Esta pesquisa propõe a investigação das práticas educativas desenvolvidas por organizações da sociedade civil e pessoas voluntárias no interior do sistema penitenciário do estado de São Paulo. Tais iniciativas, que se constituem em partilha da responsabilidade entre Estado e sociedade civil, são previstas e estimuladas em normas que versam sobre a educação no ambiente prisional. Diante da falta de informações sistemáticas acerca dessas parcerias, esta pesquisa teve entre seus objetivos: a caracterização dos tipos de parcerias estabelecidas; a identificação das motivações, intencionalidades e objetivos que regem tais iniciativas; a verificação de diferenças entre as atividades propostas nos presídios masculinos e femininos, entre outros. A pesquisa permitiu identificar sinais de mudança no campo da educação em prisões. Estes sinais, muitas vezes, parecem coerentes com as alterações percebidas por diversos autores, no Brasil e no mundo, no que diz respeito à ampliação do encarceramento, constituição de um sistema de privilégios no qual se baseia a manutenção da ordem interna às prisões, e abandono do ideal de reabilitação. No entanto, ações de governos, organizações da sociedade civil e também no campo da pesquisa indicam que a educação nas prisões vem se constituindo como um campo específico, tanto de análise quanto para a formulação de ações públicas, ainda incipientes, mas notáveis. / The purpose of this research is the investigation of educational practices carried out by civil society organizations and volunteer individuals in the São Paulo State prison system. These initiatives consist of sharing responsibility between the State and civil society, being comprehended and stimulated in guidelines concerning education in the prison environment. Considering the scarcity of systematic information concerning these partnerships, one of the goals of this research is the characterization of partnerships established; the identification of the motivations, intentionality and purposes that guide these initiatives; the differences between activities developed in male and female prisons, among others. The research made possible to identify evidences of changes in prison education. These evidences are often in accordance with the ones perceived by different authors in Brazil and in the world concerning the expansion of incarceration, the emergence of a privilege system upon which the maintenance of the prison internal order is founded, as well as the abdication of the rehabilitation purpose. However, both governments and civil society organizations actions, as well as the research area, indicate that prison education has been developing to become a specific field for both analysis and public policymaking, still incipient but already distinguishable.

A presente pesquisa teve como objetivo geral realizar um estudo exploratório sobre a função social da escola pública brasileira. O estudo recorreu à revisão da bibliografia especializada, à pesquisa documental e teve como base empírica os dados estatísticos do Programa Bolsa Família (PBF). Partimos do pressuposto de que a escola pública brasileira foi, gradualmente e de forma irreversível, assumindo funções para além de suas atribuições didático-pedagógicas e para as quais não existe, no país, uma sistemática de avaliação. A revisão bibliográfica e a análise documental demonstraram a limitação dos modelos de estudo tradicionais quanto à função social da escola pública, mas apontaram para outra perspectiva de investigação. Concluímos que a função social da escola pública brasileira está estreitamente vinculada à promoção de direitos civis, sociais e políticos decorrentes da adesão do Brasil aos tratados e convenções internacionais de Direitos Humanos, possibilitando que as chamadas políticas públicas compensatórias fossem transformadas em políticas sociais, fortemente entrelaçadas com a política educacional. Para analisar a inclusão escolar destes novos sujeitos de direitos, cujas necessidades não se limitam ao processo de escolarização formal, recorremos ao referencial teórico-metodológico da Pedagogia Social, enquanto um novo paradigma educacional que, servindo simultaneamente às práticas de educação popular, social e comunitária, é também complementar à Pedagogia Escolar e à Educação Escolar. / This research aimed to conduct an exploratory study on the social function of Brazilian public school. The study enlisted the literature review, the documentary research and the empirical basis statistical data of the Bolsa Família Program (PBF). We assume that the Brazilian public school has been gradually and irreversibly, assuming functions beyond their didactic and pedagogical assignments and for which there is not in the country, a systematic assessment. The literature review and document analysis demonstrated the limitations of traditional study models as the social function of public school, but pointed to other research perspective. We conclude that the social function of Brazilian public school is closely linked to the promotion of civil, social and political rignts resulting from the accession of Brazil to international treaties and conventions on Human Rights, enabling the compensatory public policies calls were transformed into social policies, strongly intertwined with educational policy. To analyze the school inclusion of these new rights holders, whose needs are not limited to formal schooling process, we resort to the theoretical and methodological framework of Social Pedagogy as a new educational paradigm, serving simultaneously to popular education practices, social and community it is also complementary to the School Education and School Education.

Previous issue date: 2017-10-20 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / The Vocational Technical Education is at the intersection point of two fundamental Brazilian rights: the Educational right and the Work right. A dynamic and autonomous character formation is attributed to Vocacional Technical Education, which may follow the all-time speed changes of the work around world. Furthermore, it is special modality of education that has been listed on political promises, and on television advertisements. Vocational Technical Education depicts an important goal in the National Plan of Education and keeps up with High School Reform Proposals. Target young people, from 18 to 24 years old, those are studing technical courses in the Health and Wellness field, this paper seeks to identify elements that point out the reasons and the expectations for the course choice. The research locus was a SENAC-SP´s school, in Jundiaí City. That time, eight students, equally divided among the following technical courses: Nursing, Aesthetics, Massotherapy and Podology were interviewed. As a research tool, we used the semi-structured interview, from which we seek to got the students' impressions about the proposed theme, valuing their qualitative issues. The interviews gave us the resources to study the material produced from the Content Analysis, a research tool that allowed us for the construction of three Analysis Categories: Reasons for the choice, Surprises on the way and The student project is held in the project. Life. In the first category, the possibility of nursering, as well as the pround of the Vocational Technical Education, and the pround of Health and Welness work fiels, were reasons to the course choice. For the last category, a form of Family gratitude is one of the expectations that the subjects reported to aim at the end of the course. And, an “at the middle” category, "between reasons and expectations" was constructed to express the students´surprises during the courses. The relations of constitution of the professional identity, allow us to more broadly access Vocational Technical Education porposes in the mission for the Citizens formation / A Educação Profissional Técnica de Nível Médio (EPTNM), está no ponto de intersecção de dois diretos fundamentais do cidadão brasileiro, o direto à Educação e o direito ao Trabalho. Atribui-se a ela, uma formação de caráter dinâmico e autônomo, a qual é capaz de acompanhar as constantes e velozes alterações do mundo do trabalho. Além disso, é uma modalidade de educação que tem figurado promessas políticas e propagandas televisivas, representa uma importante meta no Plano Nacional de Educação do país e acompanha as modificações propostas pela atual Reforma do Ensino Médio. Neste estudo, buscamos identificar elementos que apontem as razões e as expectativas da escolha pela EPTNM por jovens de 18 a 24 anos, especificamente, na área de Saúde e Bem-estar. Tendo como locus a unidade escolar da cidade de Jundiaí, pertencente a rede do SENAC SP, foram entrevistados oito alunos, igualmente divididos entre os seguintes cursos Técnicos: Enfermagem, Estética, Massoterapia e Podologia. Como ferramenta utilizamos a entrevista semiestruturada, a partir da qual buscamos reunir as impressões dos alunos sobre o tema proposto, valorizando seus critérios qualitativos. As entrevistas nos deram recursos para que estudássemos o material produzido a partir da Análise de Conteúdo, procedimento que nos permitiu construir três categorias de análise, a saber: Razões para a escolha, Surpresas no caminho da formação e Projeto de formação está contido no projeto de vida. Na primeira categoria, a possibilidade de ajudar e cuidar constituiu para os sujeitos, assim como a valorização da EPTNM e do trabalho na área da Saúde e Bem-estar motivos para a escolha dos cursos. Em relação à última categoria, a possibilidade de se formar como forma de gratidão à família ou para cuidar dos membros da família é uma das expectativas que os sujeitos referiram nutrir ao final do curso. E, por não representarem nem motivos que determinaram a escolha, nem expectativas em relação ao curso, uma categoria “entre as razões e as expectativas” foi construída para a expressão das surpresas vividas pelos alunos ao longo dos cursos. As relações de constituição da identidade profissional, entendida como uma constituição histórica, social e cultural dos sujeitos, e que nos são reveladas pelos motivos e expectativas em relação a escolha de um curso de formação profissional vão nos permitindo acessar mais amplamente a missão da formação de cidadãos, pela EPTNM, e nos mantém atentos em entender quais os seus propósitos

In recent debate within education, the notion of barriers to learning has been reconceptualised to focus on systemic issues rather than deficits in individual learners. These barriers are factors which contribute to learning breakdown and exclusion. HIV / AIDS has been recognised as one of the factors which contributes to preventing children from participating in and benefiting from learning. In South Africa HIV/ AIDS has reached pandemic proportions. There has been a call for in depth qualitative micro-studies to supplement the numerous macro, quantitative studies on HIV / AIDS to explore contextualised experiences of HIV / AIDS and barriers to learning. This study was aimed at mapping barriers to learning in a context of HIV and AIDS amongst grade 6 and 9 learners in the Richmond district of KwaZulu-Natal. The study used semi- structured interviews and focus groups with participative methods of data collection. The total sample was 60 with an equal number of male and female participants. The data was analysed qualitatively using thematic analysis and the framework provided by Bronfenbrenner's theory with a particular focus on contextual factors to describe and analyse the barriers to learning in the study. The study found that psychosocial exclusionary factors that were located at different system levels in terms of Bronfenbrenner's theory exacerbated the impact of mv/ AIDS in the context of the study. Philosophers and others have debated for centuries about the concept of “rights” -
what they are, where they came from, how they evolved, on what authority they
proceed, and in what formulations. Because rights express values and are not simply
rules governing an immutable status quo, there will always be debates over some
aspects of human rights. It is precisely because of this uncertainty that the
international community, in 1948, through the General Assembly of the United
Nations, drafted the Universal Declaration of Human Rights as a standard of
measurement for the formulation and interpretation of human rights and freedoms.
Acknowledged within the Declaration is the universal right to education. One reason
for its acknowledgment is the crucial role that education plays in the promotion of
equality and the full realization of all other human rights. A second reason concerns
the growing appreciation of the relationship that exists between education and
increased social and economic benefits. However, despite its pivotal role as a
multiplier of human rights and socio-economic benefits, little has actually been written
on the right to education to elaborate upon its direction or define its boundaries.
Most of what is documented on the right to education comes from legal and political
sources, through the voices of judges, lawyers, statesmen, and politicians. Educators,
who are generally held responsible for its actual promotion and implementation, have
to date contributed very little to our knowledge of the right to education. Clearly this
must change. To prevail in practice human rights require not only articulation but
interpretation, validation, legislation, enforcement by rule of law and, finally, to be
conceived of in a positive formulation. Thus, rights have to be made, and the purpose
of this study is to invite educators into the conversation to assist in the making of the
right to education by contributing to its interpretations and validating its claims.
This inquiry unfolds in twelve chapters. Chapter 1 sets an autobiographical context
and includes my own memories and experiences interpreting the right to education as
well as the research questions and methodology. Chapter 2 examines the concept of
human rights, their evolution, and the basis for their authority. Chapter 3 examines
existing interpretations of the right to education in the literature. Chapter 4 examines
the meaning of education in the right to education. Chapter 5 examines the
compulsory nature of the right to education and the basis for its distinct status among
other human rights. Chapters 6 through 8 examine the concepts of equality and equal
educational opportunity and their relationship to the promotion of human rights and
the right to education. Chapters 9 and 10 examine the ends of the right to education as
proclaimed in the Declaration, contrasting these ends with the goals set out by the
Ministry of Education in the Province of British Columbia. Chapter 11 examines
parental rights to choose the most suitable kind of education in the context of claiming
the right to a free education for their children. The final chapter represents an attempt
to make sense of the inquiry and the efforts and contributions of research participants
and researchers in the literature towards increasing our understanding of the
interpretations and implications of the right to education.

Exacerbation of heritage features throughout the history of copyright brought serious consequences for their development. The copyright laws of historical progress in the scenarios with international and national economic traits notably eventually provide man, creator of intellectual work, a secondary role. Its activity has always been important, but there was a predominance of the equity, having. With the bourgeois revolutions of the eighteenth century began a process of modification of certain ideals, policies for inclusion in the letters of the states of certain fundamental rights. The coexistence of two systems of copyrights in the world ended up further back from the moral prerogatives of the authors. Yet the international legal texts now recognize them, although they are not fully respected. At a later stage there is a change of direction in the understanding of legal systems, is now setting up the foundation for the interpretation of copyright, to emphasize a repersonalization of its institutes. Our purpose in this study is to question whether it is possible to reconsider the legal institutions copyright, even with the new information society, and if possible, today, to meet the social expectations for the achievement of fundamental rights to information, culture and education, placed in check with this new social formation. We will analyze such issues based on the principle of human dignity for in the end, demonstrate the possibility of harmonizing these rights with the alternative use of works protected by copyright laws, taking as an example, the creative commons. / A exacerbação dos traços patrimoniais ao longo da história dos direitos autorais trouxe sérias consequências para o seu desenvolvimento. O progresso histórico das legislações autorais nos cenários internacional e nacional com traços notadamente econômicos acabou por atribuir ao homem, criador da obra intelectual, um papel secundário. Sua atividade sempre foi importante, mas havia o predomínio do patrimônio, do ter. Com as revoluções burguesas do século XVIII inicia-se um processo de modificação de alguns ideais, pela inclusão nas cartas políticas dos Estados de alguns direitos fundamentais. A coexistência de dois sistemas de direitos autorais no mundo acabou por afastar ainda mais as prerrogativas morais dos autores. Mesmo assim os textos legais internacionais passaram a reconhecê-las, conquanto não sejam inteiramente respeitadas. Numa fase posterior há uma mudança de rumo no entendimento dos sistemas legais, sendo agora a constituição o fundamento para a interpretação dos direitos autorais, a enfatizar uma repersonalização de seus institutos. Nosso propósito neste estudo é questionar se é possível fazer uma releitura dos institutos jurídicos autorais, mesmo diante da nova sociedade da informação, bem como se é possível, nos dias de hoje, atender aos anseios sociais pela consecução dos direitos fundamentais à informação, cultura e educação, colocados em xeque com esta nova formação social. Faremos uma análise de tais questões com base no princípio da dignidade humana para, ao final, demonstrar a possibilidade de harmonizar tais direitos com o uso alternativo de obras protegidas pelas leis autorais, tomando, como exemplo, o creative commons.

Previous issue date: 2010-03-04 / The last twenty years have seen a change, worldwide, in the understanding of the concept of the human right to education. Traditionally this understanding basically involved access to the mandatory levels of schooling. Today, there is a growing consensus that, beyond this access, each child and youth also has a human right to an educational process of quality. Thus, the goals and indicators used in the quantification of an individual’s schooling and the expectations in regard to improvements in education have gained a more central importance in the efforts of monitoring the fulfillment of the right to education around the world. Therefore, the present dissertation was aimed at analyzing how social and governmental actors in Latin America as a whole and in Brazil in particular have been dealing with the use of educational goals and indicators, as a relevant element for monitoring the fulfillment of the human right to education. / Nos últimos vinte anos vem acontecendo, em âmbito mundial, uma mudança na compreensão do conceito de direito humano à educação. Tradicionalmente esse entendimento envolvia basicamente o acesso aos níveis obrigatórios de escolarização. Hoje, é crescente o consenso de que não só o acesso é fundamental, mas também a qualidade do aprendizado de cada criança e jovem. Assim sendo, as metas e indicadores, que permitem que se quantifique a trajetória e as expectativas de melhorias na educação, ganharam uma dimensão central nos esforços de acompanhamento do cumprimento do direito à educação em todo o mundo. Assim, a presente dissertação tem por objetivo analisar como os atores sociais e governamentais na América Latina como um todo e no Brasil especificamente têm lidado com o uso de metas e indicadores educacionais, enquanto elemento relevante para monitorar o cumprimento do direito humano à educação.

The history of South African education should not be swept under the carpet when contemporary matters on education are discussed. Public education was brought to life in order to perpetuate the ideals of separate education and apartheid. the school manager was essentially an extension of the ruling party. He or she had to inform his or her subordinates what the authorities demanded to be done in educational circles.
The 1996 Constitution (Act 108 of 1996) effectively assured a democratic order which would guarantee the removal of Acts which were discriminatory in nature. The 1996 Constitution lay the foundation for a democratic and open society which has high regard for human rights, childrens' rights and in particular the right of learners to education.
The public school must implement the stipulations of the Constitution and of the South African Schools Act (Act 84 of 1996) which aspire to be in line with international human rights documents like the 1948 Declaration of Human Rights and the 1989 Convention on the Rights of the Child.
This study is essentially about learner's right to education and the role of the public school in assisting learners to realise this right. All considerations are based on the democratic constitutional dispensation in South Africa after 1994.
