Zu den Ursachen des mangelnden Erfolges der Honorarberatung

Die Honorarberatung befindet sich überall in Europa auf dem Vormarsch. Sie ist eine von Regulierern geschätzte Alternative zur viel kritisierten Provisionsberatung. Im Widerspruch dazu verhalten sich Bankkunden zurückhaltend bis ablehnend. Dies wirft die Frage auf, worin die Ursachen liegen könnten. Mögliche Antworten werden auf Basis einer Choice-Based Conjoint-Analyse mit Kundenclusterung abgeleitet. Es zeigt sich, dass die Bankkunden gespalten sind. Eine kleine Gruppe von agilen, gut informierten, einkommensstarken Personen präferiert die Honorarberatung (6% aller Bankkunden). Währenddessen tendiert die große Masse der Kunden zur Provisionsberatung. Diese Masse zeichnet sich durch ein erstaunlich realistisches Bild von sich selbst aus. Sie hält sich für schlecht informiert und wenig erfahren, für unflexibel und nicht offen für Neues. Sie sucht ihr Heil in einem bedingungslosen Vertrauen zur Bank. Ein solches eröffnet Spielräume für opportunistisches Verhalten auch bei der Honorarberatung. Die Politik muss daher entweder die Honorarberatung regulatorisch gegen jede Art des Opportunismus absichern oder liberal agieren und Verstöße gegen den Vertrauensvorschuss ex post sanktionieren. / The transition to fee-based advisory is underway in Europe. The regulatory bodies consider this the preferred alternative in contrast to the commission-based agent approach. However, the same state of euphoria cannot be found among clients. Up until now, banking clients in Germany have been cautious, modest and reluctant. This prompts questions as to what could be the cause of such behaviour. Possible explanations can be found in a conjoint-analysis with client clustering. It can be shown that the behaviour of German clients in banking is divided. A small group of agile, well-informed individuals with high incomes prefers fee-based advisory services (6% of all clients). Meanwhile, the large majority of clients tend to prioritise the commission-based advisory service. Interestingly, this group is characterized by an astonishingly realistic picture of themselves. The clients consider themselves not properly informed, lacking experience, inflexible and not open for innovation. They seek salvation by granting unconditional trust to their banks. These clients cannot assess or judge if a new type of advisory method will offer any kind of advantage. If politics wants to promote the fee-based model it has to assure absolutely water-proof solutions, otherwise a resulting loss of confidence in case of misuse will be inevitable. Taking a more liberal approach, politics could leave several avenues open and instead sanction infringements of accredited trust.

Purpose: The purpose of this work is to analyze investors as well as analysts' views on the development of technology in Automated Trading recommendations in the stock market. Theoretical framework: The study is based on The Efficient Market Hypothesis. Method: The methodological framework of this thesis have included both a quantitative and qualitative approach. A deductive approach has been used. Empirical framework: Data was obtained from 206 members of the Swedish share savers association (Aktiespararna) plus 4 semi-structured interviews with advisers and analysts. Analysis: Data shows average investors do not trust, and are reluctant to take advice, from Robo-advisors but higher percentage of technically savvy traders rely on Robo-advisors. Most analysts perceive no threat to robo-advisor replacing their job. In fact they believed it could replace advisors job. Advisors believed the opposite. Conclusion: 67 % of the investors surveyed believed that in five years Roboadvisors will completely replace human advisors despite the fact that 82 % still liked and trusted recommendations made by humans more. Financial operators see Robo-advisors as a tool rather than threat and plan to integrate it in their own business.

Patientsäkerhet ur patientperspektiv : En kvantitativ granskning av Patientnämndens fall rörande patientsäkerhet 2015

Bakgrund: Patientnämnden är en förtroendenämnd dit patienter och anhöriga kan vända sig för att lämna synpunkter och klagomål på den vård de mottagit. Patientnämnden arbetar bland annat med att sammanställa de inkomna ärendena och återkopplar tillbaka till hälso- och sjukvården för att främja patientsäkerheten. Hur patienter och anhöriga använder sig av Patientnämnden för att rapportera vårdskador är ett relativt outforskat område i dagens läge. Syfte: Syftet med studien var att undersöka ärenden som inkommit till Patientnämnden i ett landsting i Mellansverige under 2015 för att identifiera, analysera och beskriva andelen somatiska vårdskador som anmäls av patienter och anhöriga. Metod: Studien är en empirisk studie där data från redan befintliga ärenden granskats och studien har en kvantitativ, beskrivande design. Huvudresultat: 86 av 395 studerade ärenden handlade om somatisk vårdskada, av dessa var 59 allvarliga somatiska vårdskador. Det var fler kvinnor än män som anmält somatiska vårdskador, både vad gäller allvarliga och lätta somatiska vårdskador. Den vanligaste orsaken till vårdskada var kirurgirelaterade komplikationer. Slutsats: Endast en liten del av de inkomna ärendena handlade om somatiska vårdskador, och då oftast om allvarliga vårdskador. Det behövs mer information och vägledning från vårdpersonal till patient för att fånga upp och synliggöra både lätta och allvarliga vårdskador. Det behövs även mer forskning om varför kvinnor anmäler vårdskada i större utsträckning än män. / Background: The patients' advisory committee is an independent committee to which patients and relatives can file complaints and comments about their recieved care. The patients' advisory committee works with patient safety through reconnecting the patients' cases to their caregiver. Research regarding the patient useage of the Patients' advisory committee for reporting care injuries is currently quite uncharted. Study aim: The aim of the study was to investigate cases recieved at the Patients' advisory committee in a county in Sweden during 2015 to identify and describe the somatic care injuries reported by patients and relatives. Method:  This study examines existing cases from the Patients' advisory committee and uses a quantitative, descriptive design. Main results: 86 out of 395 cases regarded somatic care injuries, of which 59 were severe care injuries. Women reported both severe and non severe care injuries more often than men. The most often occuring resason for a care injury was surgery-related complications. Conclusion: Only a small fraction of the total amount of cases regarded somatic care injuries. Severe care injuries appeared more often than non severe care injuries. More guidance and information to the patients and relatives is required from the caregivers to enlighten the occurance of care injuries. More research is needed regarding why women report care injuries more often than men.

A Descriptive Review and Analysis of the Creation and Development of an Advisory Program in an Inner-City Middle School

This study described and analyzed the development and implementation of an advisory program at one urban middle school. Development of the advisory program began during the 1997-98 school year. The implementation of the program was examined during the 1998-99 and 1999-2000 school years. This school site was chosen because of the in-depth research and planning of the program beyond the typical amount performed by many schools, and the wide-scale staff participation utilized in the program's development. In order to follow the processes of development and implementation, several models of change, innovation, and organizational analysis were used to provide focus for analysis of events that occurred during the three years of the program examined in this study. Data was collected in multiple manners. A complete review of school documents concerning the advisory program was performed, and over 50 percent of the faculty were interviewed through individual and team interviews. The findings of this study include various elements concerning the development and implementation of the advisory program. Data was collected and analyzed in three main categories including a) driving and resisting factors for beginning and implementing the program, b) processes used to plan, maintain and develop the program, and c) the periods in which the program became stable. Additional considerations were examined including the evaluation of the program, future possibilities for implementation, and staff roles in the program. Recommendations of the study include: limiting the focus of the advisory program; maintaining consistent goals; starting with a limited program; securing high staff participation; providing extensive time for planning; maintaining a high level of monitoring by administration and staff leaders; providing in-depth training; and, insuring that open lines of communication exist.

The Poetics of Appeal

This study advances a theoretical model of appeal, the framework readers’ advisory (RA) librarians use to make book suggestions. Taking an interdisciplinary approach, it combines elements of media studies, literary theory, and library science to posit new elements of appeal and new models for understanding its dynamics. This dissertation argues that, because appeal as currently practiced relies heavily on reductive binaries, it fails to account for a number of features that play a crucial role in a reader’s experience of a work. Through a historically informed explication of the existing appeal framework, it posits a new formulation: appeal is a tripartite construct involving the sensibility of a text, the content of a work, and the interest of a reader, where reader is understood in its broadest sense. The new framework demonstrates explicitly that appeal is both textual and readerly and advances a number of additional concepts that are possible only in a more nuanced, tripartite structure. The dissertation illustrates its findings through three application chapters, considering in depth Jane Austen’s Persuasion, Charlotte Brontë’s Jane Eyre, and Mary Shelley’s Frankenstein. The study further provides a new theory/practice model of appeal, strongly urging that, if RA service is to continue to advance, its provision and an understanding of its critical concepts be undertaken with depth and rigor.

No presente trabalho busca-se demonstrar a inovação trazida pela regulamentação dos Estados-partes do Mercosul, especialmente pela brasileira, que conferiu ao particular o direito subjetivo de postular Opiniões Consultivas diretamente ao Tribunal Permanente de Revisão. Para tanto, destaca-se a condição de sujeito de direito internacional adquirida pelo particular por meio de normas advindas de integrações entre Estados soberanos. Da mesma forma, a importância que possui um tribunal legitimado e com atribuições claras, tendo por exemplos a União Europeia e da Organização dos Estados Americanos, onde o Tribunal de Justiça e Corte Interamericana de Direitos Humanos são reconhecidos como responsáveis diretos pelo sucesso destes blocos. Dentre suas competências, destaca-se o protagonismo que tiveram as suas faces consultivas, representadas pelo reenvio prejudicial e pelas opiniões consultivas, respectivamente, instrumentos que não foram apenas responsáveis pela harmonização das legislações internas com a norma da integração, mas também por criar uma verdadeira cooperação jurisdicional entre organismos jurisdicionais interacionais e as jurisdições nacionais. Institutos que se assemelham às opiniões consultivas do Mercosul, cuja legitimação em postulá-las diretamente ao Tribunal Permanente de Revisão é conferida ao particular de forma inovadora em processos de integração. / This paper seeks to demonstrate the innovation brought about by the regulations of the Mercosur States Parties, especially by the Brazilian, which gave the individual the subjective right to apply for Consultative Opinions directly to the Permanent Review Tribunal. In order to do so, the condition of being a subject of international law acquired by the individual is highlighted, through norms derived from integrations between sovereign states. Likewise, the importance of a legitimate and clearly defined court, for example the European Union and the Organization of American States, where the Court of Justice and the Inter-American Court of Human Rights are recognized as directly responsible for the success of these blocs. Among its competences, the leading role played by advisory opinions, represented by the reference for a preliminary ruling and by the advisory opinions respectively, were not only responsible for the harmonization of domestic legislation with the integration rule but also for creating a genuine Jurisdictional cooperation between national courts and national courts. Institutes that resemble the consultative opinions of Mercosur, whose legitimacy in postulating them directly to the Permanent Review Tribunal is given to the individual in an innovative way in integration processes.

Remote Intelligent Air Traffic Control Systems for Non-Controlled Airports

Non-controlled airports are literally that - uncontrolled. Safe separation is achieved by pilot vigilance. The consensus of reports on incidences at noncontrolled airports generally conclude that pilots cannot rely entirely on vision to avoid collision and attempts should be made to obtain all available traffic information to enable a directed traffic search. Ideally, a system is required which has the ability to provide advice to all parties to ensure separation minima is maintained. Provision of a such a system would remove a measure of pressure from the pilot to allow that person to devote their attention to their prime responsibility of flying the aircraft. To this end, research on use of intelligent remote advisory systems for non-controlled airports was undertaken with emphasis on those systems which could minimize human resources and associated recurring costs, to provide a measure of repeatability and to provide an acceptable level of safety. A rule based system was developed and evaluated. The evaluation showed that use of a rule based system as the basis of an intelligent remote air traffic control system for non-controlled airports is a viable proposition. In test scenarios, collision hazards were identified and evasion tactics generated. For a full operational system, the application of the rules and definition of the aircraft circuit area may need refining; however, the results are certainly encouraging.

The irrigation organizations have been organized in Taiwan for more than 400 years and set the foundation of Taiwan¡¦s agricultural development. This dissertation analyzes the 17 Taiwan irrigation associations¡¦ financial statements and discusses how the members of advisory board of irrigations associations interact with resources, rules and communication from the agency theory. The conclusions in the dissertation are as follows: 1.The type of city irrigation associations sold their useless assets and got the money to maintain and operate the associations. The type of country and fragmentary irrigation associations still irrigate the farms, but they have no unused assets to sell. The finance of these two types irrigation associations are not so sufficient, they should take actions to improve their finance by themselves or by the government. 2.Those factors as the levels of educations, the vocation, the types of associations-attending, the number of the types of associations-attending, the major cadres in the associations, the time to be a member of irrigation association, and be a politician or not, will influence with the members of advisory board of irrigations associations to communicate with members, know about the rules, constitute the irrigation association, and make the commitments to the associations. 3.The members of advisory board of different types of irrigation associations have different attitudes toward the constitutions of irrigation associations and the commitment of organizations. Especially the members of advisory board in the type of fragmentary irrigation associations, they are more concerned about the constitution of the irrigation associations, and the commitments of organizations are stronger. The suggestions have been addressed as follows: 1.The government should set up a system to monitor the finance of the irrigation associations. 2.The government should bring the new thoughts of business management to the irrigation associations. 3.The irrigation associations should operate more diversely. 4.The government should subsidize farming. 5.The government should support the irrigation associations to enlarge the irrigation areas.
