L’usage de la résolution européenne a débuté en 1992, quand un nouvel article, le 88-4, a été introduit dans la Constitution, donnant pour la première fois à l’Assemblée nationale et au Sénat le droit de voter des résolutions sur des projets et propositions d’actes communautaires soumis par le Gouvernement. Le but de cet avantage en faveur du Parlement était de mettre en vigueur un contrôle parlementaire sur la politique européenne du Gouvernement. Au cours des années, la pratique de la résolution européenne montre l’inefficacité du rôle du Parlement au niveau européen. La portée de la résolution européenne demeure en soi non contraignante vis-à-vis du Gouvernement et des institutions européennes. Les cinq révisions constitutionnelles concernant les affaires européennes depuis 1992 ne peuvent pas y contribuer, malgré la dernière révision du 23 juillet 2008 reconnaissant le droit d’adoption d’une résolution européenne sur non seulement les projets ou propositions d’actes européens soumis par le Gouvernement, mais aussi sur « tout document émanant d’une institution de l’Union ». Le temps est venu pour le Parlement de mettre en place un contrôle parlementaire efficace au niveau européen. / The use of the European resolution started in 1992, when a new article, 88-4, was introduced in the Constitution, giving for the first time in the National Assembly and the Senate the right to vote on resolutions on projects and proposals for Community acts submitted by the Government. The purpose of this advantage in favor of the Parliament was put in force a parliamentary control over the Government's European policy. Over the years, the practice of the European resolution demonstrates the ineffectiveness of the role of the Parliament at European level. The scope of the European resolution remains inherently non-binding towards the Government and the European institutions. Five constitutional revisions concerning European Affairs since 1992 cannot contribute, despite the latest revision of July 23, 2008, recognizing the right to adoption of a European resolution on not only the projects or proposals of European acts submitted by the Government, but on ' any document emanating from an institution of the Union ' also. The time has come for Parliament to put in place an effective parliamentary control at European level.

The Usage of Clitic Pronouns and the Influence of the Definite Article in Spanish among Spanish-Quechua Bilinguals in Peru

This study focuses on the clitic pronoun usage by Spanish-Quechua bilingual speakers in Cuzco, Peru when faced with a question that includes a definite article preceding the direct object. Answers are analyzed to determine whether or not the definite article has an effect on the presence or absence of the clitic pronoun. Direct objects tested were both [+human] and [-human] objects to determine if these variables affect clitic pronoun use as well. Speakers who have identified themselves as bilingual in both Spanish and Quechua were given a survey to complete in order to see what factors may contribute to the use or omission of the clitic pronouns.

Kliniska prövningar i akuta situationer inom EU/EES enligt förordningen om kliniska prövningar

Bakgrund: Förordningen (EU) nr 536/2014 artikel 35 reglerar kliniska prövningar i akuta situationer. Lagen gäller inom EU/EES sedan januari 2022 och tillåter inkludering av kritiskt sjuka patienter med uppskjutet informerat samtycke, vilket innebär att den första prövningsspecifika interventionen görs innan försökspersonen eller deras juridiska ombud samtycker till deltagande i prövningen.  Syfte: Syftet med projektet är att beskriva de kliniska prövningar som sökts i akuta situationer sedan starten av den nya EU-förordningen om kliniska prövningar fram till den 15 september 2023. Metoder: Informationssystem för kliniska prövningar (CTIS) och konfidentiella databaser vid Läkemedelsverket användes för att samla in information om de sökta kliniska prövningarna enligt den nya förordningen. Resultat: Alla prövningar som definierats av sponsorn som involverade akuta situationer identifierades, omfattande 32 unika kliniska prövningar. Efter att ha analyserat ansökningsunderlagen och granskningar av medlemsstaterna, visade sig endast två tredjedelar av de inlämnade försöken involvera verkliga medicinska nödsituationer. En av dessa försöksansökningar avslogs, tre drogs tillbaka eller besvarades inte inom den maximala tiden för sponsorns feedback på frågor. Slutsatser: Den nya förordningen om kliniska prövningar tillåter forskning om akuta medicinska tillstånd som tidigare har varit uteslutna i de flesta EU/EES-medlemsstater. Det är viktigt för sponsorer att bekräfta att alla krav i artikel 35 är uppfyllda innan en klinisk prövning definieras som en klinisk prövning i en akut situation. Medlemsstaterna bör lära av varandra om hur rättsliga ombud för försökspersoner utses.

Les stratégies de traduction dans trois articles d’un journal : Une étude sur la traduction des participes présents et passés du français vers le suédois / Translation Strategies in Three News Articles : A Study of the Translation of Present and Past Participle Phrases from French into Swedish

The aim of this study was to analyze the translation of verb constructions with participles from French into Swedish of three news articles from the French magazine Le Point (2021). The articles were published in a special issue dedicated to climate change. The analysis focused on the translation of present and past participle phrases and the strategies involved in the translation process. Gerunds were excluded from the study as well as participles functioning as an adjective in order to limit the study. The present study was based on Eriksson’s model and his definitions of transpositions (Eriksson 1997), which are translation shifts taking place during the translation process. The results showed that most present and past participle phrases were being replaced by relative clauses or by main clauses in Swedish. Many participle phrases were also replaced by other types of phrases or clauses.               Some transpositions were considered as being necessary. They seemed to have been imposed on the text by the inherent grammar structures of the target language, while other translation shifts appeared to be optional. In the latter case, they seemed to have been chosen rather for stylistic reasons, and/or motivated by the personal choice of the translator when several options were available.

This thesis deals with control of stock in an inventory, focusing on inventory placement. The purpose of this thesis is to reduce the transport distance within the main stock house while gathering inventory. This will be achieved by reconstructing the inventory placement in consideration with how frequently the inventories get picked and mass of the inventory. In particular, the literature and the data that is collected from the company´s business system have laid the foundation for the thesis. In general, interviews and observations also contributed to the data collection. To fulfill the aim and to produce arbitrary results, two issues have been developed regarding which attributes that should determine the position of the inventory in the stock house and how to obtain a more effective inventory structure? The authors have jointly produced a result of suggestions for future inventory placement in terms of picking frequency and weight. Initially a situation analysis was conducted to identify known problems with the inventory´s placement and storage systems. The problems that were identified were that the inventory placement has no consideration regarding picking frequency. To determine the most frequent picked inventory an ABC analysis was conducted. All of the inventories were spread out throughout the whole stock house. To take in account, the additional criterion, which was weight, a multi-criteria analysis was performed in combination with the ABC analysis. The results of the combined analysis provided that the basis for drawing up concepts for future inventory placement. The proposal includes optimized inventory placements in different zones of the most frequently picked inventory with weight as an additional criterion. / Arbetet behandlar området lagerstyrning med inriktning på optimering av artikelplacering. Syftet med arbetet är att minska transportsträckor inom centrallagret, detta genom en omstrukturerad artikelplacering med hänsyn till plockfrekvens och tyngd. I synnerhet har litteratur samt insamlad data från företagets affärssystem lagt grunden för arbetet. I allmänhet har intervjuer och observationer också bidragit till datainsamling. För att uppfylla arbetets syfte och ta fram ett godtyckligt resultat har två frågeställningar tagits fram angående vilka attribut som bör avgöra en artikels position i lagret samt hur en effektivare lagerstruktur kan erhållas. Författarna har gemensamt arbetat fram ett resultat i form av ett förslag för framtida artikelplacering sett till plockfrekvens och tyngd. Inledningsvis genomfördes en nulägesanalys för att identifiera kända problem med artikelplacering och lagersystem. De problem som identifierades var att artikelplaceringen sker utan underlag för plockfrekvens. För att utröna de mest frekventa artiklarna genomfördes en ABC-analys. Samtliga artiklar lokaliserades utspridda över hela lagret. För att ta hänsyn till ytterligare ett kriterium, vilket var tyngd, genomfördes multikriterieanalys i kombination med ABC-analys. Resultatet av den kombinerade analysen gav underlag för att ta fram förslag för framtida artikelplacering. Förslaget innehåller optimerade artikelplaceringar inom olika zoner för de mest plockfrekventa artiklarna med tyngd som ytterligare kriterium.

This thesis that is supported by the research findings is as follows: In private law contact disputes between parents, greater weight should be attached to the statutory requirement to give children an opportunity to express their views, as well as to the statutory requirement to protect them from abuse, rather than assuming on-going contact with a both parents is essential for the promotion of a child’s welfare. Despite the acquisition of rights by women and children since the late 19th century, it is argued, they remain disempowered within private law legal process as the patria potestas (paternal power) once held by married fathers, has evolved into this assumption that a child’s welfare requires direct, regular contact with his or her biological father – whether the child wants this or not. Consequently, where children’s views are taken, but they express a view contrary to on-going contact with their biological father, their wishes are often overridden and they may be forced by the court into contact arrangements that distress them. This is particularly problematic as the majority of cases coming before the courts involve serious welfare concerns (including domestic violence and the abuse of substances) and children often have lucid reasons for not wishing to be left under the care and control of their non-resident parent. Yet, these children may sometimes be further victimised by the court system charged with their protection.

Exploring the prohibition of degrading treatment within Article 3 of the European Convention on Human Rights

This thesis addresses the meaning and scope of application of the right not to be subjected to degrading treatment, a distinct form of harm within the absolute prohibition of torture, inhuman or degrading treatment or punishment under Article 3 of the European Convention on Human Rights. Through an interpretive case-law analysis, the thesis presents a deeper conceptual understanding of the meaning of degrading treatment than is found in existing human rights literature. It is a central argument of this thesis that the concept of human dignity occupies a key position in the interpretation of degrading treatment adopted by the European Court of Human Rights. Consequently, it is argued that the meaning of human dignity in this context ‘frames’ the potential boundaries of the right. The thesis aims to facilitate identification of situations that may convincingly be argued to amount to potential instances of degrading treatment through generating a richer appreciation of the right’s proper scope of concern. A comprehensive account of the meaning of degrading treatment and corresponding state obligations is offered. This account provides a framework for future application of the right that is both practical and plausible.
