The facultative arbitration in labor matters procedures allows either party of   the employment relationship to compel the other to submit their disputes to an arbitral tribunal. One of the application assumptions of the facultative arbitration in labor mattersprocedures when bad faith of a party during the negotiation of the statement is noticed,which should be tested.What happens with the decision of the Arbitral Tribunal which admits the claim and establishes that it has jurisdiction to hear the case? In this article, the author analyzes the procedural effects of this decision, in the light of the doctrine and jurisprudence. / El arbitraje potestativo en materia laboral permite que cualquiera de las partes de la relación de trabajo pueda forzar a la otra parte a someter sus diferencias a un Tribunal Arbitral. Uno de los supuestos de procedencia del arbitraje potestativo  en materia  laboral es que se advierta la mala fe de una de las partes durante la negociación del pliego, lo cual deberá ser probado.Ahora bien, ¿qué ocurre con aquella decisión del Tribunal Arbitral que admite a trámite la demanda y se declara competente para conocer el caso? En el presente artículo, el autor analiza los efectos procesales de esta decisión, a la luz de la doctrina y la jurisprudencia.

However , what happens when the courts of a country interfere contrary to international standards in full force and effect of an award, the impact caused in that state and that leading to be internationally liable to a Bit or FtA are studied in this essay. the author further analyze jurisprudence of investment arbitration tribunals in cases Saipem v. Bangladesh, ATA v. Jordan Frontier Petroleum v. Czech Republic and White Industries v. India, also focuses on the case of Peru; and urges members of a treaty respect the rules of the game. / En el marco de los tratados internacionales, con especial énfasis en el tratado Bilateral de inversión (Bit), surgen diversas responsabilidades para los estados que lo conforman. sin embargo, el qué ocurre cuando los órganos jurisdiccionales de un país interfieren contrariamente a los estándares internacionales en plena validez y eficacia de un laudo y la repercusión que ocasionan en tal estado y que lo conllevan a ser responsable internacionalmente frente a un Bit o un tLC, son tratados en este artículo. el autor, además de analizar jurisprudencia de los tribunales arbitrales de inversiones en los casos Saipem v. Bangladesh, ATA v. Jordania, Frontier Petroleum v. República Checa y White Industries v. La pratique des affaires révèle le succès que connait l’arbitrage comme mode de résolution des différends. Cette forme de justice, promue par d’importantes conventions internationales et régionales, est reconnue et encouragée par de nombreuses législations nationales. Les Républiques arabes syrienne et égyptienne ne sont pas en reste. Elles se sont dotées de textes importants et modernes qui visent à assurer l’efficacité du processus arbitral et à créer un terrain favorable au développement de ce type de règlement des différends. Pourtant en dépit d’un contexte législatif favorable, les opérateurs du secteur bancaire de ces républiques sont encore réticents à recourir à cette forme de justice. Or si ce constat trouve sans doute quelques justifications s’agissant du contentieux né de la mise en œuvre d’opérations purement internes, il est plus surprenant de l’observer s’agissant d’opérations qui se déploient dans l’ordre international. L’objet de l’étude est donc de souligner les perspectives offertes par les nouveaux dispositifs. En premier lieu c’est la question de « l’accès à l’arbitrage » qui se trouve explorée. Au-delà de cette problématique première, il fallait encore examiner la manière dont ces dispositifs nationaux encadrent « la justice arbitrale » au stade de l’instance comme à celui des recours ouverts à l’encontre de la sentence / The practice of business reveals the success of arbitration as a means of resolving disputes. This form of justice, promoted by important international and regional conventions, is recognized and encouraged by many national legislations. The Syrian and Egyptian Arab Republics are not so left behind this way. They have adopted important and modern texts which aimed at ensuring the effectiveness of the arbitration process and creating a favorable environment for the development of this type of dispute settlement. Yet despite a favorable legislative context, banking operators in these republics are still reluctant to resort to this form of justice. Although this resume may be justified in the case of disputes arising from the implementation of so purely internal operations, it is surprising to observe it in the case of operations which are deployed in the international order. The object of the study is therefore to highlight the prospects offered by the new legal provisions. At first, the question of "access to arbitration" is explored. Going beyond this first problem, it was still necessary to examine the way in which these national provisions frame "arbitral justice" at the stage of the proceedings as well as at the level of appeals available against the award

This thesis discusses the fundamental issues of arbitration in international trade. The aim of the paper is to explain the basic aspects of international arbitration, which constitute reason for choosing this method of dispute resolution, and further evaluate whether development of arbitration as such may cause international traders to reconsider arbitration as primary dispute resolution method. The structure of this thesis consists of an introduction, nine chapters and a conclusion. I determine thesis dissertation in the introduction, followed by the first chapter, where the reader is briefly acquainted with the history of arbitration and international commercial arbitration. In the second chapter dispute resolution methods in general are defined. The third chapter is devoted to alternative dispute resolution methods, their advantages and disadvantages and I further describe certain types of ADR. In the fourth chapter, arbitration is explained together with its basic attributes, theoretical concepts of arbitration and definition of international and domestic arbitration. At the end of the chapter legal sources of arbitration are listed. The fifth chapter describes the arbitration agreement as a precondition for arbitration; conditions for the validity of arbitration agreements are further defined as well...

(ENG) Refusal to recognize and enforce arbitral award under Article V, paragraph 2 (b) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 Public policy exception is a deeply rooted instrument used in international documents governing the recognition and enforcement of foreign dispute resolution decisions. It was included in the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards of 1958 since its very first draft, which actually aimed to reform the system of recognition and enforcement of foreign arbitral awards at the time governed by Geneva Protocol and Geneva Convention. Article V section 2 b) of the New York Convention which embodies the public policy exception is quite commonly described as the weakest and the most problematic part of the Convention. In the thesis at hand, the author analyses this provision and conducts a research to find out whether and why the provision is problematic in the practice of the courts. In the first part of the thesis, the author describes the legislative process of the scrutinized provision. The Master thesis describes comprehensively attributes and operating of arbitration in the Czech Republic which has acquired significance recently. The work is divided into eight chapters. After exordium I make readers acquainted with alternative dispute resolution, e.g. mediation. The third chapter characterizes arbitration and describes history, sources of law, types of arbitration and capability of arbitrator in the Czech Republic. The fourth part deals with the arbitration agreements and their requirements. The fifth chapter is dedicated to its particular stages and revision, recognition and enforcement of the arbitral awards in order to provide the reader an complex overview of the the arbitration proceedings. In the sixth section, the author tries to define advantages and disadvantages of this method of solving disputes and to answer question why we should choose it. The seventh chapter adds a special current issues devoting an arbitration clause on consumer contracts. In the last chapter author concludes the topic and suggests improvements.

Labor Law is called to solve and prevent arisingconflicts between employers and employees. In light of this, certain conflicts between the employer and a union, or his own employees, can be solved by an arbitration board.In that line, it is important to take into account the many existing differences between juridical labor arbitration and economic labor arbitration; the author, in the present article, arguments that those differences represent the fundamental reason why the first one does exercise jurisdictional function and the second one does not. On that basis, the author affirms that it’s possible to exercise diffuse control in economic labor arbitration. / El Derecho Laboral está llamado a solucionary prevenir la mayor cantidad de conflictos que puedan darse entre trabajadores y empleadores. A la luz de ello, existen determinados supuestos en los cuales un conflicto entre el empleador y una organización sindical o sus propios trabajadores puede ser visto o solucionado en sede arbitral.Es importante tener en cuenta, para ello, las diferencias entre un arbitraje laboral jurídico y un arbitraje laboral económico; el autor, en el presente artículo, afirma que las mis- mas constituyen el fundamento de porqué el primero sí ejerce función jurisdiccional  y  el segundo no. En base a ello, se puede afirmar que no es posible ejercer el control difuso enlos arbitrajes laborales económicos.
