Le sujet de cette thèse est le paysage dans sa spécificité viticole analysée comme représentation spatiale dans le processus de construction de l'espace géographique de la vitiviniculture et aussi dans l'utilisation des images du paysage viticole comme l’image spatiale des vins des régions des Indications de Provenance (IP's) Vale dos Vinhedos, Pinto Bandeira et Monte Belo (Brésil). Les sources théoriques sont en lien avec la Géographie Critique et la Géographie Culturelle. L'objectif a été d'expliquer le paysage viticole comme représentation spatiale des régions et d’analyser l'image du paysage viticole comme symbole spatial pour les vins des IP's. L'organisation de l'espace géographique des régions de IP's s'insère dans le contexte de la colonisation italienne. Le développement de la vitiviniculture régionale a occasionné des conditions de mise en oeuvre des IP's, dont les associations de producteurs ont utilisé des images de paysages viticoles pour construire le lien espace-régiontoponyme- vin. L'analyse des paysages a révélé six types et un sous-type avec deux formes de paysages viticoles traditionnels et cinq types de paysages viticoles modernes, y compris les éléments emblématiques naturels et construits, entre lesquels se remarquent l’Araucaria angustifolia, et l'usage des Platanus acerifolia pour soutenir les vignobles, héritage de la tradition viticole étrusque. L'analyse des images des paysages viticoles utilisées par les associations a montré qu'il y a des différences significatives et la majorité sont paysages viticoles traditionnels. Les IP Vale dos Vinhedos et IP Monte Belo ont établi des liaisons directes entre espace-vinpaysage, mais non celle de IP Pinto Bandeira. La recherche a montré que le paysage viticole est un symbole de la représentation de l'espace régional et du vin des IP’s Vale dos Vinhedos, Pinto Bandeira et Monte Belo. / O tema da tese é a paisagem em sua especificidade vitícola, analisada como representação espacial no processo de construção do espaço geográfico da vitivinicultura e no uso da imagem da paisagem vitícola como imagem espacial dos vinhos das regiões das Indicações de Procedência (IP’s) Vale dos Vinhedos, Pinto Bandeira e Monte Belo, Brasil. O objetivo foi explicar a paisagem vitícola como representação espacial das regiões e analisar a imagem da paisagem vitícola como símbolo espacial para os vinhos das IP’s, cujas bases teóricas estão na Geografia Crítica e na Geografia Cultural. A organização do espaço geográfico das regiões das IP’s insere-se no contexto da colonização italiana, da qual a vitivinicultura é elemento cultural. O desenvolvimento da vitivinicultura regional levou à implementação de IP’s e ao uso de imagens de paisagens vitícolas, pelas associações de produtores, para construir o vínculo espaço/região-topônimo-vinho. A análise das paisagens das regiões revelou seis tipo e um subtipo em duas formas de paisagens vitícolas tradicionais e cinco tipos de paisagens vitícolas modernas, incluindo elementos emblemáticos naturais e construídos, entre os quais se destaca a Araucaria angustifolia e o uso do Platanus acerifolia para sustentar os vinhedos, herança da tradição vitícola etrusca. A análise das imagens de paisagens vitícolas usadas pelas associações evidenciou que há diferenças significativas sendo, a maioria, de paisagens vitícolas tradicionais. As associações das IP’s Vale dos Vinhedos e Monte Belo estabeleceram vínculos diretos entre espaço/vinho/paisagem, mas não IP Pinto Bandeira. A pesquisa evidenciou que a paisagem vitícola é um símbolo representacional do espaço regional e do vinho das IP’s Vale dos Vinhedos, Pinto Bandeira e Monte Belo. / The theme of this thesis is the landscape in its specificity vineyard analyzed as a spatial representation in the building process of the geographical area of viticulture growing and the use of image of vineyard landscape as spatial landscape of the wine of the regions of Geographical Indication (GI’s) Vale dos Vinhedos, Pinto Bandeira and Monte Belo, Brazil. The objective was to explain the use of vineyard landscape as spatial representation and the images of vineyard landscape as spatial symbol for the wines of GI’s. The theoretical sources to analyze are related to the Critical geography and with the Cultural geography. The organization of the geographic area of the regions of GI’s comes within the context of the Italian colonization process in which its culture was part of the cultivation of vines. The vineyard regional industry development took the conditions of implementation of GI’s, whose producers associations begun to use images of landscape wine to build wine-region-toponym. The landscape analysis revealed six types of traditional wine-growing landscapes and a subtype of landscapes and five types of modern wine landscapes, occurring in both natural and constructed features characteristic among these was the Araucaria angustifolia and the use of Platanus acerifolia in support of the vineyards, and is the Etruscan wine growing tradition. The analysis of the landscape vine images used by associations showed that there are significant differences; the most are images of traditional vine landscape. The association of GI’s Vale dos Vinhedos and Monte Belo established direct links of wine-region- landscape, but not IG Pinto Bandeira. The survey showed that landscape is a representational symbol of regional area and of the wine of GI’s from Vale dos Vinhedos, Pinto Bandeira and Monte Belo.

There are presented procedures of enforcement of rights to marking, definitions of terms and practical examples. The works concentrate not only on Czech legal regulations but also on legal regulations of the European Union and legal regulations of international institutions such as for example agreement TRIPS.

Communautarisation et mondialisation du droit de la propriété intellectuelle / Communitization and Globalization of Intellectual Property Law

L’internationalisation du droit de la propriété intellectuelle, initiée à la fin du XIXe siècle, a pris depuis la fin du XXe siècle une toute nouvelle tournure avec son inclusion dans le champ des disciplines commerciales multilatérales. La signature de l’accord ADPIC marque en effet l’émergence d’une véritable gouvernance mondiale de la propriété intellectuelle : l’ambition affichée par l’OMC est d’encadrer, substantiellement parlant, la marge de manœuvre des membres dans la mise en place de leurs politiques de protection. Bien qu’initié plus tardivement, la communautarisation du droit de la propriété intellectuelle revêt désormais une portée considérable : outre une conciliation effective des régimes nationaux de protection avec les principes cardinaux du traité, d’importantes directives d’harmonisation ont été édictées, et des titres européens de protection ont même été créés dans certains secteurs. Notre étude a pour vocation de montrer comment la communautarisation, au-delà de son rôle traditionnel de source du droit, officie comme un indispensable vecteur de structuration de la position européenne vis-à-vis de la mondialisation du droit de la propriété intellectuelle. Dans son versant ascendant tout d’abord – du local au global –, le vecteur communautarisation joue un rôle de mutualisation des objectifs à promouvoir sur la scène internationale. L’enjeu n’est autre que celui de façonner une gouvernance mondiale de la propriété intellectuelle qui corresponde au système d’intérêts et de valeurs de l’Union, conformément aux objectifs ambitieux assignés par le Traité. Ce processus de mutualisation n’a toutefois rien d’automatique : d’importantes contraintes institutionnelles – malgré plusieurs révisions du Traité et la progression graduelle de l’harmonisation en interne – contrarient l’émergence d’une véritable politique européenne extérieure intégrée. Mais c’est précisément à l’aune de ces contraintes qu’il convient d’apprécier la portée des accomplissements de l’UE, qui a su s’imposer comme un acteur central de la gouvernance mondiale du droit de la propriété intellectuelle. Dans son versant descendant ensuite – du global au local –, le vecteur communautarisation s’accompagne d’une montée en puissance du juge de Luxembourg dans l’arbitrage des situations d’interactions normatives fréquentes et complexes entre le droit de l’Union et le droit international de la propriété intellectuelle. L’étude systématique de la résolution par la Cour de ces interactions normatives montre combien celle-ci s’attache à préserver l’autonomie de l’ordre juridique de l’Union, en ménageant une marge d’appréciation significative dans la mise en œuvre des obligations découlant de la mondialisation du droit de la propriété intellectuelle. Cette marge d’appréciation est mise à profit pour assurer la défense d’un modèle européen original en construction, tirant parti des flexibilités du cadre normatif mondial. / The internationalization of IP Law, initiated at the end of the 19th century, has taken since the end of the 20th century a brand new twist with its inclusion in the field of multilateral trade disciplines. The signing of the TRIPS agreement marks the emergence of a global IP governance. Indeed, the ambition displayed by the WTO is to supervise the margin of maneuver of its Members in implementing their policies. Although Communitization of IP law started much later, it now has a considerable scope: national protection regimes have been conciliated with the cardinal principles of the Treaty, some important harmonization directives have been enacted, and various European titles of protection have even been created. Our study is designed to show how Communitization, beyond its traditional role of source of law, officiates as a necessary and efficient vector for structuring the European position towards the Globalization of IP Law. In its ascendant side first -- from Local to Global, the Communitization vector plays a role of merging the objectives to be promoted on the international scene. The issue at stake is to shape an IP global framework that corresponds to the system of interests and values of the EU, in accordance with the far-reaching objectives assigned by the Treaty. This merging process is, however, not automatic. In spite of several amendments to the Treaty and of the progress of internal harmonization, various institutional constraints thwart the emergence of a fully integrated external European policy in the field of IP. But it is precisely in light of these constraints that the scope of the achievements of the EU, which in now recognized as a central actor in the global IP governance, must be appreciated. In its down side then -- from Global to Local, the Communitization vector is accompanied by a rise of the European Court of Justice in arbitrating complex normative interactions between national, EU and International IP Laws. A systematic analysis of the resolution by the ECJ of these normative interactions reveals its determination to safeguard the autonomy of the EU legal order, by arranging for significant discretion in implementing international commitments. This margin of appreciation is used to defend an original European model under construction, taking advantage of the flexibilities of the global normative framework

Les négociations internationales concernant la protection des indications géographiques connaissent, depuis près de deux décennies, un blocage au sein de l’Organisation Mondiale du Commerce opposant des pays défenseurs des indications géographiques, à des pays plus sceptiques. Résultant d’un compromis entre l’approche des pays de l’Union Européenne et celle des Etats-Unis, les standards minimum de protection des indications géographiques de l’ADPIC ont mis en lumière la diversité des approches juridiques en la matière et fait émerger un débat quasi-passionnel sur les moyens appropriés que l’Etat doit mettre en œuvre pour protéger les noms géographiques. L’histoire renseigne sur le fait que le plaidoyer pour ou le réquisitoire contre l’un ou l’autre camp ont toujours tourné autour des philosophies de la protection des indications géographiques : d’une part, les pays défenseurs des indications géographiques prônent à travers leur mise en œuvre, la protection d’industries plus vulnérables à la concurrence ; d’autre part, les pays sceptiques privilégient le plus possible, la liberté du commerce et de l’industrie et par ricochet, la libre exploitation des signes. Pour ces derniers, seule la reconnaissance par le consommateur d’une association qualité-origine du produit justifie une réservation du nom. Le régime multilatéral des IG issu de l’Accord sur les aspects de la propriété intellectuelle qui touchent au commerce résulte donc d’un compromis entre ces deux philosophies de la protection. D’aucuns ont souligné le caractère insatisfaisant d’un tel compromis qui ne rend pas nécessairement compte de la nature réelle de ces signes géographiques. Ce travail tente de le transcender. Il est fondé sur le pari que, dans une perspective juridique, tout n’a peut-être pas été essayé. Dans un effort pour trouver un dénominateur commun et pour proposer une solution à l’impasse actuelle, cette recherche repose sur le rapprochement du régime de protection des indications géographiques, au régime de protection des droits de l’Homme. Non pas dans une perspective moralisatrice mais bien dans un effort pour déduire des solutions concrètes quant à la portée de la protection internationale des IG et du rôle des Etats dans la mise en œuvre de ces outils de propriété intellectuelle. L’article 15.1 c) du Pacte sur les droits économiques, sociaux et culturels prévoit : « Chacun a droit à la protection de ses intérêts moraux et matériels découlant de toute production scientifique, littéraire ou artistique dont il est l’auteur ». L’activation de cet article pourrait permettre de voir en les détenteurs d’IG non pas seulement les sujets bénéficiaires de la protection mais les sujets destinataires de politiques publiques. Il y aurait un donc un « droit de » bénéficier d’une certaine protection des IG et un « droit à » certaines prestations publiques. Au-delà de ce cadre en apparence rigide, le recours au droit international des droits de l’Homme rend la recherche d’un équilibre entre les droits de détenteurs IG et les droits du public plus intégratrice d’enjeux multiples et indispensable à la légitimité du régime multilatéral de protection des IG. / Since two decades, the international protection of geographical indications is characterized by a “blockage” in the negotiations at the World Trade Organization opposing the countries favorable to the protection of geographical indications to countries more skeptical in this regard. Deriving from a compromise between the European conception of the protection of GIs and the American one, the minimum standards of TRIPS have revealed the different legal options in this field and have resulted in a passionate debate over the appropriate role of the State. History shows that the advocacy for, or indictment against one or the other way of protecting GIs focuses essentially on the philosophy of protection in one or the other territories. As a reminder, the European Union “culture” is to protect industries far too exposed to competition while the American “culture” is to preserve economic freedom of operators and to grant monopoly on a geographical name only where such name has been tested on the market and is recognized by the “public” as having a geographical anchorage. Equally compelling, neither of these philosophies has allowed reaching the most acceptable balance for GI regime. This work seeks to transcend them. It bets that everything has not been tried yet, at least from a legal perspective. In order to find a common solution and a way forward to multilateral protection of geographical indications, the paper relies on the culture of “human rights”, not really with a view to “moralize” the field of study but more to deduct practical answers deriving from the international human rights law. As a matter of fact, article 15.1 c) of the Convention on Economic, Social and Cultural Rights provides that “The States Parties to the present Covenant recognize the right of everyone […] to benefit from the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author”. The activation of this article could allow approaching geographical indications operators, not only as beneficiaries of certain rights but also as beneficiaries of public policies. By virtue of article 15.1 c), there shall be a right to benefit from the GI protection (“right-liberty”) but also, a right to claim certain public policies (“right-debt”) in this regard. Beyond this seemingly strict framework for GIs, the reference to international human rights law proves to beneficial to the necessary balance between the rights of GI operators and the rights of the public. Incidentally, this balance is inclusive of multiple issues which is essential to the legitimacy of the multilateral regime of protection of GIs.

Due to the globalization of economy, the protection of intellectual property rights becomes very important, not only on a national and local basis but also on an international basis. The evidence is coming from the negotiation and ultimately the inclusion of the TRIPS Agreement, or Agreement on Trade Related Aspects of Intellectual Property Rights, into the World Trade Organization. In the TRIPS Agreement, one of the protections to a local intellectual property on an international level is the protection of geographical indications, and such protection can be found in Articles 22 through 24 of the TRIPS Agreement. Geographical indications identify goods as originating in a particular territory or region, and also indicate quality by letting consumers know that the goods come from an area where a given quality, reputation, or other characteristic of the goods is essentially attributable to their geographical origin. The protection of geographical indications has always been on the table and been mentioned in various international treaties, and eventually came together under the TRIPS Agreement. The different ways for geographical indications protection is examined in order to understand the different national regulations used in various countries as a tool to protect the geographical indications, hence, to protect intellectual property rights. The major issue regards the scope of protection is the extension of the TRIPS Article 23; diverse opinions and suggestions are coming from US and EU, the two biggest sovereignties. This also can be seen in the result of the WTO dispute case of EC – Trademarks and Geographical Indications. The future developments such as the negotiations for a multilateral system of register for geographical indications, the progress of developing countries toward protection of geographical indications and the involvement of the traditional knowledge, all play very crucial roles on the enforcement of geographical indications protection. This paper will explore all these matters.

Specifically, this research project involved: completing in-depth interviews with 15 women who planned a vaginal birth with limited medical intervention but instead experienced an unplanned c-section between six months and two years ago; discovering and describing the nature of the birth the mothers originally envisioned for their child; exploring the women’s experiences with, and feelings about, the birth itself and how it might differ from what they envisioned; developing a better understanding of how these experiences and feelings affected the women during the first two years following the birth; describing any challenges they faced and how, if at all, they managed such challenges; and identifying strategies that could be used to improve the experience of women recovering from an unplanned c-section who envisioned a vaginal birth with limited medical intervention.

The relationship between international regimes regulating intellectual property, traditional knowledge and biodiversity has received much attention in recent times. Of the many complex and controversial issues in contemporary international legal discourse on this matter, the protection of traditional knowledge (TK) stands out as a significant challenge. Choices abound in the search for modalities to regulate rights to use and control TK systems and their underlying biodiversity. In recent times, the protection of geographical indications (GIs) has emerged as an option for protecting TK. Despite the considerable enthusiasm over it, there is appreciable research dearth on how far and in what context GIs can be used as a protection model. Indeed, not only is the concept of GIs itself widely misunderstood. As well, analyses as to their applicability for protecting TK often reflect underlying cultural differences in the nature, scope and the jurisprudence regarding GIs across jurisdictions. This thesis examines the relationship between GIs and TK, focusing on the responsiveness of GIs to the needs and desires of indigenous peoples and local communities (ILCs). The thesis posits that the search for a model to protect TK should involve identifying different modalities, including those based on intellectual property, to fit to the nature and uses of TK in particular contexts. The analysis conceptualizes GIs as a form of IP that are structurally and functionally suitable to protect aspects of TK in traditional knowledge-based agricultural products (TKBAPs). Substantively, the thesis draws attention to the conceptual underpinnings of GIs as encompassing cultural and economic objectives in the protection of TK. As such, it is argued that stronger protection of GIs should be achieved by integrating the negotiations and discussion concerning GIs and TK at the international level. Further, the case is made for the determination of immediate challenges and long-term opportunities in choosing a legal means for protecting GIs at the national level. In this connection, the thesis suggests that the potential of GIs to meet national and local imperatives to protect TK be assessed, inter alia, based on their instrumentality for economic, biodiversity, cultural and food security objectives in protecting TKBAPs.

La construction de la propriété intellectuelle au Cambodge remonte à une date récente. Cetteconstruction se traduit, d’une part, par l’adoption d’un cadre juridique consacrant la notionjuridique de la propriété intellectuelle et, d’autre part, par l’élaboration des mécanismes deprotection de la notion consacrée.Comme la législation de la propriété intellectuelle a été adoptée pour assurer la conformité dudroit cambodgien aux exigences de l’OMC, il n’est pas surprenant de constater que la notion et lerégime juridique de la propriété littéraire et artistique et ceux de la propriété industriellecambodgiennes sont presque identiques à ceux qui sont prévus dans l’Accord ADPIC et dans lesTraités et Conventions administrés par l’OMPI. À cause des obstacles d’ordre juridique,économique et social, la plupart des lois cambodgiennes de la propriété intellectuelle ne connaitpas encore une application effective et correcte dans la pratique. En conséquence, la notion de lapropriété intellectuelle cambodgienne est très peu développée.Pour faire respecter le titre de propriété littéraire et artistique et celui de la propriété industrielle,les mécanismes légaux et judiciaires visant à prévenir les atteintes au droit exclusif dont disposentles titulaires du droit, à préserver les éléments de preuves et à réprimer des atteintes sont prévusdans la législation cambodgienne portant sur la propriété intellectuelle. Par ailleurs, le recours auxmodes alternatifs de règlements de litiges tels que l’arbitrage commercial, la médiation et laPreliminary Alternative Disputes Resolution est également possible. L’efficacité et l’effectivitéde la mise en oeuvre de ces mécanismes pour la protection de la propriété intellectuelle sur leterritoire cambodgien sont une question d’actualité. / The construction of intellectual property rights in Cambodia dates back to a recent time. This construction implies, on the one hand, the adoption of a specific legal framework that establishes the notion of intellectual property and, on the other hand, the elaboration of protection mechanisms of the established notion. As the legislation on intellectual property was adopted to ensure the conformity of Cambodian law with WTO requirements, it is not surprising that the notion and legal regime of literary and artistic property and that of industrial property are almost identical to what is provided under TRIPS Agreement and other Treaties and Conventions administered by the WIPO. Because of legal, economic and social barrier, most of Cambodian laws relating to intellectual property have not been effectively and correctly applied in practice. Consequently, the notion of intellectual property has not been well developed.To enforce the exclusive right of literary and artistic property and that of industrial property, the legal and judicial mechanisms aiming at preventing infringement, preserving the proofs and punishing the infringement are provided under Cambodian legislation relating to intellectual property. Moreover, utilization of alternative disputes resolutions mechanisms such as commercial arbitration, mediation and Preliminary Alternative Disputes Resolution, is also possible. The efficiency of these mechanisms for the protection of intellectual property in Cambodia is, however, a topical question.
