Abuse of a dominant position - the concept of abuse and modes of abusive conduct Abstract This thesis deals with an abuse of dominant position, specifically with concept of abuse as such and subsequently with individual abusing practices. Article 102 TFEU as well as § 11 ZOHS do not define concept of abuse, it is therefore necessary to analyze case law for their understanding. The same apply in case of individual abusing practices. This analysis is fitted into the wider framework which consists in exploring the object of Article 102 and the method of its application, particularly in regards to Commision's effort to modernization. The main aim of the thesis is critical reflection of case law in the context of searching of purpose of Article 102, not comprehensive and detailed review. The thesis is composed of three chapters. Chapter One characterizes basic objectives of Article 102 and method of its application. Due to brief text of Article 102, the objects of the Article are really crucial for its interpretation and application. Protection of business competition - Abuse of dominant position The main objective of this thesis is a comprehensive analysis of the term "abuse." In a wider complex, thesis deals with a question of the present aim and prevailing method of application of provision 102 TFEU in order to find out whether and if yes, to what extent is current approach compatible with the modernization process of the application of article 102 TFEU declared by the Commission. Thesis deals with a question whether decisional practise is capable to react on a challenge made by so called new economy sector. Thesis consists of five substantial chapters. The first chapter sums up historical development of the 102 prohibition in Europe and USA law with a particular focus on the objective behind the text of the relevant provisions and decisions and its changes in time. The second chapter zooms to modernization process in relation to Art. 102. This thesis focuses on the analysis of the proces of the creation and gradual transformation of japanese self-defense forces until the treshold of 21th century. Using few selected international relations theories and historical background, it explains the development of these forces, their growth and the issue concerning the existence, legitimity, geopolitical support and constitutionality. In the final part I am describing the public opinion influenced by the gradual changes of these forces. The result is a compact perspective, 60 years of existence of Japanese Self-Defence Forces, focused on their gradal change in time.

Generic use of articles in French This Diploma thesis deals with the generic use of articles in the French language. It is divided into the theoretical and the experimental part. After the broader introduction into the issue of determinants, the most important part of the work treats genericity expressed in French by the definite article in singular and plural as well as by the indefinite article in singular. Firstly, the existing research on the subject of generic articles is studied, including the presentation of various approaches and principal theories, then is formulated proper syntactic and semantic interpretation of genericity which is finally verified in the experimental part of the thesis based on the analysis of model sentences. Relationship between stunting in children 6 to 36 months of age and maternal employment status in Peru: A sub-analysis of the Peruvian Demographic and Health Survey

Objectives This study aimed to determine the relationship between stunting in children 6 to 36 months old and maternal employment status in Peru. Methods A secondary data analysis was conducted using information from the Demographic and Health Survey (DHS) in Peru. We used a representative sample of 4637 mother-child binomials to determine the association between stunting in children 6 to 36 months of age and the employment status of their mothers. Results The prevalence of stunting among children was 15.9% (95% CI: 13.9–16.7). The prevalence of working mothers was 63.7%. No association was found between maternal employment status and the presence of stunting in children [prevalence ratio (PR) = 1.04; 95% confidence interval (95% CI): 0.9 to 1.2; p = 0.627). However, on multivariate analysis we found that the prevalence of stunting was significantly higher among children of mothers performing unpaid work (12.4%) (PR = 1.38; 95% CI: 1.2–1.6; p < 0.001) compared with those of paid working mothers. Conclusion No significant association was found between maternal employment status and the presence of stunting in children 6 to 36 months of age. However, children of mothers doing unpaid work are at higher risk of stunting. These findings support the implementation of educational programs and labour policies to reduce the prevalence of stunting among children. © 2019 Chávez-Zárate et al. Abuse of Dominant Position in the ICT Sector: A European Perspective Abstract The concept of abuse of dominant position refers to business practices in which a dominant market player may engage in order to maintain or strengthen its position in the market, and are prohibited under Article 102 of the Treaty on the Functioning of the European Union. This master's thesis provides insight into theory and decisional practice of abuse of dominant position within the EU with particular focus on the area of information and communication technologies (ICT). The ICT industry belongs among the fastest developing, with many new powerful market players emerging, often creating entirely new markets for themselves. Nesta dissertação, o objetivo é analisar os artigos de opinião produzidos por estudantes dos anos finais do ensino fundamental de uma escola da rede pública da cidade de São Paulo. Está em foco a defesa de um ponto de vista sobre o tema O impeachment de Dilma Rousseff, em que as relações dialógicas foram estabelecidas com diferentes vozes apresentadas em discursos da mídia impressa e digital, no período de abril e maio de 2016. A fundamentação teórica centra-se nos conceitos de M. Bakhtin e o Círculo tais como esfera de circulação, enunciado concreto, discurso citado e na perspectiva ideológica dos estudos de letramento de Brian Street. O artigo de opinião como gênero do discurso está prescrito nos Parâmetros Curriculares Nacionais (PCNs) como texto argumentativo a ser ensinado nas práticas de leitura e de produção escrita. Esta pesquisa apresentou uma proposta didática dialógica a quatro turmas do 9º ano em três momentos: leitura da coletânea, pesquisa e discussão dos textos; produção de texto (versão 1); revisão e produção de texto (versão 2). Tendo a concepção de escrita como um processo de compreensão responsiva foram selecionados 38 artigos a partir de dois critérios: i) o discurso citado: paráfrase, uso de aspas e cópia ii) a formulação expressiva nos títulos. A análise da apreensão dos discursos da coletânea considerou o engendramento ativo dos sujeitos na produção de sentidos e os vários leitores do artigo: colegas de turma e a professora. No conjunto dos artigos de opinião sobre o tema do impeachment de Dilma Rousseff, foram identificadas quatro formas de argumentação: i) paráfrase; ii) uso de aspas na marcação do discurso alheio; iii) cópia de trechos da coletânea; iv) posicionamento valorativo nos títulos. O resultado da produção dos estudantes mostrou uma diversidade de posições a favor ou contra a situação política polarizada entre pró e contra Dilma. Os recursos argumentativos recuperaram os debates tensos e conflitantes que aconteciam nas ruas e no Congresso Nacional brasileiro. E mostraram diferentes compreensões sobre a mesma informação, sinalizando que o trabalho com a escrita não está desvinculado dos contextos sócio-históricos das práticas letradas dos estudantes, mas refletem e refratam os textos-fonte. Compreender cada texto como resposta ao discurso do outro é proposta de atividade dialógica, um trabalho com discurso político nas aulas de português. / This dissertation aims to analyze the opinion upon articles produced by senior elementary school students from a state school in São Paulo, Brazil. It focuses on a point of view regarding the theme \"The Impeachment of Dilma Rousseff \" in which the dialogic relations were established by different voices found in speeches shown in the printed and digital media, between April and May 2016. The central theoretical framework is based on the concepts set by M. Bakhtin and the Circle such as the sphere of circulation\", \"utterance\", \"quoted speech\" as well as on the ideological perspective of Brian Street literacy studies. The opinion article as discourse gender is prescribed in the Brazilian National Curricular Parametres (PCNs) as an argumentative text to be taught in the practices of reading and writing production. This research displayed a didactic dialogic proposal to four 9th grade groups which was divided in three different moments: the reading of the compilation, researches and discussion on the texts; text production (version 1); revision and text production (version 2). Considering the conception of writing as a process of responsive understanding 39 articles were selected based on two criteria: i) the quoted speech: paraphrase, the use of quotation marks and copy; ii) the expressive formulation in the titles. The analysis of the apprehension of the speeches on the collection considered the active engendering of the subjects in the production of meanings and the different readers of the article: classmates and the teacher. In the set of the opinion articles regarding the theme Dilma Rousseffs impeachment, four types of argument were identified: i) paraphrase; ii) the use of quotes in the mark of the others speech, iii) copy of excerpts from the compilation; iv) valuation positioning in the titles. The result of students production showed a diversity of positions in favour or against the polarized political situation between pros and cons about Dilmas impeachment. The argumentative resources recovered the tense and conflicting debates have taken place on the streets and in the Brazilian National Congress. And they showed different understandings of the same information, signaling that the writing project is not detached from the socio-historical contexts of literacy practices of students, but reflect and refract the source texts. Understanding each text as a response to the others speech is the dialogic activity proposed: a work on the political speech in the Portuguese class.

Este trabalho tem por finalidade verificar se há utilização de artigos no Crioulo Cabo-verdiano, variedade de Santiago (CCVS), e como são utilizados esses artigos: se há uma sistematização para seu uso, como propõe Bickerton (1981) para todos os crioulos, ou se artigos definidos, indefinidos e Ø (indicando a ausência de artigos ou outros determinantes) são utilizados indistintamente, como sugere Lucchesi (1994a). Nesta pesquisa, foi constatada a ocorrência de artigos em CCVS, podendo-se afirmar que a opção dos falantes pelos artigos, definidos ou indefinidos, ou por Ø, em SN\'s (sintagmas nominais) cujos núcleos sejam substantivos comuns, constitui um fato de variação, na qual Ø é a variável, já que a tendência predominante é a opção por ele em SN\'s (+F) (+O), cuja referência seja conhecida pelo falante e pelo ouvinte, (+F) (-O), cuja referência seja conhecida pelo falante, mas desconhecida pelo ouvinte, (-F) (-O), cuja referência seja desconhecida pelo falante e pelo ouvinte, nas posições de sujeito, objeto e predicativo do sujeito; já os artigos definidos, indefinidos e Ø são variantes combinatórias, já que não houve ocorrências de artigos indefinidos em SN\'s (+F) (+O) na posição de sujeito, assim como não surgiram artigos definidos e indefinidos, na posição de predicativo do sujeito, em SN\'s (+F) (-O) e (-F) (-O). / This work has for purpose to verify if has article use in the Capeverdean Creole, Santiago\'s variety (CCVS), and as these articles are used: if it has a systematization for its use, as Bickerton (1981) considers for all the creoles, or if definite and indefinite articles and Ø (indicating the article absence or other determinative ones) are used indistinctly, at it suggests Lucchesi (1994a). In this research, the article occurrence was evidenced in CCVS, being able itself to affirm that the option of the speaker for articles, definites or indefinites, or Ø, in NP\'s (nominal phrases) whose nucleus are substantive common, constitutes a variation fact, in which Ø is the variable, since the predominant trend is the option for it in NP\'s (+S) (+A), whose reference is known for speaker and for addressee, (+S) (-A), whose reference is known for speaker, but unknown for addressee, (-S) (-A), whose reference is unknown for speaker and for addressee, in the subject, object and predicate; already the definite and indefinite articles e Ø they are variant combinatories, since it did not have indefinite article occurrences in NP\'s (+S) (+A) in the subject posiction, as well as they had not appeared definite and indefinite articles, in the position of predicate, in NP\'s (+S) (-A) e (-S) (-A).

Uso ou omissão de preposição e artigo em orações relativas de espanhol produzidas por estudantes brasileiros / Use or omission of prepositions and articles in Spanish relative clauses produced by Brazilian students

O objetivo desta dissertação é comparar o uso ou a omissão de preposições e artigos nas orações relativas de estudantes brasileiros de ELE e nativos de E. O estudo buscou verificar se os estudantes brasileiros de ELE utilizam o relativo acompanhado de preposição e artigo, quando o usam e como o fazem; quais contextos favorecem a elipse de preposição + artigo; se o comportamento sintático entre os estudantes brasileiros e os nativos se assemelha e quais as possibilidades para essas semelhanças / diferenças. Para tanto, analisamos um corpus recolhido de testes escritos de reformulação de orações de três grupos de estudantes brasileiros adultos de ELE e o comparamos às produções de reformulações de um grupo de nativos de E argentinos. De acordo com nossas hipóteses iniciais e bibliografia consultada, as orações cortadoras seriam as mais produzidas pelos estudantes, mas de acordo com nossos dados, essa não foi a opção mais usada, e sim a opção sem o artigo com preposição. Pensamos que isso se deve ao caráter mais formal (escrito) dos testes. Concluímos que os brasileiros, em sua língua nativa, não usariam tal estrutura, mas quando têm que lidar com o E, preferem cortar o artigo em vez de produzir uma estrutura que seja mais comum em PB como a cortadora. Em contrapartida, os nativos usaram com mais frequência as orações padrão, que quase não apareceram nos resultados dos estudantes brasileiros. Ou seja, o comportamento sintático dos estudantes brasileiros e dos nativos foram evidentemente diferentes. Os estudantes brasileiros nem sempre preferiram o uso de relativas com quien para antecedente [+animado], como predizem as gramáticas. Aliás, o uso das duas orações padrão (prep. + quien e prep.+ art. + que) foi bastante equilibrado. Os nativos de E, para o mesmo tipo de antecedente, usaram a oração padrão com o relativo que com maior frequência. Quando a oração relativa apresentou caráter causal, os informantes brasileiros e nativos foram levados a expressar essa relação causal e evitaram a oração relativa. / The objective of this dissertation is to compare the use or omission of prepositions in relative clauses and articles of Brazilian students of ELE and native E speakers. The study aimed at verifing whether the Brazilian students use prepositions, accompanied by the relative pronoun and articles, when they use and how they do that; contexts which favor the ellipse \"preposition + article\"; if the syntactic behavior among Brazilian students matches the native speakers and the possibilities for these similarities / differences. To this end, we collected a corpus reformulation\'s sentences of written tests of three groups of Brazilian adult students of ELE and compared to the production of reformulations of a group of Argentinian E. native speakers. According to our initial hypotheses and consulted literature, students produce more often pp-chopping sentences, but according to our data, this was not the preferred option, but the one without article and with preposition. We think this is due to the more formal nature of the (written) tests. We concluded that Brazilian students in their native language would not use such a structure, but when they have to deal with E, they prefer to cut the article instead of producing a structure that is more common in PB - like the pp-chopping. In contrast, the native speakers used standard sentences more often, which hardly ever appeared in the results of Brazilian students. That is, the syntactic behavior of Brazilian students and native speakers were evidently different. Brazilian students do not always preferred the use of relative pronoun using \"quien\" for the antecedent [+ animate], as grammatically expected. In fact, the use of two standard sentences (\"prep. + quien\" and \"prep. + art. + que) was fairly balanced. The native speakers of E, for the same type antecedent, used the standard sentence with the relative \"que\" with more frequency. When the relative clause introduced causal character, Brazilians and native speaker informants were led to express this causal relationship and avoided the relative clause.
