Dovolání v civilním procesu / Application for an appeal review on the point of law in civil procedure

The thesis aims to describe the new regulation of the application for appeal review introduced by means of an amendment to the Civil Procedure Code made by the act No. 404/2012 Sb. and to assess its compliance with the Constitution. During the preparation of this amendment a part of the Civil Procedure Code (specifically sec. 237 (1) c)) governing the admissibility of the discretionary application for appeal review was cancelled due to being in conflict with the Constitution by means of the decision of the Constitutional Court of 21 February 2012, file No. Pl. ÚS 29/11. For that purpose, at first, the thesis deals with the application for appeal review itself and certain aspects of it, especially the role it has in the Czech legal system. Based on this general part a special part is built dealing with the admissibility of the application for appeal review. Firstly, the admissibility under the old legislation is described, after that the conclusions of the Constitutional Court are critically examined and, finally, the new legislation is described and confronted with the findings of the Constitutional Court. Creativity in Mathematics Curricula – An International Comparison between Singapore, Hong Kong, Sweden, and Norway / Kreativitet i matematikläroplaner – en internationell jämförelse mellan Singapore, Hong Kong, Sverige, och Norge

Studies have shown that creative mathematically founded reasoning (CMR) outperforms algorithmic reasoning (AR) in regards to retention and (re)construction of knowledge. This suggests that creativity should be encouraged in national high-school mathematics curricula. The aim of the present study is to compare how creativity is framed in different national high-school mathematics curricula, using the following definition: creativity is the characteristics of people, processes, and environments which lead to new and original products that are useful or otherwise attractive to an individual or a society. Utilizing content and discourse analysis, the present study thus contrasts how the high-school mathematics curricula of Singapore, Hong Kong, Sweden, and Norway handle and value creativity, and also examines which role creativity takes in each curricula. Findings suggest that Singapore’s curriculum emphasizes creativity the most, and frequently does so in relation to assessment. Hong Kong’s curriculum is found to emphasize creativity in diverse ways, often using words with connotations to playfulness. Analysis of Sweden’s curriculum indicates a relatively minute focus on creativity, tending to put it in a teacher-centered context. A feature of Norway’s curriculum is an increasing emphasis on creativity as courses approach tertiary education. This also suggests a rising value of creativity in its curriculum. A similar though not as pronounced trajectory is found also in Singapore’s curriculum. In the Asian and Norwegian curricula, creativity is expressed both as a means and an end, while in Sweden’s curriculum it is only seen as an end. The results are discussed in terms of potential reasons for the prominent national features, and the study also includes an evaluation of the aptness of the suggested definition of creativity, a review of the limitations of the study, as well as propositions for further research. Finally, two recommendations are given to the National Agency for Education in Sweden – Skolverket – based on the results of the study: 1) diversify the emphasis on creativity in the curriculum, and 2) ensure alignment between what teachers value and what Skolverket values with respect to creativity.

Restoring the Mississippi River Delta in Louisiana Ecological Tradeoffs and Barriers to Action

This study investigates the Louisiana 2012 Coastal Master Plan’s ability to reconcile conflicting economic and ecological demands on coastal resources. The Louisiana Coastal Master Plan was unique in combining flood control and coastal restoration under one authority. However, the objectives of flood control and coastal restoration can be in conflict. The plan was also unique in its approach of restoration from a working coast perspective. However, the objectives of ecological restoration and economic productivity do not always agree. By conducting semi-structured interviews with major coastal stakeholders, this research will explore how the planning process has accommodated the views and values of key stakeholder parties. This research aims to make more transparent the inherent environmental tradeoffs of restoration from a working coast perspective. A working coast is a compromise between economic and environmental stakeholder needs. The approach requires a balance of power to ensure that the projects selected best serve the needs of all parties. The study found that while there is industry buy in, mechanisms for mitigating economic externalities is lacking in the plan, corporate infrastructure benefits while wildlife resources are in decline.

Principal instrumento que materializa a política pública de conservação de florestas particulares e alicerçado nos princípios do desenvolvimento sustentável, o novo Código apresenta uma série de controvérsias a serem esclarecidas e desafios vencidos. O significado dessa lei ultrapassa o momento atual, evidenciando conexões históricas com formas sociais conflituosas de apropriação dos recursos naturais e a luta constante de grupos dotados de poder para enfraquecer as normas ambientais. Tal contexto motivou este trabalho que teve como objetivo analisar a experiência prática da internalização do novo Código por meio do estudo de caso do município de Paragominas (PA), explicando de que maneira a flexibilização das disposições e a criação dos novos instrumentos do Código Florestal repercutem na gestão ambiental local, onde, por sua vez, as políticas se transformam em ações concretas. A despeito de a análise do processo de implementação de um instrumento de política pública não abranger os resultados finais, a mesma serve como avaliação processual, permitindo acompanhar e compreender como seus impactos são construídos. Para analisar as ações, interações e contradições do novo Código, o trabalho se alicerçou nas abordagens de Biologia da Conservação e da Ecologia Política, em consonância; na observação e reflexão das ações, processos e instrumentos, realizados pela gestão ambiental local em interseção com o novo Código; e na aplicação de entrevistas com gestores e lideranças municipais. Quanto aos resultados, registram-se, nas páginas seguintes, os meandros de um novo cenário, no qual a implementação do novo Código se mostra desafiadora e, em grande parte, solitária para os municípios brasileiros; mas, ainda assim, pode render algum avanço no controle e planejamento ambiental, devido aos novos instrumentos. Entretanto, viu-se um “novo”, repleto de contradições para a conservação dos recursos florestais e impregnado da insustentável luta pela ampliação da propriedade privada sobre os recursos naturais, onde se verificam dinâmicas sutis, mas intensas na capacidade de promover mudanças ambientais. / Three years after the enactment of the new Brazilian Forest Code, the horizon, as to its real contribution is not yet well defined. Main instrument that embodies the public policy of conservation of private forests and grounded in the principles of sustainable development, the new Code includes a series of controversies to be clarified and overcome challenges. The meaning of this law exceeds the present time, showing historical connections with conflicting social forms of appropriation of natural resources and the constant struggle of groups with power to weaken environmental standards. Such a context motivated this work we aimed to examine the practical experience of internalization of the new Code through the case study of the municipality of Paragominas (PA), explaining how the relaxation of provisions and the creation of the new instruments of the Forest Code repercussions the local environmental management, which, in turn, policies are transformed into concrete actions. Despite the analysis of the implementation process of a public policy instrument does not cover the final results, it serves as a procedural evaluation, allowing monitor and understand how its impacts are built. To analyze the actions, interactions and contradictions of the new Code, the work has its foundations in biology approaches Conservation and Ecology Policy in line; the observation and reflection of actions, processes and tools, conducted by local environmental management intersection with the new Code; and the application of interviews with managers and municipal leaders. As for the results, are registered in the following pages, the intricacies of a new scenario, in which the implementation of the new Code proves challenging and largely solitary for municipalities; but still, can yield some progress in control and environmental planning, due to the new instruments. However, there appeared a "new" full of contradictions for the conservation of forest resources and impregnated unsustainable struggle for expansion of private ownership of natural resources, where there are subtle dynamics, but intense in the ability to promote environmental change.

Sweden has an active and growing culture of feminist comic book artists that use comedy as a mean of disseminating political ideas and critic. In this essay I do a reparative reading of Sara Granér’s comic book All I Want for Christmas is planekonomi in order to find out if it advocates alternative orders and/or ways of expression. By exploring what the comic book does to me as a reader and how, using the term ”skev” – a hybrid of queer that examines normativity not strictly tied to sexuality – and gulesque theory – a mix of feminism, cuteness, the grotesque and riot grrrl –, I show that the comic book, through the use of comedy, works as a trojan My Little Pony, reclaiming the girly franchise, while challenging several so-called dichotomies, such as: femininity/masculinity; youth/adult; high art/kitsch. I conclude that the comic book contain feminist figures of resistance, and that it creates affects and nourishment that can be used as a means to imagine a feminist other.

Werden normalerweise neue Museen für bereits bestehende Sammlungen gebaut, so verkehrt sich in Ústí nad Labem dieses Prinzip ins Gegenteil. Auf Initiative des Collegium Bohemicum und unterstützt von der Jan Evangelista Purkyně-Universität Ústí nad Labem wurde 2006 das „Museum für die deutschsprachigen Bewohner der böhmischen Länder“ ins Leben gerufen. Das im Aufbau befindliche Museum hat sich zum Ziel gesetzt, das Wirken und den Beitrag der deutschsprachigen Bewohner in den böhmischen Ländern aus tschechischer Perspektive, aber in europäische Zusammenhänge eingebettet darzustellen und zu vermitteln.
