A presente tese se propõe a avaliar os avanços e recuos do denominado Regime Internacional para Atrocidades (RIA), focando-se sobremaneira no seu principal desdobramento normativo e institucional: o Tribunal Penal Internacional (TPI). Tais avanços e recuos não podem ser analisados somente a partir de qualificações políticas pragmáticas ou de princípios morais cosmopolitas reconhecidos pelo Tribunal, mas sim a partir da existência de um conflito de valores exposto na construção e consolidação do regime em questão: justiça versus paz, bem como da necessidade de superá-lo. É esse conflito entre a justiça internacional, interpretada de modo cosmopolita, e também pelo viés restrito do paradigma jurídico de enforcement dos direitos humanos, e a paz, interpretada como a ausência de conflito direto, bem como a consequente necessidade de arbitrá-lo, que nos permitirá fazer recomendações sobre o que se deve fazer para implementar um RIA realmente efetivo no sentido de livrar a humanidade das violações de direitos humanos que se qualificam como atrocidades, considerando as particularidades de contextos transicionais e ampliando a prestação de contas. A estratégia recomendada pela tese é a da combinação de uma justiça judicializada, que se traduz no TPI, com outros mecanismos de justiça transicional. Ademais, uma atuação do TPI sensível às vítimas e às atividades de peacebuilding é parte fundamental dessa estratégia. Os casos sob a investigação do TPI serão trazidos à tona na presente tese no sentido de ilustrar alguns aspectos do argumento principal nela estruturado. / This thesis aims to evaluate advances and shortcomings concerning the so-called International Atrocities Regime (IAR), focusing on its main normative and institutional achievement: the International Criminal Court (ICC). Such advances and shortcomings cannot be analised either exclusively through pragmatic political qualifications or through cosmopolitan moral principles embraced by the Court. Instead, we initially sustain the existence of a conflict of values apparent in the building up and consolidation of the above mentioned regime: the justice versus peace dilemma and the necessity of overcoming it. It is this dilemma between international justice, interpreted according to both a cosmopolitan perspective and a judicial paradigm of human rights enforcement, and peace, interpreted as the absence of direct conflict, and simultaneously the urgent need of managing this conflitct of value that will allow us to make some normative recommendations about what is to be done in order to implemente an effective IAR. By effectiveness, we mean both the prevention of humanity from suffering gross human rights violations qualified as atrocities, considering the particularities involved in transitional contexts, and the promotion of accountability. The strategy recommended by the thesis is the combination of a judicialized justice, translated into ICC practices, with other transitional justice mechanisms. In addition, an ICC performance sensible to victims and peacebuilding activities is a fundamental aspect of such a strategy. In this sense, the cases under ICC investigation will be mobilized in order to illustrate some aspects of the main argument structured in the thesis.

Previous issue date: 2014-11-14 / O presente trabalho, intitulado “Proposta de Reorganização dos Procedimentos Administrativos na Superintendência de Pessoal da Secretaria de Estado de Educação de Minas Gerais”, foi desenvolvido no Mestrado Profissional em Gestão e Avaliação da Educação Pública da Universidade Federal de Juiz de Fora (UFJF). A pesquisa teve como objetivo analisar como se dá o relacionamento institucional entre a Superintendência de Pessoal (SPS) – Órgão Central da Secretaria de Estado de Educação (SEE/MG) e as 47 Superintendências Regionais de Ensino (SREs) localizadas na capital mineira e em 44 municípios do interior do Estado de Minas Gerais, assim como propor medidas para a reorganização dos procedimentos administrativos da SPS-Assessoria visando a dotar este e as SREs de instrumentos capazes de conferir a organização das rotinas dos procedimentos de trabalho, nas atividades por eles desempenhadas. No trabalho, foi descrito o caso de gestão referente à repartição pública analisada, ou seja, a SPS-Assessoria, relacionando a sua realidade e o seu “modo de fazer” com as proposições de documentos oficiais no que tange à delegação de competências dos órgãos/setores da SEE/MG, bem como foi avaliado em que medida as atividades desenvolvidas na SPS-Assessoria influenciam as atividades desempenhadas pelas SREs no que tange à gestão de pessoal. Destaca-se no trabalho a proposta de um Plano de Intervenção que compreende a produção de orientações para o gerenciamento do setor pesquisado em que são propostas ações que facilitem a organização do setor e a capacitação de seus membros e dos setores de seus relacionamentos, quais sejam as SREs. Todas as ações foram apresentadas tendo como foco a atuação do gestor, em particular a dos seus colaboradores como protagonistas do processo, visando a agregar qualidade nas atividades por eles desempenhadas. / This paper entitled "Proposal for Reorganization of the Administrative Procedures at Human Resources Superintendence of the Department of Education of Brazilian state of Minas Gerais” was developed for the Professional Master Program in Management and Assessment of Public Education of Federal University of Juiz de Fora (UFJF), Brazil. The research aimed to analyze how works the institutional relationship between the Human Resources Superintendence (SPS) - central organ of the Brazilian State Department of Education (SEE/MG) - with the forty seven Regional Offices of Education (SREs), located in the capital and 44 municipalities in the Brazilian state of Minas Gerais, as well as to propose actions to reorganize the administrative procedures of SPS-Consultancy endowing these SREs with instruments to organize the routine of the work procedures, in activities performed by them. At work, it was described the management case related to the public department analyzed, i.e., the SPS-Consultancy by relating their reality and methodology with the propositions of official documents regarding the delegation of powers of the bodies/sectors of SEE/MG, as well as it was assessed in which extent the activities in the SPS-Advisory have influence on the activities performed by SREs in regard to personnel management. Work stands out in the proposal of an Intervention Plan that includes the production of guidelines for managing of the analyzed department where actions are proposed to favor both the organization of the sector and the training of its members and its related sectors, namely the SREs. All actions were presented focusing on the role of the manager, particularly of its collaborators as protagonists of the process, in order to add quality in the activities performed by them.

Impacto do loco HLA-DPB1* em pacientes consanguíneos submetidos a transplantes de células tronco hematopoiéticas / Impact of HLA-DPB1* loco in consanguineous patients submitted hematopoietic stem cell transplantationJordana Braga 21 May 2014 (has links)
O requisito fundamental na seleção do par doador-receptor em Transplantes de Medula Óssea (TMO) é regido pelo sistema do Complexo Principal de Histocompatibilidade, ou seja, pelos mecanismos imunológicos mediados pelas moléculas dos Antígenos Leucocitários Humanos (HLA). No entanto as incompatibilidades HLA, podem influenciar de forma negativa ou positiva os resultados dos transplantes, através da Doença do Enxerto versus Hospedeiro e o efeito do enxerto versus Leucemia (EvL) respectivamente. Ainda é desconhecido o impacto do locus HLA-DPB1* neste contexto. Assim o presente projeto tem como objetivo a avaliação do impacto do HLA-DPB1* em transplantes de pacientes consanguíneos e a ocorrência de DECH. Para a tal finalidade, tipificamos o locus em questão utilizando a metodologia PCR-SSO, onde após a reação de amplificação da cadeia pela polimerase, realizamos a hibridização com uma sequência específica de oligonucleotídeos para tipificação do Loco HLA-DPB1*. Foram analisadas 826 amostras, sendo 413 pares de receptores e seus respectivos doadores familiares, submetidos a Transplantes de Células Tronco Hematopoiéticas, realizados na Unidade de Transplante de Medula Óssea de Curitiba da Universidade Federal do Paraná e da Faculdade de Medicina de Ribeirão Preto- USP. Observou-se que a presença de incompatibilidades HLA-DPB1* aumentam a chance dos receptores desenvolverem a doença do enxerto versus hospedeiro aguda, em graus mais graves. Assim, concluímos que a avaliação deste loco pode prevenir esta doença, e caso não haja outro doador, alerta o clínico quanto à utilização de medidas profiláticas. / The key requirement in the selection of the receptor-donor pair for bone marrow transplant is is defined by the Major Histocompatibility Complex, or by immunologic mechanisms mediated by molecules of the Human Leukocyte Antigens (HLA). However the post transplant complications due to HLA mismatches, as Graft versus Host Disease (GVHD) and graft failure are fundamental to the success of these transplants. Still unknown is the impact of loci HLA DPB1*, so this project aims to assess the impact of HLA - DPB1* in transplant patients consanguineous and assessing the impact of incompatibilities in HLA - DPB1 * GVHD. For this purpose, analyzed the loco in question using the PCR-SSO method, where after the amplification reaction polymerase chain, we performed hybridization with a sequence -specific primers for typing of HLA - DPB1* Loco. We analyzed 826 samples, 413 pairs of recipients and their respective donors, patients undergoing Hematopoietic Stem Cell Transplants performed in the Unit for Bone Marrow Transplantation in Curitiba, Federal University of Paraná and the Faculty of Medicine of Ribeirão Preto - USP. It was observed that the presence of mismatches HLA- DPB1* increase the chance of recipients develop chronic graft versus host disease, in more severe degrees. Thus, we conclude that the evaluation of this loci can prevent this disease and if no other donors alert the clinician to the use of prophylactic measures.

Le présent travail s’intéresse à la nature et aux effets de l’intégration d’une logique de marketing dans les organisations du secteur des arts et de la culture. La recherche conduite ambitionne d’actualiser et de prolonger les connaissances acquises concernant le « conflit » artistes versus managers exposé par Chiapello (1998) tout en l’orientant vers le conflit artistes versus marketers. Inscrit dans une démarche compréhensive, ce travail s’appuie sur la méthode des cas. Une étude qualitative exploratoire constituée de 17 entretiens précède la réalisation de 5 études de cas, menées auprès de la Bibliothèque nationale de France (BnF), la Bibliothèque publique d’information (Bpi), le Musée national d’art moderne du Centre Pompidou (MNAM), le Musée des beaux-arts de Montréal (MBAM) et la Bibliothèque et Archives nationales du Québec (BAnQ). La mise en œuvre des études de cas se fonde sur des périodes d’immersion significatives au sein des institutions mentionnées ; durant ces périodes des entretiens semi-directifs et observations ont été collectés et analysés. Par ailleurs, cette recherche a permis de réaliser une analyse comparative France-Canada. Outre le constat sur l’actualité du conflit établi, la thèse propose des pistes à l’écriture d’une intégration efficace du marketing dans les organisations culturelles. / This work examines the nature and effects of integrating marketing logic into arts and culture organizations. The research aims to update and extend the knowledge acquired about the “conflict” between artists and managers exposed by Chiapello (1998) while orienting it towards the conflict between artists and marketers. As part of a comprehensive approach, this work is based on the case method. A qualitative exploratory study consisting of 17 interviews precedes the realization of 5 case studies, conducted at the Bibliothèque nationale de France (BnF), the Bibliothèque publique d’information (Bpi), the Musée national d’art moderne Centre Pompidou (MNAM), the Musée des beaux-arts de Montréal (MBAM) and the Bibliothèque et Archives nationales du Québec (BAnQ). In my work I deal with the place of pilgrimage of the Virgin Mary on the Holy Mountain in Příbram in the interwar period. In the newly established Republic of Czechoslovakia, tense relations between Church and State has prevailed. Even iconoclastic acts are documented from that time. My assumption is that the Holy Mountain functioned as a place that helped to bring together believers, unite Catholics, and restore the faith. A catholic group called Matice Svatohorská was founded to focus on repairing extensive grounds and spreading the awareness of the Holy Mountain and the cult of the Virgin Mary through a published journal. Through an analysis of this journal I want to capture the resources that Catholic leaders used in consolidating and expanding the Catholic Faith in Bohemia. Graft-versus-host disease (GvHD) remains one of the major complications following allogeneic haematopoietic stem cell transplantation (allo-HSCT). GvHD can occur in almost every tissue, with the skin, liver, and intestines being the mainly affected organs. T cells are implicated in initiating GvHD. T cells identify a broad range of antigens and mediate the immune response through receptors on their surfaces (T cell receptors, TCRs). The composition of TCRs within a T cell population defines the TCR repertoire of an individual, and this repertoire represents exposure to self and non-self proteins. Monitoring the changes in the TCR repertoire using TCR sequencing can provide an indication of the dynamics of a T cell population. Monitoring the frequency and specificities of specific TCR clonotypes longitudinally in different conditions and specimens (peripheral blood, GvHD-affected tissue samples) can provide insights into factors modulating immune reactions following allogeneic transplantation and will help to understand the underlying mechanisms mediating GvHD. This review provides insights into current studies of the TCR repertoire in GvHD and potential future clinical implications of TCR sequencing.

An Experimental Investigation of the Effects of Contract Frame and Discretion in Performance Evaluation on EffortEwing, Robert 01 January 2016 (has links)
The design of incentive compensation plans is critical to a company’s success. This study develops and validates a theoretical model to examine how incentive contract framing affects effort. This study uses an experiment to observe the effect of the manipulation of incentive contract frame and the presence or absence of principal discretion in performance evaluation on effort. The results of the experiment show that when principal discretion in performance evaluation is absent, penalty contracts induce greater effort than bonus contracts. The results of the experiment also demonstrate that the interaction of principal discretion in performance evaluation and contract frame influences how agents view the perceived fairness of their incentive contract. Specifically, principal discretion in performance evaluation increases perceived fairness under a penalty contract but not under a bonus contract. This study also extends prior research by documenting that perceived fairness explains how incentive contract frame affects trust and effort.

Sjukhus, militären, brandkåren, polisen, krisorganisationer och bergsklättringsexpeditioner är organisationer som dagligen möter extrema situationer. Genom att dessa organisationer arbetar under förhållanden med hög osäkerhet och snabba beslutsfattanden, där besluten kan få förödande konsekvenser, står de inför unika utmaningar. Temporära organisationer skapas för att utföra en specifik uppgift, i organisationer inom extrema kontexter kan detta, till exempel vara en utryckning inom brandkåren eller en operation inom ett sjukhus. Även om dessa organisationer är flexibla krävs det ändå mycket ansträngning av ledaren. För att undersöka temporära organisationer inom extrema kontexter har bergsklättringsexpeditioner studerats eftersom de delar samma egenskaper, tid, uppgift, grupp och resurser. Inom organisationer är det ledaren som bär det övergripande ansvaret vilket inneburit att vi undersökt vad som händer med ledarskapet, när majoriteten av gruppen är oerfarna, då de befinner sig inom en extrem kontext. Eftersom ledarnas beslut kan vara livsavgörande i organisationer inom extrema kontexter har motiv undersökts som kan vara bakomliggande faktorer till besluten. Motiv är allt vad en individ bryr sig om, vidare kan dessa antingen vara egoistiskt eller altruistiskt influerade. En ledare med egoistiskt influerade motiv kan bedriva ett direktivt ledarskap om ledaren vill föra igenom sina egna motiv. När livet står på spel blir beslutsfattandet mycket viktigt. “Hur påverkar ledares motiv beslutsfattandet vid uppkomsten av en extrem situation inom en temporär organisation?” Denna studie analyserar och diskuterar ledares motiv och vilken betydelse motiven kan ha i beslutsfattanden vid uppkomsten av en extrem situation. Studiens ansats går i enhet med den gyllene medelvägen som innebär att vi går från teori till empiri och tillbaka till teorin. Det empiriska materialet samlades in genom halvstrukturerade intervjuer med fem ledare och två klienter inom bergsklättring. Genom det empiriska materialet har vi tolkat hur dessa respondenter tolkar sin verklighet, vilket går i enlighet med det hermeneutiska synsättet. Slutsatserna som dras är att ledare som har egoistiskt influerade motiv kan vara bra om ledaren även har inslag av altruistiska motiv. Däremot om ledaren endast har inslag av egoistiska motiv kan detta skapa problem, om ledaren till exempel skulle lämna gruppen utan vägledning. Dock argumenterar vi för att det inte heller är bra om ledare endast har inslag av altruistiska motiv, eftersom att de då tar hänsyn till allas åsikter. Vid uppkomsten av en extrem situation kan det bli problematiskt om de inte kommer fram till ett beslut i tid, eftersom de väljer att ta hänsyn till allas åsikter innan beslutet fattas, förödelsen kan då vara ett faktum.

Equity in rural water resource development and management : A case study of Kilombero Valley, Tanzania, and the investments delivered by a participatory and demand-driven NGOFlodin, Charlotte January 2015 (has links)
The demand-driven and participatory approach to water resource development and management in Tanzania has been both praised and criticized; some see progress where others see increased inequalities. This study focuses on one progressive, demand-driven NGO which has a participatory approach to water resource development and management. This NGO, MSABI, is active in Kilombero Valley in southern Tanzania, and can be considered successful as it manages to keep 91 % of its water points functional, whilst the national average for pump functionality is just above 50 %. To study the performance of MSABI from a user perspective, it was decided that two sites in Kilombero Valley should be investigated in terms of users’ views on water access and quality. The identification of sites is based on population density and landcover change, so that the issues of scale and urban bias, as well as changes in the landscape affecting hydrological processes, are accounted for. In total, 29 interviews were conducted (October to November 2014), 15 at the Ifakara study site, the more densely populated location, and 14 at the Mchombe Ward study site. The interviews were semi-structured, using a participatory approach, focusing on users’ perspectives on water sources and the access to and quality of those water sources in dry and rainy seasons. The information gathered was used to construct definitions for water access and quality. These definitions, as well as the two locations and categorization of participants according to socio-economic status, were then used to sort and analyse the collected material. The results show that MSABI does not manage to make water accessible in an equitable way because of its demand-driven and participatory approach to water resource development and management. However, MSABI offers the only improved water source at the Mchombe Ward study site, except for one improved open well. MSABI manages to counter urban-bias better than any of the other water resource development and management facilitators encountered at the two study sites. The seasons influence water access, especially at the more peripheral locations, where improved water sources are less common and, as open water sources, are more prone to drought and contamination. When participants in Ifakara seasonally migrate for farming, during 4-5 months per year, the majority’s access to improved water sources is lost. At the distant seasonal fields, open water sources are more common and few report that they treat the unsafe water. The migration to peripheral farmlands coincides with the rainy season, causing open water sources to have their lowest water quality when seasonal migrants utilize them. This underlines the importance of securing safe water supply for people at remote locations, and the important role MSABI plays as water resource developer at those locations. In conclusion, if the current demand-driven and participatory approach to water resource development and management is to be retained, regardless of the heavy criticism it has received with regards to equity, this study suggests that the practices of MSABI should be spread further based on MSABI’s ability to increase safe water access at remote locations. Another recommendation is to further look into the effects of seasonal migration on access to safe water. The effect seasonal migration has on water access in Kilombero could exist in other areas in Tanzania or in other countries. The aspect of seasonal migration might show that water access statistics are misleading, as the seasonal water consumption in remote locations risks being omitted in official statistics.
