Notre échantillon incluait 265 homicides sexuels de femmes codifiés dans le ViCLAS. La comparaison entre des meurtres sexuels résolus (N=178) et des meurtres sexuels non résolus (N=87), devait également permettre d’identifier les différences entre les issues de l’enquête, les stratégies du meurtrier pour éviter l’appréhension ainsi que les facteurs prédisant la résolution. D’après l’analyse de régression logistique, les prédicteurs tels que l’utilisation d’une arme, l’utilisation d’un bandeau/bâillon et l’agression impliquant une introduction par effraction ou un vol augmentent les probabilités que l’agresseur soit appréhendé. Au contraire, lorsque l’agresseur emporte un objet et que la victime est piétinée, les chances de résoudre l’enquête diminuent. Ces variables du modus operandi traduisent un déficit des compétences criminelles du meurtrier qui peut le pousser à multiplier les erreurs. De manière générale notre étude nous apprend que le contact rapproché entre l’agresseur et la victime favorise la dispersion d’indices propices à la résolution de l’enquête. Le nombre de ces indices est décuplé lorsqu’il y a pénétration vaginale ou anale et lorsque la victime est battue ou mordue. En outre, des contraintes intrinsèques à l’utilisation de stratégies d’évitement expliquent le fait que ces moyens, entravant l’avancée de l’enquête, ne sont que rarement exploités. Enfin, la faible proportion d’actes sexuels et violents observés dans ce genre de crime entrave le processus de résolution. Il en va de même pour l’impact limité des bases de données et de la spécialisation du meurtrier sexuel. / The aim of our study was to determine the characteristics of the modus operandi involved in sexual murder predicting clearance of police investigation. Our sample involved 265 sexual murders of women codified in the ViCLAS. The comparison between solved sexual murders (N = 178) and unsolved sexual murders (N = 87), should also help to identify the differences between issues of the investigation, the killer strategies to avoid detection and the factors predicting clearance. According to logistic regression analysis, murders involving use of a weapon, use of a blindfold/gag and aggression involving home intrusion or robbery are more likely to be cleared. On the opposite, when the murderer takes an object from the crime scene or when victim is stomped, the clearance rate decreases. These variables reflect a lack of criminal skills which can drive the murderer to make more mistakes. In general, our study reveals that close contact between the aggressor and the victim favors the dispersion of proofs facilitating the work of investigators. Such proofs are more likely to be spread when there is vaginal or anal penetration. The same process is involved when the victim is beaten or bitten. Moreover, most of the sexual murders are not able to clean the crime scene to avoid apprehension because of limited criminal skills. Finally, the low proportion of sexual and violence acts hinders the process of resolution. The same thing is observed concerning the limited impact of databases and specialization of sexual murderer.

L'appréhension des pratiques restrictives par les autorités françaises et européennes de la concurrence / The apprehension of restrictive practices by French and European competition authorities

Définies comme des pratiques contractuelles abusives dans les rapports entre professionnels, les pratiques restrictives amoindrissent considérablement la capacité concurrentielle du partenaire commercial. Le droit de la concurrence et plus particulièrement, le droit des pratiques anticoncurrentielles peut constituer une voie de droit permettant la répression de ces comportements. L’étude menée permet de s’interroger sur l’efficacité de l’entente et des abus de domination, entendus comme concepts d’accueil, afin de lutter contre les pratiques restrictives. Alors même que les abus de domination présentent des points de convergence importants avec la notion de «pratique restrictive », l’appréhension est profondément nuancée. Les exigences textuelles inhérentes à la démonstration de l’abus de position dominante (102 TFUE et art. L.420-2, al. 1er du Code de commerce) sont drastiques et l’appréciation de l’abus de dépendance économique en droit français (art. L.420-2, al. 2 du Code de commerce) est si étroite qu’elle ne permet pas de faciliter la captation positive des pratiques restrictives. En outre, la preuve de la restriction de concurrence est difficile à rapporter en présence de comportements qui atteignent, le plus souvent, le simple partenaire contractuel et non le marché entendu dans sa globalité. Paradoxalement, si l’entente apparaît comme un concept peu ressemblant dans ses composantes à la notion de «pratique restrictive », l’appréhension y est privilégiée. Afin de faciliter la mutation de la pratique en comportement concerté, les autorités de concurrence procèdent à une lecture généreuse du critère de la concertation. La restriction de concurrence fait également l’objet d’une appréciation compréhensive. Que l’appréhension soit opérée au titre de l’entente ou des abus de domination, des pistes de réflexion sont proposées afin de perfectionner le traitement concurrentiel des pratiques restrictives. / Defined as unfair contractual practices in relations between professionals, restrictive practices significantly undermine the competitiveness of the trading partner. Competition law and, more specifically, antitrust law can be a remedy to the suppression of these behaviours. The study raises questions about the effectiveness of the cartel and abuse of dominance in the fight against restrictive practices. The analysis tends to gauge their understanding through the prism of the two concepts that are cartels and abuse of dominance. Even as abuse of dominance have important points of convergence with the concept of “restrictive practice”, apprehension is deeply nuanced. Textual requirements inherent in the demonstration of the abuse of dominant position (102 TFUE andart. L.420-2, al. 1 of the Commercial Code) are drastic and appreciation of the abuse of economic dependence in French law (art. L.420-2, al. 2 of the Commercial Code) is so narrow that it does not facilitate the positive uptake of restrictive practices. In addition, evidence of the competition restriction is difficult to bring in conduct that reach, in most cases, the mere contractual partner and not the market heard in its entirety. Paradoxically, if the cartels appears to be a bit like concept in its components to the concept of “restrictive practice ", apprehension is preferred. To facilitate the transfer of practice concerted behaviour, competition authorities proceed to a generous reading of the meeting of minds. Competition restriction is also the subject of a comprehensive appreciation. That apprehension is made under the cartel or abuse of dominant position, actionable insights are proposed to improve the competitive treatment of restrictive practices.

Early-onset restrictive eating disturbances in primary school boys and girls

Background. This study sought to determine the distribution of early-onset restrictive eating disturbances characteristic of the new DSM-5 diagnosis, avoidant/restrictive food intake disorder (ARFID) in middle childhood, as well as to evaluate the screening instrument, Eating Disturbances in Youth-Questionnaire (EDY-Q). Methods. A total of 1444 8- to 13-year-old children were screened in regular schools (3rd to 6th grade) in Switzerland using the self-report measure EDY-Q, consisting of 12 items based on the DSM-5 criteria for ARFID. Results. Forty-six children (3.2%) reported features of ARFID in the self-rating. Group differences were found for body mass index, with underweight children reporting features of ARFID more often than normal- and overweight children. The EDY-Q revealed good psychometric properties, including adequate discriminant and convergent validity. Conclusions. Early-onset restrictive eating disturbances are commonly reported in middle childhood. Because of possible negative short- and long-term impact, early detection is essential. Further studies with structured interviews and parent reports are needed to confirm this study’s findings.

Legal limits of the cross-border movement of military materials The global trade with military materials is an important, however often under- researched, area of academic enquiry. Such attitude is not correct, because in fact it is a massive global industry in which also Czech companies play a significant role. Given the newspaper headlines and statements of arms dealer, it is obvious there have long been unsolved problems burdening arms dealers caused especially by an inappropriate legal framework. This theses aims to provide an analysis of legal framework in respect to cross-border movement of military materials covering especially European and Czech legislation focusing on its potential limits arising and important for arms dealers. On a global international level the Arms Trade Treaty and other relevant treaties regulating international trade with military materials are identified and described. Attention is also paid to limitations of arms trade such as embargoes or restrictive measures imposed by the UN and the EU respectively as well as to limitations resulting from domestic and European legislation or from its different interpretation. Systemic Inequities in the Policy and Practice of Educating Secondary Bilingual Learners and their Teachers: a Critical Race Theory Analysis

Thesis advisor: Marilyn Cochran-Smith / In 2002, voters in Massachusetts passed a referendum, commonly referred to as "Question 2," requiring that, "All children in Massachusetts public schools shall be taught English by being taught in English and all children shall be placed in English language classrooms" (M.G.L.c.71A§4). This dissertation investigates the system of education for secondary bilingual learners and their teachers resulting from the passage of Question 2 by examining assumptions and ideologies about race, culture, and language across policy and practice. Drawing on critical race theory (CRT) and the construct of majoritarian stories, two distinct and complimentary analyses were conducted: a critical policy analysis of state level laws, regulations, and policy tools, and a critically conscious longitudinal case study of one teacher candidate who was prepared to work with bilingual learners and then taught bilingual learners during her first three years of teaching. The critical policy analysis, conducted as a frame analysis, exposes that legally sanctioned racism and linguicism are institutionalized and codified through Massachusetts state policy. Additionally, Massachusetts state policy consistently and strongly promotes four common majoritarian stories regarding the education of secondary bilingual learners and their teachers: there is no story about race, difference is deficit, meritocracy is appropriate, and English is all that matters. The longitudinal case study demonstrates the power of these majoritarian stories in classroom practice and how they limit the opportunities of bilingual learners and their teachers while also perpetuating institutionalized racism and linguicism. Taken together, the two analyses that make up this dissertation reveal a problematic system deeply affected by majoritarian stories that obscure the role white privilege and white normativity play in perpetuating issues of inequity for secondary bilingual learners and teachers. An Analysis of Due Process Hearings Involving Students with Significant Disabilities in Their Least Restrictive Environment

This research analyzed all available hearings from 2013 to 2015 in a national database of due process hearings regarding placement issues and determinations of the least restrictive environment for individual students with significant disabilities. The main research question was whether parents/guardians and due process hearing officers sought placements for these children with significant disabilities that considered creatively and holistically a range of options rather than just a dialogue between already extant possible programmatic offerings. The research resulted in a description and taxonomy of the types of issues and factors arising in the hearings for students with significant disabilities from 2013 to 2015. This research shows almost no evidence of creative or holistic thinking in these due process decisions, and there was little evidence of parent advocacy for general education classes and creative options for their students with significant disabilities beyond existing offerings. The most unique placements to be found in public school settings for these students were in general education classes. Twenty-four students in this analysis were offered general education classes with their typically achieving peers. In general, though, for this unique group of students with significant disabilities, very few due process hearings could be found to have demonstrated creativity, or the consideration of holistic options, for such students. In general, in due process hearings for students with significant disabilities from 2013 to 2015, parents were overwhelming advocating for, and due process hearing officers were deciding among, options on the continuum of placements already traditionally considered for students with significant disabilities.

A Modified Obesity Proneness Model in the Prediction of Weight Status Among High School Students

The health and well-being of U.S. children is challenged by the immense crisis of obesity. The obesity proneness model, first described by Costanzo and Woody (1985), describes one mechanism by which parents influence obesity development. This model suggests that parents become concerned about their children's weight if their children show signs of becoming overweight and parents value weight highly. Parents communicate their concerns to their children and restrict their children's eating. Children internalize parents' concerns and become unable to regulate their eating. Hence, parents socialize children to be concerned about their weight but do not equip them to regulate eating, thus contributing to the development of obesity. Previous research has examined model components, primarily from parents' perspectives. This study examined the model from the adolescents' perspectives and employed structural equation modeling to test and refine a modified model and determine the best predictors of obesity among adolescents. The study was non-experimental in design, employing a secondary analysis of cross-sectional data collected as part of a modified Youth Risk Behavior Survey (YRBS) administered in Sarasota County, Florida, high schools during fall 2006. Models were tested and modified in a training sample, Sample A (N = 784); final models were cross-validated in a hold-out sample, Sample B (N = 749). Findings suggested that a refined model was plausible (χ²/df = 331.97/64, TLI = 0.94, RMSEA = 0.07; χ²/df = 226/64, TLI = 0.95, RMSEA = 0.06, Samples A and B, respectively). Many paths were statistically significant; e.g., students who perceived mothers to be concerned about their weight were likely to think mothers perceived them as heavier, valued weight highly, had restrictive feeding practices, and made comments about their weight. Students with greater internalized concern about weight were likely to think mothers made comments about their weight and were heavier. Girls were more likely than boys to think mothers were concerned about their weight. Internalized concern about weight, but not inability to self-regulate eating, was predictive of weight status. Interventions addressing some of the model's constructs may provide a partial solution to problems of weight and inability to self-regulate eating behaviors.

Scripting the Right to be Canadian: Immigrant Experiences, Policies, and Practices in Southern Ontario

The ways that categories of immigration are drawn and standards of successful citizenship are measured in Canadian society influence the ways that people script themselves to appear as worthy immigrant applicants and potential Canadian citizens. For immigrant hopefuls, scripting oneself using the language of immigration and positioning oneself as a deserving and desirable immigrant is crucial for gaining mobility and passage into Canadian society. In my thesis, I explore the literature surrounding processes and concepts like borders, mobility, good citizenship, the ???white standard???, and racialization that serve as foundations and outcomes of scripting ???good??? immigrants and ???successful??? citizenship. I embed the experiences of my informants within an analysis of this literature as well as the processes of immigration outlined by Citizenship and Immigration Canada (CIC). I find that scripting immigrant categories and citizenship can result in immigrants enacting only a limited Canadianness. Immigrant categories involve restrictive policies that can result in exploitation. I also offer that immigrants may live a double-consciousness through their transnationalism and constituting of ???back home???. The larger hope for this project is to provide an understanding of the processes of scripting that work to make exclusive the right to be Canadian so that the vulnerability and suffering caused by the existence of hierarchies of citizenship can be tackled as a public issue and make for a more inclusive and equitable Canada.
