The issue of the vertical /or horizontal operation of the Bill of Rights (chapter 3) is a controversial one. The interim constitution deals with this controversy in a subtle way by avoiding direct horizontal operation of Chapter 3. Instead, it provides for the so-called 'seepage to horizontal relationships' in terms of section35{3). This apparently was a political compromise between the pro-vertical only and the pro-horizontal groups. The human rights history of this country justifies a Bill of Rights that would have both vertical and horizontal operation. However, in section
35 (3) there is potential for the values enshrined in the constitution and Chapter 3, and the spirit hereof, to permeate and filter through the entire legal system in all it's applications. It would seem, however, as demonstrated by the decision in De Klerk v Du Plessis, that the extent to which this filtering process will benefit individuals in their private relations, will depend on the interpretation given to section 35 (3) by the
courts. If courts, as it happend in De Klerk's case fail to realise the full import of section 35 ( 3) aspects of the existing law which are unjust could remain and the process of creating a just, open and democratic society will be

Sovereignty in international politics : an assessment of Zimbabwe's Operation Murambatsvine, May 2005Nyere, Chidochashne 10 1900 (has links)
Many scholars perceive state sovereignty as absolute, inviolable, indivisible, final, binding and stagnant. That perception emanates from inter alia political, social, cultural and environmental contexts of the modern era. Most literature converge that the doctrine of sovereignty first received official codification at the Peace Treaty of Westphalia in 1648. Contemporary international norms, particularly the Responsibility to Protect (R2P) doctrine, are arguably an environment and culture of current global politics. With human rights and democracy having taken centre-stage in contemporary political discourses, sovereignty is affected and influenced by such developments in international politics. Hence the argument that globalisation, among others, has eroded, weakened and rendered the doctrine of sovereignty obsolete. This study, using Zimbabwe‟s Operation Murambatsvina as a case study, demonstrates that sovereignty is neither unitary in practice, nor sacrosanct; it is dynamic and evolves, thus, in need of constant reconfiguration. Hutchinson Professor and Chair of the Department of Gender, Sexuality and Women’s Studies The goal of this exploratory study was to evaluate risk and resiliency factors from the Deployment Risk and Resiliency Inventory (DRRI) in predicting post-deployment adjustment outcomes among police officers who served in Operation Enduring Freedom/Operation Iraqi Freedom (OEF/OIF) as part of the National Guard/Reserve (NGR). A self-reported questionnaire was completed by 44 police officers who were OEF/OIF veterans assessing risk and resiliency factors as well as current levels of anxiety, aggression, alcohol use, and PTSD symptoms. Regression analyses revealed concerns over family personal relationships and career matters during deployment along with more exposure to critical incidents involving family members predicted higher levels of alcohol use. Conversely, exposure to critical incidents involving personal safety predicted lower levels of alcohol use while exposure to hostile combat missions predicted lower levels of aggression. Post-deployment social support and military support during deployment predicted lower levels of alcohol usage, anxiety and PTSD/depression while unit peer social support predicted higher levels of alcohol usage. This study highlighted the mistrust among police veteran police officers of mental health professionals. Mistrust of mental health personnel predicted a higher level of aggression and the fear of stigma for receiving mental health assistance predicted higher alcohol usage. Impact of Combat Stress on Mental Health Outcomes: BRFSS Survey Data 2006Pedneau, Emily 01 January 2007 (has links)
Objectives: This study sought to determine the relationship between combat experience and mental health outcomes. The study sought to determine whether age was a significant factor in poor mental health outcomes. Methods: Multiple logistic regression (n = 195,048) and multiple linear regression (n = 264,154) were performed on the 2006 Behavioral Risk Factor Surveillance System (BRFSS) survey. Veteran status and a host of demographic and health status questions were analyzed in relation to diagnosis of anxiety or depressive disorder (multiple logistic regression) and to number of days poor mental health (multiple linear regression). Results: Diagnosis of anxiety or depression was not found to be associated with veteran status. Among both veterans and non-veterans, diagnosis was associated with age Conclusions: Contrary to expectations, veteran status was found to be a protective factor for poor mental health outcomes in this analysis. Younger age was found to be associated with poor mental health outcomes, but was an equal association in both veterans and non-veterans, suggesting that mental health outcomes have not been worsened by recent changes in combat characteristics. Denial of mental health status, stoicism within the military community, and limitations of the survey are proposed to explain the unexpected outcome of this analysis.

Este trabalho de pesquisa objetivou a obtenção de uma nova política de operação que melhor caracterizasse o comportamento ótimo dos sistemas hidrelétricos de potência, mesmo diante das mais variadas condições hidrológicas. Este trabalho teve duas linhas de investigação. Uma tratou do problema de previsão de vazões afluentes mensais, na busca por abordagens e técnicas que definissem bons modelos de previsão. A outra linha de pesquisa tratou de encontrar uma nova política de operação, para o problema de planejamento da operação, que fosse capaz de definir uma seqüência de decisões operativas mais estáveis, confiáveis e de menor custo operativo. Na primeira linha de pesquisa, investigou-se três aspectos importantes na definição de um modelo de previsão: técnicas de pré-processamento dos dados, definição automática do espaço de entrada e avaliação do desempenho de alguns modelos de redes neurais e sistemas Fuzzy como modelos de previsão. Nestes aspectos foram investigadas a utilização da análise dos componentes principais e o tratamento da série temporal de vazões afluentes como um sinal discreto, utilizando-se a representação \"analytic signal\". Para a definição do espaço de entrada de maneira automática utilizou-se a abordagem da \"dynamic modelling\", empregando-se a \"average mutual information\" e \"false nearest neighbors\". Para implementação dos modelos de previsão foram estudados e avaliados quatro modelos inteligentes: rede SONARX, rede SONARX-RBF, modelo ANFIS e a rede ESN. Já na outra linha de pesquisa, foi proposta uma política de operação que fosse capaz de estabilizar os despachos de geração termelétrica e conseqüentemente o custo marginal de operação. A política de operação preditiva estabilizada via termo inercial produziu excelentes resultados operativos, melhorando de forma significativa a performance da política preditiva. / This research work aimed at obtaining a new operation policy which could better describe the optimal behavior of hydropower systems, even when faced with the most varied hydrological conditions. This research had two lines of investigation. The first one dealt with the monthly water inflow forecasting problem, searching for approaches and techniques which could define efficient forecasting models. Three important aspects to define a forecasting model were investigated: data pre-processing techniques, automatic definition of the embedding and the performance assessment of some artificial neural networks and Fuzzy systems. Hence, the use of the principal components analysis was investigated and, considering the water inflow time series as a discrete signal, the analytic signal representation could be used to preprocess the data. Furthermore, the embedding was automatically defined using the dynamic modelling approach, by using the average mutual information and the false nearest neighbors techniques. The forecasting models were implemented by four intelligent models: SONARX network, SONARX-RBF network, ANFIS model and the ESN network. The other line of investigation came up with a new operation policy to solve the operation planning problem, defining a more stable, reliable and less costly operative decision sequence. It was proposed an approach to stabilize the thermoelectric generation dispatches and, as a result, the operative marginal cost. The predictive operation policy stabilized via inertial term produced excellent operation results, improving the performance of the predictive policy.

present the results of two studies conducted during the testing of equipment, (3) present
the first experimental results obtained from monitoring the daily activities of the
experimental subject in such equipment and (4) report two experiments in which they
attempted to demonstrate empirically the establishment of different surrogate
conditioned motivating operations. First, the equipment (Caixa Geradora e Monitora de
Cotidiano, CGMC) was presented. During testing of the equipment, two studies were
conducted. The first on the effects of light on the daily activities of the experimental
subject, the results produced indicated the need for adjustments to equipment, in
particular concerning the type and intensity of light used for establishing the cycles of
light / dark. The second study occurred during the tests CGMC allowed us to analyze
the effects of water restriction (imposed accidentally) of approximately five days on the
daily activities of the experimental subject. The results indicate changes in the
distribution of the daily activities of the experimental subjects, even those not
necessarily related to obtaining water. Once the testing phase of the equipment was
finished, a study was conducted in order to monitor the daily activities of the
experimental subjects, over the days. The results point to the existence of patterns in the
flow behavior that can be modified by various types of variables, such as the cycle of
light and dark used, water restrictions and changes in schedules of reinforcement.
Finally, two experiments were performed in order to demonstrate empirically the
formation of two surrogate conditioned motivating operations. The results point to the
failure to establish surrogate conditioned motivating operations / O presente trabalho pretendeu: (1) apresentar uma proposta de equipamento para a
análise do comportamento, (2) apresentar os resultados de dois estudos realizados
durante os testes do equipamento, (3) apresentar os primeiros resultados experimentais
obtidos a partir do monitoramento das atividades diárias do sujeito experimental neste
tipo equipamento e (4) relatar dois experimentos nos quais se tentou demonstrar
empiricamente o estabelecimento de diferentes operações motivadoras condicionadas
substituas. Primeiramente, o equipamento (Caixa Geradora e Monitora de Cotidiano,
CGMC) foi apresentado. Durante os testes do equipamento, dois estudos foram
realizados. O primeiro sobre os efeitos das luzes sobre as atividades diárias do sujeito

comportamental que podem ser modificados por diversos tipos de variáveis, como o
ciclo de claro-escuro utilizado, restrições hídricas e mudanças nos esquemas de

O presente trabalho tem como objetivo analisar o impacto da utilização instrumento das Operações Urbanas, como forma alternativa para captação de recursos pelo poder público através da atividade do setor imobiliário para implementar melhorias sociais e ambientais na cidade de São Paulo, em especial no que se refere a provisão habitacional às famílias diretamente atingidas pela Operação Urbana, através do estudo de caso da Operação Urbana Água Espraiada no período de 2001 a 2015. O trabalho pretende estudar elementos determinantes para a formação instrumento Operações Urbanas Consorciadas, até sua consolidação como instrumento de política nacional de desenvolvimento urbano no Estatuto da Cidade e quais os impactos gerados na cidade a partir de sua aplicação, com foco na implantação de habitação de interesse social. Para tanto, fazemos um pequeno histórico sobre a aplicação deste instrumento na cidade de São Paulo, enfocando especialmente a Operação Urbana Água Espraiada, destacando os principais momentos que marcaram sua trajetória, buscando explicitar os resultados alcançados pela provisão habitacional desta operação. Tais resultados são analisados em termos de eficiência na utilização de verbas públicas, eficácia no alcance das metas e cumprimento de prazos e efetividade da política pública no enfrentamento do problema habitacional. Apesar da alta qualidade arquitetônica dos poucos edifícios produzidos, os resultados apontam para um efeito pouco expressivo sobre o problema habitacional às margens do córrego Águas Espraiadas, que ao invés de diminuir, acabou aumentando ao longo do período de vigência da operação, além de remeter a necessidade de priorizar a aplicação dos recursos em obras que atendam o interesse público e de criação de mecanismos que garantam a permanência da população de baixa renda frente à valorização imobiliária da região. / The present study aims to analyze the impact of the implementation of the Urban Operation Consortium, as an alternative of fundraising by the Government through the construction sector activity to implement social and environmental improvements in São Paulo, particularly the effectiveness of housing provision to the families directly affected by the Urban Operation, through the case study of the Água Espraiada Urban Operation Consortium in the period between 2001-2015. The work intends to study the main elements of the Urban Operation Consortium, until its consolidation as an instrument of national policy of urban development in the City´s Statute, and what were the impacts generated in the city by its implementation, focusing on the construction of social housing. Having that in mind, we intend to recover some of the history of the application of this instrument in the city of São Paulo, focusing especially on the Água Espraiada Urban Operation highlighting its key moments, and the achievements of the social housing provision. These results were analyzed in terms of efficiency in the use of public funds, effectiveness in achieving the goals in time and effectiveness of public policy in facing the housing problem presented. Despite the high architectural quality of the buildings produced, the results point to a very little significant effect in solving the housing problem on the banks of the Água Espraiada stream, which actually increased instead of decreasing, throughout the duration of the urban operation. In addition, the results refer to the need to prioritize the application of resources in investments that attend to the public interest and to the creation of mechanisms to ensure the permanence of the low- income population against the real estate valuation in the region.

Regras de operação para sistemas hidroelétricos com previsão por redes neurais / not availableSacchi, Rodrigo 08 April 2004 (has links)
Este trabalho de pesquisa está relacionado com a aplicação de técnicas de Redes Neurais Artificiais (RNA\'s) na obtenção de políticas de operação conjunta de usinas hidroelétricas (UH\'s). O comportamento ótimo das usinas hidroelétricas depende tanto da posição relativa de cada UH ao longo da cascata como da relação entre elas. O propósito principal deste trabalho é de aplicar a rede de mapa auto-organizável (SOM) de Kohonen com modelos de sistemas dinâmicos, no aprendizado destas relações, objetivando seu uso para simular a operação ótima de um sistema hidroelétrico real. Este modelo é uma versão não-supervisionada do modelo NARX sendo chamado de modelo ou rede NARX Auto-Organizável (SONARX), capaz de processar padrões espaço-temporais. Desta maneira, um algoritmo de programação não-linear, especialmente desenvolvido para a realização da operação determinística de sistemas hidrotérmicos de potência, é utilizado para otimizar a operação deste conjunto de usinas, considerando-se várias condições hidrológicas distintas e, tendo como função objetivo a minimização do custo com complementação térmica. Em seguida, os resultados desta otimização são então processados e utilizados no treinamento da rede SONARX; ela irá captar os comportamentos relativos de cada uma das UH\'s, trabalhando com afluências futuras que ela mesma irá prever. De forma geral, a partir dos resultados obtidos com um subsistema do sistema sudeste brasileiro, pode-se concluir que a rede SONARX conseguiu assimilar o comportamento ótimo da operação do sistema teste. Os testes mostraram que o previsor neural possui uma forte tendência em seguir os resultados da otimização determinística, otimizando o uso dos recursos hídricos disponíveis para geração de energia elétrica. Posteriormente, a rede neural com função de base radial (RBF) foi aplicada na interpolação das previsões feitas pela rede SONARX, uma vez que este tipo de rede é indicado para esta tarefa. Neste contexto, os centros das funções de base, da rede RBF, passam a ser definidos pela rede SONARX, mitigando o erro inerente a este tipo de modelagem baseada na técnica de MATQV. / This research work is related to the application of Artificial Neural Networks (ANN) in the obtaining of united operation policies in hydroelectric power plants (HP). The optimal behavior of the hydroelectric power plants depends as much on the relative position of each station throughout the cascade as on the relation between them. The main purpose of this work is to apply the self-organizing map network (SOM) of Kohonem with dynamic system models, in the learning of these relations, objectifying its usage to simulate the optimal operation of a real hydroelectric power system. This model is an unsupervised version of the NARX model; which has been called self-organized model or network (SONARX), capable of processing space-time patterns. This way, a nonlinear programming algorithm, especially developed to accomplish the hydrothermal power system deterministic operation, is used to optimize the operation of this group of hydropower plants, considering many distinct hydrological conditions, and aiming the minimized cost with the thermal complementation. After this, the results of this optimization are processed and used in the SONARX network training; it will captivate the relative behavior of each one of the (HP), working with future affluences that it will predict. In a general way, from the acquired results from a subsystem of the brazilian southeast system, we may conclude that the SONARX network managed to assimilate the optimal behavior of the system test operation. The tests showed that the neural predictor has a high tendency towards deterministic optimization results, optimizing the water resources use available for the electric energy generation. After all this, the radial basis function (RBF) network was applied on the interpolation of the predictions made by the SONARX network, once this kind of network is indicated to this task. On this context, the centers of the basis functions, of RBF network, are to be defined by the SONARX network, mitigating the unrelated error to this type of modeling based on MATQV technique.

<p>Några av de stora sjöteoretiker som vi utbildas på idag var verksamma i en tid innan insatsförsvaret, men deras teorier anses fortfarande vara användbara idag. Idag genomför svenska flottan andra typer av insatser än på slutet av 1800-talet, då teoretikerna Mahan och Corbett var verksamma. Kriget ser inte likadant ut idag och både tekniken och taktiken har utvecklats. Är de teorier vi utbildas på, tillämpbara idag? Syftet med denna uppsats är att undersöka teorier om skydd av handelsfartyg och jämföra hur detta skydd genomförs i nutid med fokus på insatsen i Adenviken. Utgångspunkten har varit att genom kvalitativ textanalys beskrivit Mahans, Corbetts och Vegos teorier om skydd av handelstransporter. Dessa har jämförts med varandra samt med en fallstudie genomförd på Operation Atalanta. En av slutsatserna är att teoretikerna Mahan, Corbett och Vego har liknande teorier. De talar omsäkra hamnar, konvoj, eskort och säkra färdvägar som metoder att skydda handelstransporter. Skillnaden är hur metoderna genomförs samt hur viktiga de är. De metoder av Mahan och Corbett som återfinns i Operation Atalanta är framförallt eskort, men även vikten av säkra farleder och knutpunkter. Vegos metoder som återfinns är även eskortföretag, men även vikten av luftherravälde vid skydd av handeltransporter och att arbeta med att vidta förebyggande åtgärder.</p> / <p>Mahan and Corbett, which we study today, were operating in an era before the Cold War and international military intervention, but are still considered useful. Today the Swedish fleet carries out other types of missions than in the late 1800s, when Corbett and Mahan were active. War does not look the same today as both technology and tactics have evolved. Are the theories we study, applicable today?The purpose of this paper is to examine theories about the protection of merchant ships and compare Mahans, Corbetts and Vego theories with how it is implemented in the present day, focusing on the operation of the Gulf of Aden. This paper uses qualitative text analysis to describe Mahan, Corbettand Vegos theories, on the protection of commercial shipments. These were compared with each other and the results were later applied to a case study on Operation Atalanta. One of the conclusions are that Mahan, Corbett and Vegos theories are similar, concerning securingports, convoy, escort and securing routes. The difference however is how to apply these methods and the importance of them.
