This paper focuses on the methodology of identifying incidents of covenant violations using both programming codes and manual searches. We dedicate to minimize the time in hand-collecting while pursue high hitting rates of true covenant violations in SEC EDGAR (Electronic Data Gathering, Analysis, and Retrieval) database. Our findings provide a way to access the U.S. firms’ public financial statements reported to SEC and extends the list of companies provided by Nini, Smith and Sufi (2012).

In the present work the vacuum polarization and the circular dichroism of hydrogen-like atoms are studied. We derive equations for the Fourier transforma- tion of the vacuum expectation value of the charge density. We use it to derive Uehling potential and calculate energy shifts caused by it. Then we discuss effects of vacuum polarization in higher orders of α. In second part we define circular dichroism and we express it in terms of reduced matrix elements. Then we derive the formula for parity vilating potential which is generated by weak interaction and together with other results we use it to find the expression for circular dichro- ism in terms of hydrogen radial functions. 1

The aim of this thesis is to present a systematic overview of the legal instruments that the Labour Code provides to employers against employees who breach their duties. It is the societal interest that the obligations have been followed, and so it is in the labour process. By each breach of working obligations undesirable loss may arise to employers, notwithstanding on a possible overall decrease in the labor moral on the workplace. The Labour Code does not contain a definition of violations of duties, therefore a large role in its evaluation plays a judicial practice. Therefore much of this thesis is based on case-law. The thesis consists of four chapters, which are further divided into subchapters and parts. The first chapter describes the various sources from which duties of employees during the working process can occur - legislation, contracts, internal regulations of employer and instructions of the employer or the employer's senior staff. The second chapter deals with the obligations of employees that are required to comply with. At first, attention is paid to the obligations that apply to all employees without exception, then further there are discussed specific responsibilities of senior employees and employees who provide state administration and self-government. The Possibility of Norm-Violation in Deontic Logics for Action Types : An Analysis of Bentzen's Action Type Deontic Logic and a New Semantics

In a recent paper, Bentzen proposes a semantically characterised logic called Action Type Deontic Logic, where normative concepts are applied to action expressions, rather than propositional statements. The logic offers solutions to many of the paradoxes of deontic logic. In particular, Bentzen's semantics solves many puzzles involving the interaction of permission with conjunction and disjunction. One of the reasons for these positive results is the assumption that agents always act according to norm. This assumption means that only agents with ideal behaviour are modelled; there is no possibility for norm-violation. In this thesis, proof techniques and decision procedures for Action Type Deontic Logic in the style of semantic tableau are investigated, and soundness, completeness and termination results are obtained. In order to account for the possibility of norm-violation, a new semantics based on a generalisation of Action Type Deontic Logic models is proposed. The new semantics keeps the possibility of norm-violation open, while many of the virtues of Action Type Deontic Logic remain.

The main thrust and impetus of my art has been to explore the subjective way people interpret visual language and how that interpretation can be manipulated and undermined. By undoing these associations I hope to reveal the tentative nature of meaning.

The focus of the study is equal treatment and equality work in preschool where the aim of the study was to increase knowledge about what experiences and knowledge there are among the preschool´s educators based on two different preschool manager´s areas. It is a qualitative study where the method has been to interview six individual educators, from five different preschools in two different principal areas in a municipality in central Sweden. The result shows that equality work is carried out at all the participating preschools, by existing equal treatment plans. The results also show how the knowledge about the equal treatment work of the interviewees is varied. All the interviewed teachers are aware of that the work has to be done by law, but the deeper understanding of its meaning in the practical work was variable. The results of the study also show how equal treatment work is a continuous work in which all of the profession should be included. It also appears that it is important with locally adapted plans, for them to be used and be seen as a supportive tool for the educators in the practical work. An important point to lift from the study's conclusion is how the educators' knowledge of equal treatment is important for reporting abusive treatment by violation reports, as otherwise this can be avoided due to uncertainty and thereby creating a problem for the equal treatment work.

Os signos do paradoxo e da contradicção são intrínsecos ao poema Invenção de Orfeu (1952) de Jorge de Lima (1893-1953), desde sua intermitente teorização sobre o ato criativo, situado entre o engenhoso e o místico, entre o órfico e o sirênico, entre natura naturata e natura naturans, até a inconstante modulação dessa teoria pela crítica, que chega a convergir, não obstante as polêmicas, na consideração da obra como um difícil volume de altos e baixos, em sentido estritamente qualitativo. Esta tese intenta demonstrar como, em seu inteiro teor, a Invenção de Orfeu está calcada em uma manipulação soberana e mesmo tirana das formas, que redesenha a ars inveniendi barroca a fim de expor a errância e a violação que habitam o interior da Técnica. Dito no sentido teológico latente à Suma Poética limiana, ela demonstra como a essência corruptível que se atribui apenas à matéria, seja ela a linguagem, o sujeito ou a História, emana, desde o início, da própria Forma. Propõe-se aqui uma arqueologia dos três estratos de significado da Invenção de Orfeu, o metalinguístico, o autobiográfico e o histórico, assim como um modo de compreender a patente dialética entre o épico e o lírico através de sua síntese dramática, na trama das vozes actantes que configuram os subpoemas ou no drama sexual e antropofágico que se desenrola entre Musa, rapsodo e Guias (ou comparsas). Tem ainda importância central neste trabalho o conjunto epigráfico da Invenção, que funciona como um mapa estratégico-composicional, articulando em si o dilema da traição e da continuidade entre a literatura sagrada e a profana. O capítulo I coloca em pauta a obra marginal do autor e as epígrafes bíblicas; e analisa as intersecções entre camadas de significado, matrizes e gêneros. O capítulo II detém-se sobre a epígrafe de Guillaume Apollinaire e percorre as relações entre parábola e estranhamento, entre incesto e palimpsesto, desde Ancila Negra até o engenheiro noturno. E o capítulo III enfoca o conturbado trânsito da questão indígena na obra de Jorge de Lima, até sua inflexão final. Em Apêndice, organiza-se material de arquivo, sobretudo poemas segregados do compósito. / Signs of paradox and contradiction are intrinsic to the Invention of Orpheus (1952), Jorge de Limas (1893-1953) major poem, firstly because its theoretical conception of the creative act as a tension between the witty and the mystical, the orphical and the sirenical, natura naturata and natura naturans; secondly based on the inconstant reception by critics, who in spite of their different positions, agree in considering the poem as a difficult and irregular ensemble in terms of its aesthetical quality. This thesis argues that the Invention of Orpheus, in its whole, is grounded on a sovereign and even tyrannical manipulation of forms, reworking the baroque ars inveniendi in order to expose how astrayness and violation inhabits the core of Technique. In terms that are consistent with the theological dimension proper to de Limas Summa Poetica, it demonstrates how the corruptible essence, generally associated only to material, be it the language, the subject or the History, ultimately derives from the Form itself, since the beginning. This thesis presents an archaeology that considers three levels of meaning in Invention of Orpheus, the metalinguistic, the autobiographical and the historical, as well as a mode of understanding the dialectic of the epical and the lyrical through its dramatic synthesis, as in the acting voices that give form to subpoems, or in the sexual and anthropophagic drama between the Muse, the raphsode and the guides (or accomplices). The epigraphic ensemble of Invention is considered crucial to this study, functioning as a strategical and compositional map that articulates in itself the dilemma of betrayal and continuity between sacred and profane literature. The first chapter discusses de Limas marginal works and the biblical epigraphs, analyzing the intersections between levels of meaning, matrices and genres. Chapter II focuses on an epigraph by Guillaume Apollinaire, and analyses the relation between parable and enstrangement, between incest and palimpsest, from Ancila Negra (Black Servant/Support) to the nocturnal engineer. Chapter III focuses on the problematic development of the indigenous conflict in Jorge de Limas work. The Appendix organizes archive materials, especially poems excluded from the composite.

Grave violation has been considered a crime in Brazil since 1851, thus, besides the material loss, there is also a symbolic offense. This phenomenon has been poorly studied by both psychology and other areas of science. The aim of this study was to learn about the construction of meaning attributed by the relatives facing grave violation. This is a multiple case study involving five residents of the metropolitan area in São Paulo, who went through semi-structured interviews and construction of genogram in order to map the members of the family buried in the graves. The data collected was assessed individually using thematic analysis technique and later discussed with integrated approach. In each case studied, particular issues were addressed, such as: grave as a material possession; violence in the cemetery space; emotional impact caused by grave violation; cemetery ambiguous role; loss of funeral customs; death taboo; grave as a place of affection and memories, banalisation of violation as a crime; appreciation of family tradition; grave as a place of memory and respect; cemetery as an irrelevant place; importance of the relationship during the life. This way, the links established, added to the cultural, religious and family aspects, have influence in the meaning conveyed to the grave and, consequently, in the relationship established with it. It was possible to identify that the time gap between the grave violation and the participation in the interview was not significant / Cuidar do destino dos mortos é algo próprio do ser humano, sendo o túmulo um monumento de memória adotado por muitas famílias, por diversas gerações. A violação de túmulo é considerada crime no Brasil desde 1851, sendo que, para além do prejuízo material, há também um ataque ao simbólico. Trata-se de um fenômeno pouco estudado pela psicologia e por outras áreas das ciências. O objetivo deste trabalho foi conhecer a construção de significado do familiar diante da violação de túmulo. Trata-se de um estudo de caso múltiplo com cinco moradores da região metropolitana de São Paulo, tendo sido realizadas entrevistas semiestruturadas e construção de genograma a fim de mapear os familiares sepultados no túmulo. Os dados coletados foram avaliados individualmente a partir da técnica de análise temática e posteriormente discutidos de maneira integrada. Em cada estudo de caso foram encontrados temas particulares, como: túmulo como bem material; violência no espaço cemiterial; impacto emocional da violação do túmulo; função ambígua do cemitério; perda dos costumes fúnebres; tabu da morte; túmulo como local de afetos e memórias; banalização da violação como crime; valorização da tradição familiar; túmulo como local de memória e respeito; cemitério como local dispensável; importância do vínculo em vida. Assim, os vínculos constituídos, somados aos fatores culturais, religiosos e familiares influenciam o significado atribuído ao túmulo e consequente na relação estabelecida com ele. Foi possível identificar que o tempo decorrido entre a violação do túmulo e a participação na entrevista não se mostrou significativo

Violação de direitos humanos pelos agentes da polícia no ato de investigação do crime : (um estudo de caso da província de Tete)

Esta dissertação procurou identificar ações concretas que podem ser desenvolvidas para evitar torturas e violações de direitos humanos perpetrados por agentes da polícia no ato de investigação de crimes na província de Tete, em Moçambique. Através de entrevistas e questionários dirigidos aos agentes que compõem o sistema de administração da justiça – juízes, procuradores, membros da Liga Moçambicana dos Direitos Humanos, advogados do Instituto de Patrocínio e Assistência Jurídica e membros da Polícia de Moçambique – foi possível perceber as causas que levam os polícias a pautar pela tortura no ato da investigação criminal e identificar ações para evitá-la. A pesquisa revelou variadas causas que contribuem para que a polícia na Cidade de Tete cometa o crime de tortura durante a investigação de crimes: parte-se, pois, da má formação dos agentes policiais em matéria dos direitos humanos até a falta de uma lei própria que defina e criminalize a tortura em Moçambique, além da ausência de um advogado por parte do suspeito no momento do primeiro interrogatório policial e da fiscalização deficitária das celas da polícia e das penitenciárias por parte dos órgãos competentes (procuradores) para evitar casos de maus-tratos e/ou tratamentos desumanos nesses locais de detenção. Como recomendação, propõe-se a criação de uma lei própria e exclusiva que defina e incrimine a tortura; a presença obrigatória de um advogado durante o primeiro interrogatório policial – em caso de o indiciado não ter condições de contratar um advogado particular, que lhe seja garantido um defensor oficioso por parte do governo; a inspeção médica imediatamente após a detenção para apurar se o suspeito possui lesões corporais e, em caso afirmativo, a apuração das causas das lesões; revisões periódicas e formações sistemáticas de regras de interrogatórios, instruções, métodos e práticas aos agentes aplicadores das leis por parte do Estado; e a realização de visitas e inspeções regulares aos locais de detenção por um órgão independente que tenha poderes para ouvir queixas dos detidos de modo a obter informações sobre o tratamento policial. / This research aims to identify concrete actions that can be developed to prevent the violation of human rights and actions of torture performed by police officers on criminal investigation in the province of Tete, Mozambique. Interviews and questionnaires delivered to the agents responsible for the justice system, such as, judges, prosecutors, members of the Mozambican League of Human Rights, lawyers from the Institute for Legal Assistance and Representation, and police officers, have revealed why do police officers torture suspects under investigation, making it possible to identify actions that best prevent the violation of human rights in such cases. Among the causes that contribute for the police of the province of Tete, Mozambique, to commit the crime of torture during criminal investigation are: the poor instruction of police officers as far as Human Rights are concerned; the absence of a specific law to define and criminalize the practice of torture in the country; the absence of the attorney at the moment of the first police interrogation; and the lack of inspection in police cells and penitentiaries by relevant bodies (prosecutors) to prevent cases of abuse and ill-treatment in places of detention. As a recommendation, it is proposed: the creation of a separate and unique law to define, incriminate and apply an abstract criminal frame for the crime of torture; the mandatory presence of the attorney by the time of the first police interrogation (if the suspect is unable to get a private attorney on his own, then the government must ensure him a public defender); a physical exam right after the arrest so as to ascertain whether the suspect is injured (if so, the causes of the injury must be determined); regular systematic reviews and lectures on interrogation rules, instructions, methods and practices for laws agents; and regular visits and inspections in places of detention by an independent body that is empowered to hear complaints from prisoners in order to learn about police treatment.
