Sobre la democracia : críticas jurídico-políicas de Carl Schmitt al Estado Legislativo Parlamentarista

Memoria para optar al grado de Licenciado en Ciencias Jurídicas y Sociales / El objeto de este escrito es examinar el concepto de Democracia en la teoría jurídico-constitucional de Carl Schmitt, en oposición a la caracterización que le otorga el pensamiento liberal. En consideración a este supuesto, analizaremos la presente problemática desde dos flancos. En primer lugar, atenderemos la conceptualización de Democracia que desarrolla el jurista en su orgánica jurídica, con miras a desarrollar la arquitectura política del concepto hacia una forma democrática sustancial, en observancia a la idea de representación y forma política. En este sentido, analizaremos su argumentación considerando las nociones fundamentales de legitimidad; pueblo; poder constituyente; y los principios de identidad y representación. En segundo lugar, revisaremos la conceptualización de Democracia en la teoría liberal, a partir de un tratamiento sistemático de las principales críticas jurídico-políticas que realiza Carl Schmitt al Estado Legislativo Parlamentarista, dada su oposición al desarrollo práctico de este modelo durante el siglo XX para la correcta realización de un proyecto de Democracia directa. En base a ello, profundizaremos sobre los principios de discusión pública; publicidad; igualdad de chance; representación; e identidad. En último término, a modo de consideraciones finales, confrontaremos los planteamientos de ambos sistemas, con el propósito de presentar observaciones críticas, en atención a los presupuestos fácticos de la modernidad

The Ute Indians and the Public School System: A Historical Analysis, 1900-1985

This thesis is a historical case study of the Ute Indians of eastern Utah. The purpose of this thesis is to examine how federal Indian education policy is implemented at the local level. Ute children attend school in the Uintah and Duchesne county school districts. The thesis traces Ute experiences in public schools during crucial transitions in federal policy. From 1900 to 1930, the federal government sought to enroll Indians in public schools in order to teach them white ways. Indian enrollment increased in the 1940s and 1950s when federal funding made the attendance of Ute children lucrative to the school districts. After the reservation boarding school closed in 1952, nearly all of the Ute children attended public schools and faced a school system that was hostile to their culture. A key transition occurred in the 1970s when federal policy shifted to one of self-determination. The Indian Education Act of 1972 made mandatory the direct participation by Indian parents in the implementation of federally funded programs. Many parents failed to grasp the new opportunity. The Ute Tribal Education Division became heavily involved in running Ute history and language classes in the public schools under Title IV of the Indian Education Act of 1972 and under Title VII of the 1965 Elementary and Secondary Education Act. Despite the existence of a policy that advocated self determination, Utes were not really allowed to determine how federal money was spent. The 1972 Indian Education Act established an advisory role for parents rather than an administrative one. Local school districts still controlled the purse strings. Programs run under this act were not integrated into the core curriculum of local schools. Federal Indian education policy changed from decade to decade but local attitudes remained essentially the same, blunting each policy's effectiveness. When the federal government desired assimilation, local residents and Indians fought that goal. When the federal government switched to a policy of self-determination, misunderstanding and outright hostility kept it from fulfillment at the local level. In addition to problems associated with local attitudes, federal legislation also proved unworkable because it gave Indians no real power to make the school districts listen to them.

Signal reconstruction from discrete-time Wigner distribution

Wigner distribution is considered to be one of the most powerful tools for time-frequency analysis of rumvstationary signals. Wigner distribution is a bilinear signal transformation which provides two dimensional time-frequency characterization of one dimensional signals. Although much work has been done recently in signal analysis and applications using Wigner distribution, not many synthesis methods for Wigner distribution have been reported in the literature. This thesis is concerned with signal synthesis from discrete-time Wigner distribution and from discrete-time pseudo-Wigner distribution and their applications in noise filtering and signal separation. Various algorithms are developed to reconstruct signals from the modified or specified Wigner distribution and pseudo-Wigner distribution which generally do not have a valid Wigner distributions or valid pseudo-Wigner distribution structures. These algorithms are successfully applied to the noise filtering and signal separation problems. / Master of Science

The effect of the human menstrual cycle on kilocalorie and nutrient intake

Kilocalorie, protein, fat and carbohydrate intakes of five women were examined during the period of at least one menstrual cycle. Kilocalorie intake was significantly lower in the periovulatory phase of the cycle compared to the midluteal phase (t=2.10, p <.05). Carbohydrate and fat intakes were higher, although not significantly, during the midluteal phase compared to the periovulatory phase. Mean intake was 85 kilocalories higher in the postovulatory phase compared to preovulatory, but the difference was not significant. Mean carbohydrate and fat intakes were also increased, but not significantly, in the postovulatory phase. Protein intakes remained relatively stable when phases of the cycle were compared. A spectral analysis of variance produced two cycles showing monophasic sine component variations. Protein intake had a significant monophasic variation in two cycles; fat and carbohydrate had significant monophasic variation in one cycle each. The period of two to four days contained the most often significant sine components (10) and the period of five to seven days was next with five significant values. / Master of Science

The leverage changing consequences of convertible debt financing

Dann and Mikkelson (1984) report that the common stockholders of firms issuing convertible debt realize significantly negative returns upon the announcement of such financing. They further state that this observation is not consistent with the leverage hypothesis nor with the new financing models of Myers and Majluf (1984) and Miller and Rock (1982). This study also documents negative returns to the stockholders of convertible debt issuing firms on the announcement date. However, Dann and Mikkelson's assumption that the issuance of convertible debt increases financial leverage is questioned. A new convertible bond valuation model is proposed which valuates a convertible bond as the sum of its market perceived equity and straight debt components. Convertible bond rates of return are regressed on common stock and straight debt rates of return to demonstrate that convertible bonds have a large and significant equity component; often large enough to cause leverage decreasing changes to the issuing firm's capital structure. Furthermore, the perceived change in leverage is shown to be significant in explaining the announcement period excess returns realized by the stockholders of convertible issuing firms. In this way, negative announcement period excess returns are shown to be consistent with the leverage hypothesis. In addition, the results support the new financing model developed by Myers and Majluf. / Ph. D.
