Le devenir des très grands prématurés est marqué par la survenue de complications pouvant retentir sur la qualité de vie des enfants et de leurs familles. Si des données de qualité de vie sont disponibles dans la littérature internationale, il n’y en a pas sur la qualité de vie des très grands prématurés nés dans nos maternités. La qualité de vie est un concept récent proposé comme critère d’évaluation des stratégies de soins mais dont l’utilisation reste limitée. Peu de travaux explorant les facteurs explicatifs de cette limitation sont rapportés. Dans le domaine précis de la médecine périnatale et en particulier celui de la très grande prématurité, aucune donnée explorant ces freins n’est rapportée.L’absence de données à la fois sur la réalité de la qualité de vie des enfants nés très grands prématurés et sur la perception qu’en ont les professionnels soignant ces patients, nous a amenés à examiner le positionnement des médecins décideurs face à cet aspect qualitatif de la santé ainsi que la place de la qualité de vie dans la réflexion éthique en médecine périnatale.Notre recherche s’articule autour de trois axes : 1. L’évaluation de la qualité de vie d’une cohorte marseillaise d’enfants prématurés français, âgés de 6 à 10 ans, à partir d’une approche parentale. 2. L’étude de la perception des médecins experts de périnatalité et des médecins impliqués dans le suivi de ces enfants vis-à-vis de la prise en compte de la qualité de vie. 3. L’approche éthique de la qualité de vie à partir de la perception des médecins. / Extremely preterm children oucome is marked by the development of severe complications than can affect the quality of life of the children and their families. The coverage of these children brings decisional dilemma to physicians. While international data on preterm children quality of life are available, French preterm children quality of life remains unexplored. Quality of life is nevertheless a part of the ethical reflection of the professionals of perinatal period.Quality of life is a recent concept proposed as a criterion for evaluating care strategies but its use remains limited. Few published works have investigated the reasons for this limited use. In the field of prematurity, no data exploring these obstacles have been reported.Because of the lack of data on French preterm children quality of life and on the perception of physicians who manage preterm children, we decide to explore physicians’ perspective on the health related quality of life of extremely preterm children and the place of quality of life in ethical reflection in perinatal medicine.Our study consists in three parts: 1. A study describing health related quality of life of a cohort of French preterm children aged 6-10 years. 2. The study of physicians’ perception on health related quality of life assessment in preterm children. 3. The ethical approach of quality of life from the physicians’ perception.

This study examines the ethical challenges that Swedish social workers may facedue to the proposed “Informationsplikt” (Duty of Disclosure). Rooted in the Tidö-Agreement between government parties and the Swedish Democrats, thisobligation mandates public officials, including social workers, to verifyindividuals legal right to reside in the country and report undocumentedimmigrants to the police. Amid widespread criticism and demonstrations againstwhat is colloquially referred to as the “Angiverilagen” (The Informer Act),professionals have voiced concerns about the potential ethical implications ofenacting this proposed legislation. Through qualitative interviews with six socialworkers, this research investigates how this proposed law as a part of bureaucraticregulations intersects with personal values and professional ethics among socialworkers. The findings reveal a conflict between the reporting obligation andsocial workers personal and professional values. Respondents express acommitment to upholding their clients’ rights and dignity, while expressingapprehension that this mandatory reporting may compromise these principles.Discussions about potential strategies, such as seeking legal loopholes withinexisting legislation or contemplating civil disobedience or resignation, shed lighton the difficulties social workers may encounter in navigating these ethicalchallenges in the future. Overall, this study underscores the tension betweenfollowing laws and regulations and the core tenets of social work ethics,emphasizing the importance of social workers navigating these complexities withintegrity and ethical reflection.

Résumé : L’objectif de ce travail est d’étudier ce qui amène une personne malade à formuler un refus de traitement, à partir d’une triple approche. Celle du patient et de ses proches, celle des professionnels confrontés à ce refus, celle d’un groupe de réflexion éthique, pluri professionnel, rassemblant des représentants des sciences humaines, ainsi que des « citoyens ordinaires » non professionnels de santé, apportant le regard de la cité. Chercher le sens d’un refus consiste à analyser et décrypter une volonté de la personne que quelque chose se produise ou ne se produise pas, et correspond à la dialectique du don et de l’acceptation du soin. Refuser un traitement n’est pas refuser un soin. Les situations de refus constituent un champ de réflexion sur nos comportements, individuels et collectifs, nos doutes, nos incertitudes ainsi que sur des valeurs en conflit. Ce travail étudie la complexité des problèmes rencontrés à ce sujet en pratique clinique quotidienne, pour en approfondir le questionnement dans l’interaction qui se joue entre les différents acteurs. Il montre aussi l’importance des méthodes de travail à mettre en place pour favoriser l’éthique du dialogue. Face aux choix auxquels sont confrontés ceux qui assument la responsabilité de la décision, la question se pose de savoir vers quelles ressources se tourner pour favoriser la réflexion éthique, évitant l’arbitraire des convictions personnelles. / Abstract : The objective of this work is to study what brings a sick person to formulate a refusal of treatment, based on a three-pronged approach. One of the patient and his relatives, one of professionals faced with this refusal, and one of a multi-professional ethics reflection group, bringing together representatives of humanities and social sciences, as well as “ordinary citizens”, bringing the outside eye of the city. Looking for the meaning of a refusal consists of analyzing and decoding a willingness of the person that something happens or does not happen, and corresponds to the dialectic of the gift and acceptance of the care. To refuse a treatment doesn’t mean refusing care. Situations of refusal pave the way for reflection about our individual and collective behavior, our doubts, our uncertainties as well as conflicting values. This work explores the complexity of such problems encountered in daily clinical practice, in order to deepen the questioning about the interaction played between the different actors. It also shows how important it is to working methods that promote the ethics of dialogue. Considering the choices faced by those who assume the responsibility for the decision, the question arises of which resources to use to promote ethical reflection, avoiding the arbitrary nature of personal convictions.

[pt] Esta dissertação apresenta o Template de Metacomunicação Estendido, uma ferramenta, denominada Template Estendido de Metacomunicação, baseada em um conjunto de perguntas-guia derivadas da teoria da Engenharia Semiótica. Relatamos os resultados de um estudo para avaliar seus impactos no processo de design de sistemas de aprendizagem de máquina. Ao solicitar que designers e desenvolvedores respondam um conjunto de perguntas, a ferramenta busca auxiliá-los a organizar mentalmente suas interpretações da solução de design, ao mesmo tempo que revisitam as pressuposições por trás dela. Descrevemos, então, um estudo de design especulativo e analisamos seus resultados, identificando temas emergentes que nos ajudam a entender como a ferramenta proposta pode ser utilizada. Dentre os aspectos identificados mais relevantes estão a prática reflexiva do design, a atenção ao uso de linguagem, a atribuição de responsabilidade às pessoas envolvidas, o uso do arcabouço ético de apoio fornecido, os princípios da bioética, e as possíveis formas de se usar o template estendido. / [en] This dissertation presents the Extended Metacommunication Template, a tool based on a set of guiding questions derived from the theory of Semiotic Engineering. We report the results of a study we conducted to evaluate the tool s impacts on the design process of machine learning systems. By having designers and developers answer a set of questions, the tool aims to help them reflect on their interpretations of the design solution, while allowing them to revisit the presuppositions behind it. We then describe a speculative design study and analyze its results, identifying emergent themes that help us understand how the proposed tool may be used. Among the relevant themes identified are: the reflective practice of design, the designer s focus on their use of language, the process of attributing responsibility to the people involved, the use of the ethical framework provided to them, the bioethical principles, and the ways in which the extension of the template may be used.

First, theoretical foundations of social work are outlined, followed by definition of subsidiarity principle, subsidiarity genesis, its role within European Union. Ethical foundations, specific application of subsidiarity, and last but not least, criticism of this principle, follow. The diploma thesis is theoretical.

La réflexion éthique au service de l'analyse des pratiques professionnelles sur un territoire de santé / Ethical reflection in the service of the analysis of professionnal practices on a territory of health

Le sens de l’exercice soignant se fonde sur le “vivre ensemble” et se nourrit d’un important besoin de réflexion éthique que l’on retrouve tant chez les étudiants qu’auprès des professionnels de santé. Pour autant, l’exercice de la réflexion et le développement de la formation à l’éthique ont été peu présents en formation initiale et dans le parcours de la majorité des professionnels en activité. La posture individuelle réflexive ne suffit pas et doit être complétée par une démarche collective de réflexion éthique associant le patient, sa famille ou ses proches, au dialogue interdisciplinaire. La commission « éthique et professions de santé » (rapport A Cordier 2003) a identifié un manque de lieux et de temps pour les soignants, leur permettant de « formaliser » leur réflexion éthique. Cette thèse se propose d’identifier les dispositifs à construire, au travers de séquences de simulation en santé, afin d’accompagner les acteurs du soin dans cette démarche de questionnement à priori mais aussi à postériori,.Des questionnaires seront utilisés afin d’enrichir et de conforter l’hypothèse centrale.Un autre axe de recherche tentera d’objectiver les variations du niveau de pertinence des principes éthiques en jeu, en fonction des contextes et ceci au travers d’observations menées lors de réunions pluridisciplinaires, entre professionnels du soin..Enfin et en réponse à la question de départ, il apparait qu’un programme de Développement Professionnel Continu (DPC), conçu comme « nouvel espace de la réflexion » semble être une opportunité à saisir, pour aider les acteurs du soin à clarifier les situations et à construire en collégialité, le sens de leur pratique. / The meaning of the nursing exercise is based on the notion of “living together” and feeds on an important need for ethical reflection both from students and healthcare professionals. However, the reflection exercise and the development of training in the field of ethics have been scarce in initial training and in the career path of most of professionals in service. The individual reflexive position is not sufficient and must be completed by a collective approach of ethical reflection in which the patient, his/her family or his/her close relations are associated with interdisciplinary dialogue. The “Ethics and Health Professions” committee (as per the A Cordier report in 2003) pointed out a lack of locations and time for the nursing staff, which could allow them to “formalize” their ethical reflection. This thesis suggests identifying the systems to be created in order, for example of the sequences of simulation in health, to accompany nursing players in this questioning approach a priori but also exposit. Questionnaires will be used to enhance and consolidate the main assumption. Another research focus will attempt to objectify changes in the level of relevance of ethical principles involved, according to contexts and through observations conducted during multidisciplinary meetings between health professionals. This approach will attempt to validate another hypothesis. Finally, to answer the initial question, it appears that a Continuous Professional Development program (DPC), designed as a “new area for reflection” seems to be an opportunity that must be seized, to help care providers to clarify situations et build their practice purpose in a collegial manner.

Etická dilemata sociálních pracovníků při práci s obětí domácího násilí / Ethical dilemmas of social workers working with victim of domestic violence

The thesis deals with the topic of ethical dilemmas of social workers who meet the victims of domestic violence in their practice. The thesis is theoretical in nature, supplemented with research. The first chapter is devoted to the topic of domestic violence, it especially describes specifics of social work with the target group and points to the possible causes of formation of the dilemmas when working with clients. The second part of the diploma theses shortly defines the concept of ethical dilemma and its place in the social work practise. There are also mentioned examples of possible dilemmas in social work. In this part the final theses draws particularly from the authors L. Musil, S. Banks, D. Nedělníková and M. Nečasová. Major part of the second chapter occupies with concrete ethical dilemmas that relate to social work with victims of domestic violence and with their detailed description. The ethic dilemmas were identified on the basis of research made with eight social workers. A semi-structured interview completed by observation was chosen as the method. The last chapter introduces the ethical theories of deontology, utilitarianism and care ethics. It points to the importance and benefit of ethical theories for practise of social work in general and for social workers themselves. Two chosen ethical dilemmas, identified on the basis of research, are reflected from a position of ethical approaches mentioned above.

In the Administration area there are very few studies which approach the topic of ethics on research. The present paper tried to fill in this gap in the production of knowledge about the topic, investigating how the ethical principles found in the literature and in the codes of conduct are noticed and taken into account in Administration research activities developed by acting researchers in Administration Post Graduation Programs. Theoretically speaking, the study was based mainly on the approaches by Creswell (2007) and Bell and Bryman (2007), which discuss the research ethical principles. Methodologically speaking it was all about an exploratory kind of study, with qualitative research approach. Upon data collection, personal interviews were made aiming at its depth and focus groups were formed. The first stage had interviews with four experienced researchers who took part on a teaching and researching event and on the second stage we used the focus group technique. The focus groups were done in four college institutions along with the post graduation programs in Administration in the states of Rio Grande do Norte, Para?ba and Pernambuco, in Brazil. The results suggest the existence of general principles and parameters for the scientific research recommended in the literature and on official resolution. However, in the Administration area, there are only a few recommendations of good practices when it comes to submitting articles for scientific publications but we found no guidance with ethical principles and parameters which cover all the activities in the scientific research and which specifically meet the research particularities in Administration. The main ethical dilemma pointed by the researchers refers to ethical questions which arise at the time of data collection and on disclosing the results. Most researchers do not know the guidelines and the ethical norms on ethics about research that we have in our country neither do they send in their projects to the research ethics committee. When dilemma arises, they decide the ethical question based on their values and common sense. These elements confirm the thesis that the researcher s procedure in the research activities in Administration is predominantly signed by personal values or by common sense and less by ethical principles, whether by not knowing the normative instruments related to ethics or by disagreeing with any disciplining rules on ethical behavior in the research / A ?tica na pesquisa cient?fica ? um tema abordado e muito discutido em diversas ?reas do conhecimento ligadas ? sa?de.
