The management of potable water supply : the case of Mkhwanazi Tribal Authority / Magwaza, D.W.

This mini–dissertation addresses the management of the potable water supply in the Mkhwanazi Tribal Authority's area of jurisdiction. The main objectives of the study were to determine the organisational structures and public policies governing the potable water supply in the uMhlathuze Local Municipality with a view to establishing the factors that hinder the provision of potable water to some parts of the Mkhwanazi Tribal Area and also determine how the present potable water situation is perceived by the MTA residents. The Mkhwanazi Tribal Authority's area of jurisdiction is predominantly a residential area for the Zulu speaking people under the uMhlathuze Local Municipality's area of responsibility in the Province of KwaZulu–Natal. The organisational structures governing the potable water supply in the MTA identified in the study are the ULM comprising of the Municipal Council and the administrative; Integrated Development Plan; Water Services Provider; Water Committee; and the Mkhwanazi Tribal Council. The provision of potable water in the MTA is regulated through the UMhlathuze Water Services By–Laws which are based on the standards of basic water and sanitation in terms of the White Paper on Reconstruction and Development Programme (RDP) (SA, 1994:17). The study established that the challenges affecting the potable water supply are the lack of funds in the Municipality, rising water demand, human capacity and water loss. The MTA residents appreciate the current potable water supply by the ULM but have a negative attitude towards paying for water services because they consider water as a natural resource that must be freely supplied to them by the Government. Therefore, the study recommended that water awareness campaigns be conducted regularly amongst the MTA community to raise the importance of having potable water in the community. / Thesis (M. The influence of the learner profile on recognition of prior learning (RPL) assessment

The recognition of prior learning (RPL) is an assessment process through which experience gained outside academic contexts is recognised. The purpose of the research was to determine the influence the learner profile has on RPL assessment. To realise the purpose, the learner profile was described and consequently learning outcomes formulated for a portfolio workshop. The method which the study followed was a qualitative interpretative approach. The research comprised a literature study about adult learning theories that served as a theoretical framework for the study, as well as an overview of RPL assessment, followed by an empirical study. The empirical research component followed a multiple data collection method. The personal life stories of the research participants were analysed in order to compile a learner profile. The role the workshop played was determined from a learner perspective by means of an open questionnaire for participants. It included a collection of workshop photographs. Finally, the reflection of a group of RPL learners about their personal learning experiences was analysed. The research found that the learner profile included distinctive personal traits, such as motivation, task orientation, a sense of responsibility and an orientation towards the future. The nature of the learner profile as well as of informal learning gained within diverse learning contexts require directed preparation for assessment. The learners regarded the portfolio workshop as a sustainable learning process and as a transformational learning experience. The role the workshop played was multidimensional, as it served as preparation for compiling the portfolio. It also empowered and prepared the learner on a personal level for the context of tertiary education. Based on the research findings, the recommendations for an RPL approach should include the following: Firstly, the learner‟s voice should be afforded recognition. Secondly, preparation for assessment is essential. Thirdly, the preparation should follow an approach of assessment as a sustainable learning process. Finally, the learning outcomes for the portfolio workshop make a contribution to support the learners in bridging the learning contexts of informal learning and academic learning. The research makes a valuable contribution, as the empirical research shows that the holistic learner profile guides the approach to assessment. The mission of RPL to bring about transformation will only become a reality if a learner-centred approach recognises and empowers the learner on a personal and academic level. / Die Erkenning van Vorige Leer (EVL) is 'n assesseringsproses waardeur ervaring wat buite akademiese kontekste verwerf is, erken word. Die doel met die navorsing was om die invloed van die leerderprofiel op EVL-assessering te bepaal. Om die doel te bereik, is die leerderprofiel beskryf en voortvloeiend daaruit leeruitkomste vir 'n portefeuljewerkswinkel saamgestel. Die metode wat die studie gevolg het, was 'n kwalitatiewe interpretiewe benadering. Die navorsing bestaan uit 'n literatuurstudie oor volwasse leerteorieë wat as teoretiese raamwerk vir die studie gedien het, asook 'n oorsig oor EVL-assessering, gevolg deur 'n empiriese studie. Die empiriese navorsingskomponent het 'n meervoudige dataversamelingsmetode gevolg. Die navorsingsdeelnemers se persoonlike lewensverhale is geanaliseer om sodoende 'n leerderprofiel saam te stel. Die voorbestaan van die mensdom is nou verweef met die toestand waarin die omgewing verkeer. Menslike aktiwiteite het 'n groot impak op die omgewing, terwyl die omgewing weer die mens se lewensgehalte bepaal. Hierdie studie is dan daarop gemik om deur omgewingsopvoeding, die mens te lei tot omgewingsgesonde gedrag met die oog op volhoubare ontwikkeling. Ten einde hierin te slaag, word die verskillende omgewingsprobleme en die redes daarvoor eers uitgeklaar. Daarna word die faktore wat tot omgewingsagteruitgang kan lei, ondersoek. Hieruit blyk duidelik <lat die wereld en die RSA, in die toekoms digter bevolk, meer besoedel, ekologies minder stabiel en daarom meer gevoelig vir natuurrampe gaan word. Soos uit die proefskrif sal blyk kan omgewingsopvoeding 'n positiewe bydrae tot bierdie omgewingsprobleme lewer. Om daarby uit te kom word daar dus eers 'n kort bistoriese oorsig van omgewingsopvoeding gegee. Die rol en bydrae wat enkele internasionale organisasies tot omgewingsbewustheid gelewer het, word ondersoek. Daar word 'n oorsig gegee van verwikkelinge in die RSA en die invloed van die Aardeberaad op omgewingsopvoeding in die RSA, word ontleed. Ten einde outentieke omgewingsopvoeding te vergestalt word aanvaar <lat die mens met sy geboorte in 'n wereld gewerp word waaraan hy slegs met sy dood kan ontsnap. In hierdie gesitueerdheid in die wereld as leefnrimte, moet hy sin aan sy bestaan gee, terwyl hy ook 'n poging moet aanwend om die omgewing te verbeter, as voorsorg vir die oorlewing van toekomstige geslagte. Met inagneming van die opvoedings- en omgewingsrelasie waarin die mens tot sy omgewing staan, word die essensiele kenmerke van omgewingsopvoeding blootgele, ten einde moontlikheidsvoorwaardes te stel vir outentieke omgewingsopvoeding. Besondere Idem word gele op omgewingsgedrag wat volhoubaarheid nastreef. Dit alles kulmineer in omgewingsgesonde gedrag wat as oorkoepelende doelstelling vir omgewingsopvoeding gestel word. Omdat die mens se gedrag teenoor die omgewing bepaal word deur sy omgewingsetiek, word drie verskillende benaderings tot omgewingsetiek onderskei. Klem word gele op die noodsaak van omgewingsgeletterdheid. Ten einde die mens se optrede teenoor die omgewing te probeer verstaan, word drie omgewingsgedragstyle ontleed. Twee wetenskaplike aardgenese-hipoteses word beskryf vir verdere duidelikheid oor omgewingsgedrag. Aan die einde van die studie, word enkele beginsels gestel wat kan lei tot die ontwikkeling van omgewingsgesonde gedrag met die oog op volhoubare voortbestaan. / Mankind's survival is interwoven with the state of the environment. Human activities have a great impact on the environment, while the environment, again, determines the quality of man's life. This study aims to aid mankind, through environmental education, to environmentally sound behaviour with an eye on sustainable development. To attain this, the different environmental problems and their causes, are sorted out first. Then the factors that can lead to environmental degradation are investigated. From this it is quite clear that in the future, the world and the RSA will be more densely populated, become more polluted, be ecologically less stable and will therefore be more sensitive to natural disasters. Because environmental education can make a positive contribution to this, a short historical survey of environmental education is given. The role and contribution of some international organisations is investigated. Developments in the RSA are surveyed and the influence of the Earth Summit on environmental education in the RSA is analysed. At birth, mankind is thrown into a world from where he can escape only at death. In this world in which he has to stay, he must give meaning to his existence, while also trying to improve the environment to guarantee the survival of coming generations. Bearing in mind the educational and environmental relationship between any human being and his environment, the essential characteristics of environmental education are exposed in order to set possible conditions for authentic environmental education. Special emphasis is placed on environmental behaviour aimed at sustainablility. All this culminates in environmentally sound behaviour that acts as the overall aim for environmental education. Because man's environmental ethic determines his behaviour towards the environment, three different approaches to environmental ethics are distinguished. Emphasis is placed on the necessity for environmental literacy. In order to try to understand man's behaviour towards the environment, three styles of environmental behaviour are analysed. For further clarification of environmental behaviour, two scientific earth genesis hipotheses are also described. Volhoubare voorsiening van geselekteerde munisipale dienste in Centurion : 'n polities-geografiese ondersoek / The sustainable provision of selected municipal services in Centurion : a politico-gepgraphical investigation

Text in Afrikaans / In this study the relationship between political decision making, spatial change and provision of selected municipal services was investigated. Legislation and policy, spatial demarcation and local government structures are determined by political decision making on various government levels. The international system as well as the local history and factors leading to spatial change impact on municipal demarcation and service delivery. Demographic change due to re-delimitation of boundaries, densification within the area of jurisdiction and immigration imply that service requirements change. In 1994/5, the rural and residential areas were incorporated to the former Verwoerdburg and formed the Southern Pretoria Metropolitan Substructure (Centurion). In December 2000 Centurion lost its autonomous status and was incorporated as administrative unit into the larger Tshwane Metropolitan Municipality. Restructuring have implications for the political representation of communities, the spatial extension of service networks, priority areas, and the location of service provision points. / In hierdie studie is die verband tussen politieke besluitneming, ruimtelike verandering en die lewering van geselekteerde munisipale dienste ondersoek. Wetgewing en beleid, ruimtelike afbakening en plaaslikeowerheidstrukture word deur politieke besluitneming op verskillende regeringsvlakke bepaal. Die internasionale sisteem, asook plaaslike historiese gebeure en aanleidende faktore tot ruimtelike verandering het 'n impak op beide munisipale afbakening en dienslewering. Demografiese verandering as gevolg van die herbepaling van grense, verdigting binne die regsgebied en immigrasie impliseer dat diensbehoeftes verander. Landelike en residensiele gebiede is in 1994/5 by die voormalige Verwoerdburg geinkorporeer om die Suidelike Pretoria Metropolitaanse Substruktuur (Centurion) te vorm. Sustainability-environmental risks and legal liabilities of South African banks / Johannes Hendrik Coetzee

In the environmental context banks face direct, indirect and reputational risks from their internal operations and their external business activities. The current specific focus on the protection of the environment makes it essential for banks and their directors to be aware and stay on top of potential risks and liabilities. This is especially so because banks’ directors can be criminally prosecuted for environmental crimes. The application and effect of the Prevention of Organised Crime Act 121 of 1998 (POCA) on persons convicted of an environmental crime or crimes has been identified as a possible new or added risk for banks and their directors. Banks in addition to their normal environmental risk and liabilities also need to contend with the possibility of lender liability. Existing legislation pertinent to lender liability does not expressly or specifically deal with lender liability. Absence of judgements on lender liability further exacerbates the risks and the uncertainty for banks in South Africa. Therefore, banks remain subject to legal uncertainty and associated risks. The issue of lender liability specifically with regard to the implication of “the person in control” requires clarification. Hence, it is recommended that legislation relevant to lender liability (National Environmental Management Act 107 of 1998; National Water Act 36 of 1998 and the National Environmental Management: Waste Act 59 of 2008) be revised to specifically accommodate and protect lenders (lending banks) in certain distinct circumstances. The role of banks is that of an intermediary between borrowers and lenders of money. Therefore, it influences the direction and pace of economic development and by default steers and promotes either sustainable or non-sustainable development. Currently, mainstream banks are in effect financing a brown economy and hence subscribe to a weak form of sustainability. It would seem that mainstream banks are more concerned with managing the impact that environmental risk may have on bank lending than the impact of bank lending on the environment. The evolving nature of sustainability (from weak to strong and from a brown to green economy) demands a fundamental policy change for banks. It is expected that mainstream banks will be put under even greater pressure than before to make the transition from weak to strong sustainability. Hence, banks’ current environmental risk management systems will not be sufficient to cater for new environmental risks and liabilities that the move to stronger sustainability (in the form of the green economy) will present. Banks should adopt the stronger version of sustainability; formulate environmental principles that the bank will adhere to; incorporate these environmental principles into all aspects of its lending cycle, develop an environmental risk management system that should include as a minimum the identification of all the applicable legislation pertaining to the specific financing or lending of capital, risk identification, assessment of the specific risk, implementation of risk control measures, mitigation of the risk, risk monitoring and auditing. / LLM (Environmental Law and Governance), North-West University, Potchefstroom Campus, 2014

The South African coastal and marine environment is an essential ecologic and economic asset. Its associated services and products are substantially contributing to economic growth and sustainable development of the country. However, it is internationally and nationally recognised that land-based marine pollution (LBMP) is the most important single risk to the health and sustainability of coastal and marine waters and the associated ecosystems. The regulation of LBMP at the national level is still difficult and challenging. The issue of LBMP management has only recently been introduced in South Africa with the development of the National Programme of Action to Protect Marine Environment from Land-based Activities, 2008. South Africa is only starting to consider the question of LBMP regulation. This thesis aims to conduct a critical analysis of the South African regulatory framework pertaining to LBMP in comparison to international best practice and the French regulatory framework, in order to identify the key South African challenges in this regard and to make recommendations to address them. In order to do so, this research commences by providing an analysis of LBMP and the theoretical foundations associated with LBMP regulation, as promoted by international best practice. The study identifies and assesses the main regulatory features to be considered in the development, implementation and/or assessment of a regulatory framework pertaining to LBMP. These features will form the methodological framework to conduct the comparative legal assessment between the French and South African regulatory frameworks pertaining to LBMP. This thesis then provides a detailed and thorough legal analysis of the French and South African regulatory frameworks pertaining to LBMP using the methodological framework developed using guidance from international best practice. Guidelines for sustainable urban transport in selected areas of the City of Tshwane

Abstract in English, Xhosa and Afrikaans / In South Africa, the number of households owning private cars has increased from 22.9% in 2003 to 28.5% in 2013. The City of Tshwane Metropolitan Municipality (City of Tshwane) in South Africa had the largest increase in population that was using private cars between 2003 and 2013 of approximately 11.3%; hence, a need was identified to shift from private cars to sustainable modes of transport. The purpose of this study was to develop guidelines for sustainable urban transport. Geographical location was used for quota sampling to ensure that all seven regions of the Tshwane municipal area would be represented. The sample size of the study comprised 418 participants. The primary data were gathered in Tshwane during the month of August 2017 using a structured questionnaire. The Likert scale was employed to ascertain the public's attitudes towards sustainable urban transport. Descriptive statistics, exploratory factor analysis and inferential statistics were used to analyse the data. The results revealed that the private car is the most frequently used mode of transport in the City of Tshwane. The results further indicated that the majority of the residents of the City of Tshwane had a negative attitude towards sustainable transport modes, which was attributed to safety, reliability and convenience concerns. Regions 4 and 6 differed statistically and significantly from region 5 regarding their opinions on the safety and comfort of private cars. In order to promote sustainable transportation, it is recommended that the City of Tshwane implement transport initiatives that can improve the service quality and safety features of sustainable transport modes. Each region of the City of Tshwane made specific recommendations that were based on the results of the study. The findings of this study provide insights that can be useful to the city planners to secure sustainable urban transportation for the City of Tshwane. Daar word op grond hiervan ’n behoefte geïdentifiseer om van die gebruik van private motors weg te beweeg na volhoubare vervoerwyses. Die doel van hierdie studie is om riglyne vir volhoubare stedelike vervoer te ontwikkel. Geografiese ligging is vir die kwotasteekproefneming gebruik om te verseker dat al sewe streke van die Tshwane- munisipale gebied verteenwoordig word. Vir die steekproef wat vir die studie geneem word, word 418 deelnemers gebruik. Die primêre data word met behulp van ’n gestruktureerde vraelys in die loop van Augustus 2017 in Tshwane ingesamel. Streek 4 en 6 verskil statisties aansienlik van streek 5 betreffende hul menings oor die veiligheid en gemak van private motors. Om volhoubare vervoer te bevorder, word aanbeveel dat die Stad Tshwane vervoerinisiatiewe implementeer wat die diensgehalte en veiligheidskenmerke van volhoubare vervoerwyses kan verbeter. Elke streek van die Stad Tshwane het vorendag gekom met spesifieke voorstelle wat by die resultate ingesluit is. Die bevindinge van hierdie studie bied insigte wat bruikbaar vir stadsbeplanners kan wees om volhoubare stedelike vervoer in die Stad Tshwane moontlik te maak.
