Mining contributes significantly to the economic development of South Africa, contributes to pollution and other negative environmental impacts. Section 24 of the Constitution of the Republic of South Africa, 1996 (Constitution) places a duty on government to, amongst others adopt legislative measures to protect the environment, prevent pollution and degradation, and secure sustainable development, while promoting justifiable economic and social development. Government responded with the introduction of new acts or the amendment of existing acts most of which require an authorisation process as a “command and control” tool to enforce environmental governance within the mining sector. The abovementioned legislative development will be discussed from a historical perspective up to the current developments. The research aims to attempt to align the authorisation process pertaining to mining. The mining life cycle will be illustrated and the authorisation requirements for each of the mining life cycle processes will be discussed alongside its challenges such as fragmentation, lack of capacity in government sectors, lack of communication and cooperative governance within government. The lack of focus within the authorisation requirements will be deliberated. To avoid the negative consequences of the current authorisation processes such as duplication, unnecessary time delays and the stifling of economic growth, an investigation into how the various fragmented authorisation processes can be aligned into a single streamlined authorisation process which will contribute to the sustainable development within South Africa will be made. / MPhil (Environmental Law and Governance), North-West University, Potchefstroom Campus, 2013

Systems psychodynamic experiences of professionals in acting positions in a South African organisation

During times of organisational change and restructuring, employees, are often placed in acting positions. Consciously, organisations frame their reasons for this practice as preparing the system for a new strategy, organisational structure, work distribution and leadership challenges. This implies that the conscious reasons for using acting as a human resources practice may not be sound, leading to a question about the possibility of unconscious collusions operating in the system. From an unconscious perspective, it can be hypothesised that this practice represents how organisations respond to its unprocessed unconscious anxieties inherent to change, transformation and adapting to new ways of thinking, operating and functioning. This research was done using systems psychodynamics as theoretical paradigm and theory, offering a depth-psychology organisational theory, OD consultancy and qualitative research stance which differentiate between conscious and unconscious. The unconscious contains anxiety against which the system defends, specifically, by using dependence, fight/flight, pairing, me-ness and we-ness. Role identity consists of the normative, existential and phenomenal roles. If the three role parts are similar, anxiety is contained and bearable. When there are splits between the three role parts, persecutory and paranoid anxiety exists. The acting professionals’ normative role was relatively clear. In their existential role they introjected confusion, uncertainty, splits about their competence, doubt in their own authority, shame, and conflict in their view of the other. In their phenomenal role they received projections from the organisation about incompetence and denigration. The findings indicated how acting professionals experienced different kinds and intensities of anxiety. They got confused about their primary task, and the differences between their normative, existential and phenomenal roles caused high levels of performance anxiety. They struggled to manage their personal and work boundaries and the system de-authorised them by withholding information and feedback about their contribution to the organisation and their acting tenure. Acting professionals experienced being seduced by the power of the organisation, their careers being placed on hold, and being bullied by the systemic illness and toxicity in the organisational. A prestação privada de serviços públicos constitui atividade essencial do Estado contemporâneo. O objeto deste trabalho é o exame das formas de prestação privada de serviços públicos no Brasil. De início, analisa como pressuposto para o desenvolvimento do tema central a atividade administrativa estatal prestada nos três níveis da Federação (União, Estados, Distrito Federal e Municípios), na qual se insere a atividade administrativa material de prestação de serviço público. A seguir, analisa a evolução e as motivações da passagem da execução do serviço público, de início apenas feita pelo próprio Poder Público, para os particulares. O exame dos fundamentos constitucionais do serviço público, plantados na Constituição de 1988, aplicáveis aos três níveis de poder federativo e o estudo das formas de delegação de serviço público aos particulares previstas nos artigos 175, 223 e nos incisos XI e XII do artigo 21 da Constituição Federal completam a análise. O tema central do estudo é tratado em seguida, que cuida especificamente das formas de serviço público que permitem sua prestação por particulares e que são admitidas no ordenamento jurídico brasileiro. Demonstrado que a delegação de serviços públicos para a iniciativa privada, consoante determina a Constituição de 1988, se realiza sob três formas, a concessão, a permissão e a autorização, o trabalho se debruça inicialmente no exame da concessão de serviços públicos rotulada de tradicional. Por se tratar da primeira das fórmulas de execução privada de serviços públicos, detém-se o texto no estudo dos vários aspectos que envolvem essa modalidade de prestação de serviços públicos, aspectos que vão servir de parâmetro para a análise das demais espécies de delegação de serviços públicos aos particulares. Assim, após um breve histórico dos antecedentes da concessão de serviços públicos, examina, além de outros pontos, o significado da expressão e sua natureza jurídica, a exigibilidade de licitação e as formas de extinção da relação decorrente da concessão. As características da concessão são desenvolvidas sob a ótica tríplice do que se denomina de \"participantes\" ou \"atores\" na relação de concessão: a Administração Pública, o concessionário e o usuário e, a partir delas, busca extrair uma conceituação da concessão de serviços públicos adequada aos objetivos do trabalho. The purpose of this study is to analyse the manners in which the private sector in Brazil provide public services. First it analyses as a precondition to develop the central theme, the state\'s administrative activities throughout Brazil\'s three constitutional levels (the union, states, federal district and the cities) in which the public services are provided. Then it analyses how public services have developed since they were first offered by the State, to their transformation in being offered by the private sector. There then follows a study of artides 175, 223 and 21(XI) and (XII) of Brazil\'s Constitution of 1988, which provide the grounds for the offering of public services throughout the levels of the federation. It closes with a study of how public services are delegated to the private sector. After it analyses the central theme of this study; the different types of public services that Brazilian law states may be delegated to the private sector. The study explains that under the 1988 Constitution, public services may be delegated to the private sector using three different forms: concessions; permissions, and authorisations. The text first examines the traditional method of delegating public service: the granting of concessions. The study then analyses the different forms of concession, which will act as a parameter for the other types of delegation. After a brief history of public service concessions, the study examines the legal meaning of \"concession\" under Brazilian law, the need for a public tender and how concessions are terminated. The characteristics of the concession are developed using three perspectives from what are called \"participants\" or \"actors\" in the concession relationship: the government, the concessionaire and the user of the services. The study then attempts to define a concept of a public services concession that ties in with the purposes of this study. In this context, the study then considers legal scholarship and the Brazilian legal system: sponsored concessions, or the public-private partnership (PPPs) the administrative concessions, the public-private joint venture and franchises. The study progresses to an analysis of the other types of delegated public services - the permissions and authorisations. In analysing these types of delegation - and especially the authorisation - the problem arising from modern legal scholarship is considered in the context of its relation with the other types of delegations of public services, and how it actually applies throughout the three constitutional levels.

L’étranger et le droit pénal : étude sur la pertinence de la pénalisation

Le droit pénal génère des distinctions entre étrangers et nationaux, les premiers faisant, dans certaines situations, l’objet d’une pénalisation spécifique. Pourtant, la pertinence de cette pénalisation peut être questionnée au regard d’un balancement, opéré par le droit pénal, entre distinction et assimilation.Dans un premier temps, l’étude démontre que les différentes distinctions en droit pénal peuvent être contestées. D’une part, la pénalisation dont fait l’objet l’ensemble des étrangers ne semble pas opportune car elle apparaît tant superflue – lorsque le droit pénal se superpose à un dispositif extra-pénal suffisant – qu’illégitime – lorsque le droit pénal utilise l’apparence d’extranéité comme critère d’application. D’autre part, la pénalisation spécifique dont font l’objet les étrangers en situation irrégulière apparaît inadéquate puisque, dépendante de l’évolution des règles administratives et européennes, elle revêt un caractère instable et parce qu’elle ne présente qu’un intérêt relatif pour lutter contre l’immigration illégale.Dans un second temps, l’analyse montre, à travers un mouvement d’assimilation progressive de l’étranger au national, que le droit pénal sait aussi se désintéresser de l’extranéité. D’une part, cette assimilation répond à un impératif d’égalité qu’il est possible d’observer dans le cadre du procès pénal, mais également à l’aune de la création d’immunités pénales au profit de certains étrangers. D’autre part, cette assimilation est fondée sur la lutte contre l’impunité des auteurs d’infractions puisqu’elle est commandée par les impératifs de la coopération pénale internationale et consacrée par le mécanisme de la compétence universelle. / Criminal law gives rise to distinctions between aliens and nationals, the former being subjected to specific criminalization. But the relevance of this criminalization may be questioned, considering the balance sought by criminal law between distinction and assimilation.First, the study demonstrates that the different distinctions provided by criminal law may be challenged. On one hand, criminalization that applies to every alien is not convenient since it appears non-essential – when criminal law overlaps already sufficient extra-criminal rules – and illegitimate – when criminal law uses foreign origin as selection criterion. On the other hand, specific criminalization applied to illegal aliens appears to be inadequate since, depending on the evolution of national administrative rules and European rules, it has no legal certainty and relative interest to restrict illegal immigration.Then, the analysis shows, through a movement of progressive assimilation of aliens to nationals, that criminal law can also lose interest in foreign origin. On one hand, this assimilation meets to a requirement of equality that one may observe not only in criminal lawsuits but also in matters of criminal immunities in favor of some aliens. On the other hand, this assimilation is based on broader fight against impunity of offenders as required by international criminal cooperation and recognized by the mechanism of universal jurisdiction.

Systems psychodynamic coaching for leaders in career transition

The post-modern economy has altered the career landscape – career trajectories are now far more fluid and unpredictable, punctuated by multiple occupational changes, increased job mobility and more frequent and increasingly difficult job transitions. Leaders are frequently ill-prepared for the changing world of work that is progressively dominated by self-managed careers. Taking on a new role is fraught with complexity - for the “chosen one” and for organisations. The implications of successful, failed or derailed job transitions can have strategic and other ramifications for organisations and individuals alike. This study explores the career transition experiences of and the usefulness of career transition executive coaching for eleven individual leaders from various South African organisations. It is a descriptive, explanatory and exploratory qualitative study, employing the systems psychodynamic paradigm, chosen because it focuses on depth psychology and is a developmentally oriented, psycho-educational organisational theory. The study adopted an interpretive stance for understanding leaders’ systemic conscious and unconscious behaviour. The ACIBART model helped to interpret the experiences of leaders in transition. These transitions involve the taking and making of a role, implying the loss which attends leaving a previous role, and adjustment to and being authorised in a new, unfamiliar role, including a liminal period of being “in between”. This inevitably produces an inner drama in which internalised past figures, possibly related to the new role, are brought back to life, and perhaps even amplified in the present. These “unconscious echoes” explain the powerful emotions that frequently attend transitions, especially at the so-called mid-life, and which in turn activate various defence mechanisms. The systems psychodynamic approach to career transition coaching was particularly useful in helping the participants identify personal patterns and link these to their past and thereby develop personal awareness and insight. The “coaching space” thus became a containing, “transitional space” where the participants could safely do the work required to make the adjustment to their new roles. Finally, recommendations to various stakeholders regarding the provision of systems psychodynamic coaching for leaders in career transition are made. / Psychology / D. Phil. (Psychology)
