A reluctant response to vagrancy : the evolution of Poor Law casual relief in England and Wales, 1834-1919

From 1837 the Poor Law Commission sanctioned temporary relief, at workhouses, for poor wayfarers, heralding a departure from historic attempts to control the wandering poor with criminal vagrancy legislation. A modern, detailed account is lacking, and the thesis addresses gaps in the historiography, such as the significant underestimation of women using the system, the influence of penal separation upon casual relief, and the changing attributes of recipient The origins of casual relief are traced to local initiatives, c.1800-1830, adopted, subsequently, in the reformed Poor Law system. The assumption, by administrators, that the justice system would retain the mandate for the suppression of vagrancy, was never eradicated, partly because criminal legislation remained in force, alongside casual relief. The deterrent principle of the New Poor Law was applied in casual wards, characterized by an absence of rehabilitative elements. The reluctance of Poor Law officials to engage fully with vagrant relief was reflected in repeated attempts to transfer responsibility to the police. Contemporary views are examined to ascertain whether Poor Law vagrancy policy was based upon rational assessment, or was the product of myth and prejudice. Ignoring evidence that the majority of casual relief users were in search of employment, and that others were rendered destitute by age or ill health, officials insisted upon the intrinsic deviancy of recipients. The traditional belief in the ‘undeserving’ poor was undiminished. Phases in casual relief are identified, summarized as a gradual transition from primitive provision (‘stables and straw’) to purpose-built cells. However, notwithstanding the strengthening of central regulation, from 1871, uniform implementation of policy was never achieved. Casual relief remained a protean experience for applicants in this period. Inasmuch as most itinerant poor avoided the wards, New Poor Law deterrence succeeded; as a measure to control vagrancy, it failed.

Este trabalho trata das formas de controle e uso dos vadios e da percepção da vadiagem como um mal social na capitania de São Paulo no século XVIII. O trabalho é realizado através da análise dos Documentos interessantes para a história e costumes de São Paulo, das Atas da Câmara da Cidade de São Paulo e da Lei de Polícia, que abordam a administração do governador e capitão-general Dom Luís Antônio de Sousa Botelho Mourão, conhecido como Morgado de Mateus, durante o período de 1765 a 1775. Esta dissertação de mestrado analisa as medidas executadas pelo governador, instruído pelos preceitos do Conde de Oeiras, futuro Marquês de Pombal, que visavam fomentar a economia através da lavoura mercantil e organizar a defesa militar utilizando a mão de obra dos vadios. Todas essas medidas foram inseridas na restaurada capitania de São Paulo a partir ano de 1765, depois de submetida ao governador de Santos, sem patente de capitão-general, e sob o mando militar do Rio de Janeiro. A pesquisa tem como proposta seguir novos trabalhos da historiografia brasileira a respeito de São Paulo no século XVIII, afastando a imagem corrente de que a capitania de São Paulo teria sido uma capitania extremamente atrasada, pobre, vazia, sem fé, lei ou Rei, inserindo a perspectiva de Ilana Blaj, que demonstra como foi realizado o processo de mercantilizarão da capitania no século XVII, assim como as de Caio Prado Jr. (Formação do Brasil contemporâneo), Sérgio Buarque de Holanda (Caminhos e fronteiras e Monções) e historiadores como Maria Luiza Marcílio e Heloísa Liberalli Bellotto, que inserem na discussão os diferentes modos pelos quais o governo atuou no processo de civilização dos moradores da capitania. Outro elemento da pesquisa é a investigação sobre os homens livres pobres no Setecentos, os quais buscavam espaço para sobreviver em seus respectivos cotidianos. Men on the road: beggars and vagrants in early modern drama (William Shakespeare, John Fletcher, and Richard Brome)

This dissertation examines beggars, gypsies, rogues, and vagrants presented in early modern English drama, with the discussion of how these peripatetic characters represent the discourses of vagrancy of the period. The first chapter introduces Tudor and early Stuart governments' legislation and proclamations on vagabondage and discusses these governmental policies in their social and economic contexts. The chapter also deals with the literature of roguery to point out that the literature (especially in the Elizabethan era) disseminated such a negative image of beggars as impostors and established the antagonistic atmosphere against the wandering poor. The second chapter explores the anti-theatrical aspect of the discourses of vagrancy. Along with the discussion of early playing companies' traveling convention, this chapter investigates how the long-held association of players with beggars is addressed in the plays that are dated from the early 1570s to the closing of the playhouses in 1642. In the third chapter I read Shakespeare's King Lear with the focus on its critical allusions to the discourses of vagrancy and interpret King Lear's symbolic experience of vagrancy in that context. The chapter demonstrates that King Lear represents the spatial politics embedded in the discourses of vagrancy and evokes a sympathetic understanding of the wandering poor. Chapter IV focuses on Beggars' Bush and analyzes the beggars' utopian community in the play. By juxtaposing the play with a variety of documents relating to the vagrancy issue in the early seventeen century, I contend that Beggars' Bush reflects the cultural aspirations for colonial enterprises in the early Stuart age. Chapter V examines John Taylor's conceptualization of vagrancy as a trope of travel and free mobility, and discusses the "wanderlust" represented in A Jovial Crew: Merry Beggars as an exemplary anecdote showing the mid seventeenth century's perceptions on vagrancy and spatial mobility. Thus, by exploring diverse associations and investments regarding vagrants, this study demonstrates that the early modern discourses of vagrancy have been informed and inflected by shifting economic, socio-historical, and national interests and demands.

A criação dessa colônia tinha duas funções principais: o combate à ociosidade dos mais pobres e a reforma das prisões. Em Minas Gerais, seguindo a mesma tendência, criou-se a Colônia Correcional Agrícola do Bom Destino (1895). Obviamente, essa instituição teve influências do projeto que lhe deu origem; todavia, ela possuiu traços bem específicos quanto a sua formulação e sua construção, e analisar esses traços constitui justamente o objetivo da presente dissertação. A mudança da Capital e a construção de uma nova cidade que pudesse integrar o fragmentado território de Minas Gerais, assim como os projetos de imigração e a credibilidade dada ao imigrante no combate ao atraso material e moral proporcionado pelo trabalhador nacional, em um contexto de certa autonomia dos estados perante o federalismo republicano, fizeram com que a reforma penal mineira tomasse contornos que a distinguia na repressão/correção feita aos vadios. Dessa maneira, a presente dissertação busca analisar as ideias penais em torno das instituições prisionais durante o período republicano e, para isso, utilizará as mensagens dos governantes de Minas Gerais e Anais da Assembleia para entendermos o posicionamento da elite mineira no combate à vadiagem. No que se refere à Colônia, utilizaremos os registros de matrícula, gastos e funcionários, assim como os relatórios apresentados por seu diretor. As legislações vigentes, entre elas o Código Penal (1890) e Constituição (1891), também auxiliarão nessa investida. / The “Colônia Correcional Dois Rios”, the first in Brazil, was founded in 1894, with the aim of correcting, using the work, vagrants and vagabonds who were found in Rio de Janeiro. The creation of this colony had two main functions: the fight against idleness of the poorest and prison reform. In Minas Gerais, following the same trend, he created the “Colônia Correcional Agrícola do Bom Destino” (1895). Obviously, this institution had influences of the project that gave rise to it; however, it had very specific traits as its design and construction, and analyze these traits is precisely the objective of this dissertation. As regards to Colônia Bom Destino, we will use the registration records, expenses and staff, as well as reports submitted by its director. The existing laws, including the Penal Code (1890) and the Constitution (1891), will also help in this investee.

Vårt fredliga samhälle : ”Lösdriveri” och försvarslöshet i Sverige under 1830-talet

Between 1664 and 1885 labour in Sweden was regulated by compulsory-service statutes. Able-bodied but idle persons could be compelled to submit to em­ployment as a servant. Compulsory service was part of a larger system of laws and regulations that regulated mobility, settlement, begging, and poor relief, all of which aimed at restricting the labouring poor’s freedom and agency. Some parts of this system had medieval roots, such as vagrancy laws. From the per­spective of the propertied classes, this system of interacting regulations served several purposes, such as fighting idleness, labour shortage, high wages, begging, demands for poor relief, unwanted settlement in the parishes, and geographical movement. The obligation to serve was abolished in 1885. Failure to comply with these service statutes was punishable by being treated as a ‘vagrant’, which could mean being jailed in a house of correction, or simply being ordered to find employment within a specific time. In short, it was illegal to be without work or other means of supporting oneself, such as property. The purpose of this thesis is to analyse the social practices of the compulsory-service statutes and related issues such as mobility and settlement. The thesis has dealt with four areas of inquiry: the judicial framework, the policing of ‘vagrancy’, in what situations people were exempt from having to comply with the compulsory service statues, and the identity of the ‘vagrant’. The system for dealing with ‘vagrancy’ has left a large number of sources, and different sources give different images of the poor. This applies most clearly in the case of the Swedish Romani population, the Resande.  The thesis deals with the county (län) of Västmanland during the 1830s. It highlights how the compulsory-service statutes and related vagrancy laws shaped the lives of people and points to how these institutions restricted poor people’s agency and formed their experiences.
