In Search of the 'Golden Thread': Common Law Interactions With Indigenous Law in Canada, Australia and New Zealand

The thesis explores the interactions of the common law with indigenous law in three jurisdictions: Australia, New Zealand and Canada. Case law involving family, criminal and land law is examined in detail, to establish how the common law has interacted with indigenous law. Two aspects of common law interactions are explored: judicial approaches to the recognition of indigenous law; and, judicial perceptions about the relationship between the common law and indigenous law. Courts faced with indigenous law have taken one of three approaches to recognising it. These are respectively referred to in the thesis as the non-recognition approach, the accommodation approach and the recognition approach. With regard to judicial perceptions about the relationship between the common law and indigenous law, the case law reveals seven different perceptions. They are: no relationship; mere acknowledgement; separate but capable of recognition; adjustment; assimilation/domination; assimilation/search for partnership; and absorption. Where a relationship is acknowledged, although perceptions may vary, essentially they can be placed in one of three categories. Courts may regard the relationship as one between two separate bodies of law, with points of intersection. They may regard it as one of convergence, perhaps even partial integration, between separate legal traditions. Finally, they may regard indigenous law as having been absorbed into the dominant legal system. Courts with this latter perception regard indigenous law as analogous to English local customs. Having identified more than one approach to the recognition of indigenous law, consideration is given to the circumstances in which the approaches are used, exploring differences arising out of the subject area in question and the jurisdiction in which the case is considered. The thesis also demonstrates that some correlation exists between the judicial approach to recognition of indigenous law and judicial perceptions about the relationship of the common law with indigenous law, though this correlation cannot be demonstrated in all cases. Lastly, the capacity of the common law to recognise changes to indigenous law is considered, where the case law reveals that both the judicial approach to recognition of indigenous law, and judicial perceptions about the relationship between the common law and indigenous law have a bearing on the capacity of the courts to recognise change. The thesis demonstrates that both the judicial approach to recognition of indigenous law and judicial perceptions about the relationship between the common law and indigenous law affect common law interactions with indigenous law.

Att göra sig förstådd : En kvalitativ studie av hjälpmedelstödd kommunikation mellan två personer utan funktionshinder

<p>I den här uppsatsen beskrivs kommunikationen stödd av ett talbaserat kommunikationshjälpmedel mellan två personer utan funktionshinder. Beskrivningen görs utifrån ett teoretiskt perspektiv som tar hänsyn till att kommunikation är en interaktiv social process och fokus ligger på processen i vilken man skapar samförståelse. En kvalitativ metod användes där observationer samlades in genom videoinspelningar av personer involverade i en måltid. Materialet analyserades genom en kommunikationsanalys i vilken fokus låg på hur samförståelse uppnåddes. Hastighetsbegränsning och symbolurvalet visade sig vara egenskaper hos kommunikationshjälpmedlet som påverkade kommunikationen på så sätt att deltagarna på grund av dessa fick reparera eller avbryta den aktuella konversationen. För att kompensera för hastighetsbegränsningen och symbolurvalet använde sig deltagarna framförallt av två olika strategier, den ena innebar att man genom samkonstruktion skapade yttranden och den andra innebar att man använde sig av den ackumulerade samförståelsen för att på ett så ekonomiskt sätt skapa yttranden. Sammantaget visade sig kommunikationen med hjälp av ett hjälpmedel vara en process i vilken alla deltagare var involverade och påverkades av situationen.</p>

"Har du kontrollen?" : En fallstudie om positionsöverlämningar på ATCC Stockholm

<p>Flygledare övervakar alla flygplan som färdas världen över genom att se till attflygplanen håller separationsgränserna. Flygledarna jobbar i pass på cirka en timme ochbyts sedan av, en så kallad positionsöverlämning. Det är viktigt att den som tar överpositionen får all information den behöver för att kunna fortsätta leda flygplanen på ett säkert sätt och eventuellt vidta åtgärder för att säkerställa en välordnad flygtrafik. Incidentrapporter visar att ett oproportionerligt stort antal incidenter sker 5- 15minuter efter en positionsöverlämning. På grund av detta vill LFV undersöka hur positionsöverlämningarna går till för att senare kvalitetssäkra dem. Syftet med denna rapport har varit att beskriva positionsöverlämningar på ATCC Stockholm. Resultatet visar att flygledarna till stor del använder sig av en memorerad checklista som inte skiljer sig mycket från den fysiska de har framför sig och följer därmed ett generellt mönster. Det visar även att det svåra kan vara att upprätthålla uppmärksamheten under alla överlämningarna. Resultaten ger LFV en utgångspunkt till att börja med kvalitetssäkringen. Ur ett akademiskt perspektiv visar resultaten en tillämpning på hurde teorier som används i studien kan appliceras i kontexten positionsöverlämningar mellan flygledare.</p>

An Understanding of Common Morality

<p>The idea of common morality is not a new idea. Philosophers have been engaged with it from the very early days. Many modern philosophers intend to perceive it when they compare or contrast it with the implications of ethical theories for genuine understanding of moral facts. They believe that without having any reference to what common people think, believe and practice, it is preposterous to construct a complete set of abstract norms and postulate them as relevant to practical life. In this work, proceeding with a motive of understanding the characteristic strength of common morality and to see how meaningfully we can designate the relevance of common moral beliefs in our applied ethical discussion, I am basically exploring two different accounts common morality view. The first one is the universalistic account which emerges from the works or Bernard Gert and Tom Beauchamp (including their colleagues), and the other one, I believe, sets its journey from the wombs of the critics of the first one. In this work, in order to properly designate the relevance of common morality, I am intending to develop the second account.</p>

Multi-unit common value auctions : theory and experiments

Research on auctions that involve more than one identical item for sale was,almost non-existing in the 90’s, but has since then been getting increasing attention. External incentives for this research have come from the US spectrum, sales, the European 3G mobile-phone auctions,  and Internet auctions. The policy relevance and the huge amount of money involved in many of them have helped the theory and experimental research advance. But in auctions where values are equal across bidders, common value auctions, that is, when the value depends on some outside parameter, equal to all bidders, the research is still embryonic. This thesis contributes to the topic with three studies. The first uses a Bayesian game to model a simple multi-unit common value auction, the task being to compare equilibrium strategies and the seller’s revenue from three auction formats; the discriminatory, the uniform and the Vickrey auction. The second study conducts an economic laboratory experiment on basis of the first study. The third study comprises an experiment on the multi-unit common value uniform auction and compares the dynamic and the static environments of this format. The most salient result in both experiments is that subjects overbid. They are victims of the winner’s curse and bid above the expected value, thus earning a negative profit. There is some learning, but most bidders continue to earn a negative profit also in later rounds. The competitive effect when participating in an auction seems to be stronger than the rationality concerns. In the first experiment, subjects in the Vickrey auction do somewhat better in small groups than subjects in the other auction types and, in the second experiment, subjects in the dynamic auction format perform much better than subjects in the static auction format; but still, they overbid. Due to this overbidding, the theoretical (but not the behavioral) prediction that the dynamic auction should render more revenue than the static fails inthe second experiment. Nonetheless, the higher revenue of the static auction comes at a cost; half of the auctions yield negative profits to the bidders, and the winner’s curse is more severely widespread in this format. Besides, only a minority of the bidders use the equilibrium bidding strategy.The bottom line is that the choice between the open and sealed-bid formats may be more important than the choice of price mechanism, especially in common value settings.

The Effect of Euro on Intra-Eurozone FDI Flows

Since the end of World War II, foreign direct investment (FDI) has been leading the international financial capital flows and has tripled in 2000s over the decade earlier. With its positive effect on economic growth of host countries via spill-overs, it became a race among countries to attract multinational enterprises (MNEs) to invest in their countries. The introduction of European common currency theoretically helps reduce the transaction costs across borders with the reduction of exchange-rate uncertainties and associated costs of hedging, facilitation of international cost comparison. Moreover, mergers and acquisitions activities (M&amp;As) account for 60-80% of FDI flows, and most MNEs engage in both export and setting up affiliates abroad, suggesting complementarity between trade and FDI. Thus reducing cross-border distance costs would encourage MNEs to increase its M&amp;A activities abroad, resulting in more inward FDI flows in the eurozone, especially among member states. The gravity equation is used in this paper to estimate the euro effect from the dataset of inward FDI flows of 24 countries during 1993-2007 and the result confirms that common currency stimulates more intra-eurozone inward FDI flows by approximately 58%.

The aim of the study was to understand limitations and possibilities to the discretion of managers in order to fulfill wishes of users. The study is based on six interviews, three with managers and three with staff in common homes for mentally disabled people. The study took place in a municipality in Sweden in the spring of 2010. We used an interview guide with specific themes and questions. The theoretical framework was based on organizational theories as well as theories about management and discretion. The result suggests that there are limitations to a certain degree such as the quantity of staff and economy. There are some possibilities to enable discretion including the use of the hierarchy within the organization. Another possibility is to make use of the knowledge of the staff about the demands and wishes of users. The conclusion of the study is that there are both limitations and possibilities that have an effect on the discretion of managers in a complex organization. These limitations and possibilities affect each other and the meaning of them depend on the unique situation.
