A Fall From Grace: The Rising Rate of Attorneys with Substance Abuse Disorders, Chemical Dependencies and AddictionsYost, Amy M 01 January 2022 (has links)
This thesis is a continuation of research and scholarly writing that the author completed for a published article that appeared in Volume 5 of the University of Central Florida Undergraduate Law Journal, Spring 2022. The rising rate of attorneys with a self-reported substance abuse disorder, chemical or alcohol dependency, as the data reveals, is the highest in our country’s history. Although the notion of attorney addictions and dependency issues may come as a surprise to those outside of the legal community, these issues are not breaking news. Rather, the data has been slowly emerging due to the increasing number of law students utilizing performance-enhancing substances and attorneys’ pleas for addiction assistance and support from the legal community.
But where does the foundation for dependency lie? How did it begin and what fuels that continuum? Are addicted attorneys merely victims of circumstance? Are the consequences more or less severe than those for non-attorney civilians? Are the current resources available adequate to provide proper assistance for attorneys in need? The cornerstone here is access to the resources prior to making precarious decisions of deceit and wrongdoing, coupled with proper support and rehabilitative systems.
This thesis will explore addiction and dependency issues of law students and lawyers alike by providing analyses of the triggers, aggravating factors, and consequences whilst contemporaneously evaluating currently available resources. Perhaps a current exploration of this data will result in a reimagining of the protocols surrounding publicized disciplinary actions against lawyers stemming from a dependency or addiction. Alternatively, the research results may lead to an expansion of the existing Lawyer Assistance Programs (LAP) to include mandatory therapy, specialized group sessions, monitored sponsorships and additional Continuing Legal Education (CLE) courses. Additionally, the research explores how disciplinary proceedings are handled in an arguably unfair forum, such as inconsistencies involving judicial discretion. Further, arguments will be made to bolster reasons as to why returning to the practice of confidential disciplinary proceedings would benefit those in need, including an analysis of current substance abuse confidentiality regulations seen in California and Louisiana.

resolution that grants this release can be invalidated. Finally, it is planned to address
the repercussions of the release and its interaction with the civil liability action
against the management provided for in art. 159 of the Law No. 6.404/1976,

Darbe nagrinėjama alkoholio vartojimo problemų turinčių asmenų gyvenimo kokybės kitimas atsižvelgiant į tai, kokius gydimo metodus jie pasirenka šiai problemai spręsti. Didžiausias dėmesys skiriamas AA grupių įtakai gyvenimo kokybei ir jos kitimui. Ši problematika Lietuvoje mažai tyrinėta, tačiau dėl alkoholio vartojimo masto Lietuvoje ir pasaulyje yra pakankamai aktuali. Darbe buvo iškeltas tikslas ištirti AA grupių įtaką alkoholio vartojimo problemų turinčių asmenų gyvenimo kokybės kitimui. Darbo tikslui pasiekti analizuota alkoholio vartojimo problemų turinčių asmenų lankiusių ir nelankiusių anoniminių alkoholikų grupes gyvenimo kokybė, jos kitimas ir vertybių bei gydymo metodo įtaka jai. Manoma, kad alkoholio vartojimo problemų turinčių asmenų, lankiusių anoniminių alkoholikų grupes, gyvenimo kokybė pagerėjo labiau, palyginus su tais kurie tų grupių nelankė arba buvo viena-du kartus ir daugiau nelankė.
Darbo tikslui pasiekti naudota PSO gyvenimo kokybės klausimynas (WHOQOL-BREF; angl. The World Health Organization Quality of Life – Bref, 1996), gyvenimo vertybių įvertinimas pagal Goštautą A, Javtoką Z, Žagminą K. (2001) ir gydymo metodo įvertinimas sudarytas pačios darbo autorės. Tyrime dalyvavo aliejų lyčių, nuo 18 iki 69 m. amžiaus, įvairios šeiminės, užimtumo, profesinės padėties ir išsilavinimo, šiuo metu besigydantys lankydami AA grupę, Minesotos programą ir medikamentiniu gydymusi, asmenys.

[toliau žr. visą tekstą] / This Paper deals with changing quality of life of the people with alcohol problems, depending on what treatment methods they choose to tackle this problem. The main focus is made on the impact of AA groups to quality of life and the changes thereof. This problem has been little researched in Lithuania; however, due to the consumed alcohol level in Lithuania and world widely this issue is sufficiently relevant. The objective of the Paper is to examine the impact of AA groups to the change of the quality of life of people who have alcohol-consuming problems. For the purpose of the Objective the quality of life and of the people with alcohol-consuming problems who attended AA groups and who not attended AA groups and the change of their quality of life were analysed, as well as the values and the impact of treatment methods on it were explored. It is estimated that the quality of life of the people with alcohol-consuming problems, who attended alcoholics anonymous groups, improved more in comparison with those who did not attend these groups or those visited them once or twice and did not attend them constantly.

Nous proposons tout d'abord une étude de plusieurs problèmes de l'algorithmique distribuée. Nous fournissons un modèle formel appliqué aux réseaux de diffusion anonymes. Dans ce modèle, nous caractérisons les graphes dans lesquels il est possible de résoudre l'énumération et l'élection. Cette caractérisation se base sur la notion d'homomorphisme de graphes. Nous proposons deux algorithmes dont la complexité est polynomiale et qui améliorent les complexités exponentielles connues jusqu'à présent. Dans un second temps, nous étudions le problème du calcul de l'état global et nous introduisons la notion de weak snapshot. Nous montrons qu'il existe des solutions pour ce problème dans les réseaux anonymes. Nous présentons plusieurs résultats concernant le calcul de l'état global en liaison avec des applications telles que le calcul de points de reprise, la détection de la terminaison ou encore le calcul d'une cartographie du réseau. Dans un cadre plus pratique, nous présentons la conception, le développement et l'implémentation des algorithmes proposés pour le calcul de l'état global au sein du logiciel de simulation et de visualisation ViSiDiA. / In this thesis, we first present a study of several problems in the field of distributed algorithms. We provide a formal model that relies on anonymous networks. In this model, we characterize graphs in which it is possible to solve enumeration and leader election problems. This characterization is based on graph homomorphism. We introduce two algorithms with polynomial complexities that improve existing works with exponential complexities. On the other hand, we study the snapshot problem and we introduce the notion of weak snapshot. We show that there exist solutions for this problem in the context of anonymous networks. We present several results about distributed snapshots that deal with checkpoint and rollback recovery, termination detection or the cartography computation of a network. In a practical aspect, we present the conception, the development process and the implementation of these distributed snapshot algorithms within the simulation and visualization software ViSiDiA.

Determination of Parenthood Determination of parenthood is very actual topic due to the constant changes of the traditional understanding of the family and family relationships. It is primarily the development of modern medical science, biology or genetics that has brought new concepts into the issue of determination of parenthood. My thesis deals with the child's right to know his or her genetic origin. It is a universal human right guaranteed by the Convention on the Rights of the Child. The Article 7, paragraph 1 states that every child has a right to know his or her parents, if possible. European Court of Human Rights repeatedly postulated that the right to know one's origin is an integral part of the right to respect for private and family life provided by the Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The purpose of my work is to explain on particular problems, to what extent is this right respected in the Czech Republic, in conformity with its international obligations. The text is based on valid legal status to June 21, 2011, with regard to proposed changes in the upcoming adoption of the new Civil Code. The text is systematically divided into seven chapters. Diploma thesis 77 million PlayStation Network accounts stolen, does it affect us?: An analysis of Internet discussions revolving around this topic deals with the case of what so far seems to be the biggest case of user information leak on the Internet. The introduction outlines the history and development of PlayStation consoles and maps major attempts to jailbreak the last generation of the console by hackers. The following section presents PlayStation Network itself, whose users were at risk of the loss of their online identity because of the attack and chronologically describes the course of breach-related events including the subsequent theft of user data. It also focuses in detail on the case of GeoHot - a hacker whose dispute with Sony alienated fellow hacker community and initiated retaliatory activities which as a result led to loss of data. Dans cette thèse nous considérons une plate-forme de filtrage collaboratif distribué dans laquelle chaque pair héberge ses informations personnelles, comme les URL qu'il a aimé, les pages d'information qui ont attiré son intérêt ou les vidéos qu'il a regardé, sur sa propre machine. Ensuite, sans reposer sur un tiers fiable, le pair s'engage dans un protocole distribué combinant ses données personnelles avec celles d'autres pairs afin d'exécuter un filtrage collaboratif. L'objectif principal est d'être capable de recevoir des recommandations personnalisées ou d'autres services comme un moteur de recherche distribué et personnalisé. Les protocoles de filtrage collaboratif basés sur les utilisateurs, qui demandent de calculer des similarités entre les utilisateurs, ont été appliqués aux systèmes distribués. Comme le calcul de similarité entre les utilisateurs nécessite d'utiliser leurs profils privés personnels, cela lève de sérieuses inquiétudes quant à la vie privée. Dans cette thèse nous adressons le problème du calcul de similarités entre les pairs sur une plate forme collaborative. Notre travail fournit une primitive préservant la vie privée pour le calcul de similarité qui peut rendre les protocoles collaboratifs respectueux de la vie privée. Nous adressons le challenge unique qui est d'appliquer des techniques de préservation de la vie privée pour le calcul de similarité aux systèmes dynamiques à large échelle. En particulier, nous introduisons un protocole cryptographique bipartite qui assure la differential privacy, une notion forte de préservation de la vie privée. De plus, nous résolvons le problème du budget de vie privée qui empêcherait les pairs de calculer leur similarité plus d'un nombre fixe de fois en introduisant la notion de canaux anonymes bidirectionnels. Nous développons aussi une variante hétérogène de la differential privacy qui peut apporter différent niveaux de confidentialité pour différent utilisateurs, et même différent niveaux de confidentialité pour différents items du profile d'un même utilisateur, prenant ainsi en compte différentes attentes en terme de préservation de la vie privée. De plus, nous proposons un protocole non interactif qui est très efficace pour publier une représentation compacte et préservant la vie privée des profiles des utilisateurs qui peut être utilisée pour estimer la similarité. Enfin, nous étudions le problème de choisir un paramètre de vie privée à la fois théoriquement et empiriquement en créant plusieurs attaques par inférence qui démontrent pour quelles valeurs du paramètre de vie privée le niveau de vie privée fournis est acceptable. / In this thesis, we consider a distributed collaborative platform in which each peer hosts his private information, such as the URLs he liked or the news articles that grabbed his interest or videos he watched, on his own machine. Then, without relying on a trusted third party, the peer engages in a distributed protocol, combining his private data with other peers' private data to perform collaborative filtering. The main objective is to be able to receive personalized recommendations or other services such as a personalized distributed search engine. User-based collaborative filtering protocols, which depend on computing user-to-user similarity, have been applied to distributed systems. As computing the similarity between users requires the use of their private profiles, this raises serious privacy concerns. In this thesis, we address the problem of privately computing similarities between peers in collaborative platforms. Our work provides a private primitive for similarity computation that can make collaborative protocols privacy-friendly. We address the unique challenges associated with applying privacy-preserving techniques for similarity computation to dynamic large scale systems. In particular, we introduce a two-party cryptographic protocol that ensures differential privacy, a strong notion of privacy. Moreover, we solve the privacy budget issue that would prevent peers from computing their similarities more than a fixed number of times by introducing the notion of bidirectional anonymous channel. We also develop a heterogeneous variant of differential privacy that can provide different level of privacy to different users, and even different level of privacy to different items within a single user's profile, thus taking into account different privacy expectations. Moreover, we propose a non-interactive protocol that is very efficient for releasing a small and private representation of peers' profiles that can be used to estimate similarity. Finally, we study the problem of choosing an appropriate privacy parameter both theoretically and empirically by creating several inference attacks that demonstrate for which values of the privacy parameter the privacy level provided is acceptable.

This thesis deals with coaching with an emphasis on career and personal development. Coaching is becoming a new phenomenon which helps a person to discover and maximize his or her potential. Through in-depth qualitative research it has been established which coaching services people are most interested in. One of the sub goals of this thesis was also to analyze current tendencies and trends in coaching. The theoretical information from expert sources were verified in the practical part of this thesis and emerged from public enquiry that clients usually use coaching services which are concerned with interpersonal relationships, managing financial resources and improving their opportunities on the labour market. In conclusion of this work, I evaluate the performance of set goals for this thesis and propose recommendations for putting this subject matter into practice.
