The purpose of this thesis is to do a qualitative content analysis, with queer theory as a starting point, of the Swedish Migration Agency’s judicial stance regarding the procedure of assessing reliability and credibility as well as judicial stance regarding the investigation and examination of the forthcoming risk of persons claiming protection due to sexual orientation, gender identity or gender expressions. To conduct this analysis one research question were formulated: How can one from a theoretical perspective analyze the Swedish Migration Agency's method of assessing whether a person is likely to belong to the LGBTQI group? The study’s theoretical theorems are cumulated from Fanny Ambjörnsson’s book ”What is queer?” and six categories and themes were chosen to use as tools during the content analysis of the selected judicial stances. These six categories and themes are; the value of the language, the desire or the habit of classifying people, normalization, heteronormativity, silence and visibility as well as stereotyping. The study showed that comprise criticism can be directed towards the Swedish Migration Agency's method of assessing whether a person is likely to belong to the LGBTQI group and towards the procedure of assessing a asylum seekers reliability and credibility.

The aim of this study is to analyze and derive a more profound understanding on how the Swedish Migration Agency and the Swedish Migration Court of Stockholm determine the credibility of LGBTQI-persons applying for asylum in Sweden. Through a qualitative content analysis of nine cases where decisions from both the Swedish Migration Agency and the Swedish Migration Court of Stockholm are used, this study aims to determine what is required from LGBTQI asylum seekers to prove their reliability and credibility. Furthermore a theoretical perspective on queer theory written by Fanny Ambjörnsson is applied to the assessment methodologies of both government departments, this as a way of assessing the credibility. The study shows that the Migration Agency and the Migration Court of Stockholm have a number of recurring reasons for rejecting LGBTQI persons residence; the applicant cannot account for an inner emotional process, the applicant lacks deep thoughts regarding his/hers sexual orientation, the applicant mainly describes sexual experiences rather than feelings, the applicant gives contradictory information and lastly the applicant has not considered the risks of their actions. In accordance with Ambjörnssons theory these reasons presented by both the Agency and Court are shown in the study to be based on stereotypical assumptions and heteronormative social structures.

Tolkningen utav asylutredningsmetodik : Är asylhandläggares tolkning utav asylutredningar för sexuell läggning lika?

The purpose of this study was to analyze the level of the uniform way of interpretation from the Swedish asylum officers at the Swedish Migration Board, of asylum investigations for asylum seekers who claim sexual orientation as reason of refuge. The interviews with the officers were analyzed in relation to the policy document with investigation- guidelines and methodology. The results of the study showed that there was a uniform way to conduct asylum investigations and interpret the policy document, this despite that the document was found to be ambiguous in certain aspects. The uniform interpretation of the asylum officers was explained by the knowledge and understanding that exists within institutional organizations. This because the asylum officers at the Swedish Migration Board might have similar experience, knowledge and also the demands related to asylum investigations. The uniform interpretation demonstrated a strong similar common understanding of investigative work within the agency. This suggests a certainty that the investigations are carried out in a similar way regardless of which asylum officer within the institution conducting the investigation which indicates a well-functioning “rule of law” for the asylum seekers. / Syftet med studien var att analysera graden av samstämmighet av Svenska Migrationsverkets asylhandläggares tolkning utav asylutredningar för de som åberopat flyktingstatus för deras sexuella läggning. Intervjuerna med handläggarna analyserades i relation till Migrationsverkets styrdokument med riktlinjer och metodpunkter till utförandet av utredningen. Resultatet i studien visade att det fanns ett enhetligt sätt att utföra asylutredningar och tolka styrdokumentet trots att styrdokumentet visats vara tvetydigt i vissa punkter. Den samstämmiga tolkningen förklarades genom den kunskap och förståelse som finns inom institutionella organisationer. Detta eftersom asylhandläggarna på Migrationsverket kan ha likartad erfarenhet, kunskap och även krav kopplade till asylutredningar. Studienss resultat visar på en likartad gemensam uppfattning om utredningsarbetet inom myndigheten. Detta visar på att utredningar utförs på ett likartat sätt oberoende av vilken person på institutionen som utför utredningen vilket indikerar på en rättssäkerhet för de asylsökande.
