<p>Sammanfattning</p><p>Vi har gjort en kritisk diskursanalys av AC:s (Adoptionscentrum) medlemstidning under perioderna; 1975-1985, 1986-1996, 1997-2006. Frågeställningen lyder: Hur konstitueras diskursen om ”det goda adoptivföräldraskapet” genom AC:s medlemstidning? Vilka är möjlighetsvillkoren och vilka konsekvenser innebär diskursen? Vårt syfte har varit att förstå diskursen om ”det goda adoptivföräldraskapet”. Vi har utgått ifrån socialkonstruktioniskt, poststrukturalistiskt perspektiv och språkfilosofi.</p><p>Vårt huvudsakliga resultat har visat sig vara att AC konstituerar diskurser som producerar och reproducerar ett antal normativa föreställningar om föräldraskap, familj och individer som bygger på socialt konstruerade föreställningar om vad som är en ”riktig” familj, bra föräldraegenskaper och barnets bästa. Diskursen ”det goda adoptivföräldraskapet” uppnås genom aktivt medlemskap i adoptionsorganisationen AC. Begreppet ”barnets bästa” har visat sig vara en flytande signifikant för att konstituera olika diskurser som alla handlar om att etablera eller upprätthålla AC som organisation. Genom barnets bästa har AC fått möjlighet att legitimera sina egna verksamhetsområden, styra över vem som är lämplig förälder, vem som får bilda familj och vika barn som är tillgängliga för adoption. Ytterligare resultat har visat på att AC under perioden fått ökad makt genom att förmedlingen av adoptivbarn har övergått till adoptivorganisationerna. Således har statens makt och inflytande fördelats över ytterligare en instans.</p> / <p>Abstract</p><p>This essay is a critical discourse analysis on AC’s (Adoption Centre Organisation, Sweden) magazine for members during three periods; 1975-1985, 1986-1996, 1997-2006. Our main question is how discursive statements are made on “the good adoptive parenthood” in this magazine? What possible changeable meanings and truths are given by the discourses? Our aim is to understand the discourse “the good adoptive parenthood”. The theoretical framework consists of knowledge of social constructivism, post structural perspective and philosophy of language.</p><p>Our main results are that AC constitutes discourses that produce and reproduce a number of assumptions about parenthood, family and individuals as normative and influenced by social constructed assumptions about what is; a “real” family, a good parenthood or “the child’s best interest”. The discourse of “the good adoptive parenthood” is gained through membership in the adoption organisation AC. The claim of “the child’s best interest” has in this essay being found as a fluent significant to constitute a variety of discourses, which all aim to establish and maintain the organisation. Through the principle of “the child’s best interest”, AC has found a way to legitimate their own fields, to decide who is a suitable parent, who shall form a family, and which child will be available for adoption. Further result shows that AC during the studied period has gained increased legal and governmental power in the field of adoption. As a result, the governmental power and influence in the adoption field has been divided through additional authorities.</p>

”Att sätta barnen före sig själv”? : En argumentationsanalys på Tingsrättens avgöranden i mål om vårdnad / “To put the children first”? : An argumentation analysis of the District Court’srulings in matters of child custody

The aim of this study was to examine the District Court´s argumentations about the children´s best interests in rulings regarding custody of children, and to analyse the argumentation from a gender perspective. Rulings from the District Court from 2012 have been the basis for this study and a qualitative method has been used, argumentations analysis. The study shows that cooperative problems between the parents are the main reason why the District Court finds joint custody to be excluded. There are also argumentation regarding parent´s ability to ensure the children’s safety. The presumption of joint custody is known to be emphatic in Swedish law and in those cases the District Court finds it in the best interest of the child for the joint custody to remain, the parents still have problems cooperating but not sufficiently to repeal the importance of both parents in the child´s life. In the rulings leading up to both joint and sole custody conceptions of female and male attributes can be found, and differences regarding what´s considered good and bad attributes. The study shows differences in how we expect women and men to be parents. Conceptions of class- and ethnicity however, are rarer. The analysis also shows views of parenthood as being gender complementary, where the father´s presence is seen as a complement to the mother´s main caring responsibility. Finally, the study shows a guiding from the District Court to the fathers about getting them more involved in their children´s life, and of the importance of the Social Services Custody Report regarding the verdict.

En kvalitativ studie om barns delaktighet i socialtjänstens utredningar gällande vårdnad, boende och umgänge / A qualitative study of children’s participation in assessing custody, residence, and access

Syftet med studien har varit att undersöka hur barnets åsikter kommer till uttryck i familjerättens utredningar gällande vårdnad, boende och umgänge och på vilket sätt barnet görs delaktigt. Studiens empiri bestod av tolv vårdnadsutredningar som ingick som aktbilagor från domstolsbeslut från en större tingsrätt under mitten av 2020. Materialet undersöktes utifrån en kvalitativ innehållsmetod. Analysen av empirin gjordes med hjälp av Harts (1992) delaktighetsstege kombinerat med ett barndomssociologiskt perspektiv. Studien visar att barn oftast är delaktiga i en ganska låg nivå utifrån Harts (1992) delaktighetsstege. Barn begränsas av att delaktigheten sker genom vuxna på olika sätt eller att barn själva kan välja att inte vara delaktiga och därmed visa aktörskap. Studien visar också att vuxna spelar en stor roll för att möjliggöra för barn att vara delaktiga. Det är de vuxna som beslutar om delaktighet. Vidare visar studien att familjerättsutredaren i många fall går efter barnets vilja, antingen att det har framkommit i samtal med barnet eller att barnets åsikt har framkommit på annat sätt. / The aim of the study was to investigate how the child's views are expressed in family court investigations concerning custody, residence, and access. The empirical material of the study consisted of twelve custody investigations included as case files from court decisions from a major district court in mid-2020. The material was examined using a qualitative content method. The analysis of the empirical data was conducted using Hart's (1992) participation ladder combined with a childhood sociology perspective. The study shows that children are usually involved at a rather low level according to Hart's (1992) participation ladder. Children are limited by the fact that participation is done by adults in different ways or that children themselves can choose not to participate and thus show agency. The study also shows that adults play a major role in enabling children to be involved. It is the adults who decide on participation. Furthermore, the study shows that in many cases the family court mediator follows the child's wishes, either expressed in discussions with the child or the child's opinion expressed in other ways.

"Man får det att funka" : Ansvarsfördelning av barn vid en separation

Studiens syfte är att finna en förståelse kring vilka sociala faktorer som producerar ett normativt beteende gällande ansvarsfördelningen runt barnen efter en separation. Undersökningen grundar sig därför i följande frågeställningar: Hur ser normen kring ansvarsfördelningen av ett barn ut efter en separation och hur upplevs denna ansvarsfördelning. Studien bygger på en kvalitativ metod som i sin utformning skall generera en större förståelse för våra frågeställningar. Vi har gjort fyra enskilda interjuver med två separerade par som har delad vårdnad över sina barn. Vår teoretiska utgångspunkt utgår ifrån socialkonstruktivismen.Den behandlar och beskriver hur kvinnliga och manliga beteende mönstren reproducerasvid interaktion individer emellan. Även teorin som förklara männens dominans i dagens samhälle (patriarkatet)samt den könade arbetsfördelningen inom den privata och offentliga sfären (liberala feministiska perspektiv) finns att ta del av. Vi har funnitett dialektisktförhållande mellan traditionella könsmönster, reproducering utav dessa, den könade arbetsfördelningen samt relationen mellan barn och deras föräldrar innan separationär faktorer som påverkar normen kring hur ansvarsfördelningen av ett barn efter en separation ser ut och upplevs. / The aim of this study is to determine which social factors create the dominating pattern in the delegation of responsibility of a child after a separation. The study is therefore based on the following enquiry: What is the norm during separation concerning the delegation of responsibility for a child between parents and how is this division of responsibility perceived.  This study is based on a qualitative method through which a greater understanding of these enquiries will be met. We have done four separate interviews with two sets of already separated partners who havejoined custody over their children. Our theory is based on social constructivism and discusses how current female, respective male behavioural patterns are reproduced between individuals. In addition, the theory which explains male dominance in present society (patriarchate) together with gender based division of labour within private and public spheres (the liberal feministic perspective) are both presented. We have discovered a dialectical relationship between traditional gender roles, theirreproduction ofthese,the gender based division of labour and even the relationship between children and their parents are all factors that contribute towards the determination of assigning responsibility of a child during separation and how it is perceived.

<p>The purpose of this study has been to investigate how socialworkers describe their attitudes towards reporting childabuse to the police and if they make different decisions when they believe the violence to be honour related and how they handle these questions. The main questions are; How does socialworkers describe their and their colleagues attitudes towards reporting childabuse to the police and when do they believe they should report? Do they describe honourviolence as a specific kind of violence that should be lifted and in what way does it affect their work? The study is written from a legal sociologist perspective with a qualitative approach. Four socialworkers were interviewed and the interviews were analyzed with an anti-racist theory and with the theory about freedom of action.</p><p>The conclusions is that the socialworkers mostly report childabuse to the police when the violence is physical. This means that children who describes to be subjected to psychological violence, including honourviolence, has poor legal security. Socialworkers describes honourviolence as a specific kind of violence that has to be lifted. Without knowledge they wont be able to help. They feel limited by the legislation and have invented <em>creative solutions</em> that focuses on the child’s best interest.</p>
