Utilisation of training programmes by health advisers

Most of the training programmes received by the health advisers in the Gauteng health promotion directorate, are delivered in a lecture form, whereby trainers prepare their presentations according to themes chosen by management, without the involvement of trainees. After training, the health advisers adopt the same attitude with the individuals they educate. This study describes how participatory research was carried out to investigate how health advisers in the Gauteng Province experience and utilise these training programmes. It articulates the roles of the researcher and participants in the research process. The study showed that while it is true that trainees must receive theoretical information, it is equally true that they must be able to relate that information to their practical situations. The study indicates that this can occur by introducing a form of training in which the focus is on both the trainer and trainees as co-learners in the learning situation. / Social Work / M.A. Soc. Corporate legal advisers of state-owned enterprises in the People's Republic of China: the developing watchdogs

This thesis critically assesses the design and operation of the corporate legal adviser (“CLA”) system for state-owned enterprises (“SOEs”) in the People’s Republic of China (“PRC”). / The study of in-house legal advisers (commonly known as corporate counsel) in Western jurisdictions has developed as its own subfield of studies of the legal profession. That literature shows that the roles that in-house legal advisers in Western corporations should and can play is heavily influenced by their corporate environments, corporate policies and attitudes of the corporate leaders with whom they work. There are a range of complex organizational and ethical issues faced by Western corporate counsel in discharging the functions of effective gatekeepers, advisers and preventive law practitioners. However, as compared with the abundant published works on corporate counsel in the era of post-Enron corporate America, there is little academic literature on in-house legal advisers in China. / In the face of the challenges and risks caused by the intensifying economic reforms in the PRC since the early 1990s, and China’s entry into the WTO in 2001, the PRC Government has been attempting to strengthen measures to preserve and protect those state assets that are managed and operated through SOEs. The supervisory body for SOEs is the powerful and well-known State-owned Assets Supervision and Administration Commission (“SASAC”) which is directly under the control of the State Council. / SASAC has perceived that corporate counsel in Western corporations have been playing a critical role in corporate risk management and decision-making, and have been accorded a high status within their organizations. Therefore one of the measures implemented by SASAC under its risk management framework for SOEs is the CLA system. The CLA system requires SOEs to engage licensed CLAs as part of the corporate governance and risk management system. Pursuant to the Administrative Measures for State-owned Enterprise Corporate Legal Advisers (2004) (the SASAC document governing the system), the role, rights and obligations of CLAs are set out. The policy objective is to ensure that SOEs are managed and operated in compliance with law and with proper legal advice. / SASAC leaders have claimed that the CLA system in SOEs has made great achievements in improving the risk management performance of SOEs. However, this thesis finds that SASAC has not properly addressed the ethical and role dilemmas commonly faced by Western corporate counsel. On the basis of the Western literature on corporate counsel and analysis of SASAC’s policies and the practice of SOEs, this thesis identifies the following key concerns with the CLA system of SOEs: the status and independence of CLAs, the qualification system for CLAs, the legal and professional regulation of CLAs, and the management structure and corporate culture of SOEs where CLAs work. Finally, the inherent problems caused by the power structure in SOEs, especially the role of senior cadres of the ruling Chinese Communist Party in SOEs, has not been resolved. / This thesis concludes that CLAs as corporate watchdogs in SOEs are still at the developmental stage. More empirical research of CLAs of SOEs is warranted to better understand how China, as an emerging world economic power, is to play on the international stage.

A Nova Lei de Diretrizes e Bases da Educação Brasileira (LDB 9.394/96) prevê que a educação superior promova criticidade, reflexibilidade, correlação de saberes, mas também o incentivo ao trabalho de pesquisa e investigação científica, visando ao desenvolvimento da ciência e da tecnologia e da criação e difusão da cultura e, desse modo, desenvolver o entendimento do homem e do meio em que vive. (Artigo 43, inciso III). Entretanto, pouco se ouve sobre essas questões a partir da voz do orientador de pesquisas acadêmicas, o que esta pesquisadora considera um problema de ordem social, tendo em vista a importância desses atores sociais para o campo acadêmico. Os poucos trabalhos que abordam o tema limitam-se a identificar o orientador a partir das impressões empíricas dos orientandos e a refletir as atuações a partir de questões político-educacionais (FLECHA, 2003; MAZZILLI, 2003; BIANCHETTI & MACHADO, 2006). Neste sentido, o presente trabalho procura responder, através da Análise Crítica do Discurso (ACD), o que os orientadores têm a dizer sobre sua prática social. De caráter interpretativo (ALVEZ-MAZZOTTI, 1999), conta com dados gerados por orientadores de mestrado em Linguística/Linguística Aplicada, das esferas federal, estadual e privada, do Rio de janeiro, sendo dois participantes de cada esfera. Na primeira etapa, os sujeitos responderam a uma entrevista semiestruturada. A segunda etapa consta de: a) um questionário; b) correspondências eletrônicas; c) os regimentos dos programas de pós-graduação; e d) revisão histórica da orientação no Brasil. O caráter social deste estudo é a relação dialética entre linguagem e sociedade, já que a ACD considera qualquer evento discursivo ao mesmo tempo um texto (primeira dimensão), uma prática discursiva (segunda dimensão) e uma prática social (terceira dimensão): o modelo tridimensional (FAIRCLOUGH, 2001). O Sistema de Transitividade da LSF pautou a análise da primeira dimensão, confirmando outros estudos sobre o ranking da recorrência dos processos (LIMA LOPES, 2001). A interpretação dessa primeira dimensão aponta que os orientadores atuam na idiossincrasia, e que os principais atores sociais desse fazer são o orientador e o orientando, em relação assimétrica de poder. Na segunda dimensão, a interdiscursividade reforça essa idiossincrasia, mas inclui as pressões institucionais, que agem como reguladoras desse fazer. Na terceira dimensão, os resultados sugerem que aspectos históricos justificam a queda da qualidade dos mestrandos, associando a isso um interesse político, e as características da pós-modernidade a uma nova e híbrida atuação. Além disso, os resultados apontam para um discurso de resistência à hegemonia nas três dimensões de análise. A pesquisa possibilitou ainda a discussão em torno de aspectos práticos: a) a reflexão dos sujeitos sobre seus papeis e atribuições; e b) a atualização do aporte teórico, aplicado a um tema ainda pouco explorado. However, little is heard about these issues from the voice of the adviser of academic research, what this adviser believes a social order problem is, in view of the importance of these social actors to academia. The few studies that address the theme are limited to identify the adviser from empirical impressions of the mentees and reflect the actions from political and educational issues (ARROW, 2003; Mazzilli, 2003; Bianchetti & MACHADO, 2006). In this sense, this paper attempts to answer through the Critical Discourse Analysis (CDA), what the advisers have to say about their social practice. Interpretive in nature (Alves-Mazzotti, 1999), this research counts with data generated by advisers of master in Linguistics/Applied Linguistics, representatives of federal, state and private spheres of Rio de Janeiro, featuring two participants from each sphere. In the first stage, the subjects responded to a semi-structured interview. The second step consists of: a) a questionnaire, b) electronic mail; c) the regiments of the postgraduation programs, and d) historical review of advising in Brazil. The social character of this study is the dialectical relationship between language and society, as the CDA considers any discursive event as a text (first dimension), a discursive practice (second dimension) and a social practice (third dimension): the three-dimensional model (Fairclough, 2001). The transit system of LSF guided the analysis of the first dimension, confirming other studies on the ranking of the process recurrence (LIMA LOPES, 2001). The interpretation of this first dimension indicates that advisers act on idiosyncrasy, and that the main social actors of this act are adviser and mentees, in asymmetrical relationship power. In the second dimension, the interdiscursivity reinforces this idiosyncrasy, but includes the institutional pressures, which act as regulators of this act. In the third dimension, the results suggest that historical aspects justify the decline in the quality of the masters, associated to a political interest, and the characteristics of post-modernity to a new and hybrid performance. Moreover, the results point to a discourse of resistance against hegemony in the three dimensions of analysis. The survey also allowed discussions on practical aspects: a) the reflection of the subjects about their roles and responsibilities and b) update the theoretical, applied to a topic less explored. This work is an invitation to further research on the adviser discourse, bringing out not only his/her voice, as a literal speech of one of the interviewers, but also direct and significant contributions to studies in Linguistics and Applied Linguistics in Brazil

Tax arrears are a frequent feature in many States and a concern that demands to reflect on the diverse variables that promote, cause or block their reduction. This paper elaborates on some of the variables that could promote or contribute to generate tax arrears and on some aspects of the Peruvian tax system that could help to explain the current level of tax arrears and the tax litigiousness in Peru. Tax Administration pitfalls that contribute to the generation of tax arrears and tax litigiousness are not avoided but are certainly not the core part of this work. / Los atrasos de las deudas tributarias son un fenómeno frecuente en los Estados y una preocupación que exige reflexionar sobre las diversas variables que los incentivan, ocasionan o que impiden su reducción. El presente trabajo reflexiona sobre algunas de las variables que podrían promover, o cooperar con, la generación de atrasos tributarios y sobre algunos aspectos o atributos del sistema tributario peruano que podrían ayudar a explicar el actual nivel de atraso en la deuda tributaria y, en parte, la alta litigiosidad en el sistema. Los defectos atribuibles a la Administración tributaria para producir el atraso y la litigiosidad no se evaden, pero no forman parte central del trabajo.

Contours d'un métier traversé par un processus de féminisation : Les conseillers.ères Principaux.pales d'Éducation / Representation of a profession crossed by a process of feminization : The Principal Advisers of Education

A la croisée de la sociologie des professions, du genre et des présences sociales, cette thèse propose une lecture sociologique d’un métier peu observé. Par une enquête quantitative et qualitative, elle éclaire le métier de CPE sous différents angles, et appréhende sa dimension sexuée. Comptant 72 % de femmes aujourd’hui, cet ancien bastion masculin s’est féminisé dès sa création en 1970, mais l’analyse de cette massive progression féminine dévoile des mécanismes complexes. Un corpus inédit de rapports de jury du concours a permis d’étudier les procédés de recrutement du CPE et d’établir son portrait idéal attendu par l’institution.Remontant aux origines du métier par le biais d’une analyse sociohistorique, et s’attardant sur la compréhension des ressorts d’activités de son ancêtre professionnel le Surveillant Général, l’étude révèle la persistance de sa dimension autoritaire, et, dans une moindre mesure sa dimension éducative apparue au tournant du XXème siècle puis s’étant étoffée jusqu’à l’arrivée du CPE. Progressivement, l’accroissement de ses missions lui a donné une image polyvalente. Quoi qu'on puisse traditionnellement associer le care au féminin, tandis que l'autorité relèverait du masculin, le fait que chaque CPE doive disposer de ce socle multiple de compétences, car les exigences de son territoire d’action l’impose et parce qu'il est la plupart du temps le seul de son établissement à occuper la tâche, rend difficile une analyse strictement genrée, et invite plutôt à envisager l’analyse des processus de (dé-)sexuation des activités professionnelles. / This doctoral thesis is a sociological exploration of an occupation very little studied. It aims at examining the job of French CPE from many various angles and approaches, as well as qualitative and quantitative methods so as to better encompass the gendered dimension of this job. In its inception in 1970, this occupation used to be a male stronghold, but it has undergone a growing process of feminization since 72% of CPE today are women. Our analysis must account for the mechanisms underlying such a significant increase. The in-depth analysis of the selection committee’s recent reports sheds new light on the recruitment process of the future CPE and gives a clear picture of the ideal candidate and of what is expected from the institution. The analysis of socio-historical background and origin of the job will help trace back the evolution of the job’s required skills, with a particular focus on the forebear of the CPE (the ‘Surveillant Général’, a stern Dean of Discipline) and chart the evolution of the professional role from a former more authoritative nature to a more educational one. The job has over the years grown in scope and the CPE have been assigned a greater number of tasks and missions that they’ve been endowed with an image of all-purpose, multi-skilled employees. While authority has traditionally been seen as male, and care as more female, the fact that every CPE should have at their disposal such a wide range of skills, because they’re required by their work environment and because most of the time they’re the only ones in the school to tackle such tasks, it makes a purely gendered analysis much more difficult and invites a broader approach of the (de-)gendering of professional activities.

Dans le contexte socio-économique du début du XXI siècle, l'éducation reste un enjeu sociétal majeur. Dans cette perspective, la question de la formation des enseignants et plus précisément celle de l'accompagnement à l'entrée dans le métier des débutants apparaît centrale. Nous l'interrogeons ici sous l'angle d'une recherche qualitative visant à comprendre dans quelle mesure le dispositif actuel de conseil pédagogique contribue au développement professionnel de professeurs débutants du primaire. Plus précisément, nous étudions, dans le cadre conceptuel de la didactique professionnelle, les cheminements des conclusions formulées au cours d'un entretien-conseil, de leur formulation jusqu'à leur transformation potentielle en compétences professionnelles. Cette recherche, en utilisant des références dans les théories de l'analyse interactionniste du discours et des activités cognitives de raisonnement et de problématisation, étudie de façon longitudinale l'accompagnement dans trois dyades enseignant débutant – conseiller pédagogique sur une année scolaire. Elle permet de mettre au jour, pour notre corpus, des résultats sur : 1) la nature des conclusions formulées lors des entretiens-conseils ; 2) les processus et difficultés qui aboutissent à la formulation des conclusions ; 3) le devenir des conclusions énoncées dans la suite de l'accompagnement ; 4) les conséquences du dispositif de conseil pédagogique dans le développement professionnel des débutants ; 5) les conditions minimales pour que l'accompagnement puisse être une situation potentielle de développement professionnel. / In the socio-economic context of the beginning of the 21st century, education remains a major societal issue. In this regard, the matter of teacher training, and more specifically that of supporting novices as they go into the profession, seems central. Here, we approach it from the perspective of a qualitative investigation aiming to understand the extent to which the current system of educational advice contributes to the professional development of novice primary school teachers. More specifically, within the conceptual framework of professional didactics, we study the progress of the conclusions drawn in the course of a counselling interview, from the moment they are drawn until the time they are potentially transformed into professional skills. Using references from the theories of interactionist analysis of speech and cognitive activities of reasoning and problematizing, this research examines longitudinally the way support is provided in three novice teacher – educational adviser dyads over the course of a school year. Within the boundaries of our corpus, it leads to the uncovering of results about : 1) the nature of the conclusions drawn during the course of the counselling interviews ; 2) the processes and difficulties that lead up to the drawing of the conclusions ; 3) the evolution of the conclusions formulated in the following interviews ; 4) the consequences of the system of educational advice on the professional development of novices ; 5) the minimal conditions necessary for the support to be a potential situation of professional development.
